{"id":4855,"date":"2012-08-20T17:21:50","date_gmt":"2012-08-20T20:21:50","guid":{"rendered":""},"modified":"2015-03-09T11:57:42","modified_gmt":"2015-03-09T14:57:42","slug":"pesca-en-chile-una-carrera-contra-el-tiempo","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/pesca-en-chile-una-carrera-contra-el-tiempo\/","title":{"rendered":"<!--:es-->Pesca en Chile: Una Carrera contra el Tiempo<!--:--><!--:en-->Fishing in Chile: A Race against Time<!--:-->"},"content":{"rendered":"<p><!--:es--><\/p>\n<p style=\"text-align: justify;\">En las primeras horas del martes 10 de julio, bomberos del sure\u00f1o puerto chileno de Coronel fueron llamados a sofocar un incendio en la d\u00e1rcena. Cuando llegaron, encontraron una embarcaci\u00f3n en llamas en el muelle. Intentaron apagar las llamas, pero los encolerizados pescadores que le hab\u00edan prendido fuego les impidieron el paso.<\/p>\n<p style=\"text-align: justify;\">M\u00e1s al norte por la costa, pescadores bloquearon el acceso a la ciudad de Constituci\u00f3n y colocaron barricadas en Valpara\u00edso. Hacia el sur, hubo protestas en el muelle en Puerto Montt y en la isla de Chilo\u00e9.<\/p>\n<p style=\"text-align: justify;\">El catalizador de esta ira fue la aprobaci\u00f3n en el Congreso chileno de una nueva ley de pesca. La actual legislaci\u00f3n, que ha estado vigente por m\u00e1s de una d\u00e9cada, expira a fines de 2012 y el Gobierno elabor\u00f3 un sustituto. No ha sido f\u00e1cil. Grandes compa\u00f1\u00edas pesqueras, ambientalistas, pescadores locales, salmonicultores y trabajadores de plantas de procesamiento de pescados de Chile, todos han hecho lobby furibundamente para asegurar que reciban el mejor acuerdo posible de la nueva legislaci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">El 18 de julio, la C\u00e1mara baja de Chile aprob\u00f3 el proyecto de ley, que ahora se encuentra en el Senado donde el debate posiblemente sea igual de intenso.<\/p>\n<p style=\"text-align: justify;\">\u201cCada gobierno que ha intentado reformar el sector pesquero ha tenido problemas\u201d, sostiene el ministro de Econom\u00eda, Pablo Longueira, quien tiene la tarea de guiar el proyecto de ley hasta que se promulgue. \u201cCada vez tratamos de perfeccionar, mejorar o regular al sector, pescadores queman botes y protagonizan marchas, de modo que nunca ha sido posible implementar las reformas que Chile necesita\u201d.<\/p>\n<p style=\"text-align: justify;\"><strong>Una Historia Tortuosa<\/strong><\/p>\n<p style=\"text-align: justify;\">La historia del proyecto de ley se remonta a mediados de la d\u00e9cada de los 90, cuando los peces a\u00fan eran relativamente abundantes en la zona sur del oc\u00e9ano Pac\u00edfico y la flota de pesca comercial de Chile desembarcaba hasta 7 millones de toneladas al a\u00f1o de jurel, arenques, sardinas, merluza y bacalao.<\/p>\n<p style=\"text-align: justify;\">En ese entonces, Chile operaba un sistema de Cuotas Totales Permisibles de captura, a menudo denominado \u201ccarrera ol\u00edmpica\u201d. Las autoridades decid\u00edan cu\u00e1ntas toneladas pod\u00edan pescarse y dejaban que los pescadores se las arreglaran. El resultado fue desastroso. Los pescadores comerciales se apresuraban al mar para pescar cu\u00e1ntos peces pudieran antes de que sus rivales se quedaran con ellos.<\/p>\n<p style=\"text-align: justify;\">Entonces, en el 2001, el Gobierno cambi\u00f3 a un sistema de Cuotas Individuales de Captura transferibles, usadas en la mayor\u00eda de las principales pesquer\u00edas del mundo. A las empresas se les asignaba un porcentaje de la captura total sobre la base de su registro hist\u00f3rico.<\/p>\n<p style=\"text-align: justify;\">Ello ha estabilizado a la industria y permitido que las pesquer\u00edas fuertemente mermadas se recuperaran de alg\u00fan modo. Pero los cr\u00edticos dicen que ha dificultado que las nuevas empresas, sin historial de captura, ingresen al mercado. Esas cr\u00edticas se intensificaron de cara a una serie de recientes fusiones. Hoy en d\u00eda, seg\u00fan cifras del Ministerio de Econom\u00eda, cuatro conglomerados (Orizon, Camanchaca, Blumar y Marfood) corresponden al 91% de la cuota industrial para las principales especies en Chile.<\/p>\n<p style=\"text-align: justify;\">\u201cEstos tipos han formado un cartel\u201d, sostiene Rodrigo Vial, presidente de la Asociaci\u00f3n de Armadores de Buques Pesqueros y Empresas Procesadoras de Productos del Mar (Anapesca) y cofundador de Lota Protein, una de las empresas m\u00e1s peque\u00f1as que corresponden a cerca del 9% restante. \u201cMi predicci\u00f3n es que este grupo de grandes compa\u00f1\u00edas se reducir\u00e1 a\u00fan m\u00e1s, quiz\u00e1s a una compa\u00f1\u00eda en el norte y una en el sur\u201d.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Rodrigo_Vial_Cox.jpg\" alt=\"\" width=\"200\" height=\"150\"><\/p>\n<p style=\"text-align: justify;\">Sonapesca, la asociaci\u00f3n que representa a las empresas de pesca industrial de Chile, sostiene que la afirmaci\u00f3n de Vial de que hay un cartel es absurda.