{"id":4098,"date":"2009-05-01T01:00:00","date_gmt":"2009-05-01T01:00:00","guid":{"rendered":""},"modified":"2015-01-26T14:46:19","modified_gmt":"2015-01-26T14:46:19","slug":"limitando-la-confidencialidad-de-los-clientes-bancarios","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/limitando-la-confidencialidad-de-los-clientes-bancarios\/","title":{"rendered":"<!--:es-->Limitando la Confidencialidad de los Clientes Bancarios<!--:--><!--:en-->Limiting Bank-Client Confidentiality<!--:-->"},"content":{"rendered":"<p><!--:es--><!--break--><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Piense en un para\u00edso tributario y nombres como Bermuda o las Islas Caim\u00e1n se vienen a la mente, pero no el de Chile. Sin embargo, en abril, Chile se encontr\u00f3 en la denominada \u201clista gris\u201d -que incluye a Austria, Suiza y Singapur- de pa\u00edses que no han implementado un art\u00edculo clave del Modelo de Convenio Tributario de la OCDE para intercambiar informaci\u00f3n con fines tributarios.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La evasi\u00f3n tributaria se ha convertido en los \u00faltimos meses en un tema de atenci\u00f3n de la Organizaci\u00f3n para la Cooperaci\u00f3n y el Desarrollo Econ\u00f3micos (OCDE) como parte de la tendencia mundial hacia una mayor transparencia en las transacciones financieras. La reuni\u00f3n del G-20 realizada en Londres en abril, ocasi\u00f3n durante la cual se public\u00f3 la lista, tambi\u00e9n dio una fuerte se\u00f1al en cuanto a que ser un buen ciudadano del mundo incluye eliminar los obst\u00e1culos a la transparencia financiera.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Si bien la crisis financiera internacional no fue causada por la confidencialidad banco-cliente, ha sacudido la confianza p\u00fablica en el sistema bancario y restaurar esta confianza es una prioridad para los gobiernos de todo el mundo. Adem\u00e1s, asegurar que todos los pa\u00edses ocupen las mismas reglas tributarias permitir\u00eda que gobiernos faltos de efectivo puedan hacer un seguimiento a los evasores de impuestos y ayuden a pagar costosos planes de est\u00edmulo econ\u00f3mico, destaca Nicola Bonucci, director de Asuntos Legales de la OCDE.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Chile no es considerado un para\u00edso tributario, afirma, y tiene m\u00e1s que ganar que perder al cumplir con el est\u00e1ndar de la OCDE. \u201cNo creemos que sea una revoluci\u00f3n, es m\u00e1s bien una evoluci\u00f3n\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">A comienzos de mayo, el Gobierno -de hecho- present\u00f3 al Congreso un proyecto de ley que permitir\u00eda al Servicio de Impuestos Internos (SII) acceder a la informaci\u00f3n de las cuentas bancarias de los chilenos y compartirla con las autoridades tributarias de otros pa\u00edses.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Si el proyecto de ley se aprueba, y se espera que ello ocurra de manera bastante r\u00e1pida, Chile ser\u00e1 sacado de la lista y cumplir\u00e1 con una condici\u00f3n clave para ser miembro de la OCDE. \u201cPero no todo tiene que ver con la OCDE\u201d, se\u00f1ala Karen Poniachik, ex ministra de Miner\u00eda y representante de Chile en las negociaciones con la OCDE.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cTenemos que aprobar esta legislaci\u00f3n para mantener nuestra posici\u00f3n en el extranjero como uno de los pa\u00edses m\u00e1s transparentes\u201d, se\u00f1ala. \u201cEs la direcci\u00f3n que est\u00e1 tomando el mundo, de modo que \u00bfpor qu\u00e9 Chile debiera quedarse atr\u00e1s?\u201d<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El SII ya recopila informaci\u00f3n sobre los salarios, inversiones y activos de los contribuyentes. S\u00f3lo los saldos y las operaciones de las cuentas bancarias est\u00e1n fuera del alcance de las autoridades a menos que un tribunal dictamine que hay suficiente evidencia de actividades criminales como tr\u00e1fico de drogas, lavado de dinero o terrorismo.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEn la actualidad podemos intercambiar informaci\u00f3n con otros pa\u00edses en el 90% de los casos, pero esta ley est\u00e1 dise\u00f1ada para abordar el otro 10%\u201d, se\u00f1ala Poniachik.