Esa es la pregunta que las empresas chilenas se est\u00e1n haciendo sobre el convenio para evitar la doble tributaci\u00f3n que suscribieron Chile y Estados Unidos en febrero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Tambi\u00e9n fue la interrogante abordada por funcionarios de Gobierno y expertos tributarios en un seminario que realiz\u00f3 AmCham el 29 de abril. Mediante la explicaci\u00f3n de conceptos tales como la retenci\u00f3n de impuesto en la fuente e impuestos en el pa\u00eds de residencia adem\u00e1s de t\u00e9rminos -algunos a\u00fan poco familiares en Chile- como establecimiento permanente y cr\u00e9dito back-to-back, quienes participaron en el seminario llegaron a dos conclusiones principales: los potenciales beneficios del acuerdo son enormes, pero sacar el m\u00e1ximo partido de ellos no ser\u00e1 algo necesariamente f\u00e1cil.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Durante los \u00faltimos 20 a\u00f1os, Chile ha suscrito convenios para evitar la doble tributaci\u00f3n con la mayor\u00eda de sus socios comerciales -siendo Jap\u00f3n la significativa excepci\u00f3n- y Estados Unidos era, hasta febrero, una decepcionante laguna. Estados Unidos es, despu\u00e9s de todo, uno de los mercados de exportaci\u00f3n clave para Chile y su mayor fuente de importaciones adem\u00e1s de su m\u00e1s importante inversionista extranjero.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/ESP_Ricardo_garcia.jpg\" width=190 height=149>El acuerdo a\u00fan debe ser ratificado por el Congreso de ambos pa\u00edses, destac\u00f3 Ricardo Garc\u00eda, presidente de AmCham. \u201cPero es un significativo avance en los v\u00ednculos entre ambos pa\u00edses\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El Ministro de Hacienda de Chile, Felipe Larra\u00edn, se hizo eco de esa visi\u00f3n. Los convenios para evitar la doble tributaci\u00f3n complementar\u00e1n el tratado del libre comercio que las dos naciones suscribieron en el 2003, destac\u00f3, y tambi\u00e9n entregar\u00e1n una importante mano de ayuda para las empresas chilenas que invierten o quieren invertir en Estados Unidos.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Es m\u00e1s, seg\u00fan Liselott Kana, jefa del Departamento de Normas Internacionales del Servicio de Impuestos Internos de Chile (SII), Chile hizo un buen negocio. Lo que est\u00e1 en juego en cualquier convenio para evitar la doble tributaci\u00f3n es c\u00f3mo los dos pa\u00edses se reparten el pozo de impuestos a la renta que esperan recibir de sus empresas y ciudadanos, dijo a los asistentes al seminario.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Julio_Pereira.jpg\" width=199 height=158>Y, ah\u00ed, dos principios contrapuestos entran en juego: el <EM>principio de residencia<\/EM>, en virtud del cual a las empresas y los ciudadanos se les cobran impuestos en el pa\u00eds en el que est\u00e1n domiciliados, independientemente de d\u00f3nde se genere su renta, y el <EM>principio de la fuente<\/EM>, seg\u00fan el cual es el pa\u00eds en el que operan y ganan dinero el que les grava.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Con muchas m\u00e1s empresas extranjeras operando en Chile que compa\u00f1\u00edas chilenas operando en el extranjero, el principio de la fuente es obviamente la preferencia de Chile. No obstante,&nbsp; el pa\u00eds se enfrenta al hecho de que las econom\u00edas industrializadas del mundo, incluido la de Estados Unidos, tienden a aplicar el modelo de residencia.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Y, al negociar el convenio para evitar la doble tributaci\u00f3n entre Chile y Estados&nbsp; Unidos, hubo otra complicaci\u00f3n: el inusual \u201csistema integrado\u201d de impuesto a la renta corporativa que tiene Chile. En la mayor\u00eda de los pa\u00edses, incluido Estados Unidos, el impuesto a la retenci\u00f3n aplicado a las remesas por ganancias es adicional al impuesto a la renta pagado por la empresa sobre esas utilidades, mientras que en Chile este \u00faltimo -que actualmente se grava a una tasa del 17%, pero que va a subir temporalmente al 20% en el 2011 como parte del plan de reconstrucci\u00f3n tras el terremoto- sirve como cr\u00e9dito contra el impuesto a la retenci\u00f3n del 35%.