Que el Tratado de Libre Comercio (TLC) entre Chile y Estados Unidos, aprobado hace poco m\u00e1s de una d\u00e9cada, ha sido un \u00e9xito importante para ambos pa\u00edses ahora es algo de p\u00fablico conocimiento. Pero menos sabido es cu\u00e1n cerca estuvo de nunca llegar a concretarse. Las empresas estadounidenses, en coordinaci\u00f3n con AmCham Chile, desempe\u00f1aron un papel clave al trabajar con quienes hac\u00edan lobby y reunirse con pol\u00edticos para conseguir los votos clave que se necesitaban para dar al ex presidente George W. Bush los poderes de fast track que permitir\u00edan llevar el acuerdo ante el Congreso.<\/p>\n
Una de esas compa\u00f1\u00edas fue Caterpillar. El fabricante de equipos para la construcci\u00f3n y la miner\u00eda, los que en Chile se distribuyen a trav\u00e9s de Finning, ha sido por mucho tiempo un promotor del libre comercio en Washington, DC. William C. Lane, primer director de asuntos corporativos y gubernamentales globales, ha pasado casi 39 a\u00f1os en la firma y comenz\u00f3 a promover el acuerdo comercial con Chile en el a\u00f1o 1995.<\/span><\/p>\n Lane visit\u00f3 Chile recientemente para asistir a un seminario de AmCham en conmemoraci\u00f3n del 10\u00ba Aniversario del TLC. Durante su visita convers\u00f3 con bUSiness CHILE sobre c\u00f3mo AmCham y las empresas estadounidenses se juntaron para convencer a los legisladores de que Chile era un digno socio de libre comercio.<\/span><\/p>\n \u00bfC\u00f3mo lleg\u00f3 a involucrarse Caterpillar en la promoci\u00f3n del TLC?<\/span><\/strong><\/p>\n Desempe\u00f1amos un papel importante en el ALCAN y despu\u00e9s fuimos uno de los l\u00edderes corporativos en la Ronda de Uruguay del Acuerdo General sobre Aranceles Aduaneros y Comercio (GATT, por su sigla en ingl\u00e9s). De modo que determinamos que \u00e9ramos efectivos en la promoci\u00f3n de pol\u00edticas p\u00fablicas, particularmente en lo que se refiere a comercio. Adem\u00e1s de eso siempre est\u00e1bamos buscando temas en que tuvi\u00e9ramos una historia \u00fanica que contar. Cuando uno mira los TLC, nos hemos abanderado -Chile, Australia, Per\u00fa, Colombia y Panam\u00e1-; son ya sea grandes mercados o bien hay un gran proyecto como en el caso de Panam\u00e1. A\u00fan cuando la cantidad de poblaci\u00f3n de Chile no es numerosa, hist\u00f3ricamente ha sido un mercado importante tanto para la miner\u00eda como para la infraestructura.<\/span><\/p>\n \u00bfQu\u00e9 rol desempe\u00f1\u00f3 AmCham en las negociaciones que condujeron al TLC?<\/span><\/strong><\/p>\n En cierto sentido aprend\u00ed de AmCham. Aporta una cierta gama de fortalezas, principalmente credibilidad y la capacidad de interactuar con sus contrapartes en Estados Unidos. AmCham coloc\u00f3 activos que dispusieron la escena para una aprobaci\u00f3n definitiva. Comenz\u00f3 reuni\u00e9ndose con legisladores, pero tambi\u00e9n se reuni\u00f3 con centros de estudios. Implementaron toda la fundaci\u00f3n intelectual. Involucraron a la prensa y se reunieron con todos los grupos de comercio. Fue un esfuerzo muy sofisticado. Tocaron el aparato de la pol\u00edtica p\u00fablica como un Stradivarius. Fue as\u00ed de bueno y no he visto nada as\u00ed desde entonces. Otras iniciativas dependen m\u00e1s de personas contratadas para hacer lobby, pero Chile no lo hizo.<\/span><\/p>\n \u00bfFue el acuerdo un caso de la gente correcta en el momento correcto o hubo algo m\u00e1s que eso?<\/span><\/strong><\/p>\n Hubo un mayor grado de profesionalismo en AmCham y la embajada, realmente de manera generalizada. Me considero bueno juzgando a las personas y vi cosas en esta iniciativa que no vi en otras. En algunas iniciativas de pol\u00edtica p\u00fablica, la sensaci\u00f3n es que si se pone suficiente dinero en ellas, o si se contrata suficiente gente para el lobby, se pueden lograr. Pero este fue un enfoque totalmente diferente. Esto eraEl Se\u00f1or Smith va a Washington. La idea era que si cont\u00e1bamos una historia convincente, y si lo hac\u00edamos de una manera sincera, podr\u00edamos convencer a la gente de tomar la decisi\u00f3n correcta. Pero ese esfuerzo se estanc\u00f3 cuando Estados Unidos no avanz\u00f3 con el fast track [tambi\u00e9n llamado Autoridad de Promoci\u00f3n del Comercio, o TPA] en el a\u00f1o 1997 y casi toda la atenci\u00f3n de Washington pas\u00f3 a China.