Entonces elija. M\u00e1s de 20 aerol\u00edneas vuelan de manera regular hacia y desde el pa\u00eds a una serie de destinos en Am\u00e9rica, Europa y Asia, una cantidad significativa para un pa\u00eds del tama\u00f1o de Chile. Eso refleja el crecimiento en el n\u00famero de chilenos que vuelan y las liberales pol\u00edticas del pa\u00eds en lo que respecta a abrir su espacio a\u00e9reo a tantos operadores extranjeros como sea posible.<\/p>\n<p style=\"text-align: justify;\">Las autoridades chilenas han suscrito acuerdos de cielos abiertos con 27 pa\u00edses desde Francia hasta Fiji, en los que ofrece distintos grados de libertad de movimiento para operadores extranjeros sobre una base rec\u00edproca. El a\u00f1o pasado, la Junta de Aeron\u00e1utica Civil (JAC) de Chile renegoci\u00f3 un acuerdo con Brasil, uno de los destinos favoritos de los turistas chilenos, en el que acept\u00f3 eliminar restricciones sobre la cantidad de slots que cada uno debe ofrecer a los operadores del otro pa\u00eds.<\/p>\n<p style=\"text-align: justify;\">Los esfuerzos de Chile para liberalizar los viajes a\u00e9reos han ganado el reconocimiento internacional.<\/p>\n<p style=\"text-align: justify;\">\u201cChile ha sido pionero en la pol\u00edtica de cielos abiertos, impulsando el cambio y alentando a otros gobiernos de Am\u00e9rica Latina a hacer los mismo\u201d, afirma Anthony Concil, director de comunicaciones corporativas de la Asociaci\u00f3n de Transporte A\u00e9reo Internacional (IATA, por su sigla en ingl\u00e9s), entidad con sede en Ginebra.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, estos esfuerzos no son emulados en el mercado interno del pa\u00eds, donde apenas tres empresas chilenas dominan el sector: el operador nacional LAN, el operador de bajo costo Sky Airline y PAL Airlines, que ha estado operando vuelos programados por no m\u00e1s de dos a\u00f1os.<\/p>\n<p style=\"text-align: justify;\">La limitada cantidad de participantes, en particular la dominancia de LAN, lleva a la presentaci\u00f3n regular de quejas respecto a que la falta de competencia mantiene artificialmente altas las tarifas.<\/p>\n<p style=\"text-align: justify;\">Eso refleja en parte el peque\u00f1o tama\u00f1o del mercado, pero tambi\u00e9n las normas que evitan que operadores con sede en el extranjero vuelen dentro de Chile sin establecer primero una filial en el pa\u00eds. Tal como est\u00e1 la normativa, sus aviones pierden horas en aeropuertos chilenos esperando para dejar el pa\u00eds, cuando podr\u00edan estar volando rutas de tramos cortos.<\/p>\n<p style=\"text-align: justify;\"><strong>Competencia Local<\/strong><\/p>\n<p style=\"text-align: justify;\">Como parte de la agenda procrecimiento de 50 puntos, que fue dada a conocer en mayo bajo el nombre de Impulso Competitivo, el presidente Sebasti\u00e1n Pi\u00f1era anunci\u00f3 que el Gobierno va a flexibilizar las normas de manera que los operadores extranjeros puedan transportar pasajeros y carga entre destinos al interior de Chile.<\/p>\n<p style=\"text-align: justify;\">M\u00e1s operadores significar\u00e1n m\u00e1s competencia y menores tarifas, seg\u00fan creen las autoridades. Otros puntos en el documento incluyen permitir que barcos con bandera extranjera transporten carga entre puertos chilenos y autorizar la operaci\u00f3n de intermediarios de carga para hacer que los procedimientos aduaneros sean m\u00e1s eficientes, todo con el objetivo de reducir costos y hacer que la econom\u00eda sea m\u00e1s competitiva.<\/p>\n<p style=\"text-align: justify;\">\u201cLas medidas abrir\u00e1n el tr\u00e1fico local y mejorar\u00e1n las posibilidades para que los usuarios disfruten m\u00e1s opciones de transporte a\u00e9reo\u201d, comenta a <strong>bUSiness CHILE<\/strong> Jaime Binder, secretario ejecutivo de la Junta de Aeron\u00e1utica Civil de Chile.<\/p>\n<p style=\"text-align: justify;\">A\u00fan no est\u00e1 claro c\u00f3mo se va a llevar esto a cabo. Las libertades en el aire se basan en docenas de acuerdos rec\u00edprocos multilaterales y bilaterales, de manera que flexibilizar las restricciones podr\u00eda tardar meses de complicadas negociaciones con diversas autoridades, se\u00f1ala una fuente de la industria. El derecho a trasladar pasajeros entre aeropuertos en un pa\u00eds extranjero, conocido en la industria como \u201coctava\u201d y \u201cnovena\u201d libertades, sigue siendo una rareza fuera de la Uni\u00f3n Europea. Lograr la reciprocidad en esa instancia podr\u00eda ser dif\u00edcil.