Luego de 16 rondas de negociaciones desde el 2010 -la d\u00e9cimo s\u00e9ptima se llevar\u00e1 a cabo en Lima en el mes de mayo- la iniciativa multilateral de comercio conocida como Acuerdo de Asociaci\u00f3n Transpac\u00edfico (TPP, por su sigla en ingl\u00e9s) finalmente est\u00e1 a punto de tomar forma. El momento en que se lograr\u00e1 sigue siendo incierto, pero un borrador del acuerdo podr\u00eda estar en la mesa para fines de este a\u00f1o. El resultado ser\u00eda un nuevo bloque comercial en la regi\u00f3n del Asia-Pac\u00edfico, correspondiente a un mercado de 650 millones de consumidores.<\/P>

Chile es miembro fundador del acuerdo original P4, el que se cre\u00f3 en el 2006, junto con Brunei, Singapur y Nueva Zelanda. El intercambio comercial entre estos cuatro pa\u00edses es relativamente peque\u00f1o, pero el acuerdo ten\u00eda importancia estrat\u00e9gica, porque mantuvo viva la visi\u00f3n que ten\u00edan los miembros del Foro de Cooperaci\u00f3n Econ\u00f3mica Asia-Pac\u00edfico (APEC) de un \u00e1rea com\u00fan de comercio en la regi\u00f3n del Asia-Pac\u00edfico.<\/P>
\n
\u201cCre\u00f3 la posibilidad de que a partir de esta peque\u00f1a semilla otros pa\u00edses tambi\u00e9n pudieran unirse, que es la raz\u00f3n por la que el acuerdo P4 siempre estuvo abierto\u201d, se\u00f1al\u00f3 el ministro de Relaciones Exteriores de Chile, Alfredo Moreno, en un desayuno realizado en Santiago en marzo pasado en honor al primer ministro de Nueva Zelanda, John Key.<\/P>
\n
En el 2008, mientras los miembros del P4 estaban negociando nuevos cap\u00edtulos del acuerdo, Estados Unidos se uni\u00f3 a las negociaciones. Desde entonces, m\u00e1s pa\u00edses se han ido incorporando de manera gradual incluidos Australia, Malasia, Per\u00fa y Vietnam. Los \u00faltimos en integrarse fueron Canad\u00e1 y M\u00e9xico el a\u00f1o pasado. Hoy en d\u00eda este acuerdo representa un mercado cercano a los 650 millones de consumidores y a casi el 30% del PIB mundial.<\/P>
\n
Por supuesto, los pa\u00edses incluidos en el TPP tienen enormes diferencias culturales y distintas tasas de crecimiento econ\u00f3mico, con un PIB per c\u00e1pita que va de los US$60.000 en Singapur a los US$3.000 en Vietnam. Pero \u201csi queremos unir Ocean\u00eda y Asia de costa a costa siempre vamos a encontrar esta realidad\u201d, indic\u00f3 Moreno.<\/P>
\n
En este contexto, encontrar terreno com\u00fan para establecer altos est\u00e1ndares en \u00e1reas como propiedad intelectual y medio ambiente no ha sido f\u00e1cil, lo que explica por qu\u00e9 las negociaciones ahora se dirigen a la Ronda 17. Sin embargo, para Estados Unidos el TPP representa una oportunidad sin precedentes para aumentar las exportaciones a la regi\u00f3n del Asia-Pac\u00edfico.<\/P>
\n
Beneficios Tangibles<\/STRONG><\/P> En enero, el subsecretario de la Oficina de Representaci\u00f3n Comercial de Estados Unidos, Demetrios Marantis, encabez\u00f3 una misi\u00f3n a Chile para continuar las negociaciones con el Gobierno chileno. Durante su visita, el embajador Marantis se reuni\u00f3 con socios de AmCham para referirse al TPP y a c\u00f3mo las compa\u00f1\u00edas chilenas podr\u00edan beneficiarse con \u00e9l.<\/P> Marantis dijo que el TPP traer\u00eda como resultado \u201cun acuerdo del siglo XXI de alto est\u00e1ndar\u201d que beneficiar\u00e1 a todos los pa\u00edses miembro en el largo plazo. Pero \u00bfqu\u00e9 significa en la pr\u00e1ctica eso para Chile?<\/P> Chile ya cuenta con tratados de libre comercio con todos los pa\u00edses que conforman el TPP (incluido Vietnam, con el que suscribi\u00f3 un acuerdo en noviembre pasado). Seg\u00fan cifras del Ministerio de Relaciones Exteriores, el intercambio comercial de Chile con estos pa\u00edses sum\u00f3 un total de US$40.500 millones el a\u00f1o pasado, un alza promedio del 16% anual desde el 2003.