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Uno de los objetivos de Chile en sus negociaciones tributarias con Estados&nbsp; Unidos \u2013as\u00ed como en todos los dem\u00e1s convenios para evitar la doble tributaci\u00f3n que ha negociado- era no tener que modificar este sistema. Y logr\u00f3 eso, al tiempo que tambi\u00e9n obtuvo algunas importantes exenciones para los inversionistas chilenos en Estados Unidos y para los usuarios locales de tecnolog\u00eda estadounidense.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Los Principales Logros<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Dirigi\u00e9ndose a los asistentes del seminario, Julio Pereira, director del SII, destac\u00f3 la reducci\u00f3n en los impuestos que las empresas chilenas pagar\u00e1n por la repatriaci\u00f3n de dividendos desde inversiones en Estados Unidos. En la actualidad, estas est\u00e1n sujetas a un impuesto de retenci\u00f3n del 30%, pero una vez que el convenio para evitar la doble tributaci\u00f3n entre en vigencia, este caer\u00e1 al 15% o, si mantienen al menos una participaci\u00f3n del 10% en la empresa con sede en Estados Unidos, a un magro 5%.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Liselott_Kana.jpg\" width=199 height=135>Los dos aranceles distintos est\u00e1n dise\u00f1ados para distinguir entre inversi\u00f3n financiera -o una posici\u00f3n pasiva muy peque\u00f1a en una empresa estadounidense existente- e inversi\u00f3n extranjera directa (IED) en virtud de la cual una compa\u00f1\u00eda chilena establece su propia filial en Estados Unidos. Este es un importante logro, destac\u00f3 Roberto Carlos Rivas, socio de la oficina chilena de PricewaterhouseCoopers, porque significar\u00e1 la eliminaci\u00f3n o, al menos, una reducci\u00f3n de la doble tributaci\u00f3n a la que est\u00e1n expuestos actualmente.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Pero, en el caso de los dividendos, ese no es el \u00fanico logro. En virtud del convenio para evitar la doble tributaci\u00f3n, las administradoras de fondos de pensi\u00f3n (AFP) de Chile estar\u00e1n totalmente exentas del impuesto estadounidense a la retenci\u00f3n aplicado a los dividendos los que eran un costo neto, debido a que est\u00e1n libres de impuestos en Chile y por tanto no pueden usar impuestos pagados en Estados Unidos como cr\u00e9dito en Chile.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En un beneficio a m\u00e1s largo plazo para el desarrollo econ\u00f3mico de Chile, el convenio para evitar la doble tributaci\u00f3n tambi\u00e9n promete impulsar la transferencia tecnol\u00f3gica. En la actualidad, una empresa chilena que paga regal\u00edas a Estados Unidos est\u00e1 sujeta a un impuesto de retenci\u00f3n del 30% mientras que, en virtud del acuerdo, este porcentaje se reducir\u00e1 al 10% o a un 2% en el caso del arriendo de equipo cient\u00edfico o industrial, a menudo una forma indirecta de transferencia tecnol\u00f3gica.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Felipe_Yanez.jpg\" width=175 height=127>Luego, est\u00e1n los logros para las personas que, como destac\u00f3 Ricardo Garc\u00eda, han atra\u00eddo menos atenci\u00f3n que aquellos para las empresas. \u201cPero son igual de importantes\u201d, indic\u00f3, \u201cporque afectan la movilidad del talento\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A medida que la gente se traslada de un pa\u00eds a otro por motivos de trabajo, f\u00e1cilmente se pueden ver aprisionados en una trampa de doble tributaci\u00f3n, enfatiz\u00f3 Felipe Y\u00e1\u00f1ez de Allende Bascu\u00f1\u00e1n y C\u00eda., firma de abogados con sede en Santiago. Ello es particularmente un problema para los ciudadanos estadounidenses que trabajan en el extranjero, se\u00f1al\u00f3 en el seminario, porque -a diferencia de la mayor\u00eda de los dem\u00e1s pa\u00edses- Estados Unidos aplica impuestos a sus ciudadanos no residentes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Hugo_Hurtado.jpg\" width=177 height=136>El convenio para evitar la doble tributaci\u00f3n resuelve este problema estableciendo una <STRONG>regla de desempate<\/STRONG> para determinar d\u00f3nde son considerados residentes para fines impositivos. Tanto en el caso de empleados a contrata como de profesionales independientes, esto depender\u00e1 ampliamente de cu\u00e1ntos d\u00edas del a\u00f1o pasen en cada pa\u00eds y, para los empleados de n\u00f3mina, de si su empleador tiene un denominado \u201cestablecimiento permanente\u201d en el pa\u00eds en el que no est\u00e1 domiciliado.