Mientras a\u00fan estudiaba en la Universidad Diego Portales, el abogado de 36 a\u00f1os particip\u00f3 en el dise\u00f1o del nuevo sistema de justicia penal de Chile -que recurre a las audiencias orales en lugar de a los procedimientos escritos que se usaban anteriormente- y, una vez que el sistema entr\u00f3 en funcionamiento en Santiago en el 2005, se convirti\u00f3 en fiscal p\u00fablico.<br \/>\nAhora el director ejecutivo de Paz Ciudadana, fundaci\u00f3n sin fines de lucro que monitorea los indices de delincuencia y entrega asesor\u00edas sobre pol\u00edticas p\u00fablicas, conversa con bUSiness CHILE sobre los desaf\u00edos del pa\u00eds en esta \u00e1rea, dando \u00e9nfasis a la importancia de aprender de la experiencia de otros pa\u00edses como Estados Unidos, donde trabaj\u00f3 como fiscal de distrito en el \u00e1rea del Bronx en Nueva York antes de hacer un mag\u00edster en derecho en la Universidad de Columbia.<br \/>\n<b><i>En Chile, existe la percepci\u00f3n de que la delincuencia est\u00e1 aumentando. \u00bfEs eso cierto?<\/b><\/i><\/p>\n<p>En realidad se mantuvo estable durante los \u00faltimos cuatro a\u00f1os. En Paz Ciudadana realizamos una encuesta regular de victimizaci\u00f3n con Adimark, firma de investigaci\u00f3n de mercado, para medir el porcentaje de hogares en los que uno o m\u00e1s miembros han sido v\u00edctimas de actos delictivos en los \u00faltimos seis meses. En la \u00faltima encuesta en junio, el resultado alcanz\u00f3 el 38,2%, lo que se compara con el 41,7% de noviembre y el 37,7% de junio del a\u00f1o pasado. <\/p>\n<p><b><i>\u00bfC\u00f3mo se compara esa cifra con la realidad de otros pa\u00edses?<\/b><\/i><\/p>\n<p>Es mucho m\u00e1s alta que, por ejemplo, la de Estados Unidos o Canad\u00e1, y mayor que en muchos otros pa\u00edses latinoamericanos. Eso es cierto en el caso de la victimizaci\u00f3n y a\u00fan m\u00e1s cierto en lo que respecta al temor frente a la delincuencia. En Chile, la gente tiene mucho m\u00e1s miedo a la delincuencia que en Argentina, Paraguay o Brasil, todos pa\u00edses donde las tasas de criminalidad se perciben como altas.<\/p>\n<p><b><I>\u00bfPor qu\u00e9 tanto temor? <\/b><\/i><\/p>\n<p>No lo sabemos, pero una posible raz\u00f3n es que la gente no est\u00e1 acostumbrada a la idea de la delincuencia. Una vez que se acostumbran, los niveles de temor disminuyen. Otro factor podr\u00eda ser una alta tasa de revictimizaci\u00f3n. En junio, el 20% de los hogares encuestados hab\u00edan sido v\u00edctimas de delitos m\u00e1s de una vez en los \u00faltimos seis meses, lo que representa un 75% de todos los delitos cometidos.<\/p>\n<p><b><i>\u00bfCu\u00e1l ha sido el efecto de la reforma procesal penal? <\/b><\/i><\/p>\n<p>Los indicadores generales muestran que el sistema ha logrado un buen nivel de eficiencia y eso es mucho decir, puesto que \u00e9sta es un \u00e1rea en la que muchos pa\u00edses latinoamericanos han fallado. Est\u00e1 recibiendo m\u00e1s casos y sentenciando a m\u00e1s delincuentes; un 90% de los casos se resuelven dentro de un a\u00f1o y uno de cada cuatro casos terminan con una sentencia, que incluye la c\u00e1rcel o una sentencia alternativa, o en otras palabras, sin reclusi\u00f3n. <\/p>\n<p>Sin embargo, ha sido m\u00e1s dif\u00edcil hacer que el sistema funcione en lo que respecta a vincular el trabajo de la polic\u00eda y la fiscal\u00eda con la prevenci\u00f3n de la delincuencia, particularmente dado lo que sabemos sobre las estrategias de rehabilitaci\u00f3n y prevenci\u00f3n de la delincuencia desarrolladas durante las \u00faltimas d\u00e9cadas en pa\u00edses como Estados Unidos y Canad\u00e1. Estas estrategias realmente a\u00fan no funcionan ac\u00e1.<\/p>\n<p>Los programas que existen en Chile de sentencias sin reclusi\u00f3n y de rehabilitaci\u00f3n son muy pobres. La mitad de los delincuentes sentenciados -unos 40.000- han recibido sentencias alternativas, mientras que, en otros 90.000 casos, han recibido una condena reparatoria. Eso es el equivalente al adjournment in contemplation of dismissal en Nueva York, donde se exige al acusado realizar trabajo comunitario o participar en un programa de tratamiento contra las drogas y el alcohol o que vaya a terapia. No tenemos ning\u00fan programa as\u00ed en Chile y eso hace m\u00e1s dif\u00edcil reducir la tasa de reincidencia. <\/p>\n<p><b><i>\u00bfEs un problema de falta de recursos?