<\/P> No obstante, el TPP crear\u00eda nuevas oportunidades comerciales en \u00e1reas no cubiertas en acuerdos existentes tales como servicios financieros e inversi\u00f3n. \u201cHay beneficios reales, tangibles para Chile en t\u00e9rminos de ganar acceso a mercados y simplificar reglas\u201d, indic\u00f3 Marantis.<\/P> Chile y Estados Unidos tienen un tratado de libre comercio que eliminar\u00e1 los aranceles sobre casi todos los bienes para el 2015, pero el TPP podr\u00eda mejorar el acceso para los exportadores chilenos a otros mercados. Por ejemplo, los servicios actualmente no est\u00e1n cubiertos bajo el acuerdo de Chile con Vietnam pero lo estar\u00e1n en el TPP, destac\u00f3 Marantis.<\/P> \u201cAdem\u00e1s de las ganancias cuantificables en t\u00e9rminos de acceso a mercado, tambi\u00e9n hay ganancias en eficiencia para los exportadores chilenos en el contexto de un acuerdo regional\u201d, sostuvo.<\/P> Marantis mencion\u00f3 un estudio del profesor Peter Petri de la Massachusetts\u2019 Brandeis International Business School, que se\u00f1ala que en virtud del TPP Chile podr\u00eda incrementar sus exportaciones en US$2.900 millones al a\u00f1o hasta el 2025.<\/P> Parte de estas ganancias se deber\u00edan a una mayor inversi\u00f3n y exportaciones de servicios financieros, pero tambi\u00e9n reflejan m\u00e1rgenes comerciales m\u00e1s altos como resultado de cadenas de suministro m\u00e1s amplias para las compa\u00f1\u00edas chilenas.<\/P> Reglas de Origen Acumulativas<\/STRONG><\/P> De manera clave, el TPP incluir\u00eda reglas de origen acumulativas lo que significa que los productores chilenos pueden usar insumos de otros pa\u00edses miembro, como por ejemplo Per\u00fa, y a\u00fan as\u00ed tener acceso preferencial a mercados de exportaci\u00f3n en virtud de los tratados existentes de libre comercio.<\/P> Este mecanismo permitir\u00eda una mayor integraci\u00f3n industrial y comercial entre los miembros, explica \u00c1lvaro Jana, titular de la Direcci\u00f3n General de Relaciones Econ\u00f3micas Internacionales (DIRECON), entidad dependiente del Ministerio de Relaciones Exteriores de Chile.<\/P> El TPP no es la \u00fanica iniciativa comercial en incluir este mecanismo. La Alianza del Pac\u00edfico suscrita el a\u00f1o pasado por Chile, Per\u00fa, Colombia y M\u00e9xico aplica reglas similares, pero el TPP dar\u00eda m\u00e1s opciones a las compa\u00f1\u00edas manufactureras de Chile.<\/P> Tome por ejemplo las empresas textiles. Un emprendedor chileno podr\u00eda fabrica jeans en Chile con denim importado desde Malasia e hilado en Vietnam, que posteriormente podr\u00eda exportarse a Per\u00fa.<\/P> Tambi\u00e9n implica que las compa\u00f1\u00edas chilenas podr\u00edan cambiar de proveedores para aprovechar oportunidades comerciales. \u201cPor ejemplo, para productos pl\u00e1sticos se podr\u00eda cambiar el actual proveedor en China por uno en Malasia\u201d, dice Jana.<\/P> Lejos de reemplazar los acuerdos comerciales vigentes de Chile, el TPP los \u201ccomplementar\u00eda y completar\u00eda\u201d, afirma Jana.<\/P> Adem\u00e1s habr\u00eda una mejor protecci\u00f3n de las inversiones para las compa\u00f1\u00edas chilenas, un mecanismo de resoluci\u00f3n de disputas m\u00e1s s\u00f3lido y una mayor coherencia regulatoria en la regi\u00f3n. Esto quiero decir que los exportadores podr\u00edan llevar sus productos al mercado m\u00e1s r\u00e1pidamente y con menos burocracia.<\/P> Asimismo el bloque comercial podr\u00eda continuar creciendo en el futuro. En enero, el presidente Barack Obama invit\u00f3 a Jap\u00f3n a participar y es inminente la decisi\u00f3n respecto de si ser\u00e1 aceptado.