{"id":4560,"date":"2011-06-28T15:26:57","date_gmt":"2011-06-28T15:26:57","guid":{"rendered":""},"modified":"2015-03-17T17:54:18","modified_gmt":"2015-03-17T20:54:18","slug":"mejorando-la-supervision-del-sector-financiero","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/mejorando-la-supervision-del-sector-financiero\/","title":{"rendered":"<!--:es-->Mejorando la Supervisi\u00f3n del Sector Financiero<!--:--><!--:en-->Upgrading Financial Supervision<!--:-->"},"content":{"rendered":"<p><!--:es--><P style=\"TEXT-ALIGN: justify\">Chile sobrevivi\u00f3 a la crisis financiera global mejor que muchos pa\u00edses: sin ninguna quiebra bancaria importante y con una r\u00e1pida recuperaci\u00f3n de los mercados. Ayud\u00f3 que Chile no tuviera instrumentos respaldados por hipotecas o hipotecas subprime, los que provocaron el colapso de los mercados financieros de Estados Unidos, pero el principal motivo para el escape fue el s\u00f3lido manejo de las autoridades durante la crisis junto con un sistema bancario bien capitalizado.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La estabilidad del sector bancario chileno se debe, en gran parte, a la privatizaci\u00f3n del sistema de pensiones de Chile hace 30 a\u00f1os -las administradoras de fondos de pensiones, o AFP, hoy en d\u00eda manejan cerca de US$157.000 millones en activos, o casi el 70 por ciento del PIB de Chile- as\u00ed como tambi\u00e9n a un s\u00f3lido modelo regulatorio desarrollado despu\u00e9s de una crisis bancaria registrada a principios de la d\u00e9cada de los 80.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, mientras los gobiernos alrededor del mundo -incluidos los de Estados Unidos y Gran Breta\u00f1a- intentan mejorar la fiscalizaci\u00f3n financiera y salvaguardar sus econom\u00edas en contra de futuras debacles bancarias, Chile tambi\u00e9n ha aprovechado la oportunidad para fortalecer la supervisi\u00f3n de su sistema financiero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En agosto del 2010, el Ministerio de Hacienda cre\u00f3 una comisi\u00f3n encabezada por Jorge Desormeaux, consultor del sector bancario y ex vicepresidente del Banco Central de Chile, para evaluar el marco de supervisi\u00f3n y regulaci\u00f3n del sector financiero del pa\u00eds.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El informe de la comisi\u00f3n, presentada al Ministerio de Hacienda en marzo, recomienda una serie de reformas. \u201cLa verdad es que si no actualizamos nuestras regulaciones financieras, la pr\u00f3xima crisis financiera nos encontrar\u00e1 mal preparados\u201d, dijo Desormeaux a <STRONG>bUSiness CHILE<\/STRONG>.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El informe establece que los reguladores en Chile son incapaces de supervisar de manera efectiva las operaciones de conglomerados, lo que hace que el sistema financiero sea vulnerable a futuras crisis o shocks, tales como una abrupta ca\u00edda de los precios del cobre.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Incluso antes de la crisis, en el 2004, el Programa de Evaluaci\u00f3n del Sector Financiero (PESF) del Fondo Monetario Internacional recomendaba consolidar la fiscalizaci\u00f3n del sistema financiero de Chile para que se adaptara mejor a fin de satisfacer \u201clas necesidades de un sistema financiero crecientemente integrado y complejo\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los servicios financieros en Chile actualmente son regulados por diferentes instituciones de acuerdo al tipo de servicio. La Superintendencia de Bancos e Instituciones Financieras (SBIF) y el Banco Central est\u00e1n a cargo de la banca, la Superintendencia de Valores y Seguros (SVS) fiscaliza el mercado de acciones y seguros, y la Superintendencia de Pensiones (SP) supervisa tanto el sistema de pensiones como el seguro de desempleo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Esto significa que los conglomerados que incluyen bancos, compa\u00f1\u00edas de seguros y administradoras de fondos de pensiones podr\u00edan, en teor\u00eda, desarrollar actividades de alto riesgo en \u00e1reas en que las regulaciones son las m\u00e1s d\u00e9biles. Esta situaci\u00f3n tambi\u00e9n contribuy\u00f3 al colapso del sistema bancario de Estados Unidos, debido a que la negociaci\u00f3n de instrumentos derivados riesgosos se concentr\u00f3 en la industria de seguros.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Este peligro fue destacado por la Organizaci\u00f3n para la Cooperaci\u00f3n y el Desarrollo Econ\u00f3mico (OCDE) en su informe de 2011 Mejores pol\u00edticas para el desarrollo: Perspectivas OCDE sobre Chile: \u201cLos riesgos no detectados en partes de un grupo alcanzan niveles en los que se pone en peligro la estabilidad de importantes instituciones financieras\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Fiscalizaci\u00f3n Financiera<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La propuesta de la comisi\u00f3n para fortalecer el sistema se basa en un modelo Twin Peaks [sic] o de regulaci\u00f3n por objetivos que divide las funciones de supervisi\u00f3n entre un regulador, concentrado en la conducta del mercado y la protecci\u00f3n del consumidor, y otro concentrado en la solvencia y las pr\u00e1cticas de gesti\u00f3n de riesgo de las instituciones financieras.