<\/b><\/i><\/p>\n<p>S\u00ed, pero no es que no haya dinero, es que los recursos no se est\u00e1n invirtiendo en esta \u00e1rea. Los 40.000 delincuentes que han recibido sentencias alternativas son cubiertos con apenas el 3% del presupuesto total del sistema carcelario. <\/p>\n<p>Tambi\u00e9n es cuesti\u00f3n de responder la pregunta de qu\u00e9 funciona realmente. \u00bfC\u00f3mo haces que los infractores j\u00f3venes vuelvan al colegio? \u00bfLo dejas en familias sustitutas y se paga a esas familias? Si no podemos responder preguntas como \u00e9stas, entonces estamos desperdiciando nuestros recursos. No contamos con las herramientas para medir la efectividad de estos programas y eso es peligroso, porque por cada estrategia que funciona, hay cien que fallan.  <\/p>\n<p><b><i>\u00bfLas nuevas c\u00e1rceles privadas est\u00e1n ayudando a la rehabilitaci\u00f3n?<\/b><\/i<\n\nNo lo sabemos. Es bueno que se haya puesto fin a las condiciones incre\u00edblemente precarias y de hacinamiento que hab\u00eda en las c\u00e1rceles antiguas. Pero hasta ahora, eso es todo lo que podemos decir. \n\n<b><i>\u00bfAyudar\u00edan sentencias m\u00e1s duras?<\/b><\/i><\/p>\n<p>Tenemos que concentrarnos en la pregunta de qu\u00e9 funciona. Ello no se contesta con una estrategia \u00fanica, ya sea de prevenci\u00f3n de la delincuencia, rehabilitaci\u00f3n o de persecuci\u00f3n. Requiere un conjunto de herramientas de estrategias integradas. Necesitamos que los fiscales y la polic\u00eda se involucren con las empresas y la comunidad local. <\/p>\n<p>Por ejemplo, cuando fui fiscal, nos dimos cuenta de que casi la mitad de los robos de veh\u00edculos en el centro de Santiago ocurr\u00edan en un solo estacionamiento. Se trataba principalmente de un tipo espec\u00edfico de auto, con una falla de dise\u00f1o que lo hac\u00eda vulnerable a robos. De modo que no ten\u00eda que ver con el robo de autos en general, sino que era un problema particular en un estacionamiento particular. Hoy en d\u00eda, hay un cartel que advierte a los conductores de ese tipo de auto que se estacionen en un lugar espec\u00edfico bajo la vigilancia de una c\u00e1mara y los robos han ca\u00eddo casi a cero. Para llegar a este tipo de soluci\u00f3n, se necesita que los fiscales y la polic\u00eda trabajen juntos, y que est\u00e9n dispuestos a involucrar a la comunidad. <\/p>\n<p><b><i>La presidenta Michelle Bachelet se comprometi\u00f3 a crear un Ministerio de Seguridad P\u00fablica, pero a\u00fan no lo hace. \u00bfEs algo que debiera hacer?<\/b><\/i> <\/p>\n<p>Se crear\u00e1 con el tiempo, porque la interacci\u00f3n de la que hablo requiere cambios en la forma en que la polic\u00eda y los servicios sociales operan con el fin de integrarse m\u00e1s. Se ha hablado mucho sobre si ser\u00e1 un ministerio o una subsecretar\u00eda, lo que ha demorado su creaci\u00f3n, pero s\u00ed se crear\u00e1.<\/p>\n<p><b><i>\u00bfC\u00f3mo se compara la estrategia de Chile contra la delincuencia con la de otros pa\u00edses latinoamericanos?<\/b><\/i> <\/p>\n<p>Chile no lleva la delantera, pero est\u00e1 bien posicionado para asumir con seriedad la prevenci\u00f3n de la delincuencia. Otros pa\u00edses latinoamericanos a\u00fan est\u00e1n manejando temas estructurales, porque no pueden hacer que su sistema de justicia penal o polic\u00eda funcionen. No tenemos un problema de corrupci\u00f3n fuera de control y nuestras instituciones b\u00e1sicamente funcionan, pero a\u00fan no llegamos ah\u00ed. No se trata s\u00f3lo de la ley; la legislaci\u00f3n s\u00f3lo establece el marco, no resuelve el problema. Ah\u00ed es donde tenemos que mejorar, a trav\u00e9s de la implementaci\u00f3n y la evaluaci\u00f3n.<\/p>\n<p><b><i>Si tuviera una varita m\u00e1gica -sin limitaciones pol\u00edticas o econ\u00f3micas-, \u00bfqu\u00e9 har\u00eda para reducir la delincuencia?