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Por supuesto, el convenio para evitar la doble tributaci\u00f3n tambi\u00e9n incluye una serie de salvaguardas en una apuesta por evitar la triangulaci\u00f3n de sus beneficios o <STRONG>\u201ctreaty shopping\u201d<\/STRONG>. Hugo Hurtado de Guerrero, Olivos, Novoa y Err\u00e1zuriz, firma de abogados de Santiago, explic\u00f3 que estos definen criterios seg\u00fan los cuales se puede acceder a los beneficios del convenio tales como el hecho de que, por ejemplo, un fondo de pensiones debe tener m\u00e1s del 50% de sus contribuyentes en uno de los pa\u00edses firmantes a fin de beneficiarse del convenio para evitar la doble tributaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>M\u00e1s que Recaudaci\u00f3n de Impuestos<\/STRONG><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, los convenios para evitar la doble tributaci\u00f3n no tienen que ver s\u00f3lo con c\u00f3mo repartirse los ingresos por impuestos entre pa\u00edses. Hoy en d\u00eda, son cada vez m\u00e1s un veh\u00edculo a trav\u00e9s del cual las autoridades de impuesto buscan compartir informaci\u00f3n.<IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Franco_Brzovic.jpg\" width=170 height=133><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Esto adquiri\u00f3 nueva importancia, en particular para Estados&nbsp; Unidos, luego de los atentados terroristas del 11 de septiembre en Nueva York y Washington. Fue tambi\u00e9n una de las razones por las que el convenio para evitar la doble tributaci\u00f3n de Chile y Estados Unidos s\u00f3lo se sell\u00f3 despu\u00e9s de que Chile, como condici\u00f3n para su ingreso a la Organizaci\u00f3n para la Cooperaci\u00f3n y el Desarrollo Econ\u00f3micos (OCDE), otorg\u00f3 al SII nuevas facultades para acceder a informaci\u00f3n sobre transacciones a trav\u00e9s de cuentas bancarias y compartirla con las autoridades tributarias de otros pa\u00edses.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Este aspecto del convenio para evitar la doble tributaci\u00f3n de Chile y Estados Unidos inevitablemente gener\u00f3 algunas preocupaciones de parte de los contribuyentes chilenos. A juicio de Eduardo Lagos de Vincent &amp; Asociados, su firma de abogados con sede en Santiago ha recibido muchas consultas de clientes sobre estas nuevas facultades y sobre con qui\u00e9n exactamente el SII puede compartir informaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Sin embargo, el mensaje de Julio Pereira, Lagos fue tranquilizador. Las nuevas facultades del SII y el convenio para evitar la doble tributaci\u00f3n entre Chile y Estados Unidos no significan que la entidad podr\u00e1 \u201cir de cacer\u00eda\u201d y los contribuyentes tienen derecho a que se les avise que se ha solicitado informaci\u00f3n sobre su situaci\u00f3n tributaria, indic\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: left; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Roberto_Carlos_Rivas.jpg\" width=184 height=127>Pero los acuerdos para compartir informaci\u00f3n -formalizados en Tratados de Intercambio de Informaci\u00f3n Tributaria- aumentar\u00e1n, advirti\u00f3 el ministro de Hacienda, Felipe Larra\u00edn, en parte con el fin de evitar el financiamiento del terrorismo, pero tambi\u00e9n para un prop\u00f3sito menos dram\u00e1tico como es el resguardarse contra la evasi\u00f3n tributaria. \u201cPara evitar un mal uso de los convenios para evitar la doble tributaci\u00f3n, es importante la celebraci\u00f3n de tratados de intercambio de informaci\u00f3n para que efectivamente se utilicen bien los convenios para evitar la doble tributaci\u00f3n\u201d, insisti\u00f3.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">M\u00e1s all\u00e1 de los t\u00e9rminos de intercambio de informaci\u00f3n de su convenio para evitar la doble tributaci\u00f3n, Chile no tiene -en la actualidad- ning\u00fan acuerdo de intercambio de informaci\u00f3n tributaria, pero eso podr\u00eda cambiar. El ministro Larra\u00edn anunci\u00f3 que la negociaci\u00f3n de estos acuerdos ser\u00e1 una prioridad para el nuevo Gobierno, encabezado por el presidente Sebasti\u00e1n Pi\u00f1era, quien asumi\u00f3 el mando de la naci\u00f3n el 11 de marzo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cPorque los acontecimientos de los \u00faltimos a\u00f1os, y esto es un tema importante, revelan que hay grandes sumas de dinero en para\u00edsos tributarios y estamos analizando iniciar negociaciones para la suscripci\u00f3n de tratados de intercambio de informaci\u00f3n, por ejemplo con (\u2026) Bermuda, Islas Caim\u00e1n, Islas V\u00edrgenes, Jersey, Lichtenstein y Panam\u00e1\u201d, se\u00f1al\u00f3 el funcionario de Gobierno en el seminario de AmCham.