{"id":4562,"date":"2011-06-28T16:28:29","date_gmt":"2011-06-28T16:28:29","guid":{"rendered":""},"modified":"2015-03-17T17:53:33","modified_gmt":"2015-03-17T20:53:33","slug":"protegiendo-la-biodiversidad-de-chile","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/protegiendo-la-biodiversidad-de-chile\/","title":{"rendered":"<!--:es-->Protegiendo la Biodiversidad de Chile<!--:--><!--:en-->Protecting Chile\u2019s Biodiversity<!--:-->"},"content":{"rendered":"<p><!--:es--><P style=\"TEXT-ALIGN: justify\">El propuesto Servicio de Biodiversidad y \u00c1reas Silvestres Protegidas (SBAP) es el primer proyecto importante de legislaci\u00f3n ambiental del actual Gobierno desde que asumi\u00f3 el mando de la naci\u00f3n en marzo del 2010. Sin embargo, el proyecto de ley se ha encontrado con una ola de cr\u00edticas de organizaciones no gubernamentales (ONG), acad\u00e9micos y expertos en medio ambiente, quienes afirman que si bien el nuevo servicio es necesario, no cumple con la promesa que se hizo de integrar \u00e1reas protegidas p\u00fablicas y privadas al tiempo que tambi\u00e9n se protege la biodiversidad en el resto del territorio nacional.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Nadie cuestiona la necesidad de un servicio de este tipo. Cerca del 19 por ciento del territorio chileno, unos 16 millones de hect\u00e1reas, est\u00e1 protegido en parques y reservas por la Corporaci\u00f3n Nacional Forestal (CONAF), un porcentaje mucho m\u00e1s grande que en Estados Unidos o en la mayor parte de las naciones europeas. Pero CONAF est\u00e1 terriblemente desfinanciada y los expertos advierten que muchos ecosistemas est\u00e1n subrepresentadas o no est\u00e1n protegidos en lo absoluto. Adem\u00e1s, la funci\u00f3n de CONAF de promover el desarrollo forestal necesita separarse de sus dem\u00e1s deberes que incluyen el manejo de parques nacionales.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En el 2009, bajo el Gobierno de la ex presidenta Michelle Bachelet y en parte debido a las recomendaciones realizadas por la Organizaci\u00f3n para la Cooperaci\u00f3n y el Desarrollo Econ\u00f3micos (OEDE) durante el proceso de ingreso del pa\u00eds a esa entidad, Chile inici\u00f3 un proceso de fortalecimiento de su Ley sobre Bases Generales del Medio Ambiente de 1994. La reforma -que entr\u00f3 en vigencia a comienzos del 2010 justo antes del cambio de Gobierno- cre\u00f3 un Ministerio de Medio Ambiente, un nuevo servicio independiente para administrar la evaluaci\u00f3n ambiental de los nuevos proyectos e inst\u00f3 a la creaci\u00f3n de un Servicio de Biodiversidad y \u00c1reas Protegidas y de tribunales ambientales.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El presidente Pi\u00f1era tuvo mucho por hacer inmediatamente despu\u00e9s del terremoto en febrero del 2010 donde la reconstrucci\u00f3n era la principal prioridad del Gobierno, y los tribunales a\u00fan deben crearse, pero un proyecto de ley para formar el nuevo servicio de biodiversidad se elabor\u00f3 dentro del per\u00edodo de los 12 meses especificado por ley y fue presentado al Congreso en enero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_Barbara_Saavedra_CV_JUN_2011.jpg\" width=250 height=200>El proyecto ahora se someter\u00e1 a un debate que podr\u00eda prolongarse por a\u00f1os como la Ley del Bosque Nativo, que finalmente se aprob\u00f3 en el 2007 despu\u00e9s de 15 a\u00f1os de demoras y revisiones.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Hoy en d\u00eda, la responsabilidad por la conservaci\u00f3n en Chile es compartida entre diferentes entidades a cargo de, por ejemplo, \u00e1reas protegidas (CONAF), bosques nativos, pesquer\u00edas y agricultura. Dado que se supone que el nuevo servicio proteger\u00e1 la biodiversidad en todo el pa\u00eds, concentrar\u00e1 estas responsabilidades bajo una \u00fanica organizaci\u00f3n, lo que la convertir\u00e1 en mucho m\u00e1s que un servicio nacional de parques.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Acad\u00e9micos y ONG ambientales tienden a concordar en que el proyecto de ley es un paso positivo en t\u00e9rminos de consolidar la protecci\u00f3n de la biodiversidad. \u201cChile necesita un servicio que integre estas funciones y, en este sentido, el proyecto de ley es un gran avance para la protecci\u00f3n de la biodiversidad\u201d, sostiene B\u00e1rbara Saavedra, directora de la ONG Wildlife Conservation Society Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, el proyecto de ley se elabor\u00f3 en gran parte a puertas cerradas y sin consultar a las ONG o al sector privado. Esto es un gran problema, seg\u00fan Saavedra, debido a que en la forma en est\u00e1 escrito el nuevo servicio carece de la calidad t\u00e9cnica para ser una herramienta efectiva.