Antes de la celebraci\u00f3n del D\u00eda Mundial de la Propiedad Intelectual el 26 de abril, bUSiness CHILE<\/STRONG> convers\u00f3 con Maximiliano Santa Cruz, director nacional del Instituto Nacional de Propiedad Industrial (INAPI) de Chile, sobre los logros del pa\u00eds en este campo, sus desaf\u00edos pendientes y la contribuci\u00f3n hecha por INAPI desde su lanzamiento en enero del 2009 para reemplazar al Departamento de Propiedad Industrial del Ministerio de Econom\u00eda.<\/P> Abogado y master en Derecho de la Universidad de San Francisco, Santa Cruz tiene una vasta experiencia en protecci\u00f3n a la propiedad intelectual. Antes de unirse a INAPI, trabaj\u00f3 por casi cinco a\u00f1os como miembro de la Misi\u00f3n de Chile ante la Organizaci\u00f3n Mundial del Comercio (OMC), precisamente, a cargo entre otros temas de la propiedad intelectual. Y, antes de eso, fue encargado del mismo tema en la Direcci\u00f3n General de Relaciones Econ\u00f3micas Internacionales (DIRECON) del Ministerio de Relaciones Exteriores de Chile, donde form\u00f3 parte del equipo que negoci\u00f3 el Tratado de Libre Comercio entre Chile y Estados Unidos.<\/P> \u00bfCu\u00e1l es exactamente el rol de INAP? \u00bfEst\u00e1 a cargo de la propiedad intelectual en general o s\u00f3lo de la propiedad industrial?<\/EM><\/STRONG><\/P> S\u00f3lo de lo \u00faltimo. En otras palabras, vemos cosas como patentes, marcas comerciales, denominaci\u00f3n de origen y dise\u00f1os industriales. Temas como los derechos de autor est\u00e1n fuera de nuestro alcance.<\/P> Uno de los objetivos estrat\u00e9gicos de INAPI es promover la innovaci\u00f3n. \u00bfC\u00f3mo lo hacen?<\/STRONG><\/EM><\/P> INAPI desempe\u00f1a un rol clave, porque uno de los objetivos del sistema de protecci\u00f3n a la propiedad intelectual y, principalmente, de las patentes es alentar la innovaci\u00f3n. Lo hacemos mediante la entrega de derechos exclusivos a sus tenedores, quienes \u2013a cambio- deben compartir el conocimiento y con el tiempo esto pasa a ser de dominio p\u00fablico y puede ser usado por cualquier persona.<\/P> \u00bfC\u00f3mo ha sido el desempe\u00f1o de INAPI en su primer a\u00f1o? \u00bfQu\u00e9 resultados ha entregado?<\/STRONG><\/EM><\/P> Pasamos la mayor parte del primer a\u00f1o simplemente haciendo que la nueva organizaci\u00f3n estuviera lista y operativa. Tuvimos que seleccionar y contratar a cerca de 100 personas, y crear nuevas \u00e1reas para manejar asuntos como temas legales y administraci\u00f3n. Bajo el antiguo sistema del Departamento de Propiedad Industrial, estos temas eran manejados por la Subsecretar\u00eda del Ministerio de Econom\u00eda. Y tambi\u00e9n tuvimos que desarrollar procesos para todas nuestras distintas \u00e1reas de actividad.<\/P> Pero tambi\u00e9n creamos una nueva \u00e1rea muy importante para la transferencia de conocimiento. Su labor consiste en detectar y publicitar invenciones que ya forman parte del dominio p\u00fablico as\u00ed como tambi\u00e9n tecnolog\u00edas que pueden ser \u00fatiles para los clusters de alto potencial definidos por el Consejo Nacional para la Innovaci\u00f3n como, por ejemplo, los clusters de miner\u00eda y piscicultura.<\/P> M\u00e1s recientemente, tambi\u00e9n lanzamos un bolet\u00edn a trav\u00e9s del cual esperamos contribuir a la reconstrucci\u00f3n despu\u00e9s del terremoto. Incluye informaci\u00f3n, por ejemplo, sobre tecnolog\u00edas para tratar y almacenar agua, t\u00e9cnicas de construcci\u00f3n y diferentes maneras de procesar los escombros.<\/P> \u00bfQu\u00e9 presupuesto tiene INAPI en comparaci\u00f3n con el ex Departamento de Propiedad Industrial? \u00bfEs suficiente para todo lo que tienen que hacer?<\/STRONG><\/EM><\/P> Para este a\u00f1o, tenemos un presupuesto de poco m\u00e1s de 5.300 millones de pesos (cerca de US$ 10 millones). Es dif\u00edcil compararlo con el Departamento de Propiedad Industrial porque era parte del Ministerio de Econom\u00eda, pero se har\u00e1 una idea del tama\u00f1o del cambio si le digo que tenemos dos veces m\u00e1s personal.<\/P> El presupuesto no es \u00f3ptimo. En el 2009, tuvo en realidad cerca de 150 millones de pesos m\u00e1s, pero entendemos que, en un a\u00f1o de reconstrucci\u00f3n, ten\u00edamos que ser realistas y reducir nuestras expectativas.<\/P> \u00bfC\u00f3mo se relaciona INAPI con el sector privado?<\/STRONG><\/EM><\/P> Si bien tambi\u00e9n trabajamos con otras agencias de Gobierno, nuestro principal cliente es precisamente el sector privado. Es el sector privado el que postula a patentes y para registrar marcas, y es un participante en aquellos casos en los que INAPI act\u00faa como tribunal.<\/P> De hecho, tenemos muy buenas relaciones con el sector privado. Trabajamos mucho para proporcionar informaci\u00f3n a las firmas de abogados, universidades e investigadores as\u00ed como tambi\u00e9n a las empresas.