<\/p>\n<p style=\"text-align: justify;\">No obstante, el Gobierno afirma que la implementaci\u00f3n de la pol\u00edtica implicar\u00e1 una serie de medidas que se est\u00e1n estudiando. \u201cEl objetivo es aplicarlas lo antes posible\u201d, afirma Binder.<\/p>\n<p style=\"text-align: justify;\">La industria global de aviaci\u00f3n recibi\u00f3 de buena manera la noticia, que no s\u00f3lo beneficiar\u00e1 a los pasajeros, sino que dar\u00e1 m\u00e1s libertad de movimiento a las aerol\u00edneas.<\/p>\n<p style=\"text-align: justify;\">\u201cDeber\u00eda autorizarse a las aerol\u00edneas para organizar sus negocios y competir como cualquier otra industria y no estar sujeta a normas arcaicas que restringen el acceso a los mercados\u201d, sostiene Concil de IATA.<\/p>\n<p style=\"text-align: justify;\">\u201cEste es un excelente paso hacia la integraci\u00f3n de las econom\u00edas de la regi\u00f3n, lo que llevar\u00e1 a la creaci\u00f3n de un mercado abierto de aviaci\u00f3n\u201d, a\u00f1ade.<\/p>\n<p style=\"text-align: justify;\">Pero a\u00fan queda por ver si el mercado de aviaci\u00f3n de Chile -peque\u00f1o, pero de r\u00e1pido crecimiento- puede atraer el inter\u00e9s de las aerol\u00edneas extranjeras.<\/p>\n<p style=\"text-align: justify;\">La buena noticia es que la cantidad de chilenos que est\u00e1n volando ha despegado. En los primeros cinco meses del a\u00f1o, el n\u00famero de pasajeros en rutas nacionales creci\u00f3 en un 27,6 por ciento a 2,9 millones. Las cifras se vieron impulsadas por el efecto del terremoto del a\u00f1o pasado, que mantuvo cerrados los aeropuertos de Santiago y de otras ciudades por varias semanas, pero la expectativa es que este a\u00f1o el mercado igualar\u00e1 el crecimiento total del 20 por ciento alcanzado en el 2010.<\/p>\n<p style=\"text-align: justify;\">Pese a ello, existe una considerable incertidumbre. Los precios del petr\u00f3leo han subido en el \u00faltimo a\u00f1o, lo que ha reducido los m\u00e1rgenes, mientras que las nubes de ceniza arrojadas durante semanas por el Complejo Volc\u00e1nico Puyehue &#8211; Cord\u00f3n Caulle en el sur de Chile, han causado estragos con los horarios de los vuelos en la regi\u00f3n.<\/p>\n<p style=\"text-align: justify;\">Con mayores econom\u00edas de escala y alianzas globales tras ellos los reci\u00e9n llegados podr\u00edan, en teor\u00eda, inyectar una mayor competencia al sector. \u201cCreemos que esto conducir\u00e1 a la entrega de servicios a\u00e9reos de calidad y a tarifas m\u00e1s convenientes para los usuarios\u201d, sostiene Binder.<\/p>\n<p style=\"text-align: justify;\">La visi\u00f3n no es compartida por los operadores m\u00e1s peque\u00f1os de Chile.<\/p>\n<p style=\"text-align: justify;\">\u201cNo digo que ser\u00e1 imposible competir en este ambiente, pero ser\u00e1 muy, muy dif\u00edcil\u201d, se lamenta Kenneth Welch, gerente general de PAL Airlines.<\/p>\n<p style=\"text-align: justify;\">En lugar de expandir el mercado, la propuesta del Gobierno har\u00eda que los operadores peque\u00f1os sean reemplazados o adquiridos por aerol\u00edneas extranjeras m\u00e1s grandes. En cambio, las autoridades deber\u00edan asegurar que las actuales normas dise\u00f1adas para posibilitar una competencia justa se apliquen correctamente, sostiene Welch.<\/p>\n<p style=\"text-align: justify;\"><strong>pLANeo dif\u00edcil<\/strong><\/p>\n<p style=\"text-align: justify;\">Pero el elefante (volador) en la plaza es LAN. La empresa ha dominado los cielos chilenos desde que fuera creada por el Estado hace m\u00e1s de 80 a\u00f1os. No obstante, realmente despeg\u00f3 cuando, despu\u00e9s de su privatizaci\u00f3n, adquiri\u00f3 al segundo mayor operador del pa\u00eds LADECO en 1997.<\/p>\n<p style=\"text-align: justify;\">Desde entonces la empresa ha ido de bien en mejor y raramente ha dado un paso en falso, expandi\u00e9ndose a lo largo de Am\u00e9rica del Sur y llevando la batuta en Chile. Durante los primeros cinco meses de este a\u00f1o, LAN y sus filiales trasladaron casi al 60 por ciento de los pasajeros en los vuelos internacionales y m\u00e1s del 75 por ciento en las rutas nacionales.