{"id":4909,"date":"2012-10-19T13:27:20","date_gmt":"2012-10-19T16:27:20","guid":{"rendered":""},"modified":"2015-03-09T11:27:04","modified_gmt":"2015-03-09T14:27:04","slug":"proteger-a-los-mineros-de-chile","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/proteger-a-los-mineros-de-chile\/","title":{"rendered":"<!--:es-->Proteger a los Mineros de Chile<!--:--><!--:en-->Protecting Chile\u2019s Miners<!--:-->"},"content":{"rendered":"<p><!--:es--><\/p>\n<p style=\"text-align: justify;\">Mientras la atenci\u00f3n del mundo estaba concentrada en Chile en el 2010, esperando el milagroso rescate de los of 33 mineros atrapados en las entra\u00f1as del desierto de Atacama por 69 d\u00edas, el presidente Sebasti\u00e1n Pi\u00f1era promet\u00eda nuevas leyes para mejorar la seguridad minera en el pa\u00eds. No obstante, dos a\u00f1os m\u00e1s tarde, esas promesas est\u00e1n comenzando a parecer tan vac\u00edas e inestables como la propia mina San Jos\u00e9.<\/p>\n<p style=\"text-align: justify;\">Es cierto que se hicieron significativas mejoras tras el accidente: seg\u00fan cifras de un informe publicado por el Ministerio de Miner\u00eda, el n\u00famero de fallecidos cay\u00f3 de 45 en el 2010 a 29 en el 2011. Los accidentes en las minas de Chile tambi\u00e9n se redujeron el a\u00f1o pasado en un 40% a su menor nivel en 21 a\u00f1os.<\/p>\n<p style=\"text-align: justify;\">Chile adem\u00e1s ha conseguido notables progresos en las inspecciones de seguridad. Antes del incidente de la mina San Jos\u00e9 hab\u00eda solo 18 inspectores para las 5.400 minas a nivel nacional comparados con los 47 que hay ahora, y la cantidad de revisiones casi se ha triplicado en los \u00faltimos dos a\u00f1os de 2.586 en el 2010 a m\u00e1s de 5.000 en lo que va de este a\u00f1o.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, hay peque\u00f1as se\u00f1ales en cuanto a que los est\u00e1ndares est\u00e1n comenzando a declinar y a que las cifras de accidentes est\u00e1n volviendo a subir. Este a\u00f1o ya han fallecido 15 mineros, lo que equivale a tres m\u00e1s que en el mismo per\u00edodo del 2011, seg\u00fan el Servicio Nacional de Geolog\u00eda y Miner\u00eda de Chile (Sernageomin), el ente estatal encargado de regular a la industria minera del pa\u00eds. El aumento es marginal, pero quiz\u00e1s es indicativo de que ahora el foco ha cambiado, y as\u00ed tambi\u00e9n la presi\u00f3n por mejorar las condiciones.<\/p>\n<p style=\"text-align: justify;\">Chile no es la \u00fanica naci\u00f3n que ha tenido dificultades para mejorar los est\u00e1ndares de seguridad minera. Nueva Zelanda -otro peque\u00f1o pa\u00eds que sufri\u00f3 un accidente minero en el 2010: el desastre de la mina Pike River, en el que murieron 29 mineros- cre\u00f3 una divisi\u00f3n de Altos Riesgos el a\u00f1o pasado para supervisar su 30 minas, pero enfrenta problemas similares a los de Chile incluidos fiscalizadores mal financiados e inercia regulatoria.<\/p>\n<p style=\"text-align: justify;\"><strong>El Fracaso de las Reformas<\/strong><\/p>\n<p style=\"text-align: justify;\">Pese a las mejoras iniciales tras el incidente de la mina San Jos\u00e9, las promesas de reformar la legislaci\u00f3n minera siguen sin cumplirse. Un ejemplo es el fracaso de Chile para ratificar la Convenci\u00f3n 176 de la Organizaci\u00f3n Internacional del Trabajo (OIT), lo que el presidente Pi\u00f1era prometi\u00f3 hacer en el 2010.<\/p>\n<p style=\"text-align: justify;\">Esta convenci\u00f3n establece los derechos de los trabajadores a rehusar una labor que consideran insegura, abandonar una mina que estiman peligrosa y elegir a sus propios representantes de higiene y seguridad. No obstante, Chile contin\u00faa estudi\u00e1ndola para determinar si contravendr\u00eda cualquiera de sus legislaciones vigentes.