{"id":4898,"date":"2012-09-26T18:05:25","date_gmt":"2012-09-26T21:05:25","guid":{"rendered":""},"modified":"2015-04-21T11:20:03","modified_gmt":"2015-04-21T14:20:03","slug":"administrando-los-recursos-hidricos-de-chile","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/administrando-los-recursos-hidricos-de-chile\/","title":{"rendered":"<!--:es-->Administrando los Recursos H\u00eddricos de Chile<!--:--><!--:en-->Managing Chile\u2019s Water Resources<!--:-->"},"content":{"rendered":"<p><!--:es--><\/p>\n<p style=\"text-align: justify;\">En virtud de la Constituci\u00f3n de Chile de 1981, los derechos de agua de la naci\u00f3n est\u00e1n protegidos como propiedad privada. Para usar agua para cualquier prop\u00f3sito industrial se debe obtener el derecho a un cierto volumen por segundo ya sea del Estado o, si el derecho ya fue asignado, de un tercero. Pero en la actual situaci\u00f3n de escasez de agua que vive Chile, los derechos en algunas partes del pa\u00eds son dif\u00edciles de conseguir.<\/p>\n<p style=\"text-align: justify;\">Chile no es el \u00fanico pa\u00eds con un sistema de derechos transferibles de agua. Los mercados de agua est\u00e1n presentes tanto en Australia como en California, pero en ninguna parte el sector privado desempe\u00f1a un rol tan importante y el Estado est\u00e1 tan circunscrito como en Chile, dice Rodrigo Weisner, abogado y ex titular de la Direcci\u00f3n General de Aguas de Chile (DGA).\u00a0<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" alt=\"\" src=\"\/sites\/default\/files\/RODRIGO_WEISNER_1_0.jpg\" width=\"150\" height=\"200\" \/><strong><\/strong><\/p>\n<p style=\"text-align: justify;\">El sistema se origin\u00f3 con el C\u00f3digo de Aguas del pa\u00eds en 1981, parte de una serie de reformas de libre mercado implementadas bajo el r\u00e9gimen militar.<\/p>\n<p style=\"text-align: justify;\">Los derechos de agua han existido en Chile desde la Independencia del pa\u00eds. Pero el C\u00f3digo de Aguas rompi\u00f3 de manera cr\u00edtica el v\u00ednculo entre derechos de agua y propiedad introducido por la Reforma Agraria de 1967.<\/p>\n<p style=\"text-align: justify;\">Entonces cualquiera pod\u00eda postular a un derecho y, si el agua estaba disponible, esperar que el Estado lo otorgara sin dar ninguna consideraci\u00f3n a su uso. Si dos o m\u00e1s personas solicitaban el mismo derecho, se realizaba una licitaci\u00f3n y el agua se asignaba al mayor postor.<\/p>\n<p style=\"text-align: justify;\">Para los defensores del sistema, esta seguridad de tenencia y libertad con que los derechos se pod\u00edan comprar y vender desempe\u00f1\u00f3 un papel clave en la enorme expansi\u00f3n de la econom\u00eda durante los \u00faltimos 30 a\u00f1os, en especial en sectores dependientes del agua como la agricultura, la miner\u00eda, la industria forestal y la acuicultura.<\/p>\n<p style=\"text-align: justify;\">Los inversionistas pod\u00edan adquirir r\u00e1pidamente los derechos que necesitaran para sustentar sus proyectos, con la tranquilidad mental de que no se pod\u00edan revocar de manera arbitraria en una fecha futura.<\/p>\n<p style=\"text-align: justify;\"><strong>Especulaci\u00f3n de Agua<\/strong><\/p>\n<p style=\"text-align: justify;\">Sin embargo, con la entrega gratuita de estos recursos, la nueva disposici\u00f3n estaba lista para la especulaci\u00f3n. En algunas cuencas, las solicitudes de derechos de agua superaban la cantidad de agua disponible en una relaci\u00f3n de hasta 5 a 1. Inversionistas con prometedores proyectos con frecuencia encontraban a un tercero ubicado sobre los cruciales derechos sin ning\u00fan plan de usarlos m\u00e1s que exigir condiciones extremadamente duras a cambio.<\/p>\n<p style=\"text-align: justify;\">Algunos pudieron costearlo pago: en el 2000, la enorme mina de cobre Escondida acord\u00f3 pagar US$139 millones a una mina vecina por derechos de agua, avaluando el agua en m\u00e1s de US$214.000 por litro por segundo. Pero en incontables otros casos, los proyectos tuvieron que abandonarse.<\/p>\n<p style=\"text-align: justify;\">Particularmente culpable fue la industria el\u00e9ctrica. Endesa Chile, la mayor generadora del pa\u00eds por capacidad instalada, acumul\u00f3 80% de los derechos no consuntivos del pa\u00eds (el tipo requerido para construir una central hidroel\u00e9ctrica), lo que limit\u00f3 el acceso para otros que quer\u00edan invertir en hidroelectricidad.<\/p>\n<p style=\"text-align: justify;\">No obstante, incluso las compa\u00f1\u00edas m\u00e1s grandes vieron proyectos interrumpidos debido a que derechos clave estaban en poder de un tercero intransigente.<\/p>\n<p style=\"text-align: justify;\">\u201cEl sistema de 1981 convirti\u00f3 a todos en victimas; los \u00fanicos ganadores fueron los especuladores\u201d, sostiene Weisner.