<\/p>\n<p style=\"text-align: justify;\">\u201cUna vez que se introduzca esta ley, 35 empresas industriales ser\u00e1n responsables de desembarcar un 45% de la captura\u201d, dice Rodrigo Sarquis, presidente de Sonapesca. \u201cEl 55% restante estar\u00e1 en manos de miles de pescadores artesanales. \u00bfEn qu\u00e9 otro sector de la econom\u00eda chilena hay tantos actores diferentes involucrados?\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>\u00bfLicitar o No Licitar?<\/strong><\/p>\n<p style=\"text-align: justify;\">Si, como sugiere Vial, el poder se concentra en las manos de unos pocos, entonces \u00bfqu\u00e9 se puede hacer al respecto? Para Lota Protein, la respuesta son las licitaciones. La empresa sostiene que en lugar de asignar cuotas sobre bases hist\u00f3ricas, las autoridades deber\u00edan venderlas al mayor postor.<\/p>\n<p style=\"text-align: justify;\">Al presidente Sebasti\u00e1n Pi\u00f1era le gusta esta idea y el Gobierno intent\u00f3 incluir un sistema de licitaciones en el proyecto de ley, pero legisladores votaron en su contra. Luis Felipe Moncada, gerente general de Asociaci\u00f3n de Industriales Pesqueros del B\u00edo B\u00edo (Asipes), en la Octava Regi\u00f3n del pa\u00eds, afirma que tuvieron raz\u00f3n en hacerlo.<\/p>\n<p style=\"text-align: justify;\">\u201cLa vasta mayor\u00eda de la gente en la industria pesquera se opuso a las licitaciones\u201d, afirma. \u201cNo han funcionado en otras partes del mundo y no llevan a una mayor competencia. Por el contrario, conducen a una mayor concentraci\u00f3n, porque son las grandes empresas las que pueden costear una oferta alta\u201d.<img loading=\"lazy\" decoding=\"async\" style=\"float: right;\" src=\"\/sites\/default\/files\/Luis_Moncada.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Moncada apunta a la experiencia de Rusia y Estonia, que privatizaron sus industrias pesqueras a trav\u00e9s de licitaciones en la d\u00e9cada de los 90 con resultados insatisfactorios.<\/p>\n<p style=\"text-align: justify;\">Pero Riola Solano, gerente de asuntos corporativos de Lota Protein, se\u00f1ala que la comparaci\u00f3n es injusta, porque -a diferencia de Chile- ambos pa\u00edses estaban emergiendo de la debacle econ\u00f3mica de la ex Uni\u00f3n Sovi\u00e9tica. La ejecutiva afirma que un sistema de licitaci\u00f3n bien dise\u00f1ado beneficiar\u00eda a Chile y menciona a Estados Unidos y Nueva Zelanda como ejemplos a seguir.<\/p>\n<p style=\"text-align: justify;\">\u201cEste a\u00f1o se han licitado cuotas para 14 especies diferentes en Estados Unidos, en Maine y el estado de Washington\u201d, se\u00f1ala. \u201cY si el Gobierno chileno no quiere licitar cuotas, al menos podr\u00eda obligar a las empresas a licitar el pescado fresco &#8211; la primera captura- como se hace en Noruega\u201d.<\/p>\n<p style=\"text-align: justify;\">Cr\u00edticos de Lota Protein sostienen que la forma de crecer es comprar cuotas de otras compa\u00f1\u00edas, como permite la actual legislaci\u00f3n. Sonapesca indica que ha habido al menos 400 de este tipo de ventas desde 2001.<\/p>\n<p style=\"text-align: justify;\">Pero Solano se\u00f1ala que es m\u00e1s f\u00e1cil decirlo que hacerlo. \u201cSi tuvi\u00e9ramos la posibilidad de comprar lo habr\u00edamos hecho\u201d, asevera. \u201cEs cierto que las cuotas son transferibles, pero si la gente no quiere vender no se les puede obligar\u201d.<\/p>\n<p style=\"text-align: justify;\">Menciona una resoluci\u00f3n del Tribunal de Defensa de la Libre Competencia (TDLC) de Chile que concluy\u00f3 que entre los a\u00f1os 2001 y 2011 ni una sola empresa nueva ingreso al sector de la pesca industrial en Chile. Todas las transferencias se hicieron entre las firmas dominantes del mercado.<\/p>\n<p style=\"text-align: justify;\">Pero Sarquis dice que la raz\u00f3n de ello es que, con las menores existencias y cuotas, no hab\u00eda ning\u00fan incentivo para que las nuevas empresas ingresaran al mercado. Habr\u00edan podido hacerlo si hubieran querido. Simplemente escogieron no hacerlo.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/foto_Riola_Solano.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Parte de la dificultad de comprar cuotas adicionales, hasta ahora, es que se han registrado para barcos m\u00e1s que para propietarios de barcos. Si uno quiere comprar una cuota, tiene que comprar el barco tambi\u00e9n.<\/p>\n<p style=\"text-align: justify;\">En este punto, hay consenso en cuanto a que la ley necesita modificarse y el proyecto de ley refleja eso. Esta reforma (suponiendo que el Senado la apruebe) deber\u00eda ayudar a hacer m\u00e1s l\u00edquido el mercado secundario en cuotas de pesca transferible.