<\/p>\n<p style=\"text-align: justify;\">La compa\u00f1\u00eda y sus partidarios atribuyen el \u00e9xito a una gesti\u00f3n inteligente. Cinco a\u00f1os atr\u00e1s encar\u00f3 el desaf\u00edo de los rivales de bajo costo reduciendo los lujos en los vuelos nacionales al tiempo que manten\u00eda los altos est\u00e1ndares en los vuelos internacionales, los que la convirtieron en una de las firmas preferidas desde Miami hasta Magallanes. La consultora brit\u00e1nica de aviaci\u00f3n StarTrax la ha calificado como la mejor aerol\u00ednea en Sudam\u00e9rica en 10 de los \u00faltimos 11 a\u00f1os.<\/p>\n<p style=\"text-align: justify;\">No todos comparten esta visi\u00f3n estelar. Las cr\u00edticas, incluidas las de grupos de consumidores y operadores rivales, se\u00f1alan que la firma ha sido capaz de crecer gracias a un control absoluto del mercado de aviaci\u00f3n de Chile. En otras partes, se ha encontrado a LAN empleando pr\u00e1cticas anticompetitivas: en noviembre pasado, fue una de las aerol\u00edneas multadas con casi US$2.000 millones por las autoridades de competencia de Estados Unidos y Europa por fijar sobretasas a los servicios de carga.<\/p>\n<p style=\"text-align: justify;\">Sin embargo, las acusaciones en Chile son contradictorias. Mientras los consumidores se quejan de que la firma mantiene artificialmente altas las tarifas, los rivales se\u00f1alan que vende los asientos por debajo del costo para mantenerlos a raya.<\/p>\n<p style=\"text-align: justify;\">Un estudio realizado a nombre de la Direcci\u00f3n de Aviaci\u00f3n Civil de Chile por la consultora con sede en Santiago SCL Econometrics concluy\u00f3 que hay poca evidencia de que LAN use su participaci\u00f3n de mercado para mantener altas las tarifas a\u00e9reas. En cambio, la amenaza de perder participaci\u00f3n de mercado significa que LAN debe mantener las tarifas bajas para disuadir a los potenciales reci\u00e9n llegados: lo que los economistas denominan un mercado de acceso irrestricto. Eso es una buena noticia para los pasajeros, pero no tan buena para los posibles rivales.<\/p>\n<p style=\"text-align: justify;\">Esta dura competencia puede explicar por qu\u00e9 ning\u00fan competidor de LAN ha durado mucho tiempo: National Airlines cerr\u00f3 en 1998, la peruana Aerocontinente dej\u00f3 de volar en el 2002, mientras que AeroComet se retir\u00f3 en el 2008.<\/p>\n<p style=\"text-align: justify;\">No obstante, PAL alega que LAN activamente intenta sacar a sus rivales del negocio. Cuando PAL comenz\u00f3 a volar desde Santiago a C\u00f3rdoba, Argentina, \u2013visto como un posible hito hacia otros destinos de Sudam\u00e9rica\u2013 r\u00e1pidamente entr\u00f3 en problemas. En cosa de semanas, LAN lanz\u00f3 una oferta dos por uno para el mismo destino, reduciendo sus tarifas de m\u00e1s de US$800 a un poco m\u00e1s de US$100. Sin poder igualar la ganga ofrecida por LAN, PAL se vio obligada a abandonar la ruta, momento en que las tarifas de LAN r\u00e1pidamente volvieron a su anterior nivel. PAL ahora llev\u00f3 a LAN al Tribunal de Defensa de la Libre Competencia de Chile, acusando a la firma de fijar precios predatorios.<\/p>\n<p style=\"text-align: justify;\">\u201cNo todos los resultados de LAN se deben al buen desempe\u00f1o gerencial&#8221;, afirma Welch.<\/p>\n<p style=\"text-align: justify;\">Las preocupaciones sobre LAN han alcanzado nuevas dimensiones con sus planes para fusionarse con el operador brasile\u00f1o TAM. El acuerdo, anunciado por primera vez en agosto del a\u00f1o pasado, dar\u00e1 origen a una de las diez mayores aerol\u00edneas del mundo.<\/p>\n<p style=\"text-align: justify;\">En marzo, la asociaci\u00f3n chilena de consumidores Corporaci\u00f3n Nacional de Consumidores y Usuarios de Chile (Conadecus) convenci\u00f3 a los jueces del Tribunal de Defensa de la Libre Competencia de estudiar las implicancias de la fusi\u00f3n a lo largo de la regi\u00f3n, no s\u00f3lo respecto de las rutas entre Chile y Brasil, como solicitaban los abogados de LAN.