<\/p>\n<p style=\"text-align: justify;\">El problema se abord\u00f3 finalmente con una reforma en el 2005 al C\u00f3digo de Aguas, la que introdujo cambios para los derechos no utilizados. Siete a\u00f1os despu\u00e9s, su impacto ha sido limitado. Pero eso podr\u00eda cambiar a medida que los cobros, introducidos en niveles cautamente bajos, comienzan a subir de manera pronunciada, a menudo duplic\u00e1ndose de un a\u00f1o al siguiente. Este a\u00f1o comenzar\u00e1n a aplicarse en la Regi\u00f3n de Ays\u00e9n, la que alberga m\u00e1s de un tercio de las reservas de agua dulce del pa\u00eds.<\/p>\n<p style=\"text-align: justify;\">A medida que el costo de mantener derechos no utilizados se dispara, m\u00e1s se pondr\u00e1n en venta, se usar\u00e1n o ceder\u00e1n, lo que inyectar\u00e1 m\u00e1s liquidez a los mercados de agua, prev\u00e9 Weisner. Pero en algunas cuencas hidrogr\u00e1ficas del pa\u00eds los agricultores ya est\u00e1n comenzando a negociar, o prestar, derechos de agua.<\/p>\n<p style=\"text-align: justify;\"><strong>Mercados de Agricultores<\/strong><\/p>\n<p style=\"text-align: justify;\">Los agricultores del valle del Limar\u00ed, en la norte\u00f1a Regi\u00f3n de Coquimbo, con frecuencia transfieren derechos a los vecinos dependiendo de las condiciones del mercado y el clima. En a\u00f1os secos, la demanda sube, lo que alienta a quienes cultivan verduras, por ejemplo, a arrendar derechos a un fruticultor vecino cuyas vides y vergeles no sobrevivir\u00edan un a\u00f1o sin agua.<\/p>\n<p style=\"text-align: justify;\">Clave para el \u00e9xito de este sistema es la informaci\u00f3n y la infraestructura, se\u00f1ala Guillermo Donoso, profesor de econom\u00eda agraria de la Pontificia Universidad Cat\u00f3lica de Chile en Santiago.\u00a0<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" alt=\"\" src=\"\/sites\/default\/files\/Guillermo_Donoso_1_0.jpg\" width=\"150\" height=\"200\" \/><\/p>\n<p style=\"text-align: justify;\">El valle tiene una comunidad de usuarios de agua bien operada de modo que todos saben cu\u00e1ndo y d\u00f3nde hay derechos disponibles, afirma. En segundo lugar, cuenta con una red de embalses y canales interconectados equipados con compuertas de modo que el agua se puede desviar alrededor de la cuenca a un costo m\u00ednimo.<\/p>\n<p style=\"text-align: justify;\">No obstante, tales condiciones no existen en todas partes.<\/p>\n<p style=\"text-align: justify;\">Muchas \u00e1reas, en especial donde el agua se extrae de acu\u00edferos subterr\u00e1neos, carecen de una comunidad de usuarios de agua. Sin dicha comunidad, los derechos a menudo se ignoran y los usuarios toman todo lo que necesitan sin consideraci\u00f3n alguna, malgastando por tanto recursos preciosos.<\/p>\n<p style=\"text-align: justify;\">El Gobierno est\u00e1 respondiendo a ello mediante la organizaci\u00f3n de comunidades en \u00e1reas que carecen de ellas o el fortalecimiento de las asociaciones existentes. Adem\u00e1s propuso una legislaci\u00f3n que fortalece las facultades de la DGA para combatir el robo de agua y que eleva las multas m\u00e1ximas para los infractores reincidentes de 400.000 pesos (cerca de US$830) a 200 millones de pesos.<\/p>\n<p style=\"text-align: justify;\"><strong>Midiendo el Flujo<\/strong><\/p>\n<p style=\"text-align: justify;\">La falta de informaci\u00f3n es otro problema clave. Sin claridad sobre qui\u00e9n pose qu\u00e9, es dif\u00edcil para los compradores reunirse y acordar t\u00e9rminos. Las transacciones a menudo se negocian en t\u00e9rminos muy desiguales y no es inusual que haya enormes disparidades en el precio, lo que obstaculiza la operaci\u00f3n sin dificultades del mercado, indica Donoso.<\/p>\n<p style=\"text-align: justify;\">El C\u00f3digo de Aguas estableci\u00f3 un registro central de derechos de agua, pero eso solo aplica a derechos otorgados o modificados desde su creaci\u00f3n. Los derechos preexistentes solo est\u00e1n registrados, si es que, en las m\u00e1s de 180 oficinas de registro de tierras del pa\u00eds.<\/p>\n<p style=\"text-align: justify;\">\u201cAveriguar qui\u00e9n posee qu\u00e9 es como bucear en un pantano\u201d, afirma Guillermo Pickering, presidente ejecutivo de la Asociaci\u00f3n Nacional de Empresas de Servicios Sanitarios de Chile (ANDESS).\u00a0<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" alt=\"\" src=\"\/sites\/default\/files\/PICKERING_1_0.jpg\" width=\"150\" height=\"200\" \/><\/p>\n<p style=\"text-align: justify;\">El Gobierno espera mejorar la situaci\u00f3n con la creaci\u00f3n de un Sistema Nacional de Informaci\u00f3n del Agua, una base de datos online gratuita que cubre no solo los derechos sino que tambi\u00e9n las postulaciones a nuevos derechos y datos en tiempo real sobre lluvias, niveles de los embalses e incluso glaciares. El trabajo ya ha concluido en la primera etapa que comprende los derechos no consuntivos y ahora avanza con los derechos consuntivos que son mucho m\u00e1s numerosos, comenta Mat\u00edas Desmadryl, titular de la DGA.