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><SPAN style=\"FONT-SIZE: small\"><STRONG>Los L\u00edmites de La Privacidad<\/STRONG><\/SPAN><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">El Gobierno de Bachelet quiere que Chile se convierta en miembro de la OCDE antes del t\u00e9rmino de su mandato en marzo de 2010 y lograr esto exige legislar en contra de las empresas sospechosas de sobornos y mejorar el gobierno corporativo de empresas estatales como Codelco, pero cumplir con la normativa de intercambio de informaci\u00f3n de la OCDE es lejos la condici\u00f3n m\u00e1s importante.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Tambi\u00e9n allanar\u00eda el camino para suscribir un acuerdo que evita la doble tributaci\u00f3n con Estados Unidos. Chile tiene 20 acuerdos vigentes de este tipo con pa\u00edses que incluyen a Canad\u00e1 y el Reino Unido, pero los acuerdos con Estados Unidos, adem\u00e1s de Australia, se han estancado por el tema de la confidencialidad banco-cliente.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cEl acuerdo de doble tributaci\u00f3n (\u2026) constituye un avance natural despu\u00e9s del Tratado de Libre Comercio entre Chile y Estados Unidos\u201d, se\u00f1ala Ricardo Garc\u00eda, presidente de la AmCham y de Seguros Interamericana, la filial chilena de AIG. \u201cMejorar\u00eda el flujo de inversi\u00f3n, en particular, de inversiones chilenas en Estados Unidos\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">No obstante, hay un tema de privacidad, un derecho consagrado en el Art\u00edculo 19 de la Constituci\u00f3n de Chile, destaca Garc\u00eda. El presidente de la AmCham a\u00f1ade que dar a los funcionarios p\u00fablicos acceso a la informaci\u00f3n de cuentas bancarias incrementar\u00eda la posibilidad de su mal uso. \u201cPero ser un pa\u00eds transparente que cumple con los est\u00e1ndares de la OCDE y los acuerdos de doble tributaci\u00f3n no es incompatible en lo que respecta a los derechos de los ciudadanos\u201d, afirma.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">De hecho, los chilenos no tienen que preocuparse sobre su privacidad en virtud de la nueva ley, se\u00f1ala H\u00e9ctor Lehued\u00e9, asesor de pol\u00edtica tributaria del ministro de Hacienda. \u201cEsto no significa un t\u00e9rmino de la confidencialidad (\u2026) el SII ya maneja informaci\u00f3n confidencial sin revelarla\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Es cierto que el nuevo proyecto de ley da al SII acceso a cuentas bancarias en asuntos tributarios no criminales como exige la OCDE, pero los clientes tendr\u00e1n el derecho a objetar, en una audiencia judicial, la divulgaci\u00f3n de su informaci\u00f3n al SII o a cualquier otra autoridad tributaria extranjera.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Luego que el SII env\u00ede una solicitud de informaci\u00f3n, el banco tendr\u00eda que informar por escrito a su cliente y este \u00faltimo tendr\u00eda entonces 10 d\u00edas para decidir si acepta o rechaza la solicitud. De ser rechazada, el SII tendr\u00eda que recurrir a tribunales para conseguir una autorizaci\u00f3n judicial con el fin de acceder a la informaci\u00f3n.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Residentes de otros pa\u00edses como Estados Unidos y Canad\u00e1 no tienen la opci\u00f3n de recurrir a tribunales, pero es aceptable para la OCDE \u201csiempre y cuando el procedimiento sea r\u00e1pido\u201d, se\u00f1ala Bonucci.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cSiempre hemos dicho que el acceso a la informaci\u00f3n bancaria puede ser a trav\u00e9s de medios directos o indirectos, y los medios indirectos podr\u00edan incluir un procedimiento administrativo o judicial\u201d, explica. \u201cA solicitud no es lo mismo que cuando se solicite\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Una de las objeciones clave en Chile para permitir que el SII tenga un amplio acceso a la informaci\u00f3n bancaria ha sido que, en virtud de la actual legislaci\u00f3n, es el propio SII el que resuelve las apelaciones sobre temas tributarios. Sin embargo, ahora se est\u00e1n creando Tribunales Tributarios y Aduaneros, si bien algunos podr\u00edan no estar listos para realizar audiencias en algunas partes del pa\u00eds hasta 2012 (y, mientras tanto, las solicitudes para autorizaci\u00f3n judicial en virtud de la nueva Ley recibir\u00e1n audiencia en los tribunales civiles).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Si se considera que Chile no es un para\u00edso tributario, las autoridades prev\u00e9n que no se presentar\u00e1n frecuentemente solicitudes de informaci\u00f3n de autoridades tributarias de otros pa\u00edses. Espa\u00f1a, por ejemplo, recibe cerca de 10 solicitudes del a\u00f1o. \u201cComo Espa\u00f1a, no prevemos mucho inter\u00e9s de otros pa\u00edses, pero tenemos que tener el mismo est\u00e1ndar\u201d, afirma Lehued\u00e9.