<\/p>\n<p style=\"text-align: justify;\">Brian Kohler, director de salud, seguridad y sustentabilidad de IndustriALL Global Union, sindicato internacional que representa a 50 millones de trabajadores en 140 pa\u00edses, responsabiliza a las grandes empresas por el hecho de que no se est\u00e9n tomando importantes medidas dentro del proceso legislativo.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Brian_Kohler.jpg\" alt=\"\" width=\"200\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">\u201cEl presidente Pi\u00f1era prometi\u00f3 al mundo que Chile ratificar\u00eda la Convenci\u00f3n 176 de la OIT\u201d, afirma Kohler. \u201cEl hecho que no haya cumplido con ese compromiso solo puede explicarse por la presi\u00f3n del lobby empresarial\u201d.<\/p>\n<p style=\"text-align: justify;\">Los gerentes de peque\u00f1as minas, no solo las grandes empresas como sostiene Kohler, tambi\u00e9n se opusieron a la ratificaci\u00f3n de la convenci\u00f3n. Gast\u00f3n Araya, vicepresidente de operaciones de Laguna Resources, minera australiana con operaciones de exploraci\u00f3n de peque\u00f1a escala en Chile, se\u00f1ala que la ratificaci\u00f3n ser\u00eda equivalente a una \u201cp\u00e9rdida de soberan\u00eda\u201d.<\/p>\n<p style=\"text-align: justify;\">\u201cEn Chile contamos con leyes que ya cubren holgadamente lo que estamos buscando en este acuerdo, de modo que en lo personal estoy totalmente en contra de suscribir un acuerdo transnacional que tiene m\u00e1s fuerza que la Constituci\u00f3n\u201d, asevera Araya.<\/p>\n<p style=\"text-align: justify;\">De hecho, de cara al incidente de la mina San Jos\u00e9 el Gobierno ha desarrollado nueva legislaci\u00f3n para mejorar a\u00fan m\u00e1s la seguridad minera, en particular para las peque\u00f1as minas en donde las condiciones de seguridad a menudo son las m\u00e1s precarias. En la actualidad, hay dos proyectos de ley pendientes en Chile los que lograr\u00edan justamente eso.<\/p>\n<p style=\"text-align: justify;\"><strong>Problemas de Escala<\/strong><\/p>\n<p style=\"text-align: justify;\">Descrito como la parte m\u00e1s importante de la legislaci\u00f3n minera en los \u00faltimos 30 a\u00f1os, el proyecto de ley de seguridad minera anunciado por el presidente Pi\u00f1era en el 2011 propuso una gran reestructuraci\u00f3n de las agencias regulatoria mineras, en particular del Sernageomin, y mejoras en la capacitaci\u00f3n de los expertos t\u00e9cnicos.<\/p>\n<p style=\"text-align: justify;\">El proyecto de ley incluye un sistema de c\u00f3digos de color para calificar a las minas de acuerdo con sus est\u00e1ndares de seguridad, un sistema que permite que los mineros presenten quejas an\u00f3nimas sobre la seguridad de su lugar de trabajo y un aumento de las multas aplicadas a aquellas empresas que no cumplan con las regulaciones.<\/p>\n<p style=\"text-align: justify;\">El presidente Pi\u00f1era prometi\u00f3 que la ley llevar\u00eda a una nueva \u201ccultura de seguridad en la miner\u00eda&#8221;. Pero en septiembre, el proyecto de ley no logr\u00f3 obtener la aprobaci\u00f3n de la C\u00e1mara de Diputados de Chile solo por un voto.&nbsp;<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/Gaston_Araya_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Lo que impidi\u00f3 que el proyecto se aprobara fue un desacuerdo respecto de c\u00f3mo crear est\u00e1ndares justos pero igualmente rigurosos tanto para las peque\u00f1as como para las grandes minas. Algunos pol\u00edticos creen que el proyecto de ley ser\u00eda la sentencia de muerte para las minas peque\u00f1as. Adriana Mu\u00f1oz, miembro del Partido por la Democracia (PPD), calific\u00f3 la propuesta legislaci\u00f3n como &#8221; una l\u00e1pida y un verdadero funeral para la peque\u00f1a miner\u00eda y la miner\u00eda artesanal\u201d.<\/p>\n<p style=\"text-align: justify;\">\u201cObviamente para las minas m\u00e1s peque\u00f1as el gasto de dinero en seguridad va a corresponder a una proporci\u00f3n mayor de sus ganancias y, por tanto, va a costar m\u00e1s\u201d, afirma Ernesto Evans, presidente de la Asociaci\u00f3n de Mutuales de Seguridad de Chile.