<\/P> Para Chile, la inclusi\u00f3n de Jap\u00f3n ser\u00eda un bono. Los dos pa\u00edses ya cuentan con un tratado de libre comercio vigente desde el 2007, y el a\u00f1o pasado el comercio bilateral alcanz\u00f3 los US$10.960 millones y Jap\u00f3n recibi\u00f3 poco m\u00e1s de un tercio de las exportaciones de Chile. \u201cEl ingreso de Jap\u00f3n al TPP profundizar\u00eda nuestra relaci\u00f3n comercial a\u00fan m\u00e1s\u201d, a\u00f1ade Jana.<\/P> Pero primero Jap\u00f3n y otros posibles miembros deben acceder a cumplir con los altos est\u00e1ndares del TPP.<\/P> Un Acuerdo del \u201cSiglo XXI\u201d<\/STRONG><\/P> El TPP es mucho m\u00e1s que solo un acuerdo comercial. A juicio de Jana, sentar\u00e1 un precedente con est\u00e1ndares m\u00e1s altos que cualquier acuerdo previo.<\/P> \u201cAl ser parte del proceso, Chile se consolidar\u00e1 como un actor importante en el dise\u00f1o de nuevas normas de comercio internacional\u201d, afirma.<\/P> El TPP abordar\u00e1 \u201ctemas del siglo XXI\u201d analizados por el presidente Obama y el presidente Pi\u00f1era, dijo Marantis. Estos incluyen est\u00e1ndares de protecci\u00f3n al medio ambiente, protecci\u00f3n de la propiedad intelectual y aseguramiento de un campo de juego parejo entre las compa\u00f1\u00edas estatales y las empresas del sector privado.<\/P> Una mayor protecci\u00f3n de las patentes farmacol\u00f3gicas estadounidenses, que ha sido un continuo problema entre los dos pa\u00edses, es particularmente importante en las negociaciones bilaterales.<\/P> \u201cEstos van a ser temas dif\u00edciles\u201d, indic\u00f3 Marantis, pero calific\u00f3 las recientes conversaciones con sus contrapartes en la DIRECON y otros ministerios como \u201cproductivas y francas\u201d.<\/P> En la DIRECON, Jana dice que Chile ha estado implementando altos est\u00e1ndares en materia de propiedad intelectual y medio ambiente. \u201cLos esfuerzos de nuestro equipo negociador apuntan a garantizar que estos est\u00e1ndares no afecten los objetivos de pol\u00edticas p\u00fablicas de nuestro pa\u00eds\u201d, afirma.<\/P> Sin embargo, hay otros aspectos que se est\u00e1n negociando y que podr\u00edan tener implicancias para Chile. Por ejemplo, el Acuerdo de Asociaci\u00f3n Transpac\u00edfico podr\u00eda imponer restricciones que dificulten que Chile regule flujos de capital para proteger su econom\u00eda de crisis financieras, advierte Osvaldo Rosales, director de la divisi\u00f3n de comercio internacional e integraci\u00f3n de la Comisi\u00f3n Econ\u00f3mica para Am\u00e9rica Latina y el Caribe (Cepal) de la Organizaci\u00f3n de Naciones Unidas.<\/P> Seg\u00fan Rosales, el problema radica en encontrar el correcto equilibrio entre los objetivos de todos los participantes y satisfacer las demandas de Estados Unidos. \u201cAlgunas de estas demandas, tales como normas sobre la balanza de pagos y el movimiento de capitales son claramente inconvenientes\u201d, sostiene.<\/P> Todos Menos China<\/STRONG><\/P> Otro problema, a juicio de Rosales, es el riesgo de alienar a China, uno de los socios comerciales clave de Chile. De hecho, algunos denominan al TPP el \u201cacuerdo de todos menos China\u201d dado que el drag\u00f3n asi\u00e1tico brilla por su ausencia.<\/P> No obstante, China forma parte de otra iniciativa comercial conocida como Asociaci\u00f3n Econ\u00f3mica Integral Regional (RCEP por su sigla en ingl\u00e9s), que es el principal rival del TPP en el Asia-Pac\u00edfico. Esta iniciativa de la Asociaci\u00f3n de Naciones del Sureste Asi\u00e1tico (ASEAN por su sigla en ingl\u00e9s) incluye el econ\u00f3micamente poderoso triunvirato de China, Jap\u00f3n y Corea del Sur.<\/P> Hasta ahora este acuerdo sigue en la etapa de dise\u00f1o, pero los beneficios de la integraci\u00f3n econ\u00f3mica podr\u00edan reducir cualquier barrera cultural. Si esto ocurre, pa\u00edses como Vietnam y Malasia, que son miembros de ASEAN, podr\u00edan terminar siendo parte de dos acuerdos comerciales distintos y rivales.