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cSe ve bien en el papel, pero la ley es muy d\u00e9bil\u201d, indica.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Manejo de \u00c1reas Protegidas<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El proyecto de ley propone un acercamiento integrado al manejo de la biodiversidad que incluye \u00e1reas protegidas p\u00fablicas y privadas, pero Chile ya ha estado trabajando en un sistema para manejar \u00e1reas protegidas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En el 2009, la entonces ministra del Medio Ambiente, Ana Lya Uriarte, cre\u00f3 el proyecto Sistema Nacional de \u00c1reas Protegidas (SNAP), financiado por el Fondo para el Medio Ambiente Mundial del Programa de las Naciones Unidas para el Desarrollo (PNUD) como parte de la estrategia de biodiversidad del pa\u00eds para consolidar el manejo de \u00e1reas protegidas p\u00fablicas y privadas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, el proyecto SNAP no se integr\u00f3 durante la elaboraci\u00f3n de la ley, comenta Rafael Asenjo, ex director de la Comisi\u00f3n Nacional de Medio Ambiente (Conama) y ahora coordinador nacional del proyecto SNAP.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_Rafael_Asenjo_CVJUN2011.jpg\" width=250 height=200>En cambio, el nuevo servicio dise\u00f1ar\u00e1 un plan de manejo para cada \u00e1rea protegida, que debe ser aprobado por un Consejo Ministerial de Sustentabilidad, encabezado por el ministro del Medio Ambiente y que cuenta entre sus 11 miembros a los ministros de Energ\u00eda, Miner\u00eda y Agricultura.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El servicio dispondr\u00e1 l\u00edmites al desarrollo si bien no al nivel que algunos temen, afirma Leonel Sierralta, jefe de la Divisi\u00f3n de Recursos Naturales y Biodiversidad del Ministerio del Medio Ambiente.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cUna cosa es proteger y otra prohibir la actividad en una determinada \u00e1rea; para lo segundo se requiere una reforma constitucional\u201d, a\u00f1ade.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A\u00fan as\u00ed, sus cr\u00edticos afirman que la dependencia del servicio de otros ministerios debilita su capacidad para proteger la biodiversidad. \u201cEl director del servicio pr\u00e1cticamente no tiene facultades y eso es inusual para un servicio con un mandato tan fuerte\u201d, sostiene Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El riesgo radica en que el consejo podr\u00eda tomar decisiones basado en cuestiones pol\u00edticas m\u00e1s que en criterios ambientales, se\u00f1ala Juan Carlos Urquidi, abogado experto en temas ambientales y socio de SustentaRSE, firma de consultor\u00eda especializada en responsabilidad social empresarial y pol\u00edticas de sustentabilidad.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEl servicio puede trazar una l\u00ednea alrededor de tantos bosques y glaciares como quiera, pero el consejo tomar\u00e1 la decisi\u00f3n final\u201d, asevera.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El proyecto de ley tambi\u00e9n exige la creaci\u00f3n de un comit\u00e9 t\u00e9cnico compuesto por el director del servicio y representantes de los ministerios de Medio Ambiente, Bienes Nacionales y Agricultura, que podr\u00e1n hacer concesiones para el manejo de \u00e1reas protegidas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El proyecto de ley establece que se pueden adjudicar concesiones por \u201crazones de eficiencia de gesti\u00f3n en la conservaci\u00f3n\u201d, lo que deja abierta la posibilidad de que la administraci\u00f3n de parques nacionales usados para promover la imagen de Chile en el extranjero, tales como Torres del Paine, puedan ser administrados en virtud de concesiones de operaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNo se puede decir simplemente que se van a entregar concesiones, hay que ser mucho m\u00e1s espec\u00edfico\u201d, indica Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El proyecto de ley es igualmente impreciso respecto de la caza y pesca dentro de \u00e1reas protegidas. La pesca de captura y la acuicultura, por ejemplo, no est\u00e1n permitidas en \u00e1reas protegidas p\u00fablicas, pero s\u00ed lo est\u00e1n en \u00e1reas privadas. La caza, por otro lado, est\u00e1 prohibida en \u00e1reas protegidas a menos que sea autorizada por el plan de manejo, lo que equivale a decir, que la caza podr\u00eda permitirse en cualquier \u00e1rea protegida del pa\u00eds.