&nbsp;<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><IMG style=\"BORDER-BOTTOM: black 1px solid; BORDER-LEFT: black 1px solid; MARGIN: 5px; FLOAT: right; BORDER-TOP: black 1px solid; BORDER-RIGHT: black 1px solid\" class=mceItem alt=\"\" src=\"\/sites\/default\/files\/Panel_1.jpg\" width=226 height=155>Sin embargo, el paso m\u00e1s inmediato, ser\u00e1 que Chile ratifique su largamente esperado convenio para evitar la doble tributaci\u00f3n con Estados Unidos, y mientras antes mejor, seg\u00fan el ex senador Guillermo V\u00e1squez. \u201cEsa es la mejor manera en que podemos presionar al Congreso de Estados Unidos para que siga el ejemplo\u201d, dijo en el seminario.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Despu\u00e9s de todo, eso dar\u00eda a Chile acceso a incentivos tributarios con un socio clave a nivel comercial y de inversi\u00f3n. Y adem\u00e1s el estatus de convenio para evitar la doble tributaci\u00f3n con un pa\u00eds que es, seg\u00fan Liselott Kana, uno de los m\u00e1s \u201cquisquilloso\u201d en t\u00e9rminos de los socios que elige para tener tratados tributarios.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Ruth Bradley<\/STRONG> es corresponsal en Santiago de The Economist.<\/P><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">What\u2019s in it for us? That is the question Chilean businesses are asking about the double taxation avoidance agreement (DTAA) signed by Chile and the United States in February.<\/p>\n<p style=\"text-align: justify;\">It was also the question addressed by government officials and tax experts at an AmCham seminar on April 29. Explaining concepts such as source taxation and residence taxation as well as terms &#8211; some still unfamiliar in Chile &#8211; like permanent establishment and back-to-back lending, the seminar\u2019s participants reached two main conclusions: the potential benefits of the agreement are enormous, but making the most of them won\u2019t necessarily be easy.<\/p>\n<p style=\"text-align: justify;\">Over the past 20 years, Chile has signed DTAAs with most of its main trading partners &#8211; with the significant exception of Japan &#8211; and the United States was, until February, a disappointing gap. The U.S. is, after all, one of Chile\u2019s key export markets and its largest source of imports as well as its most important foreign investor.<img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: right; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/ING_Ricardo_garcia.jpg\" width=\"185\" height=\"138\" \/><\/p>\n<p style=\"text-align: justify;\">The agreement still has to be ratified by Congress in both countries, noted Ricardo Garc\u00eda, president of AmCham. \u201cBut it is a significant step forward in ties between the two countries.\u201d<\/p>\n<p style=\"text-align: justify;\">That view was echoed by Finance Minister Felipe Larra\u00edn. The DTAA will complement the free trade agreement that the two countries signed in 2003, he pointed out, and will also give an important helping hand to Chilean companies investing, or wanting to invest, in the United States.<\/p>\n<p style=\"text-align: justify;\">Moreover, according to Liselott Kana, head of international taxation at Chile\u2019s National Tax Service (SII), Chile got a good deal. What\u2019s at stake in any DTAA is how the two countries divide up the pool of tax revenues they can expect to receive from their businesses and citizens, she told the seminar.<\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: left; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Julio_Pereira.jpg\" width=\"190\" height=\"150\" \/>And, there, two conflicting principles come into play &#8211; the residence principle, under which businesses and individuals are taxed in the country in which they are domiciled, independently of where their income is generated, and the source principle, under which it is the country where they operate and earn their money that gets to tax them.