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Desormeaux insiste en que este modelo, que se ha adoptado en Australia y Holanda, es la mejor manera de regular a los conglomerados financieros en Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_JORGE_DESORMEAUX_SECON_JUN2011.jpg\" width=250 height=200>\u201cLa crisis demostr\u00f3 que no basta con estar atentos a cada \u00e1rbol&nbsp; individual, hay que ver al bosque como un todo\u201d, afirm\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El nuevo regulador de conducta del mercado adem\u00e1s entregar\u00e1 una mejor protecci\u00f3n a los consumidores, lo que es importante dado que las pr\u00e1cticas crediticias de algunas instituciones y emisores de tarjetas de cr\u00e9dito no bancarias \u00faltimamente han puesto en duda los est\u00e1ndares de protecci\u00f3n al consumidor, sostuvo Desormeaux<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Este regulador tambi\u00e9n ser\u00e1 m\u00e1s independiente que el propuesto defensor del consumidor financiero, conocido como Sernac Financiero, cuyo presidente ser\u00eda designado por el ministro de Hacienda, a\u00f1adi\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los dos reguladores, y una tercera entidad a cargo de las pensiones, ser\u00edan fiscalizadas por el Consejo de Estabilidad Financiera (CEF) dise\u00f1ado para detectar potenciales problemas en el sistema, mitigar riesgos y recomendar pol\u00edticas que contribuyan a la estabilidad macroecon\u00f3mica.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El consejo tendr\u00e1 un rol similar al del Consejo de Fiscalizaci\u00f3n de la Estabilidad Financiera de Estados Unidos creado por la ley Dodd\u2013Frank en el 2010, el que fue dise\u00f1ado para coordinar a diferentes reguladores y asegurar la estabilidad general del sistema financiero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Encabezado por el ministro de Hacienda, el consejo incluir\u00e1 al presidente del Banco Central y a los titulares de los tres nuevos reguladores. Una diferencia con el Consejo de Fiscalizaci\u00f3n estadounidense es que tendr\u00e1 cinco miembros en lugar de diez, lo que seg\u00fan se\u00f1ala Desormeaux le permitir\u00e1 responder m\u00e1s r\u00e1pidamente a futuras crisis en coordinaci\u00f3n con el Banco Central de Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El ministro Larra\u00edn anunci\u00f3 en abril que este consejo se crear\u00e1 como la primera etapa de la reforma: \u201cLas funciones de un consejo de este tipo son, en parte, intentar prevenir las crisis, tener \u2018luces amarillas\u2019 que se prendan y que permitan adoptar acciones antes de que ocurra una crisis. Y si se presenta una crisis internacional que no podemos evitar, intentar mitigar su propagaci\u00f3n a la econom\u00eda local\u201d, sostuvo el personero de gobierno en una conferencia de prensa.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La segunda etapa de la reforma ser\u00e1 fortalecer a los reguladores chilenos existentes mediante la adopci\u00f3n de las propuestas hechas por la comisi\u00f3n respecto del gobierno corporativo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Gobierno Corporativo<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Otra potencial debilidad del sistema financiero de Chile radica en que los reguladores son todos encabezados por personas designadas por el presidente, quien -b\u00e1sicamente- puede sacarlos de sus cargos en cualquier momento sin una raz\u00f3n particular.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En realidad, esto no pasa a menudo. Los actuales titulares de la SVS, SBIF y SP se han mantenido en sus cargos desde su designaci\u00f3n en marzo del 2010.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLos datos de los \u00faltimos 30 a\u00f1os muestran que las superintendencias han sido dirigidas por profesionales altamente calificados, quienes -en promedio- han permanecido en sus cargos por un largo per\u00edodo de tiempo\u201d, sostiene Jorge Awad, el nuevo presidente de la Asociaci\u00f3n de Bancos e Instituciones Financieras de Chile (ABIF).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, el sistema a\u00fan es vulnerable. \u201cNo ofrece garant\u00edas de objetividad para aquellas entidades sujetas a regulaciones y multas\u201d, indic\u00f3 Desormeaux.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_mario_farren_SECON_JUN2011.jpg\" width=250 height=200>Otra consecuencia negativa de la percibida falta de independencia de los reguladores es que no se les han otorgado las facultades para reformar las regulaciones del mercado. De hecho, deben esperar que el Congreso apruebe nuevas legislaciones, lo que significa que son muy lentos para reaccionar ante nuevos acontecimientos en los mercados de capital.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Dada la velocidad con que cambia el sistema financiero, esto podr\u00eda ser fatal, asever\u00f3 Desormeaux. \u201cPero nadie va a dar facultades para elaborar legislaciones a reguladores que no son independientes\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Para resolver este problema cada uno de los nuevos reguladores ser\u00e1 encabezado por cinco directores nominados por el presidente y aprobados por mayor\u00eda en el Senado. Adicionalmente, los directores s\u00f3lo pueden ser removidos de sus cargos por decisi\u00f3n un\u00e1nime de los dem\u00e1s miembros del directorio o mediante una resoluci\u00f3n de la Corte Suprema.