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Cambio en las Reglas<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La actual legislaci\u00f3n de Chile permite el desarrollo de actividades econ\u00f3micas en cualquier parte del territorio dependiendo de la aprobaci\u00f3n ambiental, pero el nuevo servicio podr\u00eda proponer \u00e1reas adicionales a ser protegidas o bien que se modifiquen los objetivos de manejo de \u00e1reas protegidas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cM\u00e1s del 20 por ciento del territorio nacional est\u00e1 protegido en la actualidad, pero esta \u00e1rea podr\u00eda estar sujeta a estrictas restricciones para el desarrollo productivo si esta ley se aprueba\u201d, manifest\u00f3 Susana Jim\u00e9nez, analista econ\u00f3mica del instituto de estudios con sede en Santiago Libertad y Desarrollo, en un documento p\u00fablico dado a conocer en marzo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ENG_Leonel_Sierralta_CV_JUN_2011.jpg\" width=250 height=200>\u201cEsto significar\u00eda un cambio importante en las reglas del juego\u201d, continu\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Pero las ONG tampoco est\u00e1n contentas. Seg\u00fan el coordinador de campa\u00f1a de Greenpeace Chile, Samuel Leiva, el proyecto de ley no hace lo suficiente para impedir que el desarrollo llegue a las \u00e1reas protegidas. \u201c\u00bfQu\u00e9 tipo de desarrollo puede llevarse a cabo en un glaciar, un bosque petrificado o una zona ind\u00edgena?\u201d, pregunta.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Cerca de la mitad de la actual \u00e1rea protegida de Chile est\u00e1 cubierta por glaciares o tierras con limitado potencial de inversi\u00f3n, pero expandir el tama\u00f1o del \u00e1rea podr\u00eda amenazar la inversi\u00f3n y afectar adversamente a la econom\u00eda, se\u00f1ala Jaime Dinamarca, gerente de medio ambiente de la Sociedad de Fomento de la Producci\u00f3n de Chile (SOFOFA).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A juicio de Dinamarca, el servicio podr\u00eda terminar protegiendo el 40 por ciento del territorio de Chile. \u201cSi eso ocurre y no hay posibilidad de trabajar en \u00e1reas protegidas, habremos clausurado efectivamente casi la mitad del pa\u00eds\u201d, se\u00f1ala.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los desarrolladores de proyectos como la central termoel\u00e9ctrica a carb\u00f3n Barrancones, que fue suspendida despu\u00e9s de que el presidente Pi\u00f1era interviniera en el 2010, o el proyecto hidroel\u00e9ctrico HidroAys\u00e9n en la Patagonia de repente podr\u00edan darse cuenta de que el terreno que hab\u00edan previsto desarrollar ahora est\u00e1 protegido o sujeto a criterios ambientales diferentes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Pero Asenjo afirma que es improbable que el servicio recomiende una expansi\u00f3n mayor de \u00e1reas protegidas, porque cada \u00e1rea debe ser aprobada por el Consejo de Sustentabilidad caso a caso.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Asimismo el consejo debe establecer un plan de manejo para los parques privados. En la actualidad, la protecci\u00f3n de los parques privados, tales como el Parque Pumal\u00edn del empresario estadounidense Douglas Tompkins en la Patagonia, b\u00e1sicamente no est\u00e1 regulada, pero el nuevo servicio podr\u00e1 inspeccionarlos para asegurarse de que las actividades de conservaci\u00f3n cumplen con el plan de manejo del \u00e1rea.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, Saavedra hace \u00e9nfasis en la necesidad de establecer un sistema nacional de \u00e1reas protegidas que integre los esfuerzos de conservaci\u00f3n p\u00fablicos y privados tanto de terrenos como de \u00e1reas marinas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Desaf\u00edos de Conservaci\u00f3n<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Pero, pese a los problemas con la forma en que se manejar\u00e1n las \u00e1reas protegidas bajo el nuevo servicio, este no es el mayor problema con el proyecto de ley. El proyecto adem\u00e1s aspira a proteger la biodiversidad fuera de \u00e1reas protegidas, lo que abre una Caja de Pandora de temas regulatorios sin mencionar el surgimiento de conflictos de inter\u00e9s con otros ministerios como el de Agricultura, Miner\u00eda y Energ\u00eda.