<\/p>\n<p style=\"text-align: justify;\">Con todos estos datos disponibles en tel\u00e9fonos m\u00f3viles y computadores port\u00e1tiles, el mercado deber\u00eda volverse mucho m\u00e1s fluido, afirma. \u201cSabemos que donde hay buena informaci\u00f3n, hay muchas transacciones\u201d, destaca Desmadryl.<\/p>\n<p style=\"text-align: justify;\">El Gobierno adem\u00e1s envi\u00f3 un proyecto de ley al Congreso, el que reduce la burocracia involucrada en la modificaci\u00f3n y transferencia de derechos, lo que puede ser \u201cprohibitivamente caro\u201d, sostiene. Una vez que se apruebe la legislaci\u00f3n, los derechos en la misma cuenca podr\u00edan agruparse en lugar de tratarse de manera individual, lo que agilizar\u00eda enormemente el sistema.<\/p>\n<p style=\"text-align: justify;\"><strong>Agua para el Crecimiento<\/strong><\/p>\n<p style=\"text-align: justify;\">Pero un sistema de mercado solo funciona si hay suficientes derechos en circulaci\u00f3n y este no es el caso en gran parte de Chile. La r\u00e1pida expansi\u00f3n econ\u00f3mica de las \u00faltimas tres d\u00e9cadas ha visto dispararse el consumo de agua en algunos valles.<\/p>\n<p style=\"text-align: justify;\">Un par de a\u00f1os de lluvias bajo el promedio dejaron grandes \u00e1reas de la zona centro y sur de Chile en crisis, con frutos marchitos y muerte de ganado. Es probable que la situaci\u00f3n empeore a medida que la demanda contin\u00faa subiendo y que el cambio clim\u00e1tico global vuelve a Chile m\u00e1s caluroso y seco. El aumento de las temperaturas ya est\u00e1 reduciendo la cantidad de nieve y hielo que acumula la cordillera de los Andes durante el invierno y la primavera.<\/p>\n<p style=\"text-align: justify;\">En muchos lugares, el impacto ha sido mitigado por la sobreasignaci\u00f3n de derechos de agua.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" alt=\"\" src=\"\/sites\/default\/files\/DESMADRYL_1_0.jpg\" width=\"150\" height=\"200\" \/><\/p>\n<p style=\"text-align: justify;\">Ello refleja la ignorancia de la autoridad sobre cu\u00e1nta agua hab\u00eda disponible o suposiciones excesivamente generosas sobre c\u00f3mo se emplea el agua, explica Donoso.<\/p>\n<p style=\"text-align: justify;\">En el pasado, si un agricultor solicitaba derechos para 100 litros por segundo, las autoridades supon\u00edan que esta agua no se usar\u00eda todo el tiempo durante el a\u00f1o o las 24 horas del d\u00eda, y calculaban el impacto en apenas 20 litros por segundo<\/p>\n<p style=\"text-align: justify;\">Pero si el agricultor luego compraba m\u00e1s tierras o invert\u00eda en t\u00e9cnicas de riego m\u00e1s eficientes, su utilizaci\u00f3n de esos mismos derechos pod\u00eda aumentar. Si decid\u00eda vender los derechos a una empresa sanitaria o a una compa\u00f1\u00eda minera, entonces la utilizaci\u00f3n de este derecho pod\u00eda subir a cerca del 100%. Multiplique eso cientos de veces en la misma cuenca y los efectos pueden ser catastr\u00f3ficos.<\/p>\n<p style=\"text-align: justify;\">En el valle de Copiap\u00f3, acu\u00edferos sobreexplotados se est\u00e1n secando presionados por una expansi\u00f3n de la fruticultura y un auge minero en la regi\u00f3n.<\/p>\n<p style=\"text-align: justify;\">En el 2010, el nuevo Gobierno adopt\u00f3 criterios mucho m\u00e1s conservadores para evaluar solicitudes de nuevos derechos en \u00e1reas donde el agua es escasa, dice Desmadryl. Pero eso no lidia con d\u00e9cadas de asignaciones demasiado generosas.<\/p>\n<p style=\"text-align: justify;\"><strong>Precipitarse a Impulsar la Oferta<\/strong><\/p>\n<p style=\"text-align: justify;\">Seg\u00fan el actual Gobierno, la respuesta radica en expandir la oferta. El trabajo ya comenz\u00f3 en cuatro nuevos embalses, mientras hay estudios en curso en otros diez, los que prometen aumentar la capacidad de almacenamiento a nivel nacional en un 30% a 5.500 millones de metros c\u00fabicos dentro de 15 a\u00f1os.<\/p>\n<p style=\"text-align: justify;\">El Gobierno tambi\u00e9n est\u00e1 proporcionando recursos para ayudar a los agricultores a explorar y recurrir a acu\u00edferos y humedales que antes no se hab\u00edan tocado. Adem\u00e1s est\u00e1 fomentando otras soluciones, m\u00e1s radicales.<\/p>\n<p style=\"text-align: justify;\">Concentrada en el \u00e1rido norte del pa\u00eds, la industria minera apunta principalmente a plantas de desalinizaci\u00f3n para suministrar el agua que necesita en sus procesos. Planes para siete plantas se han presentado solo en la Regi\u00f3n de Atacama, destaca Desmadryl. El Gobierno podr\u00eda desempe\u00f1ar un rol aqu\u00ed al alentar la consolidaci\u00f3n dadas las econom\u00edas de escala, la enorme demanda el\u00e9ctrica y el impacto ambiental involucrado, sostiene.