{"id":5191,"date":"2014-05-28T11:19:28","date_gmt":"2014-05-28T14:19:28","guid":{"rendered":""},"modified":"2015-03-04T16:57:45","modified_gmt":"2015-03-04T19:57:45","slug":"impuestos-crecimiento-y-equidad","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/impuestos-crecimiento-y-equidad\/","title":{"rendered":"<!--:es-->Impuestos, Crecimiento y Equidad<!--:--><!--:en-->Taxes, Growth and Equality<!--:-->"},"content":{"rendered":"<p><!--:es--><\/p>\n<p style=\"text-align: justify;\">Las alzas de impuestos siempre son un asunto complejo, porque -a quienquiera que afecten- duelen. Incluso The Beatles escribieron una canci\u00f3n sobre eso.<\/p>\n<p style=\"text-align: justify;\"><span>Y hay varias razones por las que el proyecto de reforma tributaria que ahora est\u00e1 en el congreso chileno es un asunto m\u00e1s complejo que lo usual. Para empezar, aumentar\u00eda la carga tributaria -la cantidad total que el Gobierno recauda como porcentaje del PIB- en cerca de un quinto.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Y lo har\u00eda no solo elevando la tasa de impuesto corporativo, sino que tambi\u00e9n haciendo que los due\u00f1os de empresas est\u00e9n sujetos al impuesto a la renta personal sobre sus ganancias reinvertidas. Eso la convierte en el tipo de cambio que, como destac\u00f3 el ex ministro de Hacienda Andr\u00e9s Velasco, &#8220;se hace una vez en una generaci\u00f3n&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Esto sugiere que cierto grado de consenso ser\u00eda prudente, pero eso es precisamente lo que, al menos en un principio, ha faltado. Apuntando a la votaci\u00f3n mayoritaria de 62% con la que la Presidenta Michelle Bachelet fue elegida en diciembre pasado, el Gobierno sostiene que tiene un mandato para llevar a cabo la reforma y, a menos que haya una rebeli\u00f3n al interior de su propia coalici\u00f3n, cuenta con los votos para que se apruebe en el Congreso.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>De hecho, pocos contravendr\u00edan su derecho a incrementar los ingresos por concepto de impuestos para financiar nuevos gastos en materia social, principalmente en educaci\u00f3n. Despu\u00e9s de todo, eso es acorde con una s\u00f3lida pol\u00edtica fiscal vigente en Chile desde 2001, seg\u00fan la cual nuevos gastos permanentes deben financiarse con nuevas fuentes permanentes de ingresos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Tambi\u00e9n es cierto que, la mayor parte de los detalles del actual proyecto de ley, como se present\u00f3 al Congreso, se expusieron en el programa de campa\u00f1a de la Presidenta Bachelet. Pero ello no deber\u00eda impedir el debate en cuanto a si es necesariamente la manera m\u00e1s eficiente de lograr sus objetivos m\u00e1s generales.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Y ah\u00ed es donde las opiniones difieren. Los cr\u00edticos sostienen que el nuevo<\/span><\/p>\n<p style=\"text-align: justify;\">Gobierno est\u00e1 poniendo la carreta delante de los bueyes. Primero, dicen, d\u00edgannos qu\u00e9 involucra la reforma educacional y cu\u00e1nto costar\u00eda, y luego hablemos de c\u00f3mo financiarla.<\/p>\n<p style=\"text-align: justify;\"><span>Tambi\u00e9n les preocupa que los aumentos de impuestos propuestos puedan enfriar el crecimiento del PIB al desalentar la inversi\u00f3n, que ya registr\u00f3 una fuerte ca\u00edda el a\u00f1o pasado y que, seg\u00fan el Banco Central de Chile, virtualmente se estancar\u00e1 este a\u00f1o. A trav\u00e9s de su efecto adverso en el empleo, afirman, anular\u00eda uno de los objetivos clave de la reforma: moderar la inequidad en la distribuci\u00f3n del ingreso.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>El FUT<\/strong><\/p>\n<p style=\"text-align: justify;\"><span>Hasta hace algunos meses, pocos chilenos, salvo abogados tributarios y contadores, hab\u00edan o\u00eddo alguna vez del FUT. Pero ahora est\u00e1 al centro del debate de los cambios tributarios propuestos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Este acr\u00f3nimo, literalmente significa Fondo de Utilidades Tributables, pero podr\u00eda describirse m\u00e1s precisamente como Registro de (hasta ahora) Utilidades No Tributables. En otras palabras, es simplemente un registro contable en el cual las compa\u00f1\u00edas anotan las ganancias que lograron en un a\u00f1o en particular, pero que no distribuyeron a sus accionistas y sobre las cuales estos \u00faltimos no est\u00e1n sujetos a impuesto a las rentas personales hasta que esas ganancias realmente se distribuyan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>De acuerdo con los defensores de su eliminaci\u00f3n, el FUT es un anacronismo. Destacan que, cuando se introdujo en el a\u00f1o 1984 para fomentar la reinversi\u00f3n de ganancias, el sistema bancario de Chile a\u00fan se tambaleaba de su colapso dos a\u00f1os antes, su mercado de capitales todav\u00eda era pr\u00e1cticamente inexistente y el acceso a cr\u00e9ditos internacionales no era una opci\u00f3n viable.