{"id":4402,"date":"2010-10-21T16:59:14","date_gmt":"2010-10-21T16:59:14","guid":{"rendered":""},"modified":"2015-03-12T11:00:15","modified_gmt":"2015-03-12T14:00:15","slug":"reglas-claras-para-la-inversion-energetica","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/reglas-claras-para-la-inversion-energetica\/","title":{"rendered":"<!--:es-->Reglas Claras para la Inversi\u00f3n Energ\u00e9tica <!--:--><!--:en-->Clear Rules for Energy Investment<!--:-->"},"content":{"rendered":"<p><!--:es--><P style=\"TEXT-ALIGN: justify\">Mover un proyecto termoel\u00e9ctrico de mil millones de d\u00f3lares no es s\u00f3lo cuesti\u00f3n de mover unos pocos generadores. Por cada sitio deben realizarse costosos estudios de ingenier\u00eda e impacto ambiental que pueden demorar a\u00f1os en concluirse, de modo que construir un proyecto en un emplazamiento distinto significa rehacer la mayor parte de esto desde cero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Esta es la alternativa indeseable que enfrenta la firma el\u00e9ctrica franco-belga GDF Suez, despu\u00e9s de recibir una llamadas del Presidente Sebasti\u00e1n Pi\u00f1era inform\u00e1ndole que la empresa ya no podr\u00eda construir su proyecto de generaci\u00f3n el\u00e9ctrica a carb\u00f3n de 540 megavatios en Barrancones, cerca de la ciudad nortina de Coquimbo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La administraci\u00f3n de GDF Suez, que invirti\u00f3 US$ 15 millones en el proyecto Barrancones, se vio sorprendida por la decisi\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEstamos estudiando qu\u00e9 hacer porque un proyecto de estas caracter\u00edsticas no se puede mover tan f\u00e1cilmente\u201d, se\u00f1ala Peter Hatton, gerente de desarrollo de negocios de GDF Suez Energy Andino.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">S\u00f3lo unos d\u00edas antes de la llamada del Presidente Pi\u00f1era, el proyecto de GDF Suez fue aprobado por la Comisi\u00f3n Regional de Medio Ambiente (Corema) de la Regi\u00f3n de Coquimbo, por 15 votos a favor y 4 en contra. El Presidente Pi\u00f1era incluso estuvo de acuerdo en que el proyecto cumpl\u00eda con todos los est\u00e1ndares medioambientales aplicables. Entonces, \u00bfcu\u00e1l fue el problema?<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los proyectos termoel\u00e9ctricos son un tema pol\u00edticamente delicado debido a su impacto sobre la poblaci\u00f3n local, la contaminaci\u00f3n del aire y la vida silvestre. El Presidente Pi\u00f1era prometi\u00f3 en su campa\u00f1a electoral oponerse a proyectos que amenazaran las reservas naturales y las ONG ambientalistas que se opon\u00edan a Barrancones insistieron para que la cumpliera.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En teor\u00eda, Barrancones habr\u00eda estado suficientemente lejos -a 25km- como para que la reserva natural Punta de Choros no hubiera tenido un impacto ambiental significativo y GDF Suez hizo todo seg\u00fan lo reglamentario.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cQueremos dejar en claro que el proyecto cumpli\u00f3 con todas las normas ambientales y las regulaciones incluidos los est\u00e1ndares del Banco Mundial y de la Uni\u00f3n Europea\u201d, sostiene Hatton. \u201cEl proyecto nunca puso en peligro el \u00e1rea protegida.\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El problema es que los proyectos a carb\u00f3n no se pueden construir simplemente en cualquier lado. \u201cNo es f\u00e1cil encontrar sitios para ese tipo de proyectos, porque necesitan instalaciones portuarias\u201d, se\u00f1ala Hatton.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Se\u00f1ales Confusas<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Si el proyecto Barrancones se cancela, lo que parece probable, GDF Suez perder\u00e1 su inversi\u00f3n, pero el costo real podr\u00eda ser pagado por los consumidores chilenos a trav\u00e9s de precios m\u00e1s altos de la energ\u00eda.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLa actitud del Presidente puso en espera a todos los proyectos a carb\u00f3n en el pa\u00eds debido a que no actu\u00f3 a trav\u00e9s de los canales legales apropiados\u201d, afirma Jaime Solari, gerente general de la firma de consultor\u00eda ambiental Sociedad de Gesti\u00f3n Ambiental (SGA).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los inversionistas est\u00e1n recibiendo \u201cse\u00f1ales confusas\u201d de La Moneda, afirma. \u201cSi un proyecto recibe todas las aprobaciones necesarias, entonces \u00bfcu\u00e1l es la raz\u00f3n para rechazarlo? Los inversionistas no pueden entender esto\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">GDF Suez acept\u00f3 la decisi\u00f3n del Presidente Pi\u00f1era, pero por ley la Comisi\u00f3n Nacional de Medio Ambiente (Conama) a\u00fan tiene que explicar su decisi\u00f3n, lo que podr\u00eda sentar un interesante precedente, se\u00f1ala Solari.