<\/p>\n<p style=\"text-align: justify;\"><strong>M\u00e1s Regulaci\u00f3n<\/strong><\/p>\n<p style=\"text-align: justify;\">Si bien las cuotas y las subastas son una preocupaci\u00f3n para la flota de pesca industrial, el principal tema para los due\u00f1os de botes m\u00e1s peque\u00f1os es la regulaci\u00f3n.<\/p>\n<p style=\"text-align: justify;\">Chile hace una clara distinci\u00f3n entre sus pequeros barcos industriales y sus botes artesanales. El punto de corte es precisamente 18 metros. Cualquier embarcaci\u00f3n de mayor eslora que eso se considera parte de la flota industrial. El Gobierno se\u00f1ala que hay 384 de estos barcos en Chile aunque, enfrentados a existencias cada vez m\u00e1s peque\u00f1as en los \u00faltimos a\u00f1os, solo 185 est\u00e1n operativas. En el 2011, esas embarcaciones desembarcaron 1,6 millones de toneladas de pescado, o poco menos de la mitad de la captura total chilena.<\/p>\n<p style=\"text-align: justify;\">El resto de los botes -aquellos de menos de 18 metros de eslora- pertenecen a la flota artesanal y est\u00e1n sujetos a muchos menos controles. Hay m\u00e1s de 13.000 de ellos en Chile.<\/p>\n<p style=\"text-align: justify;\">Debido a que las cuotas industriales se han contra\u00eddo, el sector artesanal ha crecido en importancia. En el 2000, correspondi\u00f3 al 22% de la captura total del pa\u00eds, pero en el 2010 eso hab\u00eda subido al 52%. Si bien el tama\u00f1o de la captura general chilena cay\u00f3 en un 30% durante ese per\u00edodo, la pesca artesanal subi\u00f3 en un 80%.<\/p>\n<p style=\"text-align: justify;\">El Gobierno se\u00f1ala que ha llegado el momento de regular la flota artesanal e incluy\u00f3 varias medidas en el proyecto de ley para ese fin. Por primera vez, establece una distinci\u00f3n entre los botes de mediano tama\u00f1o (aquellos entre 12 y 18 metros de eslora) y los botes que tienen menos de 12 metros de eslora.&nbsp;<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/SARQUIS.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Esta distinci\u00f3n es marcada. Los botes de tama\u00f1o mediano representan apenas el 10% de la flota artesanal, pero corresponden al 90% de su captura. El ministro Longueira se\u00f1ala que los due\u00f1os de estas embarcaciones semi-industriales deber\u00edan ser obligadas a pagar por sus licencias de pesca, certificar el tama\u00f1o de su captura y (en los casos de botes entre 15 y 18 metros de eslora) instalar sistemas de sistemas de navegaci\u00f3n satelital a bordo de modo que las autoridades puedan hacer un seguimiento de d\u00f3nde pescan.<\/p>\n<p style=\"text-align: justify;\">No es de sorprender que algunos propietarios de botes se opongan a estas propuestas, argumentando que ser\u00e1n costosas y generar\u00e1n despidos. El Gobierno incluy\u00f3 incentivos en el proyecto de ley para cubrir esas preocupaciones. Indica, por ejemplo, que los propietarios pueden deducir el precio del equipamiento de navegaci\u00f3n satelital del costo de las licencias de pesca.<\/p>\n<p style=\"text-align: justify;\"><strong>Proteger a los Peces Peque\u00f1os<\/strong><\/p>\n<p style=\"text-align: justify;\">El Gobierno tambi\u00e9n afirma que quiere proteger a los due\u00f1os de las embarcaciones m\u00e1s peque\u00f1as, los r\u00fasticos botes de madera a remo de la imaginaci\u00f3n popular. Por primera vez, los due\u00f1os de esos botes tendr\u00e1n acceso exclusivo a \u201cla primer milla\u201d, la milla de agua m\u00e1s cercana a la costa. Solo se permitir\u00e1 a los botes de mediano tama\u00f1o dentro de esa milla en ciertas \u00e1reas, para pescar ciertas especies, y solo en acuerdo con los propietarios de las embarcaciones m\u00e1s peque\u00f1as.<\/p>\n<p style=\"text-align: justify;\">Todos los botes que midan 18 metros o menos todav\u00eda tendr\u00e1n acceso exclusivo a las primeras cinco millas, tal como en la legislaci\u00f3n actual. Pero en respuesta a las quejas de los pescadores artesanales, el gobierno cambi\u00f3 el punto desde el que se cuentan esas cinco millas. El proyecto de ley propone que, donde haya una bah\u00eda, se dibuje una l\u00ednea entre los dos cabos y que las cinco millas deber\u00edan medirse desde esa l\u00ednea en lugar de hacerlo desde el borde costero. Esto en efecto llevar\u00eda a la flota industrial m\u00e1s adentro en el mar.<\/p>\n<p style=\"text-align: justify;\">\u201cEsa era una demanda muy importante para nosotros\u201d, se\u00f1ala Zoila Bustamante, presidenta de la Confederaci\u00f3n Nacional de Pescadores Artesanales de Chile (Conapach). \u201cEn algunos lugares, donde hay cabos, nuestro acceso a la plataforma continental es casi nulo en este momento\u201d.<\/p>\n<p style=\"text-align: justify;\">Pero los industriales se oponen al cambio y han prometido luchar contra \u00e9l en el Senado. Moncada lo describe de \u201cabsolutamente innecesario\u201d y advierte que redundar\u00e1 en p\u00e9rdidas de empleo.