En el mundo altamente globalizado de hoy en d\u00eda, donde el conocimiento desempe\u00f1a un papel clave, el crecimiento econ\u00f3mico y el desarrollo de un pa\u00eds dependen en gran medida de la innovaci\u00f3n. Sin embargo, la historia muestra que para que la creatividad y la innovaci\u00f3n se desarrollen, la propiedad intelectual debe protegerse en un marco econ\u00f3mico que promueva la competencia, la transparencia y la inversi\u00f3n en capital humano.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Desde el siglo XVIII, la revoluci\u00f3n industrial demostr\u00f3 el importante papel de los inventos y descubrimientos como motores del crecimiento econ\u00f3mico. Junto con el auge del comercio internacional a fines del siglo XIX, esto dio lugar a una de las primeras iniciativas de un sistema de protecci\u00f3n de la propiedad intelectual, la que culminen la suscripci\u00f3n de la Convenci\u00f3n de Par\u00eds en 1883. El objetivo b\u00e1sico de este acuerdo era asegurar que los inventos ideados en un pa\u00eds no fueran robados y usados por otros. En la historia m\u00e1s reciente, Estados Unidos representa un ejemplo claro de los beneficios econ\u00f3micos generados por la protecci\u00f3n de la propiedad intelectual.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Desde el comienzo de Estados Unidos como naci\u00f3n, el pa\u00eds dise\u00f1\u00f3 un sistema legal que alentara la innovaci\u00f3n a trav\u00e9s de la protecci\u00f3n de inventos patentados. El Art\u00edculo I, Secci\u00f3n 8, de la Constituci\u00f3n otorga facultades al Congreso para \u201cfomentar el progreso de la ciencia y las artes \u00fatiles, asegurando a los autores e inventores, por un tiempo limitado, el derecho exclusivo sobre sus respectivos escritos y descubrimientos\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Respaldada por s\u00f3lidas instituciones, esta cl\u00e1usula dio paso a la legislaci\u00f3n que cre\u00f3 un riguroso sistema de protecci\u00f3n a la propiedad intelectual que gradualmente se mejor\u00f3 y modific\u00f3, por ejemplo para permitir que los inventores en \u00e1reas rurales enviaran por correo las solicitudes de patentes sin pagar el franqueo. Una resoluci\u00f3n de la Corte Suprema de Estados Unidos reconoce a las patentes como uno de&nbsp;\u201clos derechos m\u00e1s apreciados y valiosos que reconoce la sociedad\u201d (Corte Suprema de los Estados Unidos, ex parte Wood &amp; Brundage, 22 U.S. 603, 1824). Aun cuando el progreso fue m\u00e1s lento en algunas \u00e1reas de la propiedad intelectual, hoy en d\u00eda Estados Unidos aplica principios legales similares a las patentes, derechos de autor y marcas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los resultados de la efectiva protecci\u00f3n de la propiedad intelectual en Estados Unidos no tardaron mucho en reflejarse en su productividad econ\u00f3mica y crecimiento. Es verdad, otras instituciones contribuyeron a su crecimiento, pero los estudios destacan el importante rol de una adecuada protecci\u00f3n de la propiedad intelectual.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Los sectores que requieren altos niveles de desarrollo de propiedad intelectual crean empleos muy bien remunerados y fomentan el crecimiento econ\u00f3mico producto de las inversiones en investigaci\u00f3n y desarrollo. Adem\u00e1s impulsan las exportaciones estadounidenses. Seg\u00fan el Global Intellectual Property Center, los sectores que requieren altos niveles de desarrollo de propiedad intelectual corresponden a cerca del 60% del total de las exportaciones estadounidenses, las que subieron de un total de US$665.000 millones en el 2000 a US$910.000 millones en el 2007. La industria de pel\u00edculas y televisi\u00f3n por s\u00ed sola representa casi un 10% del super\u00e1vit comercial en servicios del sector privado en Estados Unidos.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">En el 2006, Estados Unidos adjudic\u00f3 173.770 patentes, equivalentes al 24% de la totalidad de las patentes entregadas a nivel mundial ese a\u00f1o. En el 2007, cient\u00edficos estadounidenses crearon el 70% de todos los nuevos medicamentos. Y muchos de los dispositivos tecnol\u00f3gicos que hoy nos resultan tan comunes -la ampolleta, el tel\u00e9fono, el computador y el autom\u00f3vil, por nombrar a algunos- se inventaron en Estados Unidos.