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cA\u00fan no hemos visto el final de esto, estamos esperando a ver c\u00f3mo va a ser justificado por el gobierno\u201d, comenta.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, seg\u00fan Mat\u00edas Mori, vicepresidente ejecutivo del Comit\u00e9 de Inversiones Extranjeras del Gobierno, la reputaci\u00f3n de Chile como un lugar seguro donde invertir no se ha visto afectada.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEl tema de Barrancones hay que ponerlo en perspectiva: es un caso excepcional en que el Presidente se comunic\u00f3 con el inversionista, el que decidi\u00f3 de manera voluntaria echar pie atr\u00e1s con la planta\u201d, explica Mori.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La reputaci\u00f3n de Chile como una econom\u00eda estable con s\u00f3lidas instituciones ciertamente cuenta a su favor. La mayor\u00eda de su infraestructura de energ\u00eda, telecomunicaciones, transporte y miner\u00eda ha sido construida por inversionistas extranjeros, que se vieron atra\u00eddos por la legislaci\u00f3n pro empresa del pa\u00eds.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">De acuerdo con los rankings internacionales, Chile ocupa el segundo lugar -s\u00f3lo despu\u00e9s de Brasil- en t\u00e9rminos de inversi\u00f3n extranjera directa en Am\u00e9rica Latina. \u201cSi uno ve el tama\u00f1o del mercado brasile\u00f1o, y lo compara con Chile, se da cuenta de que eso no es un antecedente menor\u201d, afirma Mori.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Hay espacio para mejorar, admite, pero la incorporaci\u00f3n de Chile como miembro de la OCDE este a\u00f1o es una se\u00f1al de que el pa\u00eds est\u00e1 listo para unirse al escalaf\u00f3n de los pa\u00edses desarrollados.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cChile es un pa\u00eds que se caracteriza por ser una naci\u00f3n seria, con reglas claras, que cuenta con una certeza jur\u00eddica a toda prueba y donde se pueden hacer negocios en un ambiente legal seguro y confiable\u201d, dice Mori.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Su visi\u00f3n de que Barrancones es simplemente un obst\u00e1culo en el camino es compartida por Osvaldo Rosales, experto en comercio de la Comisi\u00f3n Econ\u00f3mica para Am\u00e9rica Latina y el Caribe (Cepal) de la Organizaci\u00f3n de Naciones Unidas, cuya sede se encuentra en Santiago. \u201cHemos escuchado ciertas preocupaciones de los inversionistas, pero un incidente no hace una tendencia\u201d, sostiene Rosales.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Seguridad Energ\u00e9tica en Riesgo<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, GDF Suez no es el primer inversionista del sector de energ\u00eda que se ha visto enfrentado a problemas legales. A mediados del 2009, AES Gener se vio obligado a suspender la construcci\u00f3n de su proyecto termoel\u00e9ctrico a carb\u00f3n Campiche cerca de Valpara\u00edso durante 12 meses, luego que las autoridades locales le quitaran el respaldo, alegando que el proyecto carec\u00eda de un permiso municipal.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">M\u00e1s recientemente, una corte de apelaciones de la norte\u00f1a ciudad de Copiap\u00f3 fall\u00f3 en contra del proyecto termoel\u00e9ctrico Castilla, avaluado en US$ 4.700 millones y propiedad de la firma brasile\u00f1a MPX Energ\u00eda. El proyecto ser\u00eda cuatro veces m\u00e1s grande que Barrancones una vez que se construya. MPX Energ\u00eda pretende apelar la decisi\u00f3n, pero el proyecto enfrenta una batalla cuesta arriba para obtener la aprobaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No son s\u00f3lo los proyectos a carb\u00f3n los que est\u00e1n en duda. La Comisi\u00f3n Nacional de Energ\u00eda de Chile (CNE) recientemente indic\u00f3 que el proyecto hidroel\u00e9ctrico HidroAys\u00e9n de 2.750MW en el sur de Chile, que ha sido el objetivo de la campa\u00f1a ambiental internacional \u201cPatagonia Sin Represas\u201d, no comenzar\u00e1 sus operaciones hasta el 2019, tres a\u00f1os despu\u00e9s de lo anticipado.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Chile necesita al menos 300MW de nueva capacidad por a\u00f1o para satisfacer sus crecientes necesidades de electricidad y para asegurar que se una a la lista de pa\u00edses desarrollados en la pr\u00f3xima d\u00e9cada, sin embargo, podr\u00eda no tener suficiente energ\u00eda. \u00bfC\u00f3mo ocurri\u00f3 esto?