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_Juan_carlos_Urquidi_CV_JUN2011.jpg\" width=250 height=200>\u201cHay una necesidad urgente de una decisi\u00f3n sobre c\u00f3mo manejar las \u00e1reas protegidas, pero proteger la biodiversidad fuera de estas \u00e1reas es un tema extremadamente complejo que involucra a muchas partes interesadas diferentes\u201d, sostiene Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El proyecto de ley incluye una lista de herramientas que involucran un inventario nacional de especies, un plan para proteger especies en peligro y un plan para recuperar ecosistemas da\u00f1ados y controlar o erradicar especies extranjeras da\u00f1inas. El servicio tambi\u00e9n ser\u00eda responsable, en alianza con otras agencias tales como el Servicio Nacional de Aduanas, de imponer multas. Todos estos son buenos objetivos, pero el proyecto no explica c\u00f3mo se lograr\u00e1n o financiar\u00e1n, comenta Saavedra de Wildlife Conservation Society.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEl desaf\u00edo m\u00e1s importante de un pa\u00eds como Chile es c\u00f3mo fortalecer la conservaci\u00f3n en \u00e1reas fuera de los parques nacionales y las reservas, pero la ley no aborda este tema de manera adecuada\u201d, indica.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El nuevo servicio requerir\u00e1 un presupuesto mucho mayor que el de CONAF para llevar a cabo sus muchas resposabilidades, pero el presupuesto no est\u00e1 establecido en el proyecto de ley y no est\u00e1 claro si el Gobierno, a trav\u00e9s del Ministerio de Hacienda, est\u00e1 dispuesto a pagar por \u00e9l, comenta Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Financiar iniciativas de conservaci\u00f3n puede ser costoso, pero el servicio tambi\u00e9n podr\u00e1 recibir fondos de otras fuentes. El proyecto de ley exige la creaci\u00f3n de un Fondo Nacional de Biodiversidad y \u00c1reas Silvestres Protegidas, administrado por el servicio, el que recibir\u00e1 financiamiento del Gobierno, organizaciones internacionales y personas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El fondo, que financiar\u00e1 proyectos relacionados con la investigaci\u00f3n de la biodiversidad y la educaci\u00f3n en Chile, es \u201cuna idea innovadora y poderosa\u201d que crea la posibilidad de nuevos mecanismos de financiamiento para las iniciativas de conservaci\u00f3n, afirma Saavedra. No obstante, su administraci\u00f3n deber\u00eda ser independiente de la del servicio y deber\u00eda incluir un fideicomiso para proyectos de largo plazo que van m\u00e1s all\u00e1 de objetivos pol\u00edticos de corto plazo, a\u00f1ade.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_Jaime_dinamarca_CVJUN2011.jpg\" width=250 height=200>Chile no es el \u00fanico pa\u00eds en proteger la biodiversidad a nivel nacional. Otros pa\u00edses con una rica biodiversidad, de los cuales Nueva Zelanda es el m\u00e1s destacado, han creado un departamento de conservaci\u00f3n para proteger el territorio nacional, pero esto s\u00f3lo ha sido posible tras una decisi\u00f3n del gobierno respecto de los objetivos de desarrollo y conservaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Seg\u00fan Asenjo, esta decisi\u00f3n ha sido postergada por sucesivos gobiernos en Chile y, como resultado, los objetivos de conservaci\u00f3n del nuevo servicio deben ser establecidos caso a caso y podr\u00edan terminar enfrent\u00e1ndose a los objetivos de otros ministerios como el Ministerio de Econom\u00eda, que est\u00e1 a cargo de promover el crecimiento econ\u00f3mico.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Proteger la biodiversidad es importante para el crecimiento sustentable de la econom\u00eda de Chile incluidas sus minas, bosques y pesquer\u00edas, pero c\u00f3mo hacer eso de una manera que equilibre las necesidades de desarrollo con la conservaci\u00f3n es una cuesti\u00f3n complicada.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Desafortunadamente, cuando se trata de proteger la biodiversidad las buenas intenciones no bastan. Con tanto en juego, Chile se merece un servicio de biodiversidad digno de su nombre.<\/P><!--:--><!--:en--><P style=\"TEXT-ALIGN: justify\">The proposed Biodiversity and Protected Areas Service is the government\u2019s first major piece of environmental legislation since it took office in March 2010. But the bill has met with a barrage of criticism from NGOs, academics and environmental experts who say that while the new service is necessary, it fails to live up to its promise of integrating the management of public and private protected areas while also protecting biodiversity in the rest of the country.