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El gobierno pretende presentar un proyecto de ley al Congreso en los pr\u00f3ximos meses que incluya modificaciones al gobierno corporativo de los reguladores financieros de Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Mario Farren, gerente de la divisi\u00f3n de banca corporativa e inversiones de Banco de Chile, recibe con benepl\u00e1cito la propuesta de la comisi\u00f3n de dar mayor independencia a los reguladores.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Un nuevo regulador a cargo de supervisar las entidades que emiten cr\u00e9ditos, incluidas las tiendas minoristas, ayudar\u00e1 a las autoridades a actuar m\u00e1s r\u00e1pidamente si surgen problemas, asevera Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El reciente anuncio realizado por la cadena chilena de tiendas por departamentos La Polar en cuanto a que tendr\u00e1 que realizar mayores provisiones por p\u00e9rdidas debido a pr\u00e1cticas crediticias poco ortodoxas es un ejemplo de los problemas que se pueden producir cuando las empresas minoristas emplean criterios crediticios diferentes a los del sector bancario, destac\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, pese a sus buenas intenciones, Farren afirma que las reformas no abordan la necesidad subyacente de una modernizaci\u00f3n de la regulaci\u00f3n de los mercados de capital de Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Modernizar los Mercados de Capital<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los esfuerzos de sucesivos gobiernos han hecho que Chile est\u00e9 m\u00e1s integrado con los mercados internacionales de capital, pero los bancos chilenos a\u00fan enfrentan barreras para recaudar capital en el extranjero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El impuesto de estampillas y retenciones que se aplica a las emisiones de bonos en el extranjero, por ejemplo, aumenta los costos para los bancos chilenos en 30 a 50 puntos base, indica Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNo es eficiente en t\u00e9rminos de costos, pero si el campo de juego se nivelara y los bancos pudieran financiarse en el extranjero, el mercado ser\u00eda m\u00e1s competitivo\u201d, sostiene.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Y no se trata s\u00f3lo de reducir impuestos. El \u201cneteo\u201d -operaci\u00f3n mediante la cual los bancos y las instituciones financieras que se prestan dinero s\u00f3lo pagan su deuda neta\u2013 es una pr\u00e1ctica com\u00fan en los pa\u00edses desarrollados, pero no se da en Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cProducto de ello, cuando un banco extranjero trata con un banco chileno usan una l\u00ednea de cr\u00e9dito mucho m\u00e1s grande\u201d, explica Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Regulaciones m\u00e1s estrictas aumentan los costos fijos de los bancos, lo que afecta a los emprendedores y los inversionistas al tiempo que hacen m\u00e1s dif\u00edcil que las instituciones peque\u00f1as compitan, pero las autoridades se han resistido a desregular los mercados de capital debido a los temores de evasi\u00f3n tributaria y una mayor apreciaci\u00f3n del peso, dice Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La Agenda Mercado de Capitales del Bicentenario (MKB) apunta mejorar el acceso al cr\u00e9dito para las personas y las empresas, pero tambi\u00e9n incluye una propuesta para regular los instrumentos derivados y la adopci\u00f3n de buenas pr\u00e1cticas en materia de competencia, supervisi\u00f3n y transparencia.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, una supervisi\u00f3n m\u00e1s atenta no tiene que ser un impedimento para el crecimiento econ\u00f3mico y consolidar la fiscalizaci\u00f3n financiera deber\u00eda hacer que Chile est\u00e9 mejor preparado para futuras crisis. Cuando se trata de reparar lo que aflige al sistema financiero, una onza de prevenci\u00f3n es mejor que una libra de remedio.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Julian Dowling<\/STRONG> es editor de <STRONG>bUSiness CHILE<\/STRONG><\/P><br \/>\n<P>&nbsp;<\/P><br \/>\n<P>&nbsp;<\/P><!--:--><!--:en--><P style=\"TEXT-ALIGN: justify\">Chile survived the global financial crisis better than many countries with no major banking failures and a swift recovery in markets. It helped that Chile had no mortgage-backed securities or subprime mortgages, which were the downfall of the US financial markets, but the main reason for the escape was the solid management by the authorities during the crisis combined with a well-capitalized banking system.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The stability of Chile\u2019s banking sector is thanks, in large part, to the privatization of the country\u2019s pension system 30 years ago &#8211; pension fund managers, or AFPs, today manage around US$157 billion in assets, or almost 70 percent of Chile\u2019s GDP \u2013 as well as a solid regulatory model developed after a banking crisis in the early 1980s.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But as governments around the world including in the United States and Britain look to improve financial oversight and safeguard their economies against future banking meltdowns, Chile has also taken the opportunity to strengthen the supervision of its financial system.