<\/p>\n<p style=\"text-align: justify;\">El Gobierno tambi\u00e9n est\u00e1 colaborando con la constructora francesa Vinci para estudiar la posibilidad de construir un ducto submarino destinado a llevar agua dulce de los r\u00edos de la zona centro-sur del pa\u00eds al norte.<\/p>\n<p style=\"text-align: justify;\">Pero Donoso critica que se ponga el \u00e9nfasis en impulsar la oferta en lugar de en controlar la demanda. El Gobierno est\u00e1 gastando m\u00e1s de US$700 millones en construir nuevos embalses, pero cantidades m\u00ednimas para fomentar el uso eficiente del agua, en especial en la agricultura, sostiene.<\/p>\n<p style=\"text-align: justify;\">Pese a ello, el Gobierno cree que Chile est\u00e1 en la senda correcta. Un informe del Banco Mundial en 2011 encargado por la DGA sobre la gesti\u00f3n de los recursos h\u00eddricos del pa\u00eds inst\u00f3 a tomar medidas para incrementar el mercado de derechos de agua, mejorar la calidad de esta y la protecci\u00f3n ambiental, pero elogi\u00f3 al pa\u00eds por contar con las instituciones para lidiar con los desaf\u00edos que vendr\u00e1n.<\/p>\n<p style=\"text-align: justify;\">Hasta ahora ajustes marginales han mantenido corriendo el agua y podr\u00eda continuar as\u00ed por muchos a\u00f1os m\u00e1s. Pero en alg\u00fan momento, la escasez podr\u00eda volverse grave y el actual sistema de derechos podr\u00eda dejar de funcionar.<\/p>\n<p style=\"text-align: justify;\">\u201cEl mercado no es la soluci\u00f3n para resolver la escasez\u201d, se\u00f1ala Wiesner.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00bfNacionalizaci\u00f3n del Agua?<\/strong><\/p>\n<p style=\"text-align: justify;\">Algunos quisieran romper en pedazos las actuales regulaciones y comenzar de nuevo. Hace tres a\u00f1os, una alianza de ambientalistas y legisladores present\u00f3 un proyecto de ley al Congreso prometiendo \u201cnacionalizar\u201d el agua del pa\u00eds, el que extend\u00eda enormemente la facultad del Estado para asignar y quitar derechos, determinar el uso y acabar con la especulaci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">Comprensiblemente, eso preocup\u00f3 a muchos grupos. La aprehensi\u00f3n es que quienes respaldan la propuesta tienen segundas intenciones, como limitar la expansi\u00f3n de la hidroelectricidad o ejercer un mayor control de industrias clave al restringir el acceso al agua.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, los m\u00e1s afectados no ser\u00edan las grandes multinacionales, contraviene Desmadryl de la DGA, sino que miles de peque\u00f1os agricultores que poseen dos tercios de los derechos de agua del pa\u00eds y enfrentar\u00edan un nuevo nivel de burocracia.<\/p>\n<p style=\"text-align: justify;\">\u201cEl tema es hasta qu\u00e9 punto el Estado deber\u00eda interferir en decisiones que pertenecen debidamente al sector privado\u201d, se\u00f1ala Desmadryl.<\/p>\n<p style=\"text-align: justify;\">Otros tienen sugerencias m\u00e1s sutiles. El Gobierno anterior propuso reformar la Constituci\u00f3n para hacer que el agua fuera un bien p\u00fablico. Despu\u00e9s de todo, se\u00f1ala Weisner, titular de la DGA en ese entonces, la Constituci\u00f3n ya protege derechos como el acceso a la informaci\u00f3n y la propiedad, ninguna tan vital para la vida como el agua.<\/p>\n<p style=\"text-align: justify;\">Sus opositores -incluido el actual Gobierno, que archiv\u00f3 el proyecto de ley- descartaron la propuesta por ser innecesaria. El C\u00f3digo de Aguas ya clasifica al agua como un \u201cbien p\u00fablico\u201d y otorga al Estado muchas de las facultades comprendidas en la reforma, dice Desmadryl.<\/p>\n<p style=\"text-align: justify;\">No obstante, tales facultades raramente se ejercen, si es que se hace, contrapone Weisner. Hacer expl\u00edcito el estatus p\u00fablico del agua en la Constituci\u00f3n obligar\u00eda a las autoridades a considerar otros aspectos del recurso m\u00e1s all\u00e1 del puramente econ\u00f3mico, asevera.<\/p>\n<p style=\"text-align: justify;\">El sistema de derechos de agua de Chile ha servido bien a las empresas, pero a menudo en detrimento del medio ambiente o de otras actividades humanas que dependen del agua, tales como la pesca o el turismo. Si bien las soluciones propuestas hasta ahora pueden no satisfacer a todos, sugieren que se necesita un debate m\u00e1s profundo, afirma Pickering de ANDESS.<\/p>\n<p style=\"text-align: justify;\">\u201cGracias al cambio clim\u00e1tico, la sequ\u00eda y la presi\u00f3n sobre los recursos, el tema se ha vuelto mucho m\u00e1s importante en t\u00e9rminos pol\u00edticos\u201d, destaca.