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No one questions the need for such a service. Around 19 percent of Chile\u2019s territory \u2013 some 16 million hectares &#8211; is protected in parks and reserves by the national forestry service (CONAF), a far greater percentage than in the U.S. or most European nations. But CONAF is woefully underfunded and experts warn many ecosystems are underrepresented or not protected at all. In addition, CONAF\u2019s function of promoting forestry development needs to be separated from its other duties that include guarding national parks and erecting fences.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">In 2009, under the government of former President Michelle Bachelet and partly due to recommendations made by the OECD during its accession process, Chile began a process of strengthening its 1994 environmental framework law. The reform, which came into force in early 2010 just before the change in government, created an Environment Ministry, a new independent service to manage the environmental evaluation of new projects, and called for the creation of a Biodiversity and Protected Areas Service as well as environmental courts.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">President Pi\u00f1era had a lot on his plate immediately after the earthquake in February 2010 with reconstruction the government\u2019s main priority and the courts have yet to be created, but a bill to create the new biodiversity service was drafted within the 12-month period specified by law and presented to Congress in January.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_Barbara_Saavedra_CV_JUN_2011.jpg\" width=250 height=200>The bill will now be subject to a debate that could drag on for years like the Native Forests Law, which was finally passed in 2007 after 15 years of delays and revisions.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Today, the responsibility for conservation in Chile is shared by different state entities in charge of, for example, protected areas (CONAF), native forests, fisheries and agriculture. Since the new service is supposed to protect biodiversity in the whole country, it will concentrate these responsibilities under one organization, making it much more than a national parks service.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Environmental NGOs and academics tend to agree that the bill is a positive step in terms of consolidating biodiversity protection. \u201cChile needs a service that integrates these functions and in this sense the bill is a great advance for biodiversity protection,\u201d said B\u00e1rbara Saavedra, the director of the NGO Wildlife Conservation Society Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the bill was drafted largely behind closed doors and without consulting NGOs or the private sector. This is a big problem, according to Saavedra, because as it is written the new service lacks the technical quality to be an effective tool.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cIt looks good on paper but the law is very weak,\u201d she said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Managing protected areas<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The bill proposes an integrated approach to biodiversity management that includes public and private protected areas, but Chile has already been working on a system to manage protected areas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">In 2009, then-Environment Minister Ana Lya Uriarte created the National System of Protected Areas (SNAP) project, funded by the United Nations Development Program\u2019s Global Environmental Facility (GEF), as part of the country\u2019s biodiversity strategy to consolidate the management of public and private protected areas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the SNAP project was not integrated during the drafting of the law, said Rafael Asenjo, a former director of environmental authority Conama and now the national coordinator for the SNAP project.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_Rafael_Asenjo_CVJUN2011.jpg\" width=250 height=200>Instead, the new service will design a management plan for each protected area, which must be approved by an 11-member Ministerial Sustainability Council headed by the environment minister with the ministers of energy, mining and agriculture amongst others.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The service will place limits on development though not to the degree feared by some, said Leonel Sierralta, head of the Natural Resources and Biodiversity Division in the Environment Ministry.