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Incluso muchos de sus defensores reconocen tambi\u00e9n que ha sido utilizado para evasi\u00f3n tributaria. El ejemplo cl\u00e1sico, pero no el \u00fanico, es una forma disfrazada de distribuci\u00f3n mediante la cual una compa\u00f1\u00eda deposita sus ganancias retenidas en una cuenta bancaria en el extranjero, la que despu\u00e9s es empleada por sus propios due\u00f1os, gracias a una tarjeta de cr\u00e9dito, para financiar el consumo en Chile.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>No obstante, excluyendo esos malos usos, las empresas -tanto las grandes como las peque\u00f1as- afirman que el FUT ha servido como una fuente clave de capital de trabajo y de financiamiento para nuevas inversiones. Obligar a los due\u00f1os de una compa\u00f1\u00eda a pagar impuesto a la renta personal sobre todas las ganancias del a\u00f1o previo -lo que, en virtud del proyecto de ley, ocurrir\u00eda a partir de 2018-<\/span><\/p>\n<p style=\"text-align: justify;\">ser\u00eda un poderoso desincentivo para la reinversi\u00f3n, aseveran, lo que implicar\u00eda ya sea una reducci\u00f3n de la inversi\u00f3n o un aumento del apalancamiento.<\/p>\n<p style=\"text-align: justify;\"><span>En un desayuno de ICARE, el Subsecretario de Hacienda, Alejandro Micco, argument\u00f3 que, en una econom\u00eda abierta como la de Chile, el costo de oportunidad de la inversi\u00f3n est\u00e1 determinado por las tasas de inter\u00e9s internacionales (actualmente bajas). Sin embargo, eso esquiva la cuesti\u00f3n no solo de si el financiamiento con deuda es un sustituto perfecto del financiamiento interno, sino que tambi\u00e9n el hecho que solo las grandes empresas pueden recurrir a los mercados internacionales.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>M\u00e1s a\u00fan, la p\u00e9rdida del FUT no ser\u00eda la \u00fanica mella al flujo de caja del que disponen las compa\u00f1\u00edas para nuevas inversiones. Su propuesta de eliminaci\u00f3n tambi\u00e9n explica por qu\u00e9, adem\u00e1s de incrementar progresivamente la tasa de impuesto corporativo de 20% a 25% en los pr\u00f3ximos cuatro a\u00f1os, el proyecto de ley a\u00f1adir\u00eda, en la pr\u00e1ctica, otro 10%.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Pagado por una compa\u00f1\u00eda en nombre de sus due\u00f1os, este nuevo impuesto -dise\u00f1ado para proteger a los accionistas en contra de un pago de impuestos por ganancias que no han recibido- servir\u00eda como un cr\u00e9dito frente a su impuesto a la renta personal. Pero ello no cambia el hecho de que ser\u00eda un nuevo costo para las empresas.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Inversi\u00f3n Extranjera<\/strong><\/p>\n<p style=\"text-align: justify;\"><span>En los \u00faltimos a\u00f1os, la reinversi\u00f3n de ganancias ha desempe\u00f1ado un rol crucial en el financiamiento de la inversi\u00f3n extranjera directa (IED) en Chile. Seg\u00fan el Banco Central, de los US$150.000 millones que compa\u00f1\u00edas extranjeras comprometieron en Chile entre 2004 y 2013, US$80.000 millones correspondieron a utilidades reinvertidas.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>En el papel, las compa\u00f1\u00edas extranjeras son menos vulnerables al alza de la tasa de impuestos corporativos que las empresas locales. Despu\u00e9s de todo, siempre han estado sujetas a un impuesto adicional de 35% frente al cual el impuesto corporativo sirve como un cr\u00e9dito, de modo que su pago total de impuestos no cambiar\u00eda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>No obstante, su flujo de caja sufrir\u00eda. En la actualidad, pagan un 20% al final del correspondiente a\u00f1o tributario y el otro 15% solo cuando remiten las ganancias, mientras que -en virtud de las modificaciones propuestas &#8211; tendr\u00edan que pagar la totalidad del 35% al t\u00e9rmino del a\u00f1o tributario.