<\/p>\n<p style=\"text-align: justify;\">El a\u00f1o pasado, las sanitarias locales se reunieron con ambientalistas, acad\u00e9micos, expertos y grupos sociales para debatir los problemas que rodean al agua en Chile y elaboraron el informe \u201cAgua y Medio Ambiente\u201d, que delinea los principales problemas, una amplia gama de posibles soluciones y las discrepancias que surgieron entre los participantes.<\/p>\n<p style=\"text-align: justify;\">El di\u00e1logo se ampli\u00f3 este a\u00f1o para incluir a entidades de gobierno, centros de estudios pol\u00edticos y representantes de las industrias de miner\u00eda y energ\u00eda.<\/p>\n<p style=\"text-align: justify;\">En el sector privado, la Confederaci\u00f3n del Producci\u00f3n y el Comercio (CPC) de Chile recientemente cre\u00f3 una comisi\u00f3n para mejorar la eficiencia en el uso del agua en Chile. La comisi\u00f3n es presidida por Pedro Crespo, presidente de la Sociedad Nacional de Agricultura (SNA), cuyos miembros corresponden a cerca del 80% del agua consumida en Chile.<\/p>\n<p style=\"text-align: justify;\">Y, en agosto, la C\u00e1mara baja de Chile aprob\u00f3 la creaci\u00f3n de una comisi\u00f3n permanente sobre recursos h\u00eddricos, desertificaci\u00f3n y sequ\u00eda que podr\u00eda encabezar nuevas reformas al C\u00f3digo de Aguas y la Constituci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">Parece estar creciendo el impulso para que el pa\u00eds d\u00e9 una mirada larga y detallada al futuro de sus recursos de agua. Dado lo delicado de los temas involucrados, es probable que un cambio importante demore en llegar; pasaron 13 a\u00f1os para que el Congreso aprobara la introducci\u00f3n de cambios a los derechos no utilizados. Si tarda tanto esta vez, para entonces la necesidad de medidas podr\u00eda ser mucho m\u00e1s fuerte.<\/p>\n<p style=\"text-align: justify;\"><strong>Tom Azzopardi trabaja como periodista freelance basada en Santiago<\/strong><\/p>\n<p><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">Under the Chilean Constitution of 1981, water rights in Chile are protected as private property. To use water for any industrial purpose you must obtain the right to a certain volume per second either from the state or, if the right has already been awarded, from a third party. But in Chile\u2019s current situation of water scarcity, rights in some parts of the country are hard to come by.<\/p>\n<p style=\"text-align: justify;\">Chile is not the only country with a system of transferable water rights. Water markets are a feature in both Australia and California, but nowhere does the private sector play so great a role and the state so circumscribed as in Chile, says Rodrigo Weisner, a lawyer and former head of the country\u2019s National Water Board (DGA).\u00a0<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/RODRIGO_WEISNER_2_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><strong><\/strong><\/p>\n<p style=\"text-align: justify;\">The system originated with the country\u2019s Water Code of 1981, part of a wave of free-market reforms implemented under the military regime.<\/p>\n<p style=\"text-align: justify;\">Water rights have existed in Chile since the country\u2019s independence. But the Water Code critically broke the link between water rights and land ownership introduced by the Agrarian Reform of 1967.<\/p>\n<p style=\"text-align: justify;\">Now anyone could apply for a right and, if the water was available, expect the state to grant it with no consideration given to its use. If two or more individuals requested the same right, a tender was held with the water going to the highest bidder.<\/p>\n<p style=\"text-align: justify;\">To the defenders of the system, this security of tenure and freedom with which rights could be bought and sold played a key role in the huge expansion of the economy over the last 30 years, especially in water-dependent sectors such as agriculture, mining, forestry and aquaculture.<\/p>\n<p style=\"text-align: justify;\">Investors could quickly acquire the rights they needed to underpin their projects, with the peace of mind that they could not be arbitrarily withdrawn at a future date.<\/p>\n<p style=\"text-align: justify;\"><strong>Water speculation<\/strong><\/p>\n<p style=\"text-align: justify;\">But with resources handed out for free, the new arrangement was ripe for speculation. In some basins, the requests for water rights exceeded the water available by as much as fifty-to-one. Investors with promising projects frequently found a third party sitting on the crucial rights with no plans to use them but demanding punishing terms in exchange.