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">In August 2010, Finance Minister Felipe Larra\u00edn created a commission headed by Jorge Desormeaux, a banking industry consultant and former vice-president of the Central Bank, to evaluate the country\u2019s financial supervision and regulatory framework.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The commission\u2019s report, submitted to the Finance Ministry in March, recommends a series of reforms. \u201cThe truth is that if we don\u2019t upgrade our financial regulations, the next financial crisis will find us unprepared,\u201d Desormeaux told bUSiness CHILE.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The report states that Chile\u2019s regulators are unable to effectively supervise the operations of conglomerates, which makes the financial system vulnerable to future crises or shocks, such as a sudden drop in the copper price.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Even before the crisis, in 2004, the IMF\u2019s Financial Services Assessment Program (FSAP) recommended consolidating oversight of Chile\u2019s financial system to better adapt to \u201cmeet the needs of an increasingly integrated and complex financial system.\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Financial services in Chile are currently regulated by different institutions according to the type of service. The Superintendencia de Bancos e Instituciones Financieras (SBIF) and the Central Bank are in charge of banking, the Superintendencia de Valores y Seguros (SV) is in charge of securities and insurance, and the Superintendencia de Pensiones (SP) supervises the pension system and unemployment insurance.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">This means conglomerates including banks, insurance firms and pension fund administrators could, in theory, develop high risk activities in areas where regulations are weakest. This situation also contributed to the collapse of the US banking system, as risky derivatives trading was concentrated in the insurance industry.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The danger was noted by the Organisation for Economic Co-operation and Development (OECD) in its 2011 Chile report Maintaining Momentum: \u201cThe undetected build-up of risks in parts of a group can reach levels at which the stability of important financial institutions may be endangered.\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Financial oversight<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The commission\u2019s proposal to strengthen financial supervision is based on a Twin Peaks model that divides regulatory functions between one regulator, focused on market conduct and consumer protection, and another focused on the solvency and risk-management practices of financial institutions.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Desormeaux insists that this model, which has been adopted by Australia and the Netherlands, is the best way to regulate conglomerates in Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/_INGJORGE_DESORMEAUX_SECON_JUN2011.jpg\" width=250 height=200>\u201cThe crisis showed that it\u2019s not good enough to keep an eye on the individual trees, you have to see the forest as a whole,\u201d he said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The new market conduct regulator would also provide better protection for consumers, which is important given that the credit practices of some institutions and non-bank credit card issuers have recently called consumer protection standards into doubt, said Desormeaux.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">This regulator would also have more independence than the government\u2019s proposed consumer financial watchdog, known as the Sernac Financiero, which would have a president appointed by the Finance Minister, he added.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The twin regulators, and a third entity in charge of pensions, would be overseen by a Financial Stability Council (CEF by its Spanish initials) designed to spot potential problems in the system, mitigate risks and recommend policies that contribute to macroeconomic stability.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The Council will serve a similar role to the US Financial Stability Oversight Council created by the Dodd\u2013Frank Act in 2010, which is designed to coordinate between regulators and ensure the overall stability of the financial system.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Headed by the Finance Minister, the Council will include the president of the Central Bank and the heads of the three new regulators. One difference with the Oversight Council is that it will have five members as opposed to ten, which Desormeaux said will allow it to respond more quickly to future crises in coordination with the Central Bank.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Minister Larra\u00edn announced in April that this Council will be created as the first stage of the reform: \u201cThe functions of this type of council are, in part, to prevent crises by flashing warning lights that allow actions to be taken before a crisis occurs, and if one does occur, which we can\u2019t prevent, to try to mitigate its impact on the economy,\u201d he said in a press conference.