<\/P> \u201cTarde o temprano surgir\u00e1n conflictos entre el TPP y las iniciativas al interior de Asia\u201d, asevera Rosales.<\/P> No obstante, Jana afirma que tales acuerdos pueden coexistir y complementarse sin problemas. \u201cNo creemos que la f\u00f3rmula para analizar estos esquemas sea la competencia\u201d, sentencia.<\/P> En definitiva, habr\u00e1 que probar para ver c\u00f3mo resulta. El presidente Obama espera que un borrador del acuerdo est\u00e9 listo para cuando los l\u00edderes de ASEAN se re\u00fanan en Bali este octubre, pero eso podr\u00eda ser optimista, en especial si Jap\u00f3n se une a las negociaciones en los pr\u00f3ximos meses.<\/P> Luego est\u00e1 el tema de la ratificaci\u00f3n. El presidente Obama planea dar v\u00eda r\u00e1pida a la legislaci\u00f3n del TPP en el Congreso, pero conseguir la aprobaci\u00f3n para un acuerdo tan amplio podr\u00eda ser un desaf\u00edo. A\u00fan as\u00ed, Marantis se mostr\u00f3 esperanzado dada la importancia de las exportaciones para que la econom\u00eda estadounidense impulse el crecimiento y cree empleo.<\/P> \u201cHay un camino dif\u00edcil en adelante, pero cuando se quiere se puede\u201d, dijo.<\/P> Como miembro fundador del TPP, Chile tiene un importante rol que desempe\u00f1ar en facilitar su expansi\u00f3n. Pero dado que los beneficios a\u00fan son inciertos, Chile deber\u00eda evaluar sus opciones cuidadosamente.<\/P> Julian Dowling es editor de bUSiness CHILE<\/STRONG><\/P> After 16 rounds of negotiations since 2010 \u2013 the 17th will be in Lima in May \u2013 the multilateral trade initiative known as the Trans-Pacific Partnership (TPP) is finally on the verge of taking shape. The timing remains uncertain, but a draft agreement could be on the table by the end of this year. The result would be a new trade bloc in the Asia-Pacific region, representing a market of 650 million consumers.<\/P> Chile is a founding member of the original P4 agreement, which was created in 2006, along with Brunei, Singapore and New Zealand. Trade between these four countries is relatively small, but the agreement had strategic importance because it kept alive the vision held by the Asia-Pacific Economic Cooperation (APEC) members of a common trade area in the Asia-Pacific region.<\/P> \u201cIt created the possibility that from this small seed other countries could also join, which is why the P4 agreement was always open,\u201d said Chile\u2019s Foreign Minister Alfredo Moreno at a breakfast for the Prime Minister of New Zealand, John Key, in Santiago last March.<\/P> In 2008, while the P4 members were negotiating new chapters of the agreement, the United States joined the talks. Since then, more countries have gradually been incorporated including Australia, Malaysia, Peru and Vietnam. The latest to join were Canada and Mexico last year. Today this agreement represents a market of around 650 million consumers and almost 30% of the world\u2019s GDP.<\/P> Of course, the countries in the TPP have huge cultural differences and different rates of economic growth, with per capita GDP ranging from US$60,000 in Singapore to US$3,000 in Vietnam. But \u201cif we want to unite Oceania and Asia from shore to shore we will always find this reality,\u201d said Moreno.<\/P> In this context, finding common ground to establish high standards in areas such as intellectual property and the environment has not been easy, which explains why negotiations are now headed to Round 17. However, for the United States the TPP represents an unprecedented opportunity to increase exports in the Asia-Pacific region.