El 30 de noviembre, AmCham celebr\u00f3 una conferencia con el fin de presentar un documento preparado por The Economist Intelligence Unit y auspiciado por Microsoft, denominado Informe de la Propiedad Intelectual en Chile. AmCham adem\u00e1s anunci\u00f3 la publicaci\u00f3n del segundo documento su serie de estudios t\u00e9cnicos dedicado a esta tem\u00e1tica -“La Propiedad Intelectual y el TLC con los Estados Unidos”, elaborado con la participaci\u00f3n de destacados expertos en este tema.<\/P>

Maximiliano Santa Cruz, director del Instituto Nacional de la Propiedad Intelectual (INAPI) de Chile, hizo una presentaci\u00f3n en la conferencia junto con George Lever, gerente de estudios de la C\u00e1mara de Comercio de Santiago.<\/P>

El presidente de AmCham, Ricardo Garc\u00eda, destac\u00f3 la importancia de este tema para la C\u00e1mara, no s\u00f3lo en t\u00e9rminos de cumplir con la legislaci\u00f3n existente, sino tambi\u00e9n como un instrumento para promover la innovaci\u00f3n y el emprendimiento en Chile: dos \u00e1reas que el gobierno est\u00e1 tratando de fortalecer y en las que Estados Unidos tiene mucha experiencia que puede beneficiar a Chile.<\/P>

Seg\u00fan el informe de The Economist, la buena noticia es que la tasa de pirater\u00eda de software comercial en Chile est\u00e1 bajando. Sin embargo, la mala noticia es que dicha tasa cay\u00f3 del 66% en el 2007 a un 64% en el 2009, nivel que a\u00fan es muy alto. Si bien Chile ha mejorado en materia de protecci\u00f3n a los derechos de propiedad intelectual este a\u00f1o mediante la aprobaci\u00f3n de una nueva ley, el cumplimiento de sus obligaciones internacionales sigue siendo poco estricto, en especial en t\u00e9rminos de pirater\u00eda y protecci\u00f3n de patentes.<\/P>

The Economist destac\u00f3 adem\u00e1s que pese a que la inversi\u00f3n de Chile en investigaci\u00f3n y desarrollo est\u00e1 cerca del promedio en la regi\u00f3n, a\u00fan es baja en comparaci\u00f3n con los pa\u00edses desarrollados de la Organizaci\u00f3n para la Cooperaci\u00f3n y el Desarrollo Econ\u00f3micos (OCDE). El porcentaje de inversi\u00f3n por parte de empresas privadas en investigaci\u00f3n y desarrollo es especialmente bajo -s\u00f3lo un 0,4% del total- y el resto es proporcionado por el gobierno y las universidades.<\/P>

En el \u00cdndice Internacional de los Derechos de Propiedad (IPRI, por su sigla en ingl\u00e9s) 2010, Chile ocup\u00f3 el lugar n\u00famero 34 entre 125 pa\u00edses y en t\u00e9rminos de propiedad intelectual espec\u00edficamente ocup\u00f3 el lugar n\u00famero 49. En la regi\u00f3n, Chile clasific\u00f3 cuarto entre los 22 pa\u00edses latinoamericanos.<\/P>
On November 30, AmCham held a seminar to introduce a report prepared by The Economist Intelligence Unit, and sponsored by Microsoft, called Intellectual Property in Chile. AmCham also announced the publication of its second report in a series of reports on this subject – Intellectual Property and the FTA with the United States \u2013 written with the participation of experts in this material.<\/P>

AmCham\u2019s president, Ricardo Garc\u00eda, highlighted the importance of this issue for the Chamber, not just in terms of complying with existing legislation, but also as an instrument to promote innovation and entrepreneurship in Chile \u2013 two areas the government is working to strengthen and in which the United States has a lot of experience that can benefit Chile.<\/P>

According to the Economist report, the good news is that the rate of software piracy in Chile is dropping. But the bad news is that the rate has fallen from 66% in 2007 to 64% in 2009, which is still very high. Although Chile has improved protection for intellectual property rights this year by passing a new law, compliance with its international obligations remains lax, especially in terms of piracy and patent protection.<\/P>

The Economist also noted that while Chile\u2019s investment in research and development is close to the average in the region, it is still low compared to developed countries in the OECD. The percentage of investment by private companies in R&D is especially low \u2013 just 0.4% of the total – with the rest provided by government and universities.<\/P>