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, el otro lado de la dependencia que tiene la econom\u00eda estadounidense de la propiedad intelectual es que no tolera la pirater\u00eda en otros pa\u00edses. Esto explica por qu\u00e9 Chile, que durante a\u00f1os ha luchado contra la pirater\u00eda con un \u00e9xito limitado, fue incluido por la Oficina del Representante Comercial de Estados Unidos (USTR, por su sigla en ingl\u00e9s) en su Priority Watch List (lista de observaci\u00f3n prioritaria) por cuarto a\u00f1o consecutivo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La nueva Ley de Propiedad Intelectual de Chile, aprobada en abril, es un importante paso hacia el mejorar la protecci\u00f3n de la propiedad intelectual y el cumplimiento de los compromisos del pa\u00eds en virtud del Tratado de Libre Comercio suscrito con Estados Unidos. Sin embargo, la ley en s\u00ed misma no es suficiente dado que hay otros temas pendientes como la protecci\u00f3n de datos y el linkage, o vinculaci\u00f3n. Lo mejor para Chile es que aborde estos temas r\u00e1pidamente. Despu\u00e9s de todo, Estados Unidos es un gran ejemplo de c\u00f3mo la propiedad intelectual puede impulsar la innovaci\u00f3n y el crecimiento.<\/P><!--:--><!--:en--><\/p>\n<p style=\"text-align: justify;\">A country\u2019s wealth is not only measured by its quantity of natural resources or its capacity to produce goods at a low cost. In today\u2019s highly globalized world, where knowledge plays a key role, a country\u2019s economic growth and development depends to a large extent on innovation. But history shows that for creativity and innovation to flourish, Intellectual Property must be protected in an economic framework which promotes competition, transparency and investment in human capital.<\/p>\n<p style=\"text-align: justify;\">Beginning in the 18th century, the industrial revolution demonstrated the important role of inventions and discoveries as drivers of economic growth. Coupled with the boom in international trade towards the end of the 19th century, this gave rise to one of the first efforts at a system for the protection of Intellectual Property, culminating in the signing of the Paris Convention in 1883. The basic aim of this agreement was to ensure that inventions in one country would not be stolen and used by another. More recently, the United States is a clear case of the economic benefits of IP protection.<\/p>\n<p style=\"text-align: justify;\">Since the United States\u2019 beginning as a nation, it designed a legal system to encourage innovation through the protection of patented inventions. Article I, Section 8, of the Constitution gives Congress the power to \u201cpromote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.\u201d<\/p>\n<p style=\"text-align: justify;\">Supported by strong institutions, this clause gave rise to legislation that created a rigorous system of IP protection which was gradually improved and modified, for example by allowing inventors in rural areas to mail patent applications without paying postage. A ruling by the U.S. Supreme Court recognized patents as one of the \u201cdearest and most valuable rights which society acknowledges\u201d (U.S. Supreme Court, ex parte Wood &amp; Brundage, 22 U.S. 603, 1824). Even though progress was slower in other areas of intellectual property, today the U.S. applies similar legal principles to patents, copyrights and trademarks.<\/p>\n<p style=\"text-align: justify;\">The results of effective IP protection in the U.S. did not take long to be reflected in its economic productivity and growth. It\u2019s true, other institutions contributed to this growth, but studies point to the important role of adequate IP protection.<\/p>\n<p style=\"text-align: justify;\">IP-intensive industries create high-paying jobs and spur economic growth resulting from investments in research and development. And they drive American exports. According to the Global Intellectual Property Center, IP-intensive industries generate approximately 60% of total U.S. exports &#8211; rising from a total of US$665 billion in 2000 to US$910 billion in 2007. The film and TV industry alone accounts for about 10% of the U.S. private sector trade surplus in services.<\/p>\n<p style=\"text-align: justify;\">In 2006, the U.S. awarded 173,770 patents, equivalent to 24% of all patents awarded worldwide that year. In 2007, U.S. scientists created 70% of all new medications. And many of the technological gadgets we take for granted \u2013 the light bulb, the telephone, the computer, the automobile to name a few \u2013 were invented in the U.S.<\/p>\n<p style=\"text-align: justify;\">The flip side of the U.S. economic dependence on intellectual property, however, is that it does not tolerate piracy in other countries. This explains why Chile, which has battled piracy for years with limited success, has been included by the Office of the United States Trade Representative (USTR) on its Priority Watch List for a fourth consecutive year.<\/p>\n<p style=\"text-align: justify;\">Chile\u2019s new IP law passed in April is an important step towards improving IP protection and complying with its obligations under its Free Trade Agreement with the U.S. But the law alone is not enough as there are other pending issues like data protection and linkage. It\u2019s in Chile\u2019s best interests to address these issues quickly.