<\/p>\n<p style=\"text-align: justify;\">Some could afford to pay: in 2000, the giant Escondida copper mine agreed to pay US$139 million to a neighboring mine for water rights, valuing the water at over US$214,000 per liter per second. But in countless other cases, projects had to be abandoned.<\/p>\n<p style=\"text-align: justify;\">Particularly guilty was the power industry. Endesa Chile, the country\u2019s largest generator by installed capacity, accumulated 80% of the country\u2019s non-consumptive rights (the kind required to build a hydroelectric plant), limiting access for others wanting to invest in hydropower.<\/p>\n<p style=\"text-align: justify;\">But even the biggest companies have seen projects waylaid because critical rights were held by an intransigent third party.<\/p>\n<p style=\"text-align: justify;\">\u201cThe system of 1981 made a victim of everyone; the only winners were the speculators,\u201d says Weisner.<\/p>\n<p style=\"text-align: justify;\">The problem was eventually tackled with a 2005 reform of the Water Code which introduced charges for unused rights. Seven years on, its impact has been limited. But that could change as the charges, introduced at cautiously low levels, begin to rise sharply, often doubling from one year to the next. This year they will begin to apply in the Ays\u00e9n Region, home to more than a third of the country\u2019s freshwater reserves.<\/p>\n<p style=\"text-align: justify;\">As the cost of holding onto unused rights skyrockets, more will be sold, used or given up, injecting more liquidity into water markets, predicts Weisner. But in some river basins of the country farmers are already trading, or borrowing, water rights.<\/p>\n<p style=\"text-align: justify;\"><strong>Farmers\u2019 markets<\/strong><\/p>\n<p style=\"text-align: justify;\">Farmers in the Limar\u00ed Valley, in the Coquimbo Region, frequently transfer rights with neighbors depending on market and climatic conditions. In dry years, demand rises, encouraging vegetable growers, for example, to rent rights to a neighboring fruit farmer whose vines and orchards would not survive a year without water.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/Guillermo_Donoso_2_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Key to this system\u2019s success is information and infrastructure, says Guillermo Donoso, professor of agricultural economics at the Catholic University in Santiago.<\/p>\n<p style=\"text-align: justify;\">The valley has a well-run community of water users so that everyone knows when and where rights are available, he says. Secondly, it boasts a network of interconnecting canals and reservoirs fitted with sluice gates so water can be diverted around the basin at minimal cost.<\/p>\n<p style=\"text-align: justify;\">But such conditions do not exist everywhere.<\/p>\n<p style=\"text-align: justify;\">Many areas, especially where water is tapped from underground aquifers, lack a community for water users. Without such a community, rights are often ignored with users taking all they need regardless, thereby squandering precious resources.<\/p>\n<p style=\"text-align: justify;\">The government is responding by organizing communities in areas which lack them or strengthening existing associations. It has also proposed legislation strengthening the powers of the DGA to combat water theft and lifting the maximum fine for reoffenders from 400,000 pesos (about US$830) to 200 million pesos.<\/p>\n<p style=\"text-align: justify;\"><strong>Measuring the flow<\/strong><\/p>\n<p style=\"text-align: justify;\">The lack of information is another critical problem. Without clarity about who owns what, it is hard for buyers to meet and agree terms. Transactions are often negotiated on very unequal terms and huge disparities in price are not unusual, hindering the smooth running of the market, says Donoso.<\/p>\n<p style=\"text-align: justify;\">The Water Code set up a central register of water rights, but that only applies to rights granted or modified since its creation. Pre-existing rights are only recorded, if at all, at the country\u2019s more than 180 land registrars.<\/p>\n<p style=\"text-align: justify;\">\u201cFinding out who owns what is like diving into swamp,\u201d says Guillermo Pickering, president of the Chilean association of water utilities ANDESS.\u00a0<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/PICKERING_2_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">The government hopes to improve the situation with the creation of a National Water Information System, a free online database covering not just rights but also applications for new rights and real-time data on rainfall, reservoir levels and even glaciers. Work has now concluded on the first stage covering non-consumptive rights and is now moving onto the much more numerous consumptive rights, says Mat\u00edas Desmadryl, head of the DGA.