&nbsp;<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Zoila_Bustamante.jpg\" alt=\"\" width=\"200\" height=\"150\"><\/p>\n<p style=\"text-align: justify;\">El proyecto de ley garantiza a los pescadores artesanales una mayor porci\u00f3n de las cuotas generales para cada especie. Por ejemplo, se les permitir\u00e1 pescar el 60% de la cuota de merluza en el canal de Chacao, entre Chilo\u00e9 y el continente, lo que se compara con el 50% actual. Su participaci\u00f3n en la pesca de arenques en el \u00e1rea comprendida entre la V y X Regiones se incrementar\u00e1 del 56% al 78%. En total, el Gobierno calcula que estos cambios a las cuotas traer\u00e1n como resultado la transferencia de US$34 millones al a\u00f1o del sector industrial al artesanal en los pr\u00f3ximos 20 a\u00f1os.<\/p>\n<p style=\"text-align: justify;\">Los impuestos son otro punto de conflicto. El Gobierno quiere que los due\u00f1os de barcos industriales y los botes artesanales m\u00e1s grandes paguen una regal\u00eda, pero hay poco consenso sobre c\u00f3mo deber\u00eda calcularse. El proyecto de ley propone una regal\u00eda del 3,3% sobre el valor comercial de las cuotas, pero las pesqueras industriales afirman que es injusto. Sostienen que si se ha de imponer una regal\u00eda, deber\u00eda aplicarse sobre la ganancia operativa, como en la industria minera, o sobre el valor de la captura de cada barco en lugar de sobre su cuota nominal.<\/p>\n<p style=\"text-align: justify;\">\u201cSi las empresas mineras ganan dinero, pagan una regal\u00eda, pero si no ganan dinero, no pagan\u201d, se\u00f1ala Sarquis. \u201cNo entendemos por qu\u00e9 el Gobierno est\u00e1 proponiendo un r\u00e9gimen tributario diferente para nosotros\u201d.<\/p>\n<p style=\"text-align: justify;\">Los pescadores de chilenos no son los \u00fanicos que siguen los avances del proyecto de ley en el Congreso. Los trabajadores de plantas procesadoras de pescado tambi\u00e9n est\u00e1n atentos, porque su empleo depende de \u00e9l. La flota industrial de Chile emplea unos 5.000 pescadores, cifra relativamente modesta, pero los peces que capturan generan 32.000 empleos adicionales en tierra.<\/p>\n<p style=\"text-align: justify;\"><strong>Sacar la Pol\u00edtica de la Pesca<\/strong><\/p>\n<p style=\"text-align: justify;\">Por su parte, los ambientalistas est\u00e1n preocupados sobre la manera en que se calculan cuotas totales de captura permisibles. En la actualidad, los l\u00edmites de captura son determinados por el estatal Instituto de Fomento Pesquero (IFOP), pero son revisadas por los consejos regionales de pesca. Representantes de la industria forman parte de dichos consejos, lo que crea un claro conflicto de intereses.<\/p>\n<p style=\"text-align: justify;\">Para resolver este problema, el Gobierno planea establecer 11 comit\u00e9s cient\u00edficos independientes, responsables de determinar los l\u00edmites de captura para las 11 especies m\u00e1s importantes en las aguas chilenas. El ministro Longueira se\u00f1ala que esto \u201csacar\u00e1 la pol\u00edtica de la pesca\u201d y asegurar\u00e1 que los l\u00edmites de captura se basen en la ciencia, no en la ambici\u00f3n.<\/p>\n<p style=\"text-align: justify;\">Eso es importante, porque algunas de las pesquer\u00edas de Chile se encuentran en un estado deplorable. Las existencias de jurel se han desplomado debido a la pesca excesiva de la d\u00e9cada de los 90. El a\u00f1o pasado, los pescadores de Chile extrajeron apenas 256.000 toneladas del pez lo que se compara con un peak de 4,4 millones de toneladas en 1995. Algunos cient\u00edficos estiman que demorar\u00e1 m\u00e1s de 100 a\u00f1os que las existencias se recuperen.<\/p>\n<p style=\"text-align: justify;\">Si el proyecto de ley se aprueba, el concepto de un \u201crendimiento m\u00e1ximo sostenible\u201d se incorporar\u00e1 a la legislaci\u00f3n de pesca de Chile por primera vez, como recomend\u00f3 la Organizaci\u00f3n de Naciones Unidas y la Uni\u00f3n Europea. Este es un c\u00e1lculo de la mayor captura que se puede obtener de un stock de cualquier especie dada indefinidamente, y fue una demanda clave del lobby ambientalista. El concepto tiene sus cr\u00edticos, pero se ha incorporado en las leyes de pesca de otros incluidos Nueva Zelanda, Islandia y Noruega.<\/p>\n<p style=\"text-align: justify;\"><strong>Batalla en el Senado<\/strong><\/p>\n<p style=\"text-align: justify;\">En las pr\u00f3ximas semanas, senadores debatir\u00e1n la denominada \u201cLey Longueira\u201d. Es probable que luego regrese a la C\u00e1mara baja para una mayor discusi\u00f3n. Si no se logra un acuerdo para el 31 de diciembre, la actual legislaci\u00f3n expirar\u00e1 y Chile, en teor\u00eda, podr\u00eda volver a la pesca libre para todos de la d\u00e9cada de los 90.<\/p>\n<p style=\"text-align: justify;\">En regiones como las del B\u00edo B\u00edo y Los Lagos, las apuestas son altas. Las exportaciones de pescado y acuicultura de Chile sumaron un valor de US$4.900 millones en el 2011 y si bien los salmonicultores correspondieron a la mayor parte de ese monto, cerca de US$1.400 millones provinieron de los oc\u00e9anos.