<\/P> Tangible benefits<\/STRONG><\/P> In January, Deputy US Trade Representative Demetrios Marantis led a mission to Chile to continue negotiations with the Chilean government. During his visit, Ambassador Marantis met with AmCham members to talk about the TPP and how Chilean companies stand to gain.<\/P> Marantis said the TPP would result in \u201ca high-standard, 21st Century agreement\u201d that will benefit all member countries in the long term. But what does that mean for Chile in practice?<\/P> Chile already has free trade agreements with all of the countries in the TPP (including with Vietnam, which it signed last November). According to figures from the Foreign Ministry, Chilean trade with these countries totaled US$40.50 billion last year, up an average 16% annually since 2003.<\/P> Nevertheless, the TPP would create new business opportunities in areas not covered in existing agreements such as financial services and investment. \u201cThere are real, tangible benefits for Chile in terms of market access gains and simplification of rules,\u201d said Marantis.<\/P> Chile and the United States have a Free Trade Agreement that will eliminate tariffs on nearly all goods by 2015, but the TPP could improve access for Chilean exporters to other markets. For example, services are not currently covered under Chile\u2019s agreement with Vietnam but they would be in the TPP, points out Marantis.<\/P> \u201cIn addition to the quantifiable market access gains, there\u2019s also the efficiency gains for Chilean exporters in the context of a regional agreement,\u201d he said.<\/P> Marantis cited a study by Professor Peter Petri at Massachusetts\u2019 Brandeis International Business School, which states that under the TPP Chile could increase its exports by US$2.9 billion annually through 2025.<\/P> Part of this gain would be due to higher investment and exports of financial services, but it also reflects higher trade margins as the result of expanded supply chains for Chilean companies.<\/P> Cumulative rules of origin<\/STRONG><\/P> Crucially, the TPP would include cumulative rules of origin, which means that Chilean producers could use inputs from other member countries, such as Peru, and still have preferential access to export markets under existing trade agreements.<\/P> This mechanism would allow greater industrial and commercial integration between members, explains \u00c1lvaro Jana, director of the General Directorate of International Economic Affairs (DIRECON) at Chile\u2019s Foreign Ministry.<\/P> The TPP is not the only trade initiative to include such a mechanism. The Pacific Alliance signed last year between Chile, Peru, Colombia and Mexico applies similar rules, but the TPP would give Chilean manufacturers more options.<\/P> Take textiles. A Chilean entrepreneur might make jeans in Chile with denim imported from Malaysia and thread from Vietnam, which could later be exported to Peru.<\/P> It also means Chilean companies could switch suppliers to take advantage of trade opportunities. \u201cFor example, for plastic products you could change a current supplier in China for one in Malaysia,\u201d Jana said.<\/P> Far from replacing Chile\u2019s existing trade agreements, the TPP would \u201ccomplement and complete\u201d them, said Jana.<\/P> There would also be better investment protection for Chilean companies, a stronger dispute resolution mechanism and greater regulatory coherence in the region. This means exporters could get their goods to market quicker and with less red tape.<\/P> The trade bloc could also continue to grow in the future. In January President Obama invited Japan to participate and a decision on whether it will be accepted is imminent.