El orador invitado del desayuno que la AmCham celebr\u00f3 el 8 de mayo -el ministro de Econom\u00eda, Hugo Lavados – es un antiguo amigo de la C\u00e1mara y ex miembro de su Comit\u00e9 Editorial. Y, se declar\u00f3 en la oportunidad como amigo de Estados Unidos tanto porque estudi\u00f3 en esa naci\u00f3n como porque, as\u00ed como por su labor como director de ProChile (la agencia gubernamental de promoci\u00f3n de las exportaci\u00f3n) entre el 2003 y el 2006, siendo responsable de ayudar a empresas chilenas a incrementar sus ventas en ese mercado clave.<\/P>

A\u00fan si se deja a un lado el efecto de los precios r\u00e9cord del cobre en los \u00faltimos a\u00f1os, el intercambio comercial de Chile con Estados Unidos es extremadamente din\u00e1mico, subray\u00f3 el ministro Lavados. Y, de manera a\u00fan m\u00e1s importante, a\u00f1adi\u00f3, ese comercio est\u00e1 altamente diversificado mientras que en el caso de China, por ejemplo, m\u00e1s del 90% de las exportaciones de Chile corresponden al cobre. El libre comercio entre Chile y Estados Unidos ha sido beneficioso para ambos socios, destac\u00f3. De hecho, las importaciones de Chile desde Estados Unidos han crecido m\u00e1s r\u00e1pidamente que sus exportaciones a Estados Unidos. Por supuesto, eso se debe en parte a la debilidad del d\u00f3lar, pero tambi\u00e9n refleja -seg\u00fan el ministro Lavados- las preferencias de los consumidores chilenos.<\/P>
\n
Sin embargo, hay un \u201cbache\u201d en las relaciones entre Chile y Estados Unidos, reconoci\u00f3, en cuanto a sus diferencias sobre la protecci\u00f3n de los derechos de propiedad intelectual. Pero, en virtud de una nueva ley, Chile est\u00e1 en proceso de crear un Instituto de Propiedad Intelectual para reemplazar al Departamento de Propiedad Industrial del Ministerio de Econom\u00eda.<\/P>

El nuevo instituto debiera comenzar a operar a comienzos del pr\u00f3ximo a\u00f1o, inform\u00f3 Lavados, y significar\u00e1 un importante cambio en t\u00e9rminos de tecnolog\u00eda, capacidad y recursos. A\u00f1adi\u00f3 que es mucho m\u00e1s que un mero cambio de nombre, como han sugerido algunos cr\u00edticos.<\/P>
\n
A trav\u00e9s del Servicio Nacional de Pesca, el Ministerio de Econom\u00eda tambi\u00e9n es responsable del cultivo de salmones, otra \u00e1rea que ha estado sujeta a controversia en el \u00faltimo tiempo, tras la publicaci\u00f3n de un art\u00edculo cr\u00edtico en un diario estadounidense. El problema, manifest\u00f3, es un brote del virus de Anemia Infecciosa del Salm\u00f3n (ISA, por su sigla en ingl\u00e9s) que \u201ccausa una baja en la producci\u00f3n y, en algunos casos, en la calidad del producto final, pero que en ning\u00fan caso se trata con el uso de antibi\u00f3ticos precisamente porque se trata de un virus\u201d.<\/P>

A grosso modo, la labor del Ministerio de Econom\u00eda tiene que ver con la productividad y la eficiencia del mercado, dijo el ministro en el desayuno a los miembros de la AmCham y sus invitados. En consecuencia, tiene una amplia gama de responsabilidades en \u00e1reas que incluyen la regulaci\u00f3n antimonopolio, la protecci\u00f3n de los consumidores y el establecimiento de tarifas para los sectores de aguas, gas y telecomunicaciones.<\/P>

Sin embargo, una de las \u00e1reas a las que asigna la m\u00e1xima importancia es el desarrollo de las peque\u00f1as y medianas empresas (Pymes). Su objetivo es establecer un campo de juego nivelado para las Pymes, reduciendo las asimetr\u00edas e ineficiencias del mercado que se dan, si se permite totalmente la libre competencia, sostuvo.<\/P>
\n
Eso implica modificar la regulaci\u00f3n, afirm\u00f3 el ministro Lavados. \u201cNo tiene sentido decir que queremos promover la innovaci\u00f3n, tener m\u00e1s empresarios y ver que las empresas privadas son m\u00e1s eficientes si estamos llenos de dificultades para la creaci\u00f3n, el desarrollo e, incluso, el cierre de empresas\u201d.<\/P>

La aplicaci\u00f3n de la normativa tambi\u00e9n debe ser did\u00e1ctica, en lugar de punitiva, insisti\u00f3, y -en lugar de imponer multas o cierres de empresas- la tendencia debiera apuntar a buscar una soluci\u00f3n al problema. \u201cPero es m\u00e1s f\u00e1cil decirlo que hacerlo\u201d, admiti\u00f3, \u201cporque hay muchas agencias estatales involucradas, todas con distintas \u00e1reas de responsabilidad\u201d.<\/P>