<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Seg\u00fan Solari, Chile se est\u00e1 quedando sin opciones de energ\u00eda. \u201cSi no queremos termoel\u00e9ctricas a carb\u00f3n, centrales hidroel\u00e9ctricas o plantas nucleares, entonces \u00bfde d\u00f3nde provendr\u00e1 nuestra energ\u00eda?\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La generaci\u00f3n a carb\u00f3n ha convertido a Chile en el mayor emisor de di\u00f3xido de carbono (CO2) de Am\u00e9rica Latina y sus emisiones se cuadruplicar\u00e1n para el 2030, pero en lugar de obligar a las actuales centrales termoel\u00e9ctricas a carb\u00f3n a reducir las emisiones, la ley obliga a los inversionistas a construir nuevas plantas en \u00e1reas de zonas v\u00edrgenes alejadas de las ciudades.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNecesitamos instalaciones a carb\u00f3n nuevas que son mucho m\u00e1s limpias que las antiguas, pero la legislaci\u00f3n s\u00f3lo beneficia las plantas existentes\u201d, comenta un ejecutivo de una firma encargada del desarrollo de un proyecto termoel\u00e9ctrico.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La mayor\u00eda de los potenciales sitios para plantas a carb\u00f3n a lo largo de la costa de Chile est\u00e1n saturados de contaminaci\u00f3n del aire al punto que firmas como GDF Suez se ven obligadas a considerar \u00e1reas aisladas y delicadas desde el punto de vista ecol\u00f3gico, afirma. \u201cLa \u00fanica soluci\u00f3n para los inversionistas es construir en una zona pr\u00edstina\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, construir proyectos en, o cerca de, \u00e1reas protegidas puede traer como resultado el tipo de oposici\u00f3n ambiental que llev\u00f3 a la decisi\u00f3n del Presidente Pi\u00f1era de \u201cmover\u201d Barrancones.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La reciente legislaci\u00f3n en la Uni\u00f3n Europea exige que las centrales a carb\u00f3n existentes paralicen sus operaciones o instalen filtros con el fin de reducir sus emisiones para el 2023. Una legislaci\u00f3n similar en Chile reducir\u00eda la contaminaci\u00f3n y permitir\u00eda que se construyeran nuevas plantas m\u00e1s cerca de centros urbanos, indica el ejecutivo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Legislaci\u00f3n ambiental<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La legislaci\u00f3n ambiental original de Chile data de 1994 cuando se cre\u00f3 la Conama para establecer normas y aprobar nuevos proyectos.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La legislaci\u00f3n ayud\u00f3 a mejorar los est\u00e1ndares ambientales, pero ten\u00eda profundas deficiencias, comenta Ignacio Arteaga, abogado que encabeza la Pr\u00e1ctica de Derecho Ambiental y Regulatorio de Arteaga Gorziglia &amp; Compa\u00f1\u00eda, firma de abogados con sede en Santiago.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLa legislaci\u00f3n original estaba llena de vac\u00edos y contradicciones, que dejaron el proceso de aprobaciones abierto a la interpretaci\u00f3n\u201d, indica Arteaga. \u201cProyectos con malas experiencias como Barrancones y Campiche son el resultado de esta legislaci\u00f3n antigua\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En virtud de este sistema, Conama ten\u00eda que tomar decisiones pol\u00edticas mientras que al mismo tiempo evaluaba nuevos proyectos, lo que llev\u00f3 a que hubiera interferencia pol\u00edtica.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La nueva legislaci\u00f3n, aprobada en enero de 2010, separa estas funciones. Cre\u00f3 un nuevo Ministerio de Medio Ambiente, un nuevo regulador nacional y un nuevo sistema de evaluaci\u00f3n de proyectos, conocido como Servicio de Evaluaci\u00f3n Ambiental (SEA), el que reemplaz\u00f3 a la Conama desde el 1 de octubre.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los temas tanto de regulaci\u00f3n como de pol\u00edtica ambiental ahora ser\u00e1n decididos por el Ministerio del Medio Ambiente, mientras que el SEA ser\u00e1 responsable exclusivamente del proceso de aprobaci\u00f3n ambiental.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La nueva legislaci\u00f3n tambi\u00e9n contempla la creaci\u00f3n de un Servicio de Biodiversidad y \u00c1reas Protegidas con el fin de definir y resguardar reservas naturales, afirma Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, a\u00fan est\u00e1 pendiente una revisi\u00f3n de las regulaciones de uso de suelo de Chile. La confusi\u00f3n sobre \u00e1reas verdes, en particular fuera de las zonas urbanas, ha llevado a que se interpongan recursos legales en contra de algunos proyectos tales como Campiche.