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, son las peque\u00f1as minas las que necesitan la mayor cantidad de atenci\u00f3n y ayuda. Estas tienden a abrir solo cuando los precios del cobre est\u00e1n lo suficientemente altos para hacer que la extracci\u00f3n en cantidades tan peque\u00f1as sea rentable y emplean a una fuerza laboral menos capacitada y de car\u00e1cter temporal, elevando por tanto el riesgo de accidentes. \u201cLas minas m\u00e1s grandes con m\u00e1s de 100 empleados tienen una tasa de accidentes en torno al 0,3%, b\u00e1sicamente nada. Como siempre, el problema son las micro-minas m\u00e1s peque\u00f1as\u201d, dice Evans.<\/p>\n<p style=\"text-align: justify;\">Luego que el proyecto de ley fuera rechazado, el entonces subsecretario de Miner\u00eda Pablo Wagner acept\u00f3 que deber\u00eda modificarse para distinguir entre operaciones mineras de distintos tama\u00f1os, en especial respecto de las multas por incumplimiento.<\/p>\n<p style=\"text-align: justify;\">Pero eso es un dilema sin salida, dado que las minas m\u00e1s peque\u00f1as ir\u00f3nicamente est\u00e1n pidiendo las mismas reformas que el proyecto de ley pondr\u00eda en marcha de haberse aprobado<em>. <\/em>\u201cChile necesita mejorar de manera radical la dotaci\u00f3n de personal y el equipamiento de Sernageomin de modo que pueda supervisar efectivamente a las minas de peque\u00f1a envergadura y entregar capacitaci\u00f3n\u201d, sostiene Araya.<\/p>\n<p style=\"text-align: justify;\">El proyecto de ley propone la creaci\u00f3n de una nueva Superintendencia de Miner\u00eda que se concentrar\u00eda espec\u00edficamente en la inspecci\u00f3n de seguridad. Tal modernizaci\u00f3n ayudar\u00eda a aclarar la confusi\u00f3n que existe actualmente entre los diferentes entes gubernamentales que comparten la labor de realizar revisiones de seguridad.<\/p>\n<p style=\"text-align: justify;\">Separar las labores reguladoras de Sernageomin de sus responsabilidades de monitoreo de la geolog\u00eda del pa\u00eds adem\u00e1s salvaguardar\u00e1 a personal altamente calificado. En el pasado las grandes compa\u00f1\u00edas mineras a menudo se quedaban con sus mejores empleados, capacitados no solo para supervisar la seguridad de las minas, sino que tambi\u00e9n para realizar mapas de recursos minerales y asesorar al gobierno sobre c\u00f3mo adjudicar concesiones mineras, socavando por tanto su marco institucional.<\/p>\n<p style=\"text-align: justify;\">Siempre y cuando el proyecto de ley se apruebe, significar\u00e1 claramente un importante paso en materia de seguridad minera en Chile. Pero despu\u00e9s de que el ahora ex subsecretario Pablo Wagner renunciara a comienzos de octubre por el desastre de una licitaci\u00f3n de litio, el futuro del proyecto de ley es incierto.<\/p>\n<p style=\"text-align: justify;\"><strong>Seguro de Accidentes <\/strong><\/p>\n<p style=\"text-align: justify;\">El segundo proyecto de ley que el Gobierno espera mejorar\u00e1 no solo la seguridad minera, sino que tambi\u00e9n la seguridad en el lugar de trabajo en general, surge bajo el pretexto de una reforma para incrementar la competencia entre las empresas privadas de seguro de accidentes en el lugar de trabajo, o <em>Mutuales, <\/em>la primera reforma de este tipo desde 1968.<\/p>\n<p style=\"text-align: justify;\">Tal como est\u00e1, el Instituto de Seguridad Laboral (ISL) del Ministerio del Trabajo asegura a cerca del 22% de los trabajadores de Chile incluidos la mayor\u00eda de los mineros. El otro 77% (Codelco tiene su propio sistema, equivalente al 1%) est\u00e1 cubierto por una de las tres mutuales privadas<em>.<\/em><\/p>\n<p style=\"text-align: justify;\">Los trabajadores en el sistema estatal reciben una atenci\u00f3n inferior a la de otros empleados, porque son tratados en cl\u00ednicas p\u00fablicas de m\u00e1s bajo est\u00e1ndar en lugar de en hospitales privados. Parad\u00f3jicamente, sus empleadores en realidad pagan primas m\u00e1s altas que las compa\u00f1\u00edas en el sistema privado debido a que est\u00e1n sometidos a mayores riesgos en el lugar de trabajo.