<\/p>\n<p style=\"text-align: justify;\">A nivel nacional, la pesca corresponde solo al 0,4% del PIB a\u00fan cuando la captura pesquera general de Chile en el 2010 fue la s\u00e9ptima m\u00e1s grande a nivel mundial. Solano de Lota Protein afirma que es una clara indicaci\u00f3n de que la industria no esta teniendo un desempe\u00f1o acorde con su verdadero potencial.<\/p>\n<p style=\"text-align: justify;\">\u201cTenemos 4.000 kil\u00f3metros de borde costero en Chile. Deber\u00edamos ser una fuerza importante en la producci\u00f3n pesquera y no lo somos\u201d, sostiene.<\/p>\n<p style=\"text-align: justify;\">Vial de Anapesca se\u00f1ala que luchar\u00e1 \u201chasta las \u00faltimas consecuencias\u201d para asegurar que las licitaciones se restituyan en la legislaci\u00f3n durante su paso por el Senado.<\/p>\n<p style=\"text-align: justify;\">Del otro lado del argumento, Sarquis de Sonapesca y Moncada de Asipes se comprometieron a oponerse en\u00e9rgicamente a las licitaciones. Afirman que las empresas que representan han invertido fuertemente en la industria por m\u00e1s de medio siglo y se han ganado sus cuotas hist\u00f3ricas.<\/p>\n<p style=\"text-align: justify;\">En tanto, en medio de esta amarga disputa entre las grandes firmas pesqueras de Chile, los pescadores artesanales intentar\u00e1n hacer que sus voces sean escuchadas.<\/p>\n<p style=\"text-align: justify;\">\u201cA\u00fan no hemos logrado nada\u201d, se\u00f1ala Bustamante de Conapach. \u201cHemos mejorado el proyecto de ley, pero no cantaremos victoria hasta que se convierta en ley\u201d.<\/p>\n<p style=\"text-align: justify;\"><strong>Gideon Long trabaja como periodista freelance en Santiago. When they arrived, they found a ship burning in the harbor. They tried to extinguish the flames but were driven back by angry fishermen who had set it alight.<\/p>\n<p style=\"text-align: justify;\">Further up the coast, fishermen blocked access to the city of Constituci\u00f3n and set up barricades in Valpara\u00edso. To the south, there were dockside protests in Puerto Montt and on the island of Chilo\u00e9.<\/p>\n<p style=\"text-align: justify;\">The catalyst for this anger was the passage through the Chilean Congress of a new fishing law. The current one, which has been in force for over a decade, expires at the end of 2012 and the government has drafted a replacement. It has not proved easy. Chile\u2019s big fishing companies, environmentalists, local fishermen, salmon farmers and workers at fish processing plants have all lobbied furiously to ensure they get the best deal possible from the new legislation.<\/p>\n<p style=\"text-align: justify;\">On July 18, Chile\u2019s lower house approved the draft law. It is now before the Senate where the arguments are likely to be just as intense.<\/p>\n<p style=\"text-align: justify;\">\u201cEvery government that\u2019s tried to reform the fishing industry has run into problems,\u201d says Economy Minister Pablo Longueira, who has the task of shepherding the bill into law. \u201cEvery time we try to perfect, improve or regulate the sector, fishermen burn boats and stage marches, so it\u2019s never been possible to implement the reforms that Chile needs.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Tortured history<\/strong><\/p>\n<p style=\"text-align: justify;\">The history of the draft law can be traced back to the mid-1990s, when fish were still relatively plentiful in the South Pacific and Chile\u2019s commercial fishing fleet landed up to 7 million tons a year of jack mackerel, pilchards, sardines, hake and kingclip.<\/p>\n<p style=\"text-align: justify;\">Back then, Chile operated a Total Allowable Catch system, often referred to as an \u201cOlympic system\u201d. The authorities decided how many tons could be caught and left the fishermen to get on with it. The result was disastrous. Commercial fishermen rushed out to sea to net as many fish as possible before their rivals got to them.<\/p>\n<p style=\"text-align: justify;\">So, in 2001, the government switched to a system of Individual Transferable Quotas, used in most of the world\u2019s major fisheries. Companies were assigned a percentage of the overall catch on the basis of their historical record.<\/p>\n<p style=\"text-align: justify;\">That has stabilized the industry and allowed badly depleted fisheries to recover somewhat. But critics say it makes it difficult for new companies, with no historical catch, to enter the market. Those criticisms have intensified in the light of a series of recent mergers. These days, according to data from the Economy Ministry, four conglomerates (Orizon, Camanchaca, Blumar and Marfood) account for 91% of the industrial quota for the main species in Chile.<\/p>\n<p style=\"text-align: justify;\">\u201cThese guys have built a cartel,\u201d says Rodrigo Vial, president of the ship owners\u2019 association Anapesca and co-founder of Lota Protein, one of the smaller companies that account for the remaining 9%. \u201cMy prediction is that this group of big companies will be reduced further still, to maybe one company in the north and one in the south.