La Oficina del Representante Comercial de Estados Unidos (USTR, por su sigla en ingl\u00e9s) entreg\u00f3 su informe 301 para 2010 sobre la protecci\u00f3n e implementaci\u00f3n de los est\u00e1ndares de propiedad intelectual. Por cuarto a\u00f1o consecutivo, Chile est\u00e1 incluido en su Priority Watch List (lista de observaci\u00f3n prioritaria) de pa\u00edses que no han protegido de manera adecuada la propiedad intelectual. Adem\u00e1s estipula que el Gobierno de Estados Unidos aspira a trabajar con las nuevas autoridades de Chile en la implementaci\u00f3n de sus compromisos en virtud del tratado de libre comercio (TLC).<\/P>

AmCham lamenta la reiterada inclusi\u00f3n de Chile en esta lista. Esta clasificaci\u00f3n de la USTR se bas\u00f3 en una evaluaci\u00f3n de los esfuerzos que los pa\u00edses hicieron para mejorar el nivel de protecci\u00f3n de la propiedad intelectual durante el a\u00f1o 2009.<\/P>

En el caso de Chile, la USTR reconoce los avances realizados, incluidos los registrados en los primeros meses del 2010, pero identifica varios temas pendientes, los cuales deben resolverse de manera acorde a los compromisos suscritos por Chile en virtud de su TLC con Estados Unidos.<\/P>

Es preocupante que la excelente relaci\u00f3n comercial y pol\u00edtica entre Chile y Estados Unidos se vea afectada negativamente por un tema que no se ha resuelto desde que entrara en vigencia el TLC en el 2004. Por supuesto, la propiedad intelectual es uno de los temas m\u00e1s importantes para Estados Unidos, naci\u00f3n que est\u00e1 profundamente ligada a su cultura y a la base de su desarrollo.<\/P>

Con motivo del D\u00eda Mundial de la Propiedad Intelectual el 26 de abril, AmCham suscribi\u00f3 una declaraci\u00f3n en la que se enumeran los temas pendientes en varias \u00e1reas de la protecci\u00f3n a la propiedad intelectual y donde destacan la no implementaci\u00f3n por parte de Chile de sus compromisos en virtud del TLC. Muchos de los puntos en la declaraci\u00f3n tambi\u00e9n fueron mencionados en el informe 301 de la USTR.<\/P>

Si bien reconocemos que los Gobiernos anteriores hicieron avances significativos en esta \u00e1rea, hay algunos temas pendientes que deber\u00edan resolverse antes de que se transformen en importantes obst\u00e1culos para el comercio bilateral.<\/P>

Creemos que la propiedad intelectual deber\u00eda protegerse no s\u00f3lo para cumplir con acuerdos internacionales, sino tambi\u00e9n porque es la base para promover la innovaci\u00f3n y el emprendimiento en Chile. Como ha enfatizado el nuevo Gobierno, el futuro desarrollo de Chile depende en gran medida de su capacidad para proteger la propiedad intelectual.<\/P>

Ricardo Garc\u00eda The US Trade Representative\u2019s Office (USTR) has completed its 2010 301 report on the protection and implementation of intellectual property standards. For a fourth consecutive year, Chile is included on a Priority Watch List of countries that have not protected intellectual property adequately. It also states the U.S. government aims to work with Chile\u2019s new authorities on the implementation of its obligations under the FTA.<\/P> AmCham regrets the repeated inclusion of Chile on this list. The USTR classification was based on an evaluation of efforts made by countries to improve the level of protection of intellectual property in 2009.<\/P> In Chile\u2019s case, the USTR recognizes progress has been made, including in the first few months of 2010, but identifies various pending issues which must be resolved in line with Chile\u2019s obligations under its FTA with the U.S.<\/P> It is worrying that the excellent business and political relationship between Chile and the U.S. is negatively affected by this issue unresolved since the FTA came into force in 2004. Of course, intellectual property is one of the most important issues for the United States, deeply related to its culture and the basis of its development.<\/P> In recognition of World Intellectual Property Day on April 26, AmCham signed a declaration which touched on pending issues in various areas of intellectual property protection, highlighting Chile\u2019s failure to implement its commitments under the FTA. Many of the points in the declaration were also mentioned in the USTR 301 report.<\/P> Although we recognize that previous governments made significant progress in this area, there are some remaining issues that should be resolved before they become major obstacles to bilateral trade.<\/P> We believe that intellectual property should be protected, not just to comply with international agreements, but also because it is the basis for promoting innovation and entrepreneurship in Chile.