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cIt\u2019s one thing to protect and another to prohibit activity in a certain area, for the second a constitutional reform is required,\u201d he said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Even so, its critics say that the service\u2019s dependence on other ministries weakens its ability to protect biodiversity. \u201cThe service\u2019s director is virtually powerless and that\u2019s unusual for a service with such a strong mandate,\u201d said Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The risk is that the Council could make decisions based on political rather than environmental criteria, said Juan Carlos Urquidi, an environmental lawyer and partner at SustentaRSE, a consulting firm specialized in corporate social responsibility and sustainability policies.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThe service can draw a line around as many forests and glaciers as it chooses but the Council will make the final decision,\u201d he said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The bill also calls for the creation of a Technical Committee composed of the service\u2019s director and representatives of the environment, economy, national heritage and agriculture ministries, which will be able to award concessions for the management of protected areas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The bill states that concessions could be awarded for \u201creasons of conservation management efficiency\u201d, leaving open the possibility that the administration of national parks used to promote Chile\u2019s image abroad, such as Torres del Paine, could be privatized.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cYou can\u2019t just say you are going to give away concessions, you have to be much more specific,\u201d said Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The bill is similarly imprecise about fishing and hunting within protected areas. Capture fishing and aquaculture, for example, are not permitted in public protected areas, but they are in private areas. Hunting, on the other hand, is prohibited in protected areas unless it is allowed by the management plan, which is to say that hunting could be allowed in any protected area in the country.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Changing the rules<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Chile\u2019s existing law allows for the development of economic activities in any part of the territory subject to environmental approval, but the new service would be able to propose that additional areas be protected or that the management objectives of protected areas be changed.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cMore than 20 percent of the national territory is currently protected, but this area could be subject to strict restrictions for productive development if this law is approved,\u201d wrote Susana Jim\u00e9nez, an economic analyst at the Santiago think-tank Libertad y Desarrollo, in a public document published in March.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThis would mean an important change in the rules of the game,\u201d she continued.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_Leonel_Sierralta_CV_JUN_2011.jpg\" width=250 height=200>But NGOs are not happy either. According to Greenpeace Chile\u2019s campaign coordinator Samuel Leiva, the bill does not go far enough in making protected areas off limits to development. \u201cWhat sort of development can take place on a glacier, a petrified forest, or an indigenous area?\u201d he asks.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">About half of Chile\u2019s existing protected area is covered in glaciers or lands with limited investment potential, but expanding the size of the area could threaten investment and adversely impact the economy, said Jaime Dinamarca, head of environmental affairs at Chile\u2019s manufacturers\u2019 association (SOFOFA).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">According to Dinamarca, the service could end up protecting 40 percent of Chile\u2019s territory. \u201cIf that happens, and there is no chance at working in protected areas, we will have effectively chained off nearly half of the country,\u201d he said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Developers of projects like the Barrancones coal-fired project, which was suspended after President Pi\u00f1era intervened in 2010, or the HidroAys\u00e9n hydroelectric project in Patagonia could suddenly find that land they had planned to develop is now protected or subject to different environmental criteria.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But Asenjo says the service is unlikely to recommend a major expansion of protected areas because each new area must be approved by the Sustainability Council on a case-by-case basis.