\u201d&nbsp;<img loading=\"lazy\" decoding=\"async\" style=\"float: left;\" src=\"\/sites\/default\/files\/Rodrigo_Vial_Cox_0.jpg\" alt=\"\" width=\"200\" height=\"150\"><\/p>\n<p style=\"text-align: justify;\">Sonapesca, the association that represents Chile\u2019s industrial fishing companies, says Vial\u2019s cartel claim is absurd.<\/p>\n<p style=\"text-align: justify;\">\u201cOnce this law is introduced, 35 industrial companies will be responsible for landing 45% of the catch,\u201d says Rodrigo Sarquis, president of Sonapesca. \u201cThe remaining 55% will be in the hands of thousands of artisanal fishermen. In what other sector of the Chilean economy are there so many different players involved?\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Auction or no auction?<\/strong><\/p>\n<p style=\"text-align: justify;\">If, as Vial suggests, power is concentrated in the hands of a few, then what can be done about it? For Lota Protein, the answer is auctions. The company says that rather than allocating quotas on historical grounds, the authorities should sell them to the highest bidder.<\/p>\n<p style=\"text-align: justify;\">President Sebasti\u00e1n Pi\u00f1era is keen on this idea and the government tried to include an auction system in the bill, but Congress members voted it down. Luis Felipe Moncada, general manager of Asipes, the industrial fishing association in the B\u00edoB\u00edo Region, says they were right to do so.<\/p>\n<p style=\"text-align: justify;\">\u201cThe vast majority of people in the fishing industry are opposed to auctions,\u201d he says. \u201cThey haven\u2019t worked elsewhere in the world and they don\u2019t lead to increased competition. On the contrary, they lead to further concentration because it\u2019s the big companies that can afford to bid high.\u201d<\/p>\n<p style=\"text-align: justify;\">Moncada points to the experience of Russia and Estonia, which privatized their fishing industries through auctions in the 1990s with unsatisfactory results.<\/p>\n<p style=\"text-align: justify;\">But Riola Solano, Lota Protein\u2019s head of corporate affairs, says the comparison is unfair because, unlike Chile, both countries were emerging from the economic debacle of the former Soviet Union. She says a well-designed auction system would benefit Chile, and cites the United States and New Zealand as examples to follow.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/foto_Riola_Solano_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">\u201cThis year they\u2019ve auctioned quotas for 14 different species in the U.S. &#8212; in Maine and the state of Washington,\u201d she says. \u201cAnd if the Chilean government doesn\u2019t want to auction quotas, they could at least oblige companies to auction fresh fish &#8211; the first catch &#8211; as they do in Norway.\u201d<\/p>\n<p style=\"text-align: justify;\">Critics of Lota Protein say the way to grow is to buy quotas from other companies, as allowed under current legislation. Sonapesca says there have been over 400 such sales since 2001.<\/p>\n<p style=\"text-align: justify;\">But Solano says that\u2019s easier said than done. \u201cIf we\u2019d had the chance to buy we would have done so,\u201d she says. \u201cIt\u2019s true that the quotas are transferable but if people don\u2019t want to sell then you can\u2019t force them to.\u201d<\/p>\n<p style=\"text-align: justify;\">She cites a ruling from Chile\u2019s antitrust authority (<em>Tribunal de Defensa de Libre Competencia<\/em>, TDLC) that found that between 2001 and 2011, not a single new company entered the industrial fishing sector in Chile. All the transfers were between market incumbents.<\/p>\n<p style=\"text-align: justify;\">But Sarquis says the reason is that, with stocks and quotas declining, there was no incentive for new companies to enter the market. They could have done so if they\u2019d wanted to. They simply chose not to.<\/p>\n<p style=\"text-align: justify;\">Part of the difficulty of buying extra quotas is that they have, until now, been registered to ships rather than ship owners. If you want to buy the quota, you have to buy the ship too.<\/p>\n<p style=\"text-align: justify;\">On this point, there is consensus that the law needs to be changed, and the bill reflects that. This reform (assuming the Senate approves it) should help make the secondary market in transferable fishing quotas more liquid.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Luis_Moncada_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\"><strong>More regulation<\/strong><\/p>\n<p style=\"text-align: justify;\">While quotas and auctions are a concern for the industrial fishing fleet, the main issue for the owners of smaller boats is regulation.