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cHay un problema en Chile con la planificaci\u00f3n de suelo, no tenemos una pol\u00edtica para los usos de \u00e1reas rurales\u201d, sostiene Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No son s\u00f3lo las inversiones en el sector de energ\u00eda las que se han visto afectadas producto de ello. Una propuesta planta de procesamiento de cerdo en Casablanca, valle de producci\u00f3n vin\u00edcola cerca de Santiago, fue aprobada recientemente por la Conama, pero las vi\u00f1as locales alegan que el proyecto da\u00f1ar\u00eda su negocio y est\u00e1n apelando la decisi\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Parte del problema, argumenta Arteaga, ha sido la influencia de grupos de inter\u00e9s especial en el proceso de aprobaci\u00f3n. No obstante, la nueva legislaci\u00f3n, que considera la creaci\u00f3n de tribunales ambientales especiales, deber\u00eda hacer que el proceso sea m\u00e1s independiente.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNecesitamos reducir (el uso de) la discreci\u00f3n mediante el establecimiento de normas claras para que las autoridades las sigan\u201c, asevera<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Respetando la Ley <\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, las empresas tambi\u00e9n tienen algo de responsabilidad por la confusi\u00f3n en el proceso de aprobaci\u00f3n ambiental, afirma Sara Larra\u00edn, directora ejecutiva de la ONG Chile Sustentable.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLas propias empresas generaron esta incertidumbre al presionar al Gobierno para que les permitiera construir sus proyectos en \u00e1reas protegidas\u201d, destaca.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El Presidente Pi\u00f1era ha contribuido a la incertidumbre legal al intervenir en el proyecto Barrancones en el \u00faltimo momento, pero esto era necesario para proteger la reserva natural Punta de Choros, afirma Larra\u00edn.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La ley en s\u00ed no es el problema, sino m\u00e1s bien la presi\u00f3n de las empresas privadas para hacer que las autoridades interpreten las normas de manera que puedan construir sus proyectos donde los costos son m\u00e1s bajos, argumenta Larra\u00edn.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cHay un doble est\u00e1ndar operando porque las empresas no respetan el marco legal\u201d, a\u00f1ade. \u201cHan escondido los costos reales bajo la alfombra de modo que la sociedad pague por ellos en el largo plazo a trav\u00e9s de la contaminaci\u00f3n\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los inversionistas extranjeros en el sector de energ\u00eda en Chile niegan estas afirmaciones, se\u00f1alando que respetan las leyes de Chile tal como obedecen las leyes de cualquier pa\u00eds donde deciden invertir.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Pero cumplir con la ley es insuficiente para asegurar que un proyecto no enfrentar\u00e1 oposici\u00f3n. Invertir en un plan ambiental estrat\u00e9gico que involucre a la comunidad local desde el comienzo de un proyecto podr\u00eda ayudar a evitar problemas legales a futuro, afirma Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLas empresas tienen que mejorar la forma en que negocian con las comunidades en Chile, pero nos faltan expertos en este tipo de negociaciones\u201d, asevera Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La firma de Arteaga, por ejemplo, trabaja con C3 International Consultants, consultora con sede en M\u00e9xico que se especializa en negociaciones comunitarias, pero prev\u00e9 que la demanda de este tipo de servicios aumentar\u00e1 a medida que las compa\u00f1\u00edas se den cuenta del valor de lograr un consenso con las comunidades locales.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Tal consenso puede ayudar a las empresas a protegerse de la oposici\u00f3n ambiental, argumenta Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Algunas empresas, como Endesa, ya est\u00e1n haciendo avances en esta \u00e1rea. \u201cHidroAys\u00e9n es un buen ejemplo de c\u00f3mo las compa\u00f1\u00edas deber\u00edan relacionarse con las comunidades locales\u201d, indica Arteaga.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>El Costo de la Energ\u00eda Limpia<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Finalmente, el tema se reduce a cu\u00e1nto est\u00e1 dispuesto a pagar Chile por la energ\u00eda y a qu\u00e9 costo para el medio ambiente.