<\/p>\n<p style=\"text-align: justify;\">With all this data available on mobile phones and laptops, the market should become much more fluid, he says. \u201cWe know that where there is good information, there are a lot of transactions,\u201d Desmadryl points out.<\/p>\n<p style=\"text-align: justify;\">The government has also sent a bill to Congress, reducing the red tape involved in modifying and transferring rights, which can be \u201cprohibitively expensive,\u201d he says. Once the law is passed, rights in the same basin could be bundled together rather than being treated individually, massively streamlining the system.\u00a0<\/p>\n<p style=\"text-align: justify;\"><strong>Water for growth<\/strong><\/p>\n<p style=\"text-align: justify;\">But a market system only works if there are enough rights to go around and this is not the case in much of Chile. Rapid economic expansion over the last three decades has seen water consumption skyrocket in some valleys.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/DESMADRYL_2_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">A couple of years of below average rainfall have left large areas of central and northern Chile in crisis, with fruit withered and livestock dying. The situation is likely to worsen as demand continues to rise and global climate change makes Chile hotter and drier. Rising temperatures are already reducing the amount of snow and ice that accumulates in the Andes Mountains during the winter and spring.<\/p>\n<p style=\"text-align: justify;\">In many places, the impact has been extenuated by the over-allocation of water rights.<\/p>\n<p style=\"text-align: justify;\">That reflects the authority\u2019s ignorance about how much water was available or excessively generous assumption about how water would be used, explains Donoso.<\/p>\n<p style=\"text-align: justify;\">In the past, if a farmer requested rights for 100 liters a second, the authorities would assume that this water would not be used at all times of the year or round the clock, and calculate the impact at just 20 liters a second.<\/p>\n<p style=\"text-align: justify;\">But if the farmer then bought more land or invested in more efficient irrigation techniques, their utilization of those same rights could increase. If he decided to sell the rights to a water utility or mining company, then utilization of this right could rise to close to 100%. Multiply that hundreds of times through the same basin and the effects can be catastrophic.<\/p>\n<p style=\"text-align: justify;\">In the Copiap\u00f3 Valley, overexploited aquifers are running dry under pressure from an expansion of fruit-farming and a boom in mining in the region.<\/p>\n<p style=\"text-align: justify;\">In 2010, the new government adopted much more conservative criteria for evaluating requests for new rights in areas where water is scarce, says Desmadryl. But that does not deal with decades of overgenerous allocations.<\/p>\n<p style=\"text-align: justify;\"><strong>Rushing to boost supply<\/strong><\/p>\n<p style=\"text-align: justify;\">According to the current government, the answer lies with expanding supply. Work has already begun on four new reservoirs while studies are underway on another ten, which promise to increase storage capacity nationally by 30% to 5.5 billion cubic meters within 15 years.<\/p>\n<p style=\"text-align: justify;\">The government is also providing resources to help farmers explore and tap previously untouched aquifers and wetlands. It is also encouraging other, more radical, solutions.<\/p>\n<p style=\"text-align: justify;\">Concentrated in the arid north, the mining industry is looking principally to desalination plants to provide the water it needs in its processes. Plans for seven plants have been submitted in the Atacama Region alone, notes Desmadryl. The government could play a role here by encouraging consolidation given the economies of scale, huge power demand and environmental impact involved, he says.<\/p>\n<p style=\"text-align: justify;\">The government is also collaborating with French construction firm Vinci to study the possibility of building an undersea pipeline to pump fresh water from rivers in the center-southern part of the country to the north.<\/p>\n<p style=\"text-align: justify;\">But Donoso criticizes the emphasis on boosting supply rather than controlling demand. The government is spending over US$700 million building new reservoirs but minimal amounts to encourage more efficient water use, especially in farming, he says.