<\/p>\n<p style=\"text-align: justify;\">Las aerol\u00edneas rivales y las agencias de viajes comparten las preocupaciones de los consumidores, argumentando que el nuevo grupo -que operar\u00e1 bajo la marca LATAM\u2013 vendr\u00e1 a dominar los viajes a\u00e9reos no s\u00f3lo en sus dos pa\u00edses de origen, sino que tambi\u00e9n a lo largo de la regi\u00f3n. Tras una audiencia p\u00fablica celebrada en mayo, los jueces deben emitir un pronunciamiento sobre el caso a fines de julio.<\/p>\n<p style=\"text-align: justify;\">El anuncio del Gobierno de que planea eliminar las restricciones a los operadores extranjeros surgido en medio de este debate, ha generado sospechas. \u201cEl momento en que ocurre es curioso, por decir lo menos\u201d, afirma Welch.<\/p>\n<p style=\"text-align: justify;\">Pero abrir los cielos chilenos a\u00fan m\u00e1s a la competencia deber\u00eda significar rivales m\u00e1s fuertes que podr\u00edan desafiar el mercado de origen de LAN, ejerciendo presi\u00f3n sobre las tarifas y manteniendo la calidad. Y eso deber\u00eda convertir a los cielos en un lugar m\u00e1s amigable, al menos para los pasajeros.<\/p>\n<p style=\"text-align: justify;\"><strong>Tom Azzopardi<\/strong> trabaja como periodista freelance en Santiago<\/p>\n<p><!--:--><!--:en--><P style=\"TEXT-ALIGN: justify\">Want to get out of Chile? Then take your pick. More than 20 airlines regularly fly in and out of the country to a range of destinations in the Americas, Europe and Asia \u2013 a significant number for a country of Chile\u2019s size. That reflects growth in the number of Chileans flying and the country\u2019s liberal policies on opening its airspace to as many foreign operators as possible.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Chilean authorities have signed open skies agreements with 27 countries from France to Fiji, offering different degrees of freedom of movement to foreign carriers on a reciprocal basis. Last year, Chile\u2019s Civil Aviation Board (JAC) renegotiated an agreement with Brazil, a favorite with Chilean tourists, agreeing to remove restrictions on the number of slots each must offer carriers from the other country.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Chile\u2019s efforts to liberalize air travel have earned it international plaudits.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cChile has been a pioneer in open skies policy, driving change and encouraging other governments in Latin America to do the same,\u201d says Anthony Concil, director of corporate communications at the Geneva-based International Air Transport Association (IATA).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">These efforts, however, are not mirrored in the country\u2019s domestic market where just three Chilean companies dominate the sector \u2013 national carrier LAN, low-cost carrier Sky Airline and PAL Airlines, which has been operating scheduled flights for just two years.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The limited number of participants, particularly the dominance of LAN, leads to regular complaints about a lack of competition keeping fares artificially high.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">That partly reflects the market\u2019s small size but also rules preventing foreign-based carriers from flying within Chile without setting up a subsidiary here first. As it stands, their planes waste hours at Chilean airports waiting to leave the country, when they could be flying short-hop routes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Domestic competition<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">As part of the 50-point pro-growth agenda, Impulso Competitivo, unveiled last May, President Sebastian Pi\u00f1era announced that the government will relax rules so foreign operators can transport passengers and cargo between destinations inside Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">More operators will mean more competition and lower fares, the authorities believe. Other points in the document include allowing foreign flag ships to transport cargo between Chilean ports and authorizing the operation of cargo brokers to make customs procedures more efficient, all with the aim of cutting costs and making the economy more competitive.