Tambi\u00e9n es necesario reducir la burocracia, a\u00f1adi\u00f3. \u201cLa cantidad de permisos que las empresas tienen que obtener -y esto probablemente se apliqu\u00e9 a empresas de todos los tama\u00f1os- y las demoras involucradas son un costo que tenemos que tratar de reducir\u201d, se\u00f1al\u00f3.<\/P>

No obstante, el ministro Lavados tambi\u00e9n tuvo palabras para aquellos que quieren un Estado m\u00e1s peque\u00f1o, argumentando que, adem\u00e1s de ser eficiente, el Estado necesita desarrollarse de manera acorde con las nuevas actividades y las demandas que ello implica.<\/P>

La reciente erupci\u00f3n del volc\u00e1n Chait\u00e9n, en el sur de Chile, sirve de ejemplo, destac\u00f3. Pese a ser uno de los pa\u00edses m\u00e1s \u201cvolc\u00e1nicos\u201d del mundo, Chile no sabe mucho de sus volcanes y necesita ampliar sus muy limitadas estaciones de monitoreo. \u201c\u00bfEs eso algo que el sector privado puede hacer? Claramente no, porque se trata de un bien p\u00fablico\u201d, concluy\u00f3 el ministro Lavados.<\/P>

Even setting aside the effect of the record copper prices of recent years, Chile\u2019s trade with the U.S. is extremely dynamic, noted Minister Lavados. And, even more importantly, he added, that trade is highly diversified whereas, in the case of China, for example, more than 90% of Chile\u2019s exports are copper. <\/p>\n
Free trade between the Chile and the U.S. has been beneficial for both partners, he pointed out. Indeed, Chile\u2019s imports from the U.S. have grown more quickly than its exports to the U.S. That is, of course, due partly to the dollar\u2019s weakness but, according to Minister Lavados, also reflects the preferences of Chilean consumers. <\/p>\n
There is, however, a \u201cbump\u201d in Chile-U.S. relations, he recognized, in the form of their differences over protection of intellectual property rights. But, under a new law, Chile is in the process of creating an Industrial Property Institute to replace the Economy Ministry\u2019s Industrial Property Department. <\/p>\n
The new Institute should start operations at the beginning of next year, reported Lavados, and will mean an important change in technology, capacity and resources. It is, he added, far more than a mere change of name, as some critics have suggested. <\/p>\n
Through the National Fisheries Service, the Economy Ministry is also responsible for salmon farming, another area that has been a subject of controversy recently, following the publication of a critical article in a U.S. newspaper. The problem there, he said, is an outbreak of the ISA virus which \u201ccauses a drop in production and, in some cases, the quality of the final product but is, in no case, treated using antibiotics precisely because it is a virus.\u201d <\/p>\n
In broad terms, the Economy Ministry\u2019s job has to do with productivity and market efficiency, the minister told AmCham members and their guests at the breakfast. As a result, it has wide-ranging responsibilities in areas that include anti-trust regulation, consumer protection and tariff-setting in the water, gas and telecommunications industries.<\/p>\n
However, one of the areas to which it attaches prime importance is the development of small and mid-sized enterprises (SMEs). Its aim is to create a level playfield for SMEs, reducing the asymmetries and market inefficiencies that exist if totally free competition is permitted, he said. <\/p>\n
That involves changing regulation, argued Minister Lavados. \u201cThere is no point in saying we want to promote innovation, have more entrepreneurs and see private business being more efficient if we\u2019re full of difficulties for the creation, development and, even, closure of firms.\u201d <\/p>\n
Enforcement of regulation should also be didactic, rather than punitive, he insisted, and, instead of imposing fines or closing a business, the tendency should be to seek a remedy to the problem. \u201cBut that\u2019s easier said than done,\u201d he admitted, \u201cbecause there are a lot of state agencies involved, all with different areas of responsibility.\u201d <\/p>\n
Bureaucracy also needs to be pruned, he added. \u201cThe quantity of permits that businesses have to obtain – and this is probably valid for companies of all sizes – and the delays involved are a cost that we have to try to reduce,\u201d he said. <\/p>\n
But Minister Lavados also had a word of warning for those who call for a smaller state, arguing that, as well as being efficient, the state needs to develop in line with new activities and the demands made upon it.<\/p>\n
The recent eruption of the Chait\u00e9n volcano in the south of Chile serves as an illustration, he pointed out. Despite being one of the world\u2019s most \u2018volcanic\u2019 countries, Chile doesn\u2019t know much about its volcanoes and needs to expand its very limited monitoring facilities. \u201cIs that something the private sector can do?