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The second stage of the reform will be to strengthen Chile\u2019s existing regulators by adopting the commission\u2019s proposals regarding corporate governance.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Corporate governance<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Another potential weakness of Chile\u2019s financial system is that the regulators are all led by individuals appointed by the President who, crucially, may also remove them at any time without giving a reason.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">In reality, this does not happen often. The current heads of the SVS, SBIF, and SP have all remained in their jobs since being appointed in March 2010.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cThe data from the last 30 years shows that the Superintendencias have been led by highly qualified professionals who, on average, have remained in their position for a long period of time,\u201d said Jorge Awad, the new president of Chile\u2019s banking association, ABIF.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But the system is still vulnerable. \u201cIt doesn\u2019t offer guarantees of objectivity to those entities subject to regulations and penalties,\u201d said Desormeaux.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ING_mario_farren_SECON_JUN2011.jpg\" width=250 height=200>Another negative consequence of the regulators\u2019 perceived lack of independence is that they have not been given the power to reform market regulations. Instead, they must wait for Congress to approve new laws, which means they are slow to react to new developments in capital markets.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Given the speed of change in the financial system, this could be lethal, said Desormeaux. \u201cBut no one will give lawmaking powers to regulators that are not independent.\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">To solve this problem the new regulators would each be led by a board of five directors nominated by the President and approved by a Senate majority. In addition, they could only be removed by unanimous decision of the other directors or by a Supreme Court ruling.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The government plans to submit a bill to Congress in the next few months that will include changes to the corporate governance of Chile\u2019s financial regulators.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Mario Farren, head of corporate and investment banking at Banco de Chile, welcomes the commission\u2019s proposal to make regulators more independent.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A new regulator in charge of supervising credit-issuing entities, including retail stores, would also help the authorities to act more swiftly if problems arise, said Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The recent announcement by Chilean department store chain La Polar of increased loss provisions due to dodgy lending practices is an example of the problems that can occur when retail companies use different credit criteria than the banking sector, he noted.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But, despite the commission\u2019s good intentions, Farren argued that the reforms do not address the underlying need for a modernization of Chile\u2019s capital markets regulation.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Modernizing capital markets<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Efforts by successive governments have made Chile more integrated with global capital markets, but local banks still face barriers to raising capital abroad.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The stamp and withholding taxes on offshore bond issues, for example, increases costs for Chilean banks by 30 to 50 basis points, said Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cIt\u2019s not cost efficient, but if the playing field was level and banks could fund themselves abroad, it would make the market more competitive,\u201d he said.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">And it\u2019s not just about reducing taxes. \u201cNetting\u201d \u2013 whereby banks and financial institutions that loan to each other only pay their net debt \u2013 is common practice in developed countries but does not occur in Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cAs a result, when a foreign bank deals with a Chilean bank they use a much bigger credit line,\u201d said Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Stricter regulations increase fixed costs for banks, which hurts entrepreneurs and investors while also making it harder for small institutions to compete, but the authorities have resisted deregulating capital markets due to concerns about tax evasion and further appreciation of the peso, said Farren.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">The Bicentennial Capital Markets Reform Agenda (MKB) aims to improve access to credit for individuals and businesses, but it also includes a proposal to regulate derivatives and the adoption of best practices on competition, supervision and transparency.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">But closer supervision does not have to be an impediment to economic growth and consolidating financial oversight should make Chile better prepared for future crises.