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Evans_1.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">El proyecto de ley, que se anunci\u00f3 en el segundo aniversario del accidente de la mina San Jos\u00e9 en agosto, esencialmente eliminar\u00eda la distinci\u00f3n entre obreros sin calificaciones y trabajadores calificados. Eso significa que el Estado podr\u00eda enviar a trabajadores mineros para ser tratados, por primera vez, en hospitales administrados por mutuales, que podr\u00edan participar en licitaciones de contratos de salud p\u00fablica.<\/p>\n<p style=\"text-align: justify;\">Adem\u00e1s, y de manera m\u00e1s controvertida, el proyecto de ley propone un cambio en el esquema de contribuciones. En la actualidad, el costo del seguro se divide entre el empleador y el empleado (basado en un porcentaje del salario del empleado), pero el proyecto de ley a\u00f1adir\u00eda un tercer componente financiado por las empresas como un grupo o industria. Esta prima, ajustada seg\u00fan el riesgo del sector, ser\u00eda de igual monto ya sea que la empresa sea grande o peque\u00f1a y tenga o no excelentes est\u00e1ndares de seguridad en pie.<\/p>\n<p style=\"text-align: justify;\">La idea es que las minas m\u00e1s grandes y m\u00e1s seguras se ver\u00e1n obligadas a arrastrar a aquellas con peores reputaciones a subir a su nivel, con lo que reducir\u00e1n el riesgo para su sector como un todo y, por tanto, el costo de asegurar a su fuerza laboral. Esto deber\u00eda ejercer presi\u00f3n sobre las empresas con un mejor historial de seguridad para que compartan experiencia t\u00e9cnica y recursos con el fin de elevar los est\u00e1ndares de seguridad de la industria.<\/p>\n<p style=\"text-align: justify;\">Esto es exactamente lo que quieren las peque\u00f1as minas, seg\u00fan Araya, y dado que el sector minero es comparativamente de bajo riesgo respecto de los sectores de la manufactura y la construcci\u00f3n, la prima no ser\u00eda alta. Pero no todos piensan que hacer frente al tema de la seguridad minera a trav\u00e9s de una reforma al seguro laboral es una buena idea.<\/p>\n<p style=\"text-align: justify;\">Las mutuales creen que la propuesta es fundamentalmente injusta y que el gobierno necesita encontrar otra forma de reducir los costos. \u201cSi uno trabaja en una compa\u00f1\u00eda, ya sea grande o peque\u00f1a, con un buen registro, pero uno est\u00e1 en un sector riesgoso entonces va a tener que pagar m\u00e1s y esto es un desincentivo. Simplemente no tiene sentido\u201d, dice Evans.&nbsp;<\/p>\n<p style=\"text-align: justify;\">Para Brian Kohler, la legislaci\u00f3n para mejorar la seguridad minera es, en definitiva, una cuesti\u00f3n de simple sentido comercial. \u201cNuestra esperanza es que los empleadores lleguen a entender que ellos tambi\u00e9n ganan con una mejor salud y seguridad en las minas\u201d, afirma.<\/p>\n<p style=\"text-align: justify;\">Mientras Chile impulsa sus actividades mineras, la seguridad en la miner\u00eda solo va a volverse m\u00e1s vital y la necesidad de una legislaci\u00f3n que beneficie a toda la industria va a ser m\u00e1s apremiante. Los accidentes continuar\u00e1n ocurriendo, pero se requieren mejores regulaciones para proteger a los mineros de Chile y considerando su importancia para la econom\u00eda, es lo menos que merecen.&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong>Olivia Crellin trabaja como periodista freelance en Santiago<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">While the world\u2019s attention was fixed on Chile in 2010, waiting to see the miraculous rescue of 33 miners trapped in the bowels of the Atacama Desert for 69 days, President Sebastian Pi\u00f1era promised new laws to improve mining safety in the country. Yet two years on, those promises are starting to look as hollow and unstable as the San Jos\u00e9 mine itself.