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>M\u00e1s a\u00fan, esa no es la \u00fanica raz\u00f3n de los temores de un impacto en el atractivo<\/span><\/p>\n<p style=\"text-align: justify;\">de larga data que tiene Chile como destino para la inversi\u00f3n extranjera. El proyecto de ley adem\u00e1s derogar\u00eda el Estatuto de la Inversi\u00f3n Extranjera DL 600.<\/p>\n<p style=\"text-align: justify;\"><span>Introducido en el a\u00f1o 1974, cuando la IED en Chile se encontraba muy baja, ofrece a los inversionistas un contrato con el Estado, que garantiza temas como el acceso al mercado cambiario y el derecho a repatriar capital y ganancias. Asimismo, incluye la opci\u00f3n de una tasa impositiva fija de 42%, aunque -seg\u00fan el Comit\u00e9 de Inversiones Extranjeras del Gobierno- en realidad solo ha sido pagado por una compa\u00f1\u00eda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Los defensores de la eliminaci\u00f3n del DL 600 mencionan dos argumentos principales. En primer lugar, que es un instrumento unilateral y, como tal, &#8220;regala&#8221; ventajas que podr\u00edan usarse para negociar condiciones similares para empresas chilenas que invierten en otros pa\u00edses y, en segundo lugar, que ya no es necesario.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Ello -afirman- no se debe \u00fanicamente al cambio en la situaci\u00f3n econ\u00f3mica y pol\u00edtica de Chile, sino que tambi\u00e9n a que las mismas garant\u00edas -y m\u00e1s- ahora est\u00e1n contempladas en los Tratados de Inversi\u00f3n Bilateral (TIB) que, en los \u00faltimos 20 a\u00f1os, Chile ha suscrito con 38 pa\u00edses y en los cap\u00edtulos de inversi\u00f3n de sus Tratados de Libre Comercio (TLC). (Ver tabla: Garant\u00edas de la IED)<\/span><\/p>\n<p style=\"text-align: justify;\"><span>A juicio de Manuel Jos\u00e9 Garc\u00e9s, abogado tributario de Carey, firma de abogados con sede en Santiago, el DL 600 tambi\u00e9n tiene una serie de desventajas pr\u00e1cticas. Garc\u00e9s destaca que involucra m\u00e1s burocracia que el Cap\u00edtulo XIV del Compendio de Normas de Cambios Internacionales del Banco Central, el veh\u00edculo alternativo para la EID en Chile, y adem\u00e1s implica programar el ingreso de los fondos a costa de la agilidad que podr\u00eda requerirse, por ejemplo, en el caso de una fusi\u00f3n o una adquisici\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Los inversionistas, de hecho, han estado mostrando su preferencia al usar cada vez m\u00e1s el Cap\u00edtulo XIV en lugar del DL 600. Entre 2003 y 2007, cerca de 60% de la IED en Chile correspondi\u00f3 al DL 600, pero en los \u00faltimos cuatro a\u00f1os, estuvo solo en torno a 40%.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>No obstante, dado que Chile ahora cuenta con BITs o TLCs con tantos pa\u00edses, el DL 600 no regala mucho, ni cuesta mucho dinero a la naci\u00f3n. Y quiz\u00e1s no es el mejor momento para proponer su eliminaci\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Est\u00e1 el tema de la competitividad. Las compa\u00f1\u00edas mineras han preferido mayoritariamente emplear el DL 600 y, en los \u00faltimos a\u00f1os, sus inversiones han sido claves para impulsar el crecimiento de Chile.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Pese a ello, en el sondeo anual sobre el atractivo de inversi\u00f3n de distintos pa\u00edses mineros que elabora el Fraser Institute de Canad\u00e1, Chile ha estado perdiendo terreno y el a\u00f1o pasado se ubic\u00f3 en el n\u00famero 23, lo que se compara con el puesto n\u00famero 7 de hace solo unos a\u00f1os (si bien a\u00fan est\u00e1 muy por encima de Per\u00fa, su principal rival en la apuesta regional por atraer inversi\u00f3n extranjera, el que alcanz\u00f3 el lugar 58). Esta ca\u00edda se debi\u00f3 en parte a una creciente percepci\u00f3n de incertidumbre en materia de regulaci\u00f3n, precisamente un punto que toca la propuesta de eliminaci\u00f3n del DL 600.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong><span>Ceteris paribus<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><span>Una de las dificultades de estudiar los efectos de cualquier medida econ\u00f3mica es que el resultado es v\u00e1lido solo ceteris paribus o, en otras palabras, si nada m\u00e1s cambia. Lo que, por supuesto, hace y que incluye no tan solo variables tangibles, sino que intangibles, como la confianza o las expectativas, que tienen una poderosa influencia en temas como las decisiones de inversi\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Una vez que est\u00e9n en plena operaci\u00f3n, los cambios impositivos propuestos recaudar\u00edan US$8.200 millones adicionales -cerca de 3% del PIB- y, seg\u00fan el subsecretario Micco, beneficiar\u00edan el crecimiento de Chile en el largo plazo al incrementar la equidad y, por medio de la reforma educacional propuesta por el Gobierno, impulsar el capital humano.