<\/P> Hace poco, adem\u00e1s de nuestras otras actividades conjuntas, lanzamos un nuevo proceso de di\u00e1logo abierto y franco con expertos del sector privado en el que estaremos trabajando juntos para elaborar propuestas destinadas a mejorar la regulaci\u00f3n de los derechos de propiedad intelectual de Chile.<\/P> Usted mencion\u00f3 las universidades, pero en general estas no tienen pol\u00edticas sobre la protecci\u00f3n de propiedad intelectual\u2026<\/STRONG><\/EM><\/P> Afortunadamente, vemos que est\u00e1n mostrando cada vez m\u00e1s inter\u00e9s en el tema. INAPI tiene un rol muy importante que desempe\u00f1ar para que haya una mayor comprensi\u00f3n del sistema de protecci\u00f3n a la propiedad intelectual y para ayudar a las universidades a desarrollar sus propias pol\u00edticas. Estamos preparando lo que hemos denominado Set de Herramientas PI que ayudan a las universidades a maximizar el uso del sistema, proteger y comercializar su propiedad intelectual y tambi\u00e9n a respetar la de otros. Otro buen ejemplo de lo que estamos haciendo es un acuerdo que suscribimos recientemente con la Corporaci\u00f3n REUNA, la que nos permitir\u00e1 usar sus redes para informar a la comunidad cient\u00edfica fuera de Santiago sobre temas relacionados con la propiedad intelectual.<\/P> Un nuevo Gobierno asumi\u00f3 en marzo, \u00bfimplica eso nuevas pol\u00edticas de propiedad intelectual?<\/STRONG><\/EM> <\/P> Por el momento, no hay ning\u00fan cambio. Sin embargo, las decisiones del nuevo Gobierno sobre la estrategia nacional de innovaci\u00f3n ser\u00e1n muy importantes.<\/P> \u00bfQu\u00e9 ve usted como debilidades de Chile en materia de propiedad intelectual?<\/STRONG><\/EM><\/P> En los \u00faltimos a\u00f1os, el pa\u00eds ha logrado enormes avances en distintas \u00e1reas, pero -en mi opini\u00f3n- a\u00fan hay mucho por hacer en el fortalecimiento del marco institucional y en el desarrollo de una legislaci\u00f3n moderna y arm\u00f3nica que realmente fomente la creatividad y la innovaci\u00f3n. Ello tambi\u00e9n ayudar\u00eda a evitar la confusion del mercado.<\/P> A su juicio, \u00bf Chile est\u00e1 cumpliendo con su Tratado de Libre Comercio con Estados Unidos en lo relativo a la protecci\u00f3n de la propiedad intelectual?<\/EM><\/STRONG><\/P> Creo que esa es una pregunta para el Ministerio de Relaciones Exteriores.<\/P> Si la Oficina del Representante Comercial de Estados Unidos (USTR por su sigla en ingl\u00e9s) mantiene a Chile por otro a\u00f1o m\u00e1s en su Lista Prioritaria de Vigilancia de pa\u00edses que no han protegido de manera adecuada la propiedad intelectual, \u00bfc\u00f3mo afectar\u00eda eso a su imagen pa\u00eds?<\/EM><\/STRONG><\/P> Tenemos que esperar hasta fin de mes para saber si eso ser\u00e1 as\u00ed o no, pero por supuesto no es bueno estar en la lista. Sin embargo, no se puede poner en duda que Chile ha logrado una gran cantidad de avances en los \u00faltimos a\u00f1os y la creaci\u00f3n de INAPI es una clara se\u00f1al de la importancia que se ha asignado a este tema.<\/P> Ruth Bradley<\/STRONG> es corresponsal en Santiago de The Economist<\/P> Ahead of the celebration of World Intellectual Property Day on April 26, bUSiness CHILE<\/STRONG> talked to Maximiliano Santa Cruz, director of Chile\u2019s National Industrial Property Institute (INAPI), about Chile\u2019s achievements in this field, its pending challenges and the contribution made by INAPI since its launch in January 2009 to replace the Economy Ministry\u2019s Department of Industrial Property.<\/P> A lawyer who holds a master\u2019s degree from the University of San Francisco, Santa Cruz has vast experience in intellectual property protection. Before joining INAPI, he served for almost five years as a member of Chile\u2019s mission to the World Trade Organization where the issues he was responsible for included, precisely, intellectual property. And, before that, he covered the same issue at the Foreign Ministry\u2019s Directorate of International Economic Relations (DIRECON) where he was part of the team that negotiated the Chile-U.S. Free Trade Agreement (FTA).<\/P> What exactly is INAPI\u2019s role? Is it responsible for intellectual property in general or just industrial property?<\/EM><\/STRONG><\/P> Just the latter. In other words, we manage things like patents, trademarks, denomination of origin and industrial designs. Matters like copyright are out of our scope.<\/P> One of INAPI\u2019s strategic objectives is to promote innovation. How do you do that?<\/EM><\/STRONG><\/P> INAPI plays a key role because one of the aims of the system of protection of intellectual property and, principally, patents is to foster innovation. We do this by granting exclusive rights to their holder who must, in exchange, share the knowledge and, eventually, this falls into the public domain and can be used by everyone.