<\/p>\n<p style=\"text-align: justify;\">It\u2019s true that significant improvements were made following the accident: according to figures from a report published by the Ministry of Mining, fatalities dropped from 45 in 2010 to 29 in 2011. Accidents in Chile&#8217;s mines also fell last year by 40% to their lowest level in 21 years.<\/p>\n<p style=\"text-align: justify;\">Chile has also made notable progress in safety inspections. Before the San Jos\u00e9 incident there were only 18 inspectors for the 5,400 mines nationwide compared with 47 now, and the number of checks has almost tripled in the past two years from 2,586 in 2010 to over 5,000 so far this year.<\/p>\n<p style=\"text-align: justify;\">There are small signs, however, that standards are beginning to slip and accident numbers creep back up. Already this year 15 miners have died which is three more than in the same period of 2011, according to Chile\u2019s National Geology and Mining Service (Sernageomin), the state body tasked with regulating the country\u2019s mining industry. The increase is marginal but perhaps indicative that now the spotlight has moved on, so too has the pressure to improve conditions.<\/p>\n<p style=\"text-align: justify;\">Chile is not the only country that has struggled to improve mining safety standards. New Zealand, another small country that suffered a mining accident in 2010 \u2013 the Pike River Mine disaster in which 29 miners died \u2013 created a High Hazards unit last year to supervise its 30 mines, but it faces similar problems to Chile including underfunded watchdogs and regulatory inertia.<\/p>\n<p style=\"text-align: justify;\"><strong>Failure to reform<\/strong><\/p>\n<p style=\"text-align: justify;\">Despite the initial improvements after the San Jos\u00e9 incident, promises to reform mining legislation are still unfulfilled. An example is Chile\u2019s failure to ratify the International Labor Organization (ILO) convention 176, which President Pi\u00f1era promised to do back in 2010.<\/p>\n<p style=\"text-align: justify;\">This convention establishes workers&#8217; rights to refuse work they consider unsafe, to leave a mine they consider dangerous and to elect their own health and safety representatives. But Chile continues to study it to determine if it would contravene any of its existing laws.<\/p>\n<p style=\"text-align: justify;\">Brian Kohler, Director for Health Safety &amp; Sustainability at IndustriALL Global Union, an international workers\u2019 union that represents 50 million workers in 140 countries, blames big business for the fact that important steps within the legislative process are not being taken.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Brian_Kohler_0.jpg\" alt=\"\" width=\"200\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">\u201cPresident Pi\u00f1era promised the world that Chile would ratify ILO Convention 176,\u201d says Kohler. \u201cThe fact that he has not delivered on that pledge can only be explained by pressure from the business lobby.\u201d<\/p>\n<p style=\"text-align: justify;\">Small-mine managers, not just big business as Kohler alleges, also oppose ratification of the convention. Gaston Araya, operations manager for Laguna Resources, an Australian mining company with small-scale exploration operations in Chile, says ratification would be equivalent to a \u201closs of sovereignty\u201d.<\/p>\n<p style=\"text-align: justify;\">\u201cIn Chile we have laws that already loosely cover what we are looking for in this agreement so personally I am completely against signing a transnational agreement that has more force than the Constitution,\u201d says Araya.