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Pero, a la espera de los detalles sobre la reforma educacional, su impacto es imposible de predecir. Y, en parte como consecuencia, tambi\u00e9n es impredecible el resultado final para la equidad y el crecimiento.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>La experiencia internacional sugiere que los aumentos de impuestos en s\u00ed mismos tienen un impacto relativamente peque\u00f1o sobre la distribuci\u00f3n del ingreso. Seg\u00fan un estudio de Harald Beyer, director del Centro de Estudios P\u00fablicos, los cambios que se est\u00e1n debatiendo en la actualidad reducir\u00edan el coeficiente de Gini de Chile (donde 1 representa la inequidad perfecta del ingreso y 0 la equidad perfecta), de cerca de 0,5 punto en un mero 0,014 punto.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Mucho m\u00e1s importante desde el punto de vista de la distribuci\u00f3n del ingreso -as\u00ed como del crecimiento- es la forma en que se gastan los ingresos tributarios. &#8220;Si vas a tomar 3% del PIB del sector privado, tienes que estar muy seguro de ser un muy buen gastador&#8221;, destaca Alberto M. Ramos, director de econom\u00eda latinoamericana de Goldman, Sachs &amp; Co.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Para el crecimiento, por otro lado, la cuesti\u00f3n clave es el impacto en el ahorro. Parte de los ingresos adicionales se utilizar\u00edan para terminar con un d\u00e9ficit fiscal, que ajustado c\u00edclicamente, actualmente alcanza el 1% del PIB y que, en<\/span><\/p>\n<p style=\"text-align: justify;\">otras palabras, se ahorrar\u00eda.<\/p>\n<p style=\"text-align: justify;\"><span>Sin embargo, el resto ser\u00eda gastado por el Gobierno, en lugar de ser ahorrado o reinvertido al menos parcialmente por las compa\u00f1\u00edas y los individuos de los que se obtuvo. En consecuencia, hay cierto consenso en que, ceteris paribus, la tasa de ahorro del pa\u00eds posiblemente caiga en cerca de un punto porcentual.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Eso ser\u00eda malo no solo para las tasas de inter\u00e9s, sino que tambi\u00e9n para el actual d\u00e9ficit de cuenta corriente. Ubicado hoy en d\u00eda en torno a 3,5% del PIB, est\u00e1 por debajo del nivel que enciende las alarmas de riesgo pa\u00eds y, de manera saludable, ha sido financiado en gran medida con inversi\u00f3n extranjera.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Pero eso podr\u00eda cambiar. Con el precio del cobre a la baja, el que por lejos es la exportaci\u00f3n m\u00e1s importante de Chile, el Banco Central prev\u00e9 que el super\u00e1vit comercial, un componente clave de la cuenta corriente, se reducir\u00e1 a la mitad este a\u00f1o.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Sin embargo, no son solo las cambiantes circunstancias econ\u00f3micas las que hacen que los resultados de los cambios tributarios propuestos sean dif\u00edciles, si no imposibles de predecir. Tambi\u00e9n est\u00e1 el hecho de que, como en cualquier reforma tributaria, los detalles son clave.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Ello sugiere que la mejor inversi\u00f3n que Chile podr\u00eda hacer es tomarse mucho tiempo para un debate sereno e informado. De lo contrario, el riesgo es de a lo menos herir a la gallina que ha puesto los huevos de oro durante un cuarto de siglo de \u00e9xito econ\u00f3mico.<\/span><\/p>\n<p><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">Tax hikes are always a big deal because, whoever gets hit, it hurts. The Beatles even wrote a song about it.<\/p>\n<p style=\"text-align: justify;\"><span>And there are several reasons why the tax bill currently before Chile&#8217;s Congress is a bigger deal than usual. To start with, it would increase the tax burden &#8211; the total amount the government collects as a percentage of GDP &#8211; by close to a fifth.