<\/span><\/p>\n \u00bfC\u00f3mo recuper\u00f3 Chile el impulso en los primeros a\u00f1os de este nuevo siglo?<\/span><\/strong><\/p>\n [George W.] Bush fue elegido y fue claramente proclive al libre comercio. Trabaj\u00f3 arduamente para que la Autoridad de Promoci\u00f3n del Comercio obtuviera varios votos pol\u00e9micos, finalmente 21 dem\u00f3cratas votaron a favor en el 2002. Esto fue justo despu\u00e9s de los atentados del 11 de septiembre y hab\u00eda ciertos cambalaches. La industria sider\u00fargica reci\u00e9n hab\u00eda superado momentos dif\u00edciles y estaba solicitando protecci\u00f3n de modo que el gobierno estuvo m\u00e1s asequible a ello de lo que algunas personas hubieran pensado [Bush impuso aranceles temporales al acero importado en el 2002]. Producto de ello, pudimos conseguir que algunos republicanos que normalmente no apoyar\u00edan el libre comercio lo hicieran. Estos votos fueron uno o dos; estuvo muy, muy ajustado.<\/span><\/p>\n Usted dijo con anterioridad que el TLC con Chile fue mejor que el ALCAN, \u00bfqu\u00e9 quiso decir?<\/span><\/strong><\/p>\n El ALCAN hizo que mucha liberalizaci\u00f3n se llevara a cabo en un largo per\u00edodo de tiempo de 10 a 15 a\u00f1os. Al menos para los bienes manufacturados, el TLC con Chile elimin\u00f3 de manera inmediata los aranceles entre Estados Unidos y Chile, adem\u00e1s de ello fue m\u00e1s amplio en el sentido de que incluy\u00f3 bienes re-manufacturados [bienes producidos usando partes de equipos viejos] e incluy\u00f3 nuevas \u00e1reas. Creo que la comunidad agr\u00edcola estuvo extremadamente contenta con eso. Adopt\u00f3 el libre comercio en lugar de introducirlo gradualmente.<\/span><\/p>\n \u00bfEn qu\u00e9 forma fue bueno el TLC para Caterpillar?<\/span><\/strong><\/p>\n En cierta forma esto fue lo m\u00e1s beneficioso del TLC: fue un validador de que Chile es un buen lugar para invertir. De repente, de 210 pa\u00edses en el mundo, Chile es uno de los cinco que tiene un acuerdo de libre comercio y con ello vienen todo tipo de disciplinas en t\u00e9rminos de protecciones para los inversionistas y liberalizaci\u00f3n del comercio. Eso se convierte en un im\u00e1n para el crecimiento. Chile adem\u00e1s comenz\u00f3 a invertir en infraestructura, lo que claramente nos beneficia, y el no cobrar altos aranceles a los equipos mineros implica que el sector es m\u00e1s eficiente y tambi\u00e9n nos beneficiamos por los mayores precios del cobre. De modo que las tres cosas vinieron juntas.<\/span><\/p>\n \u00bfQu\u00e9 aprendi\u00f3 usted personalmente de la experiencia de negociaci\u00f3n?<\/span><\/strong><\/p>\n Expandi\u00f3 mi campo de visi\u00f3n, hizo que me diera cuenta de que hay mucho m\u00e1s en el lobby que solo las relaciones. No quieres depender de consultores, quieres depender de ti mismo y eso es lo que hizo AmCham.<\/span><\/p>\n <\/p>\n That the Chile-US Free Trade Agreement (FTA), passed just over a decade ago, has been a major success for both countries is by now common knowledge. But less well known is how close it was to never happening. American businesses, in coordination with AmCham Chile, played a key role in working with lobbyists and meeting with politicians to get the crucial votes that were needed to give former President George W. Bush fast track authority to bring the agreement before Congress.<\/span><\/p>\n One of these businesses was Caterpillar. The manufacturer of construction and mining equipment, which in Chile is distributed through Finning, has long been a free trade promoter in Washington, DC. William C. Lane, Senior Director of Global Government and Corporate Affairs, has spent nearly 39 years with the firm and started promoting a trade agreement with Chile in 1995.<\/span><\/p>\n He came to Chile recently to attend an AmCham seminar celebrating the 10-year anniversary of the FTA. During his visit he spoke to bUSiness CHILE about how AmCham and US businesses came together to convince lawmakers that Chile was a worthy free trade partner.<\/span><\/p>\n How did Caterpillar become involved in promoting the FTA?