<\/p>\n<p style=\"text-align: justify;\">In fact, in the wake of the San Jos\u00e9 incident the government has developed new legislation to further improve mining safety, particularly for small mines where safety conditions are often the most precarious. Currently in Chile there are two bills pending that would achieve just that.<\/p>\n<p style=\"text-align: justify;\"><strong>Problems of scale<\/strong><\/p>\n<p style=\"text-align: justify;\">Described as the most important piece of mining legislation in the last 30 years, the Mining Safety bill announced by President Pi\u00f1era in 2011 proposed a major restructuring of the mining regulatory agencies, notably Sernageomin, and improvements in the training of technical experts.<\/p>\n<p style=\"text-align: justify;\">The bill includes a color-coded system to rate mines according to their safety standards, a system to allow miners to make anonymous complaints about the safety of their workplace and an increase in fines levied on those companies that do not comply with regulations.<\/p>\n<p style=\"text-align: justify;\">President Pi\u00f1era promised that the law would lead to a new \u201cculture of safety in mining&#8221;. But in September the bill failed by just one vote to obtain approval in Chile\u2019s Chamber of Deputies.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/Gaston_Araya_1.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">It was disagreement over how to create fair but equally rigorous standards for both small and big mines that prevented the bill from passing. Some politicians believe that the bill would be the death knell for small mines. Adriana Mu\u00f1oz, a member of the Democratic Party (PPD), called the proposed legislation &#8220;a gravestone and a true funeral for small-scale and artisanal mining.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cObviously for smaller mines money spent on safety is going to take a larger proportion of their profits and so cost them more,\u201d says Ernesto Evans, president of Chile\u2019s association of mutual insurance companies.<\/p>\n<p style=\"text-align: justify;\">It is the smaller mines, however, that are in need of the most attention and help. They tend to open only when copper prices are high enough to make mining in such small quantities profitable and employ a lesser-trained, temporary workforce, thus raising the risk of accidents. \u201cThe bigger mines with more than 100 employees have an accident rate of around 0.3%, basically nothing. As ever, the issue is the smaller micro-mines,\u201d Evans says.<\/p>\n<p style=\"text-align: justify;\">After the bill was rejected, the then-Undersecretary of Mining Pablo Wagner agreed that the bill should be modified to distinguish between mining operations of different sizes, especially in regards to fines for non-compliance.<\/p>\n<p style=\"text-align: justify;\">But it is a catch 22 as smaller mines are ironically calling out for the very reforms that the bill would enact if passed. \u201cChile needs to radically improve the staffing and equipping of Sernageomin so that it can effectively supervise small-scale mines and provide training,\u201d Araya said.<\/p>\n<p style=\"text-align: justify;\">The bill proposes the creation of a new Superintendency of Mining that would focus specifically on safety inspection. Such streamlining would help to clear up the confusion that currently exists between the different government bodies that share the duty of performing safety checks.<\/p>\n<p style=\"text-align: justify;\">Separating Sernageomin\u2019s regulatory duties from its responsibilities for monitoring the country\u2019s geology will also safeguard highly trained staff. In the past big mining companies often poached its best employees, trained not only for supervising mine safety but also in mapping mineral resources and advising the government on how to award mining concessions, thus undermining the institutional framework.