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>And it would do so not only by raising the corporate tax rate but also by making a company&#8217;s owners liable to personal income tax on its reinvested profits. That makes it the sort of change that, as former Finance Minister Andr\u00e9s Velasco has pointed out, happens &#8220;only once in a generation&#8221;.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>This suggests that some degree of consensus would be prudent but that is precisely what, at least initially, has been lacking. Pointing to the 62% majority with which President Michelle Bachelet was elected in December, the government claims a mandate for the reform and, barring a revolt within its own coalition, has the votes to get it through Congress.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Few would, indeed, dispute its right to raise tax revenues to finance new social spending, principally on education. That is, after all, in line with a sound fiscal policy in force in Chile since 2001 under which new permanent expenditure must be financed with new permanent sources of revenue.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>True also, most of the details of the current bill, as presented to Congress, were set out in President Bachelet&#8217;s election program. But that should not preclude debate as to whether they are necessarily the most efficient way to achieve its broader aims.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>And that is where opinions diverge. Critics maintain that the new government is getting the cart before the horse. First, they say, tell us what the educational reform involves and how much it would cost and then let&#8217;s talk about how to&nbsp;<\/span><span>finance it.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>They are also concerned that the proposed tax increases could dampen GDP growth by discouraging investment, which already slipped sharply last year and, according to the Chilean Central Bank, will virtually stagnate this year. Through its adverse impact on employment, that would, they argue, defeat one of the reform&#8217;s other key aims &#8211; that of tempering the inequality of income distribution.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>The F word<\/strong><\/p>\n<p style=\"text-align: justify;\"><span>Just a few months ago, few Chileans, barring tax lawyers and accountants, had ever heard of the FUT. But it is now at the heart of debate about the proposed tax changes.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>An acronym, it stands literally for Fund of Taxable Profits but could more accurately be described as Register of (as yet) Non-Taxable Profits. It is, in other words, simply an accounting register on which companies record the profits they made in a particular year but did not distribute to their shareholders and on which the latter are not liable for personal income tax until those earnings are actually distributed.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>According to advocates of its elimination, the FUT is an anachronism. They point out that, when it was introduced in 1984 to encourage reinvestment of profits, Chile&#8217;s banking system was reeling from its collapse two years earlier, its capital market was still virtually non-existent and access to overseas borrowing was not a viable option.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Even many of its defenders also recognize that it has been used for tax avoidance. The classic, but not only, example is a disguised form of distribution whereby a company deposits its retained profits in an overseas bank account which is then used by its owners, thanks to a credit card, to finance consumption in Chile.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>But, barring such misuses, companies, both large and small, claim that the FUT has served as a key source of working capital and funding for new investments. Obliging a company&#8217;s owners to pay personal income tax on all the previous year&#8217;s profits &#8211; which, under the bill, would be the case as from 2018 &#8211; would, they say, be a powerful disincentive for reinvestment, implying either a reduction in investment or an increase in leverage.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Speaking at a breakfast of the ICARE business organization, Undersecretary for Finance Alejandro Micco argued that, in an open economy like Chile&#8217;s, the<\/span><\/p>\n<p style=\"text-align: justify;\">opportunity cost of investment is determined by (currently low) international interest rates. That, however, sidesteps the issue not only of whether debt financing is a perfect substitute for internal financing but also the fact that only large companies can tap international markets.