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La legislaci\u00f3n chilena promulgada en el 2008 exige que las generadoras aumenten de manera gradual la generaci\u00f3n de fuentes de energ\u00eda renovable no convencional para llegar al 10% de su generaci\u00f3n en el 2020, pero no hay subsidios en Chile como los que hay en Europa.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cYa sea a trav\u00e9s de impuestos o de cuentas de electricidad m\u00e1s altas, los consumidores tendr\u00e1n que pagar de su bolsillo por la energ\u00eda renovable\u201d, se\u00f1ala un ejecutivo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El viento sopla fuerte en algunas zonas de Chile y el sol brilla durante todo el a\u00f1o, pero los expertos afirman que la energ\u00eda e\u00f3lica y la solar es demasiado ineficiente e impredecible para satisfacer las necesidades base de carga del pa\u00eds.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Construir una granja e\u00f3lica cuesta casi lo mismo que una central a carb\u00f3n, o cerca de US$ 2 millones por MW, pero los molinos de viento operan a una tasa de eficiencia de casi el 30% versus el 90% de una central a carb\u00f3n y deben contar con el respaldo de fuentes alternativas del sistema interconectado.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Eso deja la energ\u00eda a carb\u00f3n, gas natural licuado, nuclear o hidroel\u00e9ctrica. No obstante, los inversionistas extranjeros tienen otras opciones cuando deciden d\u00f3nde poner su dinero y la seguridad legal pesa fuertemente en estas decisiones.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Para dar garant\u00edas a los inversionistas, el gobierno deber\u00eda crear una pol\u00edtica energ\u00e9tica clara que facilite la inversi\u00f3n, pero las empresas tambi\u00e9n deben aceptar que los est\u00e1ndares ambientales en Chile ser\u00e1n tan altos como los de Estados Unidos, Canad\u00e1 o Europa.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Seg\u00fan Arteaga, \u201clo que se necesita es un sentido de bien com\u00fan\u201d. Esto es que los sectores p\u00fablico y privado trabajen en conjunto en los intereses de largo plazo de todos los chilenos.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Julian Dowling<\/STRONG> es editor de <STRONG>bUSiness CHILE<\/STRONG><\/P><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">Moving a billion dollar thermoelectric project is not just a matter of moving a few generators. Costly engineering and environmental studies that can take years to complete must be done for each site, so building a project in a different location means redoing most of these from scratch.<\/p>\n<p style=\"text-align: justify;\">This is the undesirable alternative facing the Franco-Belgian utility GDF Suez after receiving a call from President Sebastian Pi\u00f1era informing the company it could no longer build its 540 megawatt coal-fired generation project in Barrancones, near the northern city of Coquimbo.<\/p>\n<p style=\"text-align: justify;\">GDF Suez\u2019s management, which has invested US$15 million in the Barrancones project, was surprised by the decision.<\/p>\n<p style=\"text-align: justify;\">\u201cWe are studying what to do because a project of these characteristics cannot be moved so easily,\u201d said Peter Hatton, Business Developer Manager of GDF Suez Energy Andino.<\/p>\n<p style=\"text-align: justify;\">Just a few days before President Pi\u00f1era\u2019s call, GDF Suez\u2019s project was approved by Coquimbo\u2019s Regional Commission for the Environment (COREMA), which voted 15-4 in favor. President Pi\u00f1era even agreed the project met all applicable environmental standards. So what was the problem?<\/p>\n<p style=\"text-align: justify;\">Thermoelectric projects are a politically thorny issue because of their impact on local residents, air pollution and wildlife. President Pi\u00f1era made a campaign promise to oppose projects that threaten nature reserves, and environmental NGOs opposed to Barrancones held him to it.<\/p>\n<p style=\"text-align: justify;\">In theory, Barrancones would have been far enough away \u2013 25km &#8211; from the Punta de Choros nature reserve not to have had a significant environmental impact, and GDF Suez did everything by the book.<\/p>\n<p style=\"text-align: justify;\">\u201cWe want to be clear that the project complied with all environmental norms and regulations including World Bank and EU standards,\u201d said Hatton. \u201cThe project never endangered the protected area.