<\/p>\n<p style=\"text-align: justify;\">With far more foreign companies operating in Chile than Chilean companies operating abroad, the source principle is obviously Chile\u2019s preference. It is, however, up against the fact that the world\u2019s industrialized economies, including the United States, tend to apply the residence model.<\/p>\n<p style=\"text-align: justify;\">And, in negotiating the Chile-U.S. DTAA, there was another complication in the form of Chile\u2019s unusual \u2018integrated system\u2019 of corporate income tax. In most countries, including the United States, withholding tax on profit remittances is additional to that on income tax whereas, in Chile, the latter &#8211; currently charged at a rate of 17% but due to increase temporarily to 20% in 2011 as part of an earthquake reconstruction plan &#8211; serves as a credit against a 35% withholding tax.<\/p>\n<p style=\"text-align: justify;\">One of Chile\u2019s aims in its tax talks with the United States &#8211; as in all the other DTAAs it has negotiated &#8211; was not to have to alter this system. And it achieved that, while also obtaining some important breaks for Chilean investors in the U.S. and for local users of U.S. technology.<\/p>\n<p style=\"text-align: justify;\"><strong>The main gains<\/strong><\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: left; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Liselott_Kana.jpg\" width=\"232\" height=\"179\" \/>Addressing the seminar, Julio Pereira, director of the SII, highlighted the reduction in taxes Chilean companies will pay on repatriation of dividends from investments in the United States. At present, they are liable to a 30% withholding tax but, once the DTAA comes into force, this will drop to 15% or, if they hold at least a 10% stake in the U.S.-based company, to a mere 5%.<\/p>\n<p style=\"text-align: justify;\">The two different rates are designed to distinguish between financial investment &#8211; or a very small, passive position in an existing U.S. company &#8211; and foreign direct investment (FDI) under which a Chilean company sets up its own subsidiary in the United States. This is an important gain, pointed out Roberto Carlos Rivas, a partner at the Chilean office of PricewaterhouseCoopers, because it will mean the elimination or, at least, reduction of the double taxation to which they are currently exposed.<\/p>\n<p style=\"text-align: justify;\">But, in the case of dividends, that is not the only gain. Under the DTAA, Chile\u2019s private pension funds (AFPs) will be totally exempt from U.S. withholding tax on dividends which, because they are tax-free in Chile and cannot, therefore, use taxes paid in the U.S. as a credit in Chile, was a net cost.<img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: right; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Felipe_Yanez.jpg\" width=\"219\" height=\"165\" \/><\/p>\n<p style=\"text-align: justify;\">In a longer-term benefit for Chile\u2019s economic development, the DTAA also promises to boost technology transfer. At present, a Chilean company paying royalties to the U.S. is subject to a withholding tax of 30% whereas, under the agreement, this will drop to 10% or, in the case of the leasing of industrial or scientific equipment &#8211; often an indirect form of technology transfer &#8211; to 2%.<\/p>\n<p style=\"text-align: justify;\">Then, there are the gains for individuals which, as Ricardo Garc\u00eda noted, have attracted less attention than those for businesses. \u201cBut they\u2019re just as important,\u201d he said, \u201cbecause they affect the mobility of talent.\u201d<\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: left; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Hugo_Hurtado.jpg\" width=\"237\" height=\"171\" \/>As people move from one country to another for work reasons, they can easily become caught in a double-taxation trap, pointed out Felipe Y\u00e1\u00f1ez of Allende Bascu\u00f1\u00e1n y C\u00eda, a Santiago law firm. That is particularly a problem for U.S. citizens working overseas, he told the seminar, because, unlike most other countries, the U.S. taxes its non-resident citizens.