<\/p>\n<p style=\"text-align: justify;\"><span>The loss of the FUT would, moreover, not be the only dent in the cash flow available to companies for new investments. Its proposed elimination also explains why, in addition to increasing the corporate tax rate from 20% to 25% over the next four years, the bill would, in practice, add on a further 10%.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Paid by a company on behalf of its owners, this new tax &#8211; designed to protect shareholders against a tax bill for profits they have not received &#8211; would serve as a credit against their personal income tax. But that does not change the fact that it would be a new up-front cost for companies.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Foreign investment<\/strong><\/p>\n<p style=\"text-align: justify;\"><span>In recent years, reinvestment of profits has played a crucial role in financing foreign direct investment (FDI) in Chile. According to the Central Bank, out of the US$150 billion that overseas companies committed to Chile between 2004 and 2013, US$80 billion corresponded to reinvested profits.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>On paper, foreign companies are less vulnerable to the increase in the corporate tax rate than local companies. They have, after all, always been liable to a 35% withholding tax against which corporate tax serves as a credit so their total tax bill would not change.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>But their cash flow would suffer. At present, they pay 20% at the end of the corresponding tax year and the other 15% only when remitting profits whereas, under the proposed changes, they would get hit for the full 35% at the end of the tax year.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>That is, moreover, not the only reason for fears of an impact on Chile&#8217;s longstanding attractiveness as a destination for foreign investment. The bill would also abolish the DL 600 Foreign Investment Statute.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Introduced in 1974 when FDI in Chile was at a low, it offers investors a contract with the state, guaranteeing matters such as access to the foreign exchange market and the right to repatriate capital and profits. It also includes the option of a locked-in 42% tax rate although, according to the government&#8217;s Foreign Investment Committee, that has only ever actually been paid by one company.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Advocates of DL 600&#8217;s elimination cite two main arguments. Firstly, that it is a&nbsp;<\/span><span>unilateral instrument and, as such, &#8220;gives away&#8221; advantages that could be used to negotiate similar conditions for Chilean companies investing in other countries and, secondly, that it is no longer necessary.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>That, they argue, is not only because of Chile&#8217;s changed economic and political situation but also because the same &#8211; and more &#8211; guarantees are now provided by the Bilateral Investment Treaties (BITs) which, over the past twenty years, Chile has signed with 38 countries and the investment chapters of its Free Trade Agreements (FTAs). (See Table: FDI Guarantees).<\/span><\/p>\n<p style=\"text-align: justify;\"><span>According to Manuel Jos\u00e9 Garc\u00e9s, a tax lawyer at Carey, a Santiago law firm, DL 600 also has a number of practical drawbacks. He points out that it involves more bureaucracy than Chapter XIV of the Central Bank&#8217;s Compendium of Foreign Exchange Regulations, the alternative vehicle for FDI in Chile, and also means programming the entry of the funds at the expense of the agility that may be required in, for example, the case of a merger or acquisition.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Investors have, indeed, been voting with their feet, increasingly using Chapter XIV in preference to DL 600. Between 2003 and 2007, DL 600 accounted for close to 60% of total FDI in Chile but, over the past four years, only around 40%.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>But, given that Chile now has BITs or FTAs with so many other countries, DL 600 neither gives much away nor costs the country much money. And it is not perhaps the best time to propose its elimination.