<\/p>\n<p style=\"text-align: justify;\">Chile makes a clear distinction between its industrial fishing ships and its artisanal boats. The cut-off point is precisely 18 meters. Any vessel longer than that is considered part of the industrial fleet. The government says there are 384 such ships in Chile although, faced with dwindling stocks in recent years, only 185 are operative. In 2011 those ships landed 1.6 million tons of fish, or just under half of the total Chilean catch.<\/p>\n<p style=\"text-align: justify;\">The rest of the boats \u2013 those under 18 meters in length &#8212; belong to the artisanal fleet and are subject to far fewer checks and balances. There are over 13,000 of them in Chile.<\/p>\n<p style=\"text-align: justify;\">As industrial quotas have shrunk, the artisanal sector has grown in importance. In 2000, it accounted for 22% of the country\u2019s total catch but by 2010 that had risen to 52%. While the size of the overall Chilean catch dropped by 30% during that period, the artisanal catch rose by 80%.<\/p>\n<p style=\"text-align: justify;\">The government says the time has come to regulate the artisanal fleet and has included several measures in the draft law to that effect. For the first time, it draws a distinction between medium-sized boats (those between 12 and 18 meters in length) and boats that are less than 12 meters long.<\/p>\n<p style=\"text-align: justify;\">This distinction is stark. The medium-sized boats represent just 10% of the artisanal fleet but account for 90% of its catch. Minister Longueira says the owners of these semi-industrial vessels should be forced to pay for fishing licenses, certify the size of their catches and (in the cases of boats between 15 and 18 meters in length) install on-board satellite navigation systems so that authorities can monitor where they fish.<img loading=\"lazy\" decoding=\"async\" style=\"float: right; margin: 4px;\" src=\"\/sites\/default\/files\/SARQUIS_0.jpg\" alt=\"\" width=\"150\" height=\"200\"><\/p>\n<p style=\"text-align: justify;\">Unsurprisingly, some boat owners object to these proposals, saying they will be expensive and lead to redundancies. The government has included incentives in the bill to meet those concerns. It says, for example, that owners can deduct the price of satellite navigation equipment from the cost of fishing licenses.<\/p>\n<p style=\"text-align: justify;\"><strong>Protecting the minnows<\/strong><\/p>\n<p style=\"text-align: justify;\">The government also says it wants to protect the owners of the very smallest vessels, the rustic wooden rowing boats of popular imagination. For the first time, the owners of those boats will have exclusive access to \u201cthe first mile\u201d \u2013 the mile of water closest to the coast. Medium-sized boats will only be allowed inside that mile in certain areas, to fish certain species, and only in agreement with owners of the smaller vessels.<\/p>\n<p style=\"text-align: justify;\">All boats measuring 18 meters or less will still have exclusive access to the first five miles, as under current law. But in response to complaints from artisanal fishermen, the government has changed the point from which those five miles are measured. The bill proposes that, where there is a bay, a line should be drawn between the two headlands and the five miles should be measured from that line rather than from the coastline. This would effectively push the industrial fleet further out to sea.<\/p>\n<p style=\"text-align: justify;\">\u201cThat was a very important demand for us,\u201d says Zoila Bustamante, president of the artisanal fishing federation Conapach. \u201cIn some places, where there are headlands, our access to the continental shelf is next to nothing at the moment.\u201d<\/p>\n<p style=\"text-align: justify;\">But the industrialists oppose the change and have vowed to fight it in the Senate. Moncada describes it as \u201cabsolutely unnecessary\u201d and warns it will mean job losses.<img loading=\"lazy\" decoding=\"async\" style=\"float: left; margin: 4px;\" src=\"\/sites\/default\/files\/Zoila_Bustamante_0.jpg\" alt=\"\" width=\"200\" height=\"150\"><\/p>\n<p style=\"text-align: justify;\">The draft law grants artisanal fishermen a greater share of the overall quotas for each species. For example, they will be allowed to catch 60% of the hake quota in the Chacao channel, between Chilo\u00e9 and the mainland, compared to 50% now. Their share of the pilchard catch in the area between Regions V and X will increase from 56% to 78%. In all, the government calculates that these quota changes will result in the transfer of US$34 million a year from the industrial sector to the artisanal sector over the next 20 years.