<\/b><\/i> <\/p>\n<p>Cambiar\u00eda el enfoque de la polic\u00eda y los fiscales a estrategias espec\u00edficas y locales de prevenci\u00f3n de la delincuencia. Debieran trabajar junto con los municipios y la comunidad local adem\u00e1s de con las empresas individuales. Luego pueden abordar uno a uno los problemas a nivel local. Y, por ejemplo, si los robos en el centro se asocian a los vendedores ambulantes, entonces el servicio de impuestos internos debiera involucrarse y la municipalidad debiera revocar los permisos de las tiendas que vendan objetos robados. <\/p>\n<p>Se requerir\u00e1 un proceso de ensayo y error para descubrir qu\u00e9 funciona, pero no es necesario que reinventemos la rueda. Afortunadamente, pa\u00edses como Estados Unidos, Canad\u00e1, Reino Unido, Australia y Nueva Zelanda han gastado mucho tiempo y recursos en desarrollar pr\u00e1cticas policiales superiores y en mejorar la prevenci\u00f3n y la rehabilitaci\u00f3n. Tenemos que aprender de lo que ha funcionado en el resto del mundo y adaptarlo a las necesidades de Chile, pero no estamos partiendo de cero.<!--:--><!--:en--><br \/>\n<!--break--><br \/>\nAndr\u00e9s Baytelman knows a lot about crime. While still at the Diego Portales University, the 36-year-old lawyer participated in the design of Chile\u2019s new criminal justice system &#8211; which uses public hearings instead of the previous written proceedings &#8211; and, once the new system came into operation in Santiago in 2005, he became a public prosecutor.<br \/>\nNow the executive director of Paz Ciudadana, a non-profit foundation that monitors crime and provides advice on public policy, he talks to bUSiness CHILE about the country\u2019s challenges in this area, emphasizing the importance of learning from the experience of other countries such as the United States, where he worked as a district attorney in the Bronx area of New York before taking a postgraduate law degree at Colombia University.<br \/>\n<b><I>There\u2019s a perception in Chile that the crime rate is rising? Is that true?<\/b><\/I><\/p>\n<p>It\u2019s actually held steady over the last four years. At Paz Ciudadana, we carry out a regular victimization survey with Adimark, a market research company, to measure the percentage of homes in which one or more member has been the victim of crime in the previous six months. In the last survey in June, the result was 38.2% as compared to 41.7% in November and 37.7% in June last year. <\/p>\n<p><b><I>How does that compare with other countries?<\/b><\/I><\/p>\n<p>It\u2019s far higher than, for example, the U.S. or Canada and higher than in many other Latin American countries. That\u2019s true for victimization and even truer for fear of crime. In Chile, people are more afraid of crime than in Argentina, Paraguay or Brazil, all countries in which the crime rate is perceived to be high.<\/p>\n<p><b><I>Why such a high level of fear? <\/b><\/I><\/p>\n<p>We don\u2019t know, but one possible reason is that people here aren\u2019t used to the idea of crime. When they get used to it, the level of fear drops. Another factor may be a high re-victimization rate. In June, 20% of the homes surveyed had been victimized more than once in the previous six months, representing 75% of all crimes committed.<\/p>\n<p><b><I>What\u2019s been the effect of the new criminal justice system? <\/b><\/I><\/p>\n<p>General indicators show that the system has achieved a good level of efficiency and that\u2019s saying a lot &#8211; this is an area in which many Latin American countries have failed. It\u2019s receiving more cases and sentencing more offenders; 90% of cases are resolved within a year and one in four cases result in sentencing, including either a prison or an alternative &#8211; or, in other words, non-custodial &#8211; sentence. <\/p>\n<p>However, it has been more difficult to make the system work in terms of linking prosecution and police work to crime prevention, particularly given what we know about the crime prevention and rehabilitation strategies developed over the last two decades in countries like the U.S. and Canada. These strategies are not really working here yet.<\/p>\n<p>The programs that exist in Chile for non-custodial sentences and rehabilitation are very poor. Half of convicted criminals &#8211; some 40,000 &#8211; have received alternative sentences while, in another 90,000 cases, they have received a conditional discharge. That\u2019s the equivalent of adjournment in contemplation of dismissal in New York where the defendant is required to perform community service or participate in a program such as drug and alcohol treatment or counseling. We don\u2019t have any programs like this in Chile and that makes it more difficult to reduce the rate of re-offence. <\/p>\n<p><b><I>Is that a problem of lack of resources?