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The Council must also establish a management plan for private parks. Currently, the protection of private parks, such as U.S. businessman Douglas Tompkins\u2019 Pumal\u00edn Park in Patagonia, is basically unregulated, but the new service will be able to inspect them to make sure that conservation activities comply with the area\u2019s management plan.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">However, Saavedra emphasizes the need to establish a national system of protected areas that integrates public and private conservation efforts on land and in marine areas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Conservation challenges<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But, despite the problems with the way protected areas will be managed under the new service, this is not the biggest problem with the draft law. The project also aims to protect biodiversity outside protected areas, which opens a Pandora\u2019s Box of regulatory issues not to mention running into possible conflicts of interest with other ministries such as agriculture, mining and energy.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_Juan_carlos_Urquidi_CV_JUN2011.jpg\" width=250 height=200>\u201cThere is an urgent need for a decision about how to manage protected areas, but protecting biodiversity outside these areas is an extremely complex issue that involves many different stakeholders,\u201d said Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The bill includes a list of tools including a national inventory of species, a plan to protect endangered species, and a plan for recovering damaged ecosystems and controlling or eradicating harmful foreign species. The service would also be responsible, in partnership with other agencies such as the national customs service, for levying fines. These are all good objectives, but the bill does not explain how they will be achieved or funded, said the Wildlife Conservation Society\u2019s Saavedra.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThe most important challenge for a country like Chile is how to strengthen conservation in areas outside national parks and reserves, but the law doesn\u2019t address this adequately,\u201d she said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The new service will require a much higher budget than CONAF to carry out its many responsibilities, but the budget is not stated in the bill and it is not clear if the government, through the Finance Ministry, is willing to pay for it, said Asenjo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Financing conservation initiatives can be costly, but the service will also be able to receive funds from other sources. The bill calls for the creation of a National Biodiversity and Protected Areas Fund, administered by the service, which will receive funding from the government, international organizations and individuals.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The Fund, which will finance projects related to biodiversity research and education in Chile, is \u201can innovative and powerful idea\u201d that creates the possibility of new financing mechanisms for conservation efforts, said Saavedra. However, its administration should be separate from the service and should include a trust fund for long-term projects that are beyond short-term political aims, she added.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_Jaime_dinamarca_CVJUN2011.jpg\" width=250 height=200>Chile is not the only country to protect biodiversity at a national level. Other countries with rich biodiversity, most notably New Zealand, have created a conservation department to protect the national territory, but this has only been possible after a decision by the government regarding conservation and development objectives.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">According to Asenjo, this decision has been postponed by successive governments in Chile and, as a result, the conservation aims of the new service must be established case by case and could end up clashing with the aims of other ministries like the economy ministry, which is charged with promoting economic growth.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Protecting biodiversity is important for the sustainable growth of Chile\u2019s economy including its mines, forests and fisheries, but how to do that in a way that balances the needs of development with conservation is a complicated question.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Unfortunately, when it comes to protecting biodiversity good intentions are not nearly good enough.