<\/p>\n<p style=\"text-align: justify;\">Taxes are another point of conflict. The government wants the owners of industrial ships and the larger artisanal boats to pay a royalty, but there is little consensus on how it should be calculated. The bill proposes a 3.3% royalty on the commercial value of quotas, but the industrial fishers say that is unfair. They say that if a royalty is to be imposed, it should be levied on operating profit, as in the mining industry, or on the value of each ship\u2019s catch rather than on its nominal quota.<\/p>\n<p style=\"text-align: justify;\">\u201cIf the mining companies make money, they pay a royalty, but if they don\u2019t make money they don\u2019t pay,\u201d Sarquis says. \u201cWe don\u2019t understand why the government is proposing a different tax regime for us.\u201d<\/p>\n<p style=\"text-align: justify;\">Chile\u2019s fishermen are not the only ones following the bill\u2019s progress through Congress. Workers at fish processing plants are watching too, because their jobs depend on it. Chile\u2019s industrial fleet employs a relatively modest 5,000 fishermen but the fish they catch provide an additional 32,000 jobs on land.<\/p>\n<p style=\"text-align: justify;\"><strong>Taking the politics out of fishing<\/strong><\/p>\n<p style=\"text-align: justify;\">Environmentalists, for their part, are worried about the way in which total allowable catches are calculated. At present, catch limits are determined by the state\u2019s Fisheries Development Institute (IFOP) but are reviewed by regional fishing councils. Industry representatives sit on those councils, creating a clear conflict of interest.<\/p>\n<p style=\"text-align: justify;\">To resolve this problem, the government plans to set up 11 independent scientific committees, responsible for setting catch limits for the 11 most important species in Chilean waters. Minister Longueira says this will \u201ctake the politics out of fishing\u201d and ensure that catch limits are based on science, not greed.<\/p>\n<p style=\"text-align: justify;\">That is important, because some of Chile\u2019s fisheries are in a woeful state. Stocks of jack mackerel have plummeted due to the overfishing of the 1990s. Last year, Chile\u2019s fishermen netted just 256,000 tons of the fish compared to a peak of 4.4 million tons in 1995. Some scientists estimate it will take over 100 years for stocks to recover.<\/p>\n<p style=\"text-align: justify;\">If the bill is approved, the concept of a \u201cmaximum sustainable yield\u201d will be incorporated into Chilean fishing legislation for the first time, as recommended by the United Nations and the European Union. This is a calculation of the largest catch that can be taken from the stock of any given species indefinitely, and was a key demand of the environmental lobby. The concept has its critics but has been incorporated into fishing laws in other countries including New Zealand, Iceland and Norway.<\/p>\n<p style=\"text-align: justify;\"><strong>Battle in the Senate<\/strong><\/p>\n<p style=\"text-align: justify;\">Over the coming weeks, senators will debate the so-called \u201cLongueira Law\u201d. It is then likely to return to the lower house for further discussion. If no agreement is reached by December 31, the current legislation will expire and Chile could in theory return to the fishing free-for-all of the 1990s.<\/p>\n<p style=\"text-align: justify;\">In regions like B\u00edoB\u00edo and Los Lagos, the stakes are high. Chile\u2019s fish and aquiculture exports were worth US$4.9 billion in 2011 and although salmon farmers accounted for most of that, around US$1.4 billion came from the oceans.<\/p>\n<p style=\"text-align: justify;\">Nationally, fishing accounts for only 0.4% of GDP even though Chile\u2019s overall fishing catch in 2010 was the seventh largest in the world. Lota Protein\u2019s Solano says that is a clear indication that the industry is not performing to its true potential.<\/p>\n<p style=\"text-align: justify;\">\u201cWe have 4,000 kilometers of coastline in Chile. We should be a major force in fish production and we\u2019re not,\u201d she says.<\/p>\n<p style=\"text-align: justify;\">Anapesca\u2019s Vial says he will fight \u201cto the bitter end\u201d to ensure auctions are re-inserted into the legislation during its passage through the Senate.<\/p>\n<p style=\"text-align: justify;\">On the other side of the argument, Sarquis at Sonapesca and Moncada at Asipes vow to oppose auctions vociferously. They say the companies they represent have invested heavily in the industry for over half a century and have earned their historic quotas.<\/p>\n<p style=\"text-align: justify;\">Meanwhile, amid this bitter dispute between Chile\u2019s big fishing firms, the artisanal fishermen will try to make their voices heard.<\/p>\n<p style=\"text-align: justify;\">\u201cWe haven\u2019t achieved anything yet,\u201d says Conapach\u2019s Bustamante. \u201cWe\u2019ve improved the bill, but we won\u2019t cry victory until it becomes law.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong style=\"text-align: justify;\"><strong>Gideon Long is a freelance journalist based in Santiago.