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>There is the matter of competitiveness. Mining companies have mostly preferred to use DL 600 and, in recent years, their investments have been key in driving Chile&#8217;s growth.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Yet, in the annual survey of the investment attractiveness of different mining countries carried out by Canada&#8217;s Fraser Institute, Chile has been losing ground and ranked 23rd last year, down from 7th just a few years ago (although still well ahead of Peru, its main rival in the regional mining investment attraction stakes, at 58th). And its drop was due partly to an increased perception of regulatory uncertainty, precisely a point that the proposed elimination of DL 600 touches.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Ceteris paribus<\/strong><\/p>\n<p style=\"text-align: justify;\"><span>One of the catches of studying the effects of any economic measure is that the results only hold ceteris paribus or, in other words, if nothing else changes. Which, of course, it does and that includes not only tangible variables but also intangible ones, such as confidence or expectations, which have a powerful&nbsp;<\/span><span>influence over matters such as investment decisions.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Once in full operation, the proposed tax changes would raise an extra US$8.2 billion &#8211; approximately 3% of GDP &#8211; and, according to Undersecretary Micco, would benefit Chile&#8217;s growth in the long term by increasing equality and, through the government&#8217;s proposed educational reform, boosting human capital.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>But, pending details of the educational reform, its impact is impossible to predict. And, partly as a result, so too is the bottom line for equality and growth.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>International experience suggests that tax increases in themselves have relatively little impact on income distribution. According to a study by Harald Beyer, director of the Centro de Estudios P\u00fablicos, a think tank, the changes currently being debated would reduce Chile&#8217;s Gini coefficient (where 1 represents complete income inequality and 0 complete equality) of around 0.5 by a mere 0.014 points.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>Far more important from the point of view of income distribution &#8211; as well as growth &#8211; is the way tax revenues are spent. &#8220;If you&#8217;re going to take 3% of GDP from the private sector, you need to be very sure you&#8217;re a very good spender,&#8221; points out Alberto M. Ramos, head of Latin American economics at Goldman, Sachs &amp; Co.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>For growth, on the other hand, the key question is the impact on saving. Part of the extra revenues would be used to close a cyclically-adjusted fiscal deficit that currently reaches 1% of GDP and would, in other words, be saved.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>The rest, however, would be spent by the government, rather than being at least partly saved or reinvested by the companies and individuals from whom it is taken. There is, as a result, some consensus that, ceteris paribus, the country&#8217;s savings rate would likely drop by around one percentage point.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>That would be bad not only for interest rates but also for the current account deficit. Currently running at around 3.5% of GDP, it is short of the level that triggers country-risk red lights and, healthily, has been largely financed by foreign investment.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>But that could change. With the price of copper, by far Chile&#8217;s most important export, dropping, the Central Bank is forecasting that the trade surplus, a key component of the current account, will halve this year.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>It is, however, not just changing economic circumstances that make the results of the proposed tax changes difficult, if not impossible, to predict. It is also the fact that, as in any tax reform, the devil is in the details.<\/span><\/p>\n<p style=\"text-align: justify;\"><span>That suggests that Chile&#8217;s best investment could be to take plenty of time for calm, collected and informed debate.