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><SPAN style=\"FONT-SIZE: small\"><STRONG>Las Ventajas de la Transparencia<\/STRONG><\/SPAN><\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">De manera rec\u00edproca, la legislaci\u00f3n potencialmente otorgar\u00e1 al SII acceso a la informaci\u00f3n de chilenos que podr\u00edan estar evadiendo impuestos locales a trav\u00e9s de cuentas bancarias en el extranjero. Esto har\u00e1 que la recaudaci\u00f3n tributaria sea m\u00e1s eficiente y dar\u00e1 a los contribuyentes chilenos la confianza de que todos son tratados de la misma manera por la ley, argumenta Lehued\u00e9.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cNo hay una relaci\u00f3n directa entre acceso a la informaci\u00f3n bancaria y una reducci\u00f3n de la evasi\u00f3n tributaria\u201d, se\u00f1ala el director del SII, Ricardo Escobar, \u201cpero es un complemento de nuestras herramientas para asegurar que los impuestos se paguen\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La evasi\u00f3n tributaria no terminar\u00e1 nunca, admite, pero una mejor regulaci\u00f3n puede reducirla. \u201cEso contribuye a formar una econom\u00eda m\u00e1s sana en la que las empresas que cumplen no enfrentan la competencia desleal de quienes no pagan sus impuestos\u201d, se\u00f1ala.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Por supuesto, esto depende de la cooperaci\u00f3n con los bancos. La nueva legislaci\u00f3n significar\u00e1 m\u00e1s trabajo y mayores costos en la recolecci\u00f3n de informaci\u00f3n sobre clientes y en su traspaso a las autoridades, se\u00f1ala Jos\u00e9 Manuel Montes, fiscal de la Asociaci\u00f3n de Bancos e Instituciones Financieras (ABIF).<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">La mayor parte de la informaci\u00f3n que posiblemente se solicitar\u00e1 est\u00e1 disponible mediante un clic, pero en algunos casos podr\u00eda ser m\u00e1s complicado. Es por ello que los bancos europeos han solicitado que el Estado les reembolse por este servicio, indica Montes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cExiste el riesgo de que (el SII) pueda emprender una tarea de b\u00fasqueda solicitando a los bancos informaci\u00f3n sobre 100.000 clientes con la esperanza de encontrar a uno que no cumpla, pero esperamos que ello no ocurra\u201d, sostiene Montes.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Para evitar esto, las solicitudes s\u00f3lo debieran presentarse en casos espec\u00edficos en donde hay una investigaci\u00f3n garantizada, comenta. \u201cEl negocio de los bancos no es proteger a criminales, obedeceremos la ley (\u2026), pero esperamos que la autoridad tributaria sea racional y prudente en sus solicitudes\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">Claramente, la transparencia es una prioridad para el Gobierno de Chile. En abril, los sueldos de todos los funcionarios p\u00fablicos se divulgaron en Internet como resultado de una nueva legislaci\u00f3n que requiere la total transparencia de las instituciones p\u00fablicas.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cMi sueldo como asesor del ministro se public\u00f3 en una p\u00e1gina del cuerpo B2 del diario (\u2026) de manera que \u00bfpor qu\u00e9 las autoridades tributarias, que son responsables de garantizar que todos paguen sus impuestos, no debieran tener (\u2026) acceso a la informaci\u00f3n de mi cuenta bancaria?\u201d, pregunta Lehued\u00e9.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\">\u201cLos beneficios de estar a la vanguardia de la transparencia son mucho mayores que los del status quo\u201d, insiste Poniachik. Chile es un pa\u00eds peque\u00f1o y una de sus ventajas competitivas es su reputaci\u00f3n de transparencia, destaca. \u201cNuestros socios esperan que nosotros tengamos los est\u00e1ndares m\u00e1s altos y no hay ninguna excusa para que no sea as\u00ed\u201d.<\/P><br \/>\n<P style=\"TEXT-ALIGN: justify\"><STRONG>Julian Dowling<\/STRONG> trabaja como periodista freelance y contribuye de manera regular a <STRONG>bUSiness CHILE<\/STRONG>.<\/P><!--:--><!--:en--><br \/>\n<!--break--><br \/>\n<b><I>Chile\u2019s bid to become a member of the OECD &#8211; and sign a double taxation agreement with the U.S. &#8211; hangs on a bill, presented to Congress at the beginning of May, to give the tax authorities access to Chileans\u2019 bank accounts.  <\/b><\/I><\/p>\n<p>Think of a tax haven and names like Bermuda or the Cayman Islands spring to mind, but not Chile. Yet, in April, Chile found itself on a so-called \u2018grey list\u2019 of countries,  including Austria, Switzerland and Singapore, that have not yet implemented a key article of the OECD Model Tax Convention to allow exchange of information for tax purposes. <\/p>\n<p>Tax evasion has become a focus of the Organisation for Economic Co-operation and Development (OECD) in recent months as part of the global trend towards greater transparency in financial transactions. The G-20 meeting in London in April, during which the list was issued, also gave a strong signal that being a good global citizen includes removing obstacles to financial transparency.<\/p>\n<p>Although the international financial crisis was not caused by bank-client confidentiality, it has shaken public confidence in the banking system and restoring this trust is a priority of governments worldwide. In addition, ensuring that all countries play by the same tax rules would let cash-strapped governments track down tax avoiders and help pay for expensive economic stimulus plans, points out Nicola Bonucci, the OECD\u2019s director for legal affairs.<\/p>\n<p>Chile is not considered a tax haven, he says, and has more to gain than lose from complying with the OECD standard. \u201cWe don\u2019t believe it\u2019s a revolution, it\u2019s more of an evolution.\u201d <\/p>\n<p>At the beginning of May, the government did, in fact, present Congress with a bill that would allow the national tax service, the <I>Servicio de Impuestos Internos <\/I>(SII), to access Chileans\u2019 bank account information and share it with other countries\u2019 tax authorities.  <\/p>\n<p>If the bill passes &#8211; and it is expected to do so fairly quickly &#8211; Chile will be taken off the list and meet a key condition for OECD membership. \u201cBut this is not only about the OECD,\u201d says Karen Poniachik, a former minister of mining and Chile\u2019s representative in negotiations with the OECD. <\/p>\n<p>\u201cWe have to pass this legislation to keep up our position abroad as one of the more transparent countries,\u201d she says. \u201cIt\u2019s the direction the world is going, so why should Chile be left behind?\u201d <\/p>\n<p>The SII already collects information about the salaries, investments and assets of taxpayers. Only bank account balances and transactions are off-limits for the authorities unless a court rules there is sufficient evidence of criminal activity like drug trafficking, money laundering or terrorism.<\/p>\n<p>\u201cWe\u2019re currently able to exchange information with other countries in 90% of cases, but this law is designed to address the other 10%,\u201d says Poniachik.<\/p>\n<p><font size= \u201c2\u201d> <b>The limits of privacy<\/b><\/font><\/p>\n<p>The Bachelet administration wants Chile to become a member of the OECD before the end of its term in March 2010 and achieving this requires legislating against companies suspected of bribery and improving the corporate governance of state-owned companies like Codelco, but falling into line with the OECD\u2019s exchange-of-information rules is by far the most important condition.<\/p>\n<p>It would also pave the way to signing a double taxation avoidance agreement with the United States. Chile has 20 such agreements in force with countries including Canada and the UK, but agreements with the U.S., as well as Australia, have stalled on the issue of bank-client confidentiality. <\/p>\n<p>\u201cThe double taxation agreement\u2026 is a natural development after the Chile-U.S. Free Trade Agreement,\u201d says Ricardo Garc\u00eda, president of AmCham and AIG\u2019s Chilean subsidiary Seguros Interamericana. \u201cIt would improve the flow of investments, in particular Chilean investments in the U.S.\u201d <\/p>\n<p>But there is the matter of privacy, a right enshrined in Article 19 of Chile\u2019s constitution, points out Garc\u00eda, who also adds that giving public officials access to bank account information would increase the possibility of its misuse. \u201cBut being a transparent country aligned with OECD standards and double taxation agreements is not incompatible with respecting the rights of citizens,\u201d he says. <\/p>\n<p>Indeed, Chileans need not be concerned about their privacy under the new law, says H\u00e9ctor Lehued\u00e9, tax policy advisor to the finance minister. \u201cThis does not mean an end to confidentiality\u2026 the SII already manages confidential information without disclosing it.