<\/b><\/I><\/p>\n<p>Yes, but it\u2019s not that there isn\u2019t money; it\u2019s that resources aren\u2019t being invested in this area. The 40,000 offenders who have received alternative sentences are covered by just 3% of the prison system\u2019s total budget. <\/p>\n<p>It\u2019s also a matter of answering the question of what really works. How do you get young offenders back to school? Do you put them in surrogate families and should those families be paid? If we can\u2019t answer questions like that, then we\u2019re wasting our resources. We don\u2019t have the tools to measure the effectiveness of these programs and that\u2019s dangerous because for every strategy that works, there are a hundred that fail.  <\/p>\n<p><b><I>Are the new private prisons helping rehabilitation?<\/b><\/I><\/p>\n<p>We don\u2019t know. It\u2019s good that they\u2019ve ended the incredibly precarious, overcrowded conditions of the old prisons. But so far that\u2019s all we can say. <\/p>\n<p><b><I>Would stiffer sentences help?<\/b><\/I><\/p>\n<p>We have to focus on the question of what works. This is not answered by a single strategy, whether crime prevention, rehabilitation or prosecution. It requires a tool kit of integrated strategies. We need prosecutors and the police involved with the local community and businesses. <\/p>\n<p>For example, when I was a prosecutor, we found that nearly half of vehicle thefts in downtown Santiago happened at a single parking lot. They were mainly of a specific type of car, with a design flaw making them vulnerable to theft. So this was not about car theft in general, it was a particular problem in a particular parking lot. Today, there is a warning sign there telling drivers of that type of car to park in a specific place under camera surveillance and the thefts have dropped to almost zero. To get to these kinds of solution, you need prosecutors and the police working together and being willing to involve the community. <\/p>\n<p><b><I>President Michelle Bachelet promised to create a Public Safety Ministry, but hasn\u2019t done so yet. Should she? <\/b><\/I><\/p>\n<p>It will happen eventually because the interaction I am talking about requires changes in the way the police and social services operate in order to become more integrated. There has been a lot of talk about whether it will be a Ministry or an Undersecretariat, which has delayed its creation, but it will happen.<\/p>\n<p><b><I>How does Chile\u2019s strategy against crime compare to other Latin American countries?<\/b><\/I><\/p>\n<p>Chile is not leading the way but it\u2019s well-placed to take crime prevention seriously. Other Latin American countries are still dealing with structural issues because they can\u2019t get their criminal justice system or police force to work. We don\u2019t have an out-of-control corruption problem and our institutions basically work but we haven\u2019t got there yet. It\u2019s not only about the law; the law only establishes the framework, it doesn\u2019t solve the problem. That\u2019s where we have to get better, through implementation and assessment.<\/p>\n<p><b><I>If you could wave a magic wand &#8211; no economic or political constraints &#8211; what would you do to reduce crime?<\/b><\/I> <\/p>\n<p>I would shift the focus of the police and prosecutors to specific, local crime-prevention strategies. They should work together with city hall and the local community and individual businesses. Then they can address problems on a local basis one-by-one. And, for example, if theft downtown is linked to street vendors, then the tax service should be involved and city hall should revoke the licenses of shops that sell stolen goods. <\/p>\n<p>It will take a process of trial and error to figure out what works but we don\u2019t need to reinvent the wheel. Fortunately, countries like the U.S., Canada, the U.K., Australia and New Zealand have spent a lot of time and resources developing better ways of policing and improving prevention and rehabilitation.