<\/p>\n<p style=\"text-align: justify;\">Still, the government believes Chile is on the right track. A 2011 World Bank report commissioned by the DGA into management of the country\u2019s water resources urged measures to deepen the market in water rights, improve water quality and environmental protection, but praised the country for having the institutions in place to deal with the challenges to come.<\/p>\n<p style=\"text-align: justify;\">So far marginal adjustments have kept the water running and may continue to do so for many years to come. But at some point, shortages could turn critical, and the existing system of rights could break down.<\/p>\n<p style=\"text-align: justify;\">\u201cThe market is not the solution for resolving scarcity,\u201d says Wiesner.<\/p>\n<p style=\"text-align: justify;\"><strong>Water nationalization?<\/strong><\/p>\n<p style=\"text-align: justify;\">Some would like to tear up the existing regulations and start again. Three years ago, an alliance of environmentalists and legislators presented a bill to Congress promising to \u201cnationalize\u201d the country\u2019s water, hugely extending the state\u2019s power to assign and remove rights, determine use and clamp down on speculation.<\/p>\n<p style=\"text-align: justify;\">Understandably, that has many groups worried. The suspicion is that the proposal\u2019s backers have ulterior motives, such as limiting the expansion of hydropower or exercising greater control of key industries by restricting access to water.<\/p>\n<p style=\"text-align: justify;\">However, the most affected would not be large multinationals, counters Desmadryl at the DGA, but thousands of small farmers who hold two-thirds of the country\u2019s water rights and would face a new layer of bureaucracy.<\/p>\n<p style=\"text-align: justify;\">\u201cThe question is to what extent the state should interfere in decisions which properly belong to the private sector,\u201d Desmadryl says.<\/p>\n<p style=\"text-align: justify;\">Others have more subtle suggestions. The previous government proposed reforming the Constitution to make water a public good. After all, says Weisner, head of the DGA at the time, the Constitution already protects rights such as access to information and property, neither as vital to life as water.<\/p>\n<p style=\"text-align: justify;\">Opponents \u2013 including the current government, which shelved the bill \u2013 dismiss the proposal as unnecessary. The Water Code already classes water as a \u201cpublic good\u201d and grants the state many of the powers covered by the reform, says Desmadryl.<\/p>\n<p style=\"text-align: justify;\">But, Weisner counters, such powers are rarely exercised, if at all. Making the public status of water explicit in the Constitution would force authorities to consider other aspects of the resource beyond the purely economic, he says.<\/p>\n<p style=\"text-align: justify;\">Chile\u2019s system of water rights has served business well, but often to the detriment of the environment or other water-dependent human activities, such as fishing or tourism. While the solutions proffered so far may not please all, they suggest a deeper debate is needed, says Pickering at ANDESS.<\/p>\n<p style=\"text-align: justify;\">\u201cThanks to climate change, the drought and the pressure on resources, the issue has become much more politically important,\u201d he notes.<\/p>\n<p style=\"text-align: justify;\">Last year, local water utilities joined with environmentalists, academics, experts and social groups to debate the problems surrounding water in Chile and produced the report \u201cWater and Environment\u201d, outlining the main issues, a wide range of possible solutions and the discrepancies that arose between participants.<\/p>\n<p style=\"text-align: justify;\">The dialogue has been broadened this year to include government agencies, political think-tanks and representatives of the mining and energy industries.<\/p>\n<p style=\"text-align: justify;\">In the private sector, the Chilean Confederation of Production and Commerce (CPC) recently created a commission to improve the efficiency of water use in Chile. It is chaired by Pedro Crespo, president of the National Agriculture Association (SNA), whose members account for roughly 80% of the water consumed in Chile.<\/p>\n<p style=\"text-align: justify;\">And, in August, Chile\u2019s lower house approved the creation of a permanent commission on water resources, desertification and drought that could lead to new reforms to the Water Code and the Constitution.<\/p>\n<p style=\"text-align: justify;\">Momentum appears to be growing for the country to take a long hard look at the future of its water resources. Given the sensitivity of the issues involved, major change is likely to be slow in coming; it took 13 years for Congress to approve the introduction of charges for unused rights.