<\/P> For Chile, Japan\u2019s inclusion would be a bonus. The two countries already have a Free Trade Agreement in place since 2007, and last year bilateral trade reached US$10.96 billion with Japan receiving just over one third of Chile\u2019s exports. \u201cThe entry of Japan into the TPP would deepen our trade relationship even further,\u201d said Jana.<\/P> But first Japan and other potential members must agree to comply with the TPP\u2019s high standards.<\/P> A \u201c21st Century\u201d agreement<\/STRONG><\/P> The TPP is much more than just a trade agreement. According to Jana, it will set a precedent with higher standards than any previous agreement.<\/P> \u201cBy being part of the process, Chile will consolidate itself as an important actor in the design of new international trade rules,\u201d he said.<\/P> The TPP will address \u201c21st Century issues\u201d discussed by President Obama and President Pi\u00f1era, said Marantis. These include environmental protection standards, intellectual property protection and ensuring a level playing field between state-owned enterprises and private sector companies.<\/P> Stronger protection for US pharmaceutical patents, which has been a contentious issue between the two countries, is particularly important in bilateral negotiations.<\/P> \u201cThese are going to be tough issues,\u201d said Marantis, but he described recent talks with his counterparts in DIRECON and other ministries as \u201cproductive and frank\u201d. But there are other aspects being negotiated that could have implications for Chile. For example, the Trans-Pacific Partnership could impose restrictions that make it difficult for Chile to regulate capital flows to protect its economy from financial crises, warns Osvaldo Rosales, director of the International Trade and Integration Division at the UN\u2019s Economic Commission for Latin America (ECLAC).<\/P> According to Rosales, the problem is finding the right balance between the aims of all the participants and meeting the demands of the United States. \u201cSome of these demands, such as rules on the balance of payments and movement of capital are clearly inconvenient,\u201d he said.<\/P> Everybody but China<\/STRONG><\/P> Another problem, according to Rosales, is the risk of alienating China, one of Chile\u2019s key trading partners. Indeed, some are calling TPP the \u201ceverybody but China agreement\u201d since the Asian dragon is conspicuous by its absence.<\/P> China is, however, part of another trade initiative known as the Regional Comprehensive Economic Partnership (RCEP), which is the TPP\u2019s main rival in the Asia-Pacific. This initiative of the Association of Southeast Asian Nations (ASEAN) includes the economically powerful triumvirate of China, Japan and South Korea.<\/P> So far this agreement remains on the drawing board, but the benefits of economic integration could dwarf any cultural barriers. If this happens, countries like Vietnam and Malaysia, which are members of ASEAN, could find themselves part of two different and competing trade agreements.<\/P> \u201cSooner or later conflicts between TPP and intra-Asia initiatives will arise,\u201d said Rosales. Ultimately the proof will be in the pudding. President Obama hopes to have a draft agreement ready by the time ASEAN leaders meet in Bali this October but that may be optimistic, especially if Japan joins talks in the coming months.<\/P> Then there is the issue of ratification. President Obama plans to fast track TPP legislation through Congress but getting approval for such an expansive agreement could be a challenge. Even so, Marantis is hopeful given the importance of exports to the US economy in boosting growth and creating jobs.<\/P> \u201cThere\u2019s a difficult road ahead, but where there\u2019s a will there\u2019s a way,\u201d he said.<\/P> As a founding TPP member, Chile has an important role to play in facilitating its expansion.