\u201d<\/p>\n<p style=\"text-align: justify;\">The problem is that coal-fired projects cannot be built just anywhere. \u201cIt\u2019s not easy to find sites for these types of projects because they need port facilities,\u201d said Hatton.<\/p>\n<p style=\"text-align: justify;\"><strong>Confusing signals<\/strong><\/p>\n<p style=\"text-align: justify;\">If the Barrancones project is cancelled, which seems likely, GDF Suez will lose its investment, but the real cost could be paid by Chilean consumers through higher energy prices.<\/p>\n<p style=\"text-align: justify;\">\u201cThe President\u2019s attitude has put all coal fired projects in the country on hold because he didn\u2019t act through the proper legal channels,\u201d said Jaime Solari, CEO of the environmental consulting firm, Sociedad de Gesti\u00f3n Ambiental (SGA).<\/p>\n<p style=\"text-align: justify;\">Investors are getting \u201cconfusing signals\u201d from La Moneda, he said. \u201cIf a project receives all the necessary approvals, then what is the reason to reject it? Investors can\u2019t understand this.\u201d<\/p>\n<p style=\"text-align: justify;\">GDF Suez has accepted President Pi\u00f1era\u2019s decision for now, but by law the National Commission for the Environment, CONAMA, still has to explain its decision, which could set an interesting precedent, said Solari.<\/p>\n<p style=\"text-align: justify;\">\u201cWe haven\u2019t seen the end of this yet, we\u2019re waiting to see how this will be justified by the government,\u201d he said.<\/p>\n<p style=\"text-align: justify;\">But according to Mat\u00edas Mori, Executive Vice-President of the government\u2019s Foreign Investment Committee, Chile\u2019s reputation as a safe place to invest has not been harmed.<\/p>\n<p style=\"text-align: justify;\">\u201cBarrancones should be put in perspective: it is a special case in which the President spoke with the investor, which then voluntarily decided to walk away,\u201d said Mori.<\/p>\n<p style=\"text-align: justify;\">Chile\u2019s reputation as a stable economy with strong institutions certainly counts in its favor. Most of its energy, telecommunications, transport and mining infrastructure have been built by foreign investors attracted by the country\u2019s pro-business legislation.<\/p>\n<p style=\"text-align: justify;\">According to international rankings, Chile is second only to Brazil in terms of direct foreign investment in Latin America. \u201cIf you look at the size of Brazil\u2019s market compared to Chile\u2019s, this is no minor achievement,\u201d said Mori.<\/p>\n<p style=\"text-align: justify;\">There is room to improve, he admits, but Chile\u2019s membership in the OECD, which was accepted this year, is a sign it is ready to join the ranks of developed countries.<\/p>\n<p style=\"text-align: justify;\">\u201cChile is known as a serious nation with clear rules and legal guarantees where business can be done in a safe environment,\u201d said Mori.<\/p>\n<p style=\"text-align: justify;\">His view that Barrancones is just a bump on the road is shared by Osvaldo Rosales, a trade expert at the United Nations\u2019 Santiago-based Economic Commission on Latin America and the Caribbean. \u201cWe have heard some concerns from investors, but one incident does not make a trend,\u201d Rosales said.<\/p>\n<p style=\"text-align: justify;\"><strong>Energy security at risk<\/strong><\/p>\n<p style=\"text-align: justify;\">But GDF Suez is not the first energy investor to run into legal problems. In mid-2009, AES Gener was forced to suspend construction of its Campiche coal-fired project near Valparaiso for 12 months after local authorities pulled the rug out, claiming the project lacked a municipal permit.<\/p>\n<p style=\"text-align: justify;\">More recently, an appeals court in the northern city of Copiap\u00f3 ruled against Brazilian firm MPX Energ\u00eda\u2019s US$4.7 billion Castilla thermoelectric project, which would be four times as big as Barrancones once constructed. MPX Energ\u00eda plans to appeal the decision, but the project faces an uphill battle for approval.<\/p>\n<p style=\"text-align: justify;\">It\u2019s not just coal projects that are in doubt. Chile\u2019s National Energy Commission (CNE) recently said that the 2,750MW HidroAys\u00e9n hydroelectric project in southern Chile, which has been the target of the international \u201cPatagonia Without Dams\u201d environmental campaign, will not start operations until 2019, three years later than anticipated.<\/p>\n<p style=\"text-align: justify;\">Chile needs at least 300MW of new capacity a year to meet its growing electricity needs and ensure it joins the ranks of developed countries in the next decade, but it might not have enough energy. How did this happen?