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThe measures will open up domestic traffic and improve the possibilities for users to enjoy more air transport options,\u201d Jaime Binder, executive secretary of Chile\u2019s Civil Aviation Board, told <STRONG>bUSiness CHILE<\/STRONG>.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">How this is to be done is unclear. Freedoms of the air are based on dozens of bilateral and multilateral reciprocal agreements, so relaxing restrictions could take months of complicated negotiations with multiple authorities, an industry source says. The right to carry passengers between airports in a foreign country, known in the industry as the \u201ceighth\u201d and \u201cninth\u201d freedoms, remains a rarity outside the EU. Persuading reciprocity in this instance could be difficult.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the government says implementing the policy will involve a series of measures which are being studied. \u201cThe aim is to apply them as soon as possible,\u201d says Binder.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The global aviation industry has welcomed the news, which will not only benefit passengers but give more freedom of movement to airlines.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cAirlines should be allowed to organize their businesses and compete like any other industry and not be subject to archaic rules that restrict access to markets,\u201d says IATA\u2019s Concil.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThis is an excellent step toward further integrating the region\u00b4s economies, leading to the creation of an open aviation market,\u201d he adds.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But whether Chile\u2019s small but rapidly expanding aviation market can attract the interest of foreign airlines has yet to be seen.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The good news is that the number of Chileans flying has taken off. In the first five months of the year, the number of passengers on domestic routes grew 27.6 percent to 2.9 million. Figures have been boosted by the impact of last year\u2019s earthquake which closed Santiago and other airports for several weeks, but the expectation is that this year the market will match the 20 percent overall growth seen in 2010.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But there is considerable uncertainty. Oil prices have risen over the last year, squeezing margins, while ash clouds spewing from the Puyehue-Cordon Caulle volcano in southern Chile have played havoc with schedules across the region for weeks.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">With larger economies of scale and global alliances behind them the newcomers could, in theory, inject greater competition into the sector. \u201cWe believe that this will lead to the provision of quality air services and more convenient fares for users,\u201d says Binder.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The view is not shared by Chile\u2019s smaller domestic carriers.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cI am not saying it will be impossible to compete in this environment but it will be very, very difficult,\u201d laments Kenneth Welch, CEO of PAL Airlines.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Rather than expanding the market, the government\u2019s proposal would lead to small operators being replaced or bought out by bigger foreign airlines. Instead, the authorities should ensure that existing rules designed to enable fair competition are properly enforced, Welch says.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Rough LANding<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the (flying) elephant in the room is LAN. The company has dominated Chilean skies since it was created by the state more than 80 years ago. But it really took off when, after privatization, it acquired the country\u2019s second largest carrier LADECO in 1997.