\u201d <\/p>\n<p>It\u2019s true that the new bill gives the SII access to bank accounts in non-criminal tax matters as requested by the OECD, but clients would have the right to object, at a judicial hearing, to the disclosure of their information to the SII or any foreign tax authority.<\/p>\n<p>After the SII sends a request for information, the bank would have to inform their client in writing, and the client would then have ten days to decide whether to accept or reject the request. If rejected, the SII would have to go to court to get judicial authorization to access the information. <\/p>\n<p>Residents of other countries like the U.S. and Canada do not have the option of going to court, but it is acceptable to the OECD \u201cprovided the procedure is a speedy one,\u201d says Bonucci. <\/p>\n<p>\u201cWe have always said that access to banking information can be through direct or indirect means, and indirect means could include an administrative or judicial proceeding,\u201d he explains. \u201cOn request does not mean on demand.\u201d  <\/p>\n<p>One of the key objections in Chile to allowing the SII broader access to banking information has been that, under present legislation, it is the SII itself that rules on appeals on tax matters. Now, however, independent Tax and Customs Courts are being created, although some may not be ready to hear cases in parts of the country until 2012 (and, in the interim, requests for judicial authorization under the new law would be heard by the civil courts).   <\/p>\n<p>Considering that Chile is not a tax haven, the authorities do not expect frequent requests for information from other countries\u2019 tax authorities. Spain, for example, receives about ten requests a year. \u201cLike Spain, we don\u2019t expect much interest from other countries, but we must have the same standard,\u201d says Lehued\u00e9.<\/p>\n<p><font size= \u201c2\u201d> <b>The advantages of transparency<\/b><\/font><\/p>\n<p>By reciprocity, the law will potentially give the SII access to information about Chileans who may be avoiding local taxes via foreign bank accounts. This will make tax collection more efficient and give Chilean taxpayers confidence that everyone is being treated equally under the law, argues Lehued\u00e9.<\/p>\n<p>\u201cThere is no direct relation between access to banking information and a reduction in tax evasion,\u201d says SII director Ricardo Escobar, \u201cbut it is an addition to our toolbox for ensuring taxes are paid.\u201d<br \/>\nTax evasion will never end, he admits, but better regulation can reduce it. \u201cThat helps make a healthier economy in which companies that do comply do not face unfair competition from those that don\u2019t pay their taxes,\u201d he says. <\/p>\n<p>Of course, this depends on the cooperation of the banks. The new law will mean more work and higher costs in collecting information about clients and passing it on to the authorities, says Jos\u00e9 Manuel Montes, head of the legal department at the Association of Banks and Financial Institutions (ABIF).<\/p>\n<p>Most of the information likely to be requested is available at the click of a button but some cases could be more complicated. That is why European banks have asked to be reimbursed by the state for this service, says Montes.<\/p>\n<p>\u201cThere is a risk that (the SII) could go on fishing expeditions asking the banks for information on 100,000 clients in the hopes of catching one cheating, but we hope this doesn\u2019t happen,\u201d says Montes.<\/p>\n<p>To avoid this, requests should only be made in specific cases where an investigation is warranted, he says. \u201cThe banks are not in the business of protecting criminals, we will obey the law\u2026 but we expect the tax authority to be rational and prudent in its requests.\u201d <\/p>\n<p>Clearly, transparency is a priority for Chile\u2019s government. In April, the salaries of all public officials were published on the Internet as the result of a new law requiring full transparency in public institutions.<\/p>\n<p>\u201cMy salary as advisor to the minister was published on page B2 of the newspaper\u2026 so why shouldn\u2019t  the tax authorities, who are responsible for making sure we all pay our taxes, have\u2026  access to my bank account information?\u201d asks Lehued\u00e9.<\/p>\n<p>\u201cThe benefits of being in the vanguard of transparency are far greater than the status quo,\u201d insists Poniachik.