<\/p>\n<p style=\"text-align: justify;\">According to Solari, Chile is running out of energy options. \u201cIf we don\u2019t want coal, hydro or nuclear plants, then where will our energy come from?\u201d<\/p>\n<p style=\"text-align: justify;\">Coal-fired generation has made Chile into Latin America\u2019s largest emitter of carbon dioxide (CO2) with emissions set to quadruple by 2030, but instead of forcing existing coal plants to reduce emissions, the law obliges investors to build new plants in wilderness areas far from cities.<\/p>\n<p style=\"text-align: justify;\">\u201cWe need new coal facilities that are much cleaner than the old ones but the legislation only benefits existing plants,\u201d said an executive at one thermoelectric project developer.<\/p>\n<p style=\"text-align: justify;\">Most of the potential sites for coal plants along Chile\u2019s coast are saturated with air pollution to the point that firms like GDF Suez are forced into isolated, ecologically sensitive areas, he said. \u201cThe only solution for investors is to build in a pristine site.\u201d<\/p>\n<p style=\"text-align: justify;\">But building projects in, or near, protected areas can result in the type of environmental opposition that led to President Pi\u00f1era\u2019s decision to \u201cmove\u201d Barrancones.<\/p>\n<p style=\"text-align: justify;\">Recent EU legislation requires existing coal plants to shut down or install filters to cut their emissions by 2023. Similar legislation in Chile would reduce pollution and allow new plants to be built nearer to urban centers, said the executive.<\/p>\n<p style=\"text-align: justify;\"><strong>Environmental legislation<\/strong><\/p>\n<p style=\"text-align: justify;\">Chile\u2019s environmental law dates from 1994 when the National Commission for the Environment (CONAMA) was created to establish norms and approve new projects.<\/p>\n<p style=\"text-align: justify;\">The legislation helped to improve environmental standards but was deeply flawed, said Ignacio Arteaga, a lawyer who leads the Environmental and Regulatory practice at Santiago law firm Arteaga Gorziglia &amp; Compa\u00f1\u00eda.<\/p>\n<p style=\"text-align: justify;\">\u201cThe original legislation was full of holes and contradictions, which left the approval process open to interpretation,\u201d Arteaga said. \u201cProjects with bad experiences like Barrancones and Campiche are the result of this old legislation.\u201d<\/p>\n<p style=\"text-align: justify;\">Under this system, CONAMA had to make policy decisions while at the same time evaluating new projects, which led to political interference.<\/p>\n<p style=\"text-align: justify;\">New legislation, approved in January 2010, separates these functions. It created a new Environment Ministry, a new national regulator and a system for evaluating projects, known as the Environmental Evaluation Service (SEA), which replaced CONAMA on October 1.<\/p>\n<p style=\"text-align: justify;\">Regulatory and policy issues will now be decided by the Environment Ministry, while the SEA will be responsible exclusively for the environmental approval process.<\/p>\n<p style=\"text-align: justify;\">The new legislation also calls for the creation of a Biodiversity and Protected Areas Service to define and protect nature reserves, said Arteaga.<\/p>\n<p style=\"text-align: justify;\">But still pending is a review of Chile\u2019s land use regulations. Confusion about green areas, particularly outside urban areas, has led to legal challenges against some projects such as Campiche.<\/p>\n<p style=\"text-align: justify;\">\u201cThere is a problem in Chile with land planning, we don\u2019t have a policy for the uses of rural areas,\u201d said Arteaga.<\/p>\n<p style=\"text-align: justify;\">It\u2019s not just energy investments that have suffered as a result. A proposed pork processing plant in Casablanca, a wine producing valley near Santiago, was recently approved by CONAMA, but local vineyards claim the project will harm their business and are appealing the decision.<\/p>\n<p style=\"text-align: justify;\">Part of the problem, argues Arteaga, has been the influence of special interest groups in the approval process. But the new legislation, which calls for the creation of special environmental courts, should make the process more independent.<\/p>\n<p style=\"text-align: justify;\">\u201cWe need to reduce discretion by making clear rules for authorities to follow,\u201d he said.