<\/span><\/strong><\/p>\n We played an important role in NAFTA, and then we were one of the corporate leaders of the GATT Uruguay Round. So we established that we were effective in public policy advocacy, particularly as it relates to trade. On top of that we were always looking for issues that we had a unique story to tell. When you look at the FTAs we\u2019ve championed \u2013 Chile, Australia, Peru, Colombia and Panama \u2013 they\u2019re either big markets or there is a big project as in the case of Panama. Even though the population base of Chile isn\u2019t high, it\u2019s been a historically important market both for mining and infrastructure.<\/span><\/p>\n What role did AmCham play in the negotiations leading to the FTA?<\/strong><\/p>\n In some ways I learned from AmCham. It brings a certain set of strengths, primarily credibility and the ability to interact with their counterparts in the US. AmCham put assets in place that set the stage for eventual passage. It started out with meeting members of Congress but they also met with thinktanks. They put all of the intellectual foundation in place. They engaged the press and met with all the trade groups. It was a very sophisticated effort. They played the public policy apparatus like a Stradivarius. It was that good and I\u2019ve not seen anything as good since. Other efforts relied more on paid lobbyists, but Chile didn\u2019t.<\/span><\/p>\n Was the agreement a case of the right people at the right time or was there something more to it?<\/strong><\/p>\n There was a higher degree of professionalism in AmCham and the Embassy, really across the board. I think I\u2019m a good judge of people and I was seeing things in this effort that I wasn\u2019t seeing in others. In some public policy efforts the feeling is that if you throw enough money at it, or if you hire enough lobbyists, you can get it done. But this was a whole different approach. This was Mr. Smith goes to Washington. The idea was that if we tell a compelling story, and if we can do it in a sincere way, we could convince people to make the right decision. But that effort stalled when the US did not move forward on fast track authority [also called Trade Promotion Authority, or TPA] in 1997 and almost all the focus in Washington moved to China.<\/span><\/p>\n How did Chile recapture the momentum in the early 2000s?<\/strong><\/p>\n [George W.] Bush was elected and he was clearly a free trader. He worked hard for Trade Promotion Authority getting very contentious votes, ultimately 21 Democrats voted for it in 2002. This was right after 9\/11 and some bartering took place. The steel industry had just come off hard times and they were seeking protection so the administration was more amenable to it than some people would have thought [Bush placed a temporary tariff on imported steel in 2002]. As a result we were able to get some Republicans who wouldn\u2019t normally support free trade to support it. These votes were by one or two votes; it was very, very close.<\/span><\/p>\n You said earlier that the Chile FTA was better than NAFTA, what did you mean?<\/strong><\/p>\n NAFTA had a lot of liberalization take place over a long period of 10-15 years. At least for manufactured goods, the Chile FTA immediately eliminated tariffs in the US and Chile, on top of that it was broader in the sense that it included remanufactured goods [goods produced using parts from old equipment] and included new areas. I think the agricultural community was exceedingly pleased with it. It embraced free trade rather than try to phase it in.<\/span><\/p>\n How was the FTA good for Caterpillar?<\/span><\/strong><\/p>\n In some ways this was the best benefit of the FTA \u2013 it was a validator that Chile is a good place to invest. All of a sudden, out of 210 countries in the world, Chile is one of five that has a free trade agreement and with it comes all sorts of disciplines in terms of investor protections and trade liberalization. That becomes a magnet for growth. Chile also started investing in infrastructure, which clearly benefits us, and by not charging high tariffs on mining equipment it means the sector is more efficient, and we also benefitted from higher copper prices. So all three things came together.<\/span><\/p>\n What did you personally learn from the negotiating experience?<\/span><\/strong><\/p>\n Expanding my field of view, it made me realize there\u2019s a lot more to lobbying than just relationships. You have a lot of tools you can use that include working with CEO community, the lobby community, engaging the press and developing grassroots apparatus.