<\/p>\n<p style=\"text-align: justify;\">If and when the bill is passed, it would clearly mean an important step in mining safety in Chile. But after the now former Undersecretary Pablo Wagner resigned in early October over the lithium auction debacle the future of the bill is uncertain.<\/p>\n<p style=\"text-align: justify;\"><strong>Accident insurance <\/strong><\/p>\n<p style=\"text-align: justify;\">The second bill that the government is hoping will improve not just mining safety but workplace safety in general comes in the guise of a reform to increase competition among Chile\u2019s private workplace accident insurance companies, or <em>Mutuales, <\/em>the first such reform since 1968.<\/p>\n<p style=\"text-align: justify;\">As it stands, the Labor Ministry\u2019s Workplace Safety Institute (ISL) insures around 22% of workers in Chile including most miners. The other 77% (Codelco has its own system, equivalent to 1%) are covered by one of three private mutual companies<em>.<\/em><\/p>\n<p style=\"text-align: justify;\">Workers in the state system receive inferior care to other employees because they are treated in lower-standard public health clinics rather than private hospitals. Paradoxically, their employers actually pay higher premiums than companies in the private system because they undergo greater risks in the workplace.<\/p>\n<p style=\"text-align: justify;\">The insurance bill, which was unveiled on the second anniversary of the San Jos\u00e9 accident in August, would essentially eliminate the distinction between unskilled laborers and skilled workers. This means the state could send mining workers to be treated, for the first time, at hospitals managed by mutual companies, which could bid on tenders for public health contracts.<\/p>\n<p style=\"text-align: justify;\">In addition, and more controversially, the bill proposes a change in the contributions scheme. Currently the cost of insurance is split between the employer and employee (based on a percentage of the employee\u2019s salary), but the bill would add a third component financed by companies as a group or industry. This premium, adjusted according to the sector\u2019s risk, would be the same amount whether the company is big or small and has excellent safety standards in place or not.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Evans_2_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">The idea is that bigger, safer mines will be forced to drag those with worse reputations up to their level, lowering the risk for their sector as a whole and thus the cost of insuring their workforce. This should pressure companies with a better safety track record into sharing expertise and resources in order to raise the safety standards of the industry.<\/p>\n<p style=\"text-align: justify;\">This is exactly what the small mines want, according to Araya, and because the mining sector is comparatively low risk compared to the manufacturing and construction sectors, the premium would not be high. But not everyone thinks tackling mining safety through workplace insurance reform is a good idea.<\/p>\n<p style=\"text-align: justify;\">Mutual companies believe that the proposal is fundamentally unjust and that the government needs to find another way of lowering costs. \u201cIf you work in a company, whether it is big or small, with a good record but you are in a risky sector then you are going to have to pay more and this is a disincentive. It just doesn\u2019t make sense,\u201d says Evans.&nbsp;<\/p>\n<p style=\"text-align: justify;\">For Brian Kohler, legislation to improve mining safety is, ultimately, a matter of simple business sense. \u201cIt is our hope that employers will come to understand that they also will gain from improved health and safety in mines,\u201d he says.<\/p>\n<p style=\"text-align: justify;\">With Chile pushing its mining activities forward, mining safety is only going to become more vital and the need for legislation that benefits the whole industry even more pressing.