<\/p>\n<p style=\"text-align: justify;\"><strong>Respecting the law<\/strong><\/p>\n<p style=\"text-align: justify;\">But companies also have some responsibility for the confusion in the environmental approval process, said Sara Larra\u00edn, executive director of the NGO Chile Sustentable.<\/p>\n<p style=\"text-align: justify;\">\u201cThe companies themselves generated this uncertainty by pressuring the government to let them build their projects in protected areas,\u201d she said.<\/p>\n<p style=\"text-align: justify;\">President Pi\u00f1era has contributed to legal uncertainty by intervening in the Barrancones at the last minute, but this was necessary to protect the Punta de Choros nature reserve, said Larra\u00edn.<\/p>\n<p style=\"text-align: justify;\">The law itself is not the problem, but rather pressure by private business to make the authorities bend the rules so they can build their projects where costs are lowest, argues Larra\u00edn.<\/p>\n<p style=\"text-align: justify;\">\u201cThere is a double standard at work because companies don\u2019t respect the legal framework,\u201d she said. \u201cThey have swept the real costs under the carpet so society pays for it in the long-term through pollution.\u201d<\/p>\n<p style=\"text-align: justify;\">Foreign investors in Chile\u2019s energy sector deny this, saying they respect Chile\u2019s laws just as they abide by the laws of any country where they decide to invest.<\/p>\n<p style=\"text-align: justify;\">But obeying the law is insufficient to ensure a project will not face opposition. Investing in a strategic environmental plan that involves the local community from the beginning of a project could help prevent legal problems down the road, said Arteaga.<\/p>\n<p style=\"text-align: justify;\">\u201cCompanies have to improve the way they negotiate with communities in Chile, but we lack experts in these types of negotiations,\u201d said Arteaga.<\/p>\n<p style=\"text-align: justify;\">Arteaga\u2019s firm, for example, works with Mexico-based C3 International Consultants that specializes in community negotiations, but he predicts demand for this type of service will increase as companies realize the value of building a consensus with local communities.<\/p>\n<p style=\"text-align: justify;\">Such a consensus can help companies protect themselves from environmental opposition, argues Arteaga.<\/p>\n<p style=\"text-align: justify;\">&nbsp;Some companies, like Endesa, are already making progress in this area. \u201cHidroAysen is a good example of how companies should relate to local communities,\u201d said Arteaga.<\/p>\n<p style=\"text-align: justify;\"><strong>The cost of clean energy<\/strong><\/p>\n<p style=\"text-align: justify;\">Finally, the question comes down to how much Chile is willing to pay for energy and at what cost to the environment.<\/p>\n<p style=\"text-align: justify;\">Chilean legislation enacted in 2008 requires generators to gradually increase generation from non-conventional renewable energy sources to reach 10% of their output by 2020, but there are no subsidies in Chile as there are in Europe.<\/p>\n<p style=\"text-align: justify;\">\u201cWhether through taxes or higher energy bills, consumers will have to pay out of their pocket for renewable energy,\u201d said one executive.<\/p>\n<p style=\"text-align: justify;\">The wind blows strong in parts of Chile and the sun shines year-round, but experts say wind and solar power are too inefficient and unpredictable to meet the country\u2019s base load needs.<\/p>\n<p style=\"text-align: justify;\">Building a wind farm costs about the same as a coal plant, or about US$2 million per MW, but windmills operate at about 30% efficiency versus 90% efficiency for coal, and they must be backed up with alternative supplies from the grid.<\/p>\n<p style=\"text-align: justify;\">That leaves coal, LNG, hydro or nuclear power. A nuclear plant could take 10 years to develop, but as Chile looks to accelerate its economic growth in the next decade it will need a lot more energy.<\/p>\n<p style=\"text-align: justify;\">The new environmental legislation should help in this regard by eliminating some of the uncertainties surrounding the approval process for new coal-fired projects.<\/p>\n<p style=\"text-align: justify;\">But, most importantly, foreign investors need to be reassured that the rules will not change overnight and that a phone call from the President will not cancel their project, said SGA\u2019s Jaime Solari.<\/p>\n<p style=\"text-align: justify;\">As for GDF Suez, despite the Barrancones debacle Hatton says his firm is considering other alternatives to help meet Chile\u2019s energy needs.