<\/p>\n<p style=\"text-align: justify;\">The DTAA resolves this problem by establishing a \u201ctie-break\u201d rule to determine where they are considered resident for tax purposes. In the case of both company employees and independent professionals, this will depend largely on how many days of the year they spend in each country and, for payroll employees, on whether their employer has a so-called \u201cpermanent establishment\u201d in the country in which it is not domiciled.<\/p>\n<p style=\"text-align: justify;\">Of course, the DTAA also includes a number of safeguards in a bid to prevent triangulation of its benefits or \u2018treaty shopping\u2019. Explained by Hugo Hurtado of Guerrero, Olivos, Novoa y Err\u00e1zuriz, a Santiago law firm, these define eligibility criteria such as the fact that, for example, a pension fund must, in order to benefit from the DTAA, have more than 50% of its contributors in one of the signatory countries.<\/p>\n<p style=\"text-align: justify;\"><strong>More than tax collection<\/strong><\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: right; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Franco_Brzovic.jpg\" width=\"190\" height=\"150\" \/>DTAAs are, however, not only about how to divide up tax revenues between countries. Nowadays, they are increasingly a vehicle through which tax authorities seek to share information.<\/p>\n<p style=\"text-align: justify;\">This acquired new importance, particularly for the United States, after the 9\/11 terrorist attacks in New York and Washington. It was also one of the reasons why the Chile-U.S. DTAA was only sealed after Chile, as a condition for its accession to the Organisation for Economic Co-operation and Development (OECD), gave the SII new powers to access information about transactions through bank accounts and share it with other countries\u2019 tax authorities.<\/p>\n<p style=\"text-align: justify;\">This aspect of the Chile-U.S. DTAA has inevitably raised some concerns on the part of Chilean taxpayers. According to Eduardo Lagos of Vincent &amp; Asociados, his Santiago-based law firm has received many queries from clients about these new powers and with exactly whom the SII can share information.<\/p>\n<p style=\"text-align: justify;\">Like Julio Pereira, he was, however, reassuring. The SII\u2019s new powers and the Chile-U.S. DTAA don\u2019t mean that it will be able to go on \u201cfishing trips,\u201d he said, and taxpayers are entitled to be told that information about their tax situation has been requested.<\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: left; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Roberto_Carlos_Rivas.jpg\" width=\"190\" height=\"150\" \/>But information-sharing arrangements, formalized as Tax Information Exchange Agreements (TIEAs), will increase, warned Finance Minister Felipe Larra\u00edn, partly in order to prevent the financing of terrorism but also for the less dramatic purpose of guarding against tax evasion. \u201cTIEAs are essential to prevent misuse of DTAAs,\u201d he insisted.<\/p>\n<p style=\"text-align: justify;\">Beyond the information-sharing terms of its DTAAs, Chile does not, at present, have any TIEAs, but that could change. Their negotiation will be a priority for the new government, headed by President Sebasti\u00e1n Pi\u00f1era, which took office on March 11, announced Minister Larra\u00edn.<\/p>\n<p style=\"text-align: justify;\">\u201cGiven the events of recent years and the large sums held in tax havens, we will analyze the possibility of TIEA talks with these countries,\u201d he told the AmCham seminar. The candidates, he said, include Bermuda, the Cayman Islands, the<img loading=\"lazy\" decoding=\"async\" class=\"mceItem\" style=\"margin: 5px; float: right; border: black 1px solid;\" alt=\"\" src=\"\/sites\/default\/files\/Panel_1.jpg\" width=\"190\" height=\"155\" \/> Virgin Islands, Jersey, Lichtenstein and Panama.<\/p>\n<p style=\"text-align: justify;\">The most immediate step, however, will be for Chile to ratify its long-awaited DTAA with the United States, and the sooner the better, according to former senator, Guillermo V\u00e1squez. \u201cThat\u2019s the best way we can pressure the U.S. Congress to follow suit,\u201d he told the seminar.<\/p>\n<p style=\"text-align: justify;\">That would, after all, give Chile access to tax breaks with a key trading and investment partner.