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Since then it has gone from strength to strength with rarely a false move, expanding across South America and ruling the roost in Chile. During the five months of this year, LAN and its subsidiaries carried almost 60 percent of passengers on international flights and more than 75 percent on domestic routes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The company and its supporters put its success down to smart management. Five years ago it saw off a challenge from low-cost challengers by cutting frills on domestic flights while maintaining the high standards on international flights that make it a favorite from Miami to Magallanes. UK aviation consultancy StarTrax has named the company the best airline in South America for ten of the last 11 years.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Not everyone shares this starry view. Critics, including consumer groups and rival carriers, say the firm has been able to grow thanks to a vice-like grip on Chile\u2019s aviation market. Elsewhere, LAN has been caught employing anti-competitive practices: last November, it was one of a group of airlines fined almost US$2 billion by US and European competition authorities for fixing surcharges on cargo services.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the accusations in Chile are contradictory. While consumers complain the firm keeps fares artificially high, rivals say it sells seats below cost to keep them in check.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A study carried out on behalf of Chile\u2019s Civil Aviation Board by Santiago-based consultants SCL Econometrics found little evidence that LAN use its market share to keep airfares high. Rather the threat of losing market share means that LAN must keep fares low to dissuade potential newcomers \u2013 what economists call a contestable market. That\u2019s good news for passengers, but not so good for potential rivals.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">This tough competition may explain why none of LAN\u2019s rivals have lasted for long: National Airlines closed in 1998; Peru-owned Aerocontinente stopped flying in 2002, while AeroComet withdrew in 2008.<BR>\u00a0<BR>But PAL claims LAN actively tries to put its rivals out of business. When PAL began flying last year from Santiago to Cordoba, Argentina, \u2013 seen as a possible stepping stone to other destinations in South America \u2013 it soon ran into trouble. Within weeks, LAN launched a two-for-one offer for the same destination, slashing its fares from over US$800 to the equivalent of just over US$100. Unable to match LAN\u2019s bargain fare, PAL was forced to drop the route at which point LAN\u2019s fares quickly returned to their former level. PAL has now taken LAN to Chile\u2019s antitrust court, accusing the firm of predatory pricing.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNot all of LAN\u2019s results are due to good managerial performance,&#8221; says Welch.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Concerns about LAN have reached new heights with its plans to merge with Brazilian carrier TAM. The deal, first announced in August last year, would create one of the world\u2019s ten largest airlines.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">In March, the Chilean consumers\u2019 association CONADECUS persuaded judges at the antitrust court to study the implications of the merger across the region, not just on routes between Chile and Brazil, as LAN\u2019s lawyers urged.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Rival airlines and travel agencies share consumers\u2019 concerns, arguing that the new group \u2013 operating under the LATAM name \u2013 will come to dominate air travel not just in its two home countries but across the region. Following a public hearing in May, judges are due to pronounce on the case by the end of July.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The government\u2019s announcement in the middle of this debate that it plans to remove restrictions on foreign operators has drawn suspicion. \u201cThe timing is curious to say the least,\u201d says Welch.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But opening Chilean skies even further to competition should mean stronger rivals who could challenge LAN\u2019s home market, putting pressure on fares and keeping quality up.