<\/P> How has INAPI performed in its first year? What results has it delivered?<\/EM><\/STRONG><\/P> We spent most of the first year simply getting the new organization up and running. We had to select and hire around 100 people and create new areas to handle things like legal affairs and administration. Under the former system with the Department of Industrial Property, these matters were managed by the undersecretariat of the Economy Ministry. And we also had to develop processes for all our different areas of activity.<\/P> But we also created a very important new area for the transfer of knowledge. Its job is to detect and publicize inventions that are already in the public domain as well as technologies that can be useful for the high-potential clusters defined by the National Council for Innovation like, for example, the mining and fish-farming clusters.<\/P> More recently, we\u2019ve also launched a newsletter through which we hope to contribute to reconstruction after the earthquake. It includes information, for example, about technologies for treating and storing water, building techniques and different ways of processing rubble. <\/P> What budget does INAPI have as compared to the former Department of Industrial Property? Is it sufficient for all you have to do?<\/EM><\/STRONG><\/P> For this year, we have a budget of just over 5.3 billion pesos (around US$10 million). It\u2019s difficult to compare with the Department of Industrial Property because it was part of the Economy Ministry but you\u2019ll get some idea of the scale of the change if I tell you that we have twice as many staff.<\/P> The budget isn\u2019t optimum. In 2009, it was actually around 150 million pesos more but we understand that, in a year of reconstruction, we had to be realistic and reduce our expectations.<\/P> How does INAPI relate to the private sector?<\/EM><\/STRONG><\/P> Although we also work with other government agencies, our principal client is precisely the private sector. It\u2019s the private sector that applies for patents and to register trademarks and is a player in those cases in which INAPI acts as a tribunal.<\/P> In fact, we have very good relations with the private sector. We do a lot to provide information to law firms, universities and researchers as well as companies.<\/P> More recently, in addition to our other joint activities, we have launched a new process of open and frank dialogue with private-sector experts in which we\u2019ll be working together to draw up proposals for improving Chile\u2019s regulation of intellectual property rights.<\/P> You mentioned universities, but in general these don\u2019t have policies on the protection of intellectual property\u2026<\/EM><\/STRONG><\/P> Fortunately, we see that they\u2019re showing ever greater interest in the issue. INAPI has a very important role to play in increasing understanding of the system of intellectual property protection and helping universities to develop their own policies. We\u2019re preparing what we call IP Toolkits that help universities to make the best use of the system, protecting and marketing their intellectual property and also respecting that of others. Another good example of what we\u2019re doing is an agreement we signed recently with the REUNA Corporation, which will allow us to use its networks to inform the scientific community outside Santiago about issues relating to intellectual property.<\/P> A new government took office in March; does that mean new policies on intellectual property?<\/EM><\/STRONG> <\/P> For the moment, there isn\u2019t any change. The new government\u2019s decisions on the national innovation strategy will, however, be very important.<\/P> What do you see as Chile\u2019s weaknesses on intellectual property?<\/EM><\/STRONG><\/P> In recent years, it\u2019s made enormous progress in different areas but, in my view, there\u2019s still a lot to do in strengthening the institutional framework and in developing modern and harmonic legislation that really fosters creativity and innovation. This would also help to avoid market confusion.<\/P> In your view, is Chile in compliance with its Free Trade Agreement with the United States as regards protection of intellectual property?<\/EM><\/STRONG><\/P> I think that\u2019s a question for the Foreign Affairs Ministry.<\/P> If the USTR keeps Chile on its Priority Watch List of countries that have not adequately protected intellectual property for another year, what impact would that have on its country image?<\/EM><\/STRONG><\/P> We have to wait until the end of the month to know whether that will be the case but, of course, it isn\u2019t good to be on the list.
