* la implementación en curso del Tratado de Libre Comercio (TLC) entre Chile y Estados Unidos;

* el desarrollo de Chile como país plataforma;

* la protección de los derechos de propiedad intelectual;

* la promoción de la responsabilidad social empresarial;

* la entrega de servicios cada vez más eficientes a los socios de la Cámara.

Mateo Budinich, AmCham’s new president, sets out the Chamber’s plans for 2007, its aims and challenges, and the new services it will be providing to members.

I would like to start by saying that I am deeply honored to have been chosen to preside AmCham for the next two years and hope this period will be one in which not only the Chamber but also its member companies reap much success. However, the main purpose of this letter is to explain the broad thrust of AmCham’s plans for 2007 and the framework within which it will be structuring its many activities.

Last October, AmCham held its Annual Strategic Planning Meeting at which it was decided that the Chamber should organize its work this year around five key pillars:

* the ongoing implementation of the Chile-U.S. Free Trade Agreement (FTA);

* Chile’s development as a platform country;

* protection of intellectual property rights;

* promotion of corporate social responsibility;

* the delivery of ever more effective services for Chamber members.

Under this roadmap, all five areas will be given equal importance and – as we are well aware – will call for close collaboration between AmCham’s board of directors and all the Chamber’s members.

There are many areas in which the greatest contribution AmCham can make is as a channel of communication for passing on the know-how and experience of U.S. companies. And, in 2007, we will have a unique opportunity to do precisely this, exchanging information not only with the U.S. but also the entire continent.

I am referring to the Business Future of the Americas (BFA) conference that will take place in Santiago in June. Organized by AmCham in conjunction with the Association of American Chambers of Commerce in Latin America (AACCLA) and the El Mercurio newspaper, this will bring together senior executives from the 23 American Chambers of Commerce around the region as well as invited speakers of the highest international level.

This event will not only serve as a showcase for Chile as a country in which to do business. It will also be a chance for the members of our Chamber to participate in a privileged debate about some of the most pressing issues facing Chile and other Latin American countries.

The facilitation of trade, regional integration, the promotion of entrepreneurship and innovation, and the challenges of energy supply security are just some of the topics on the agenda. In view of the importance of this conference, I would like to invite you to learn more and to register on www.amchamchile.cl/bfa or by contacting our office directly on tel: (56-2) 290 9700.

CHILE-U.S. FTA

In the three years since the Chile-U.S. FTA came into force, bilateral trade has increased by 133%. This is unquestionably a very positive result and even better than expected. Moreover, the negative consequences predicted by sectors opposed to the agreement have not materialized.

Nevertheless, AmCham believes that some of the agreement’s benefits are still not being fully utilized. These include the vast U.S. public procurement market to which, under the FTA, Chilean companies were granted access. This covers all supplies required by public agencies at both the national and state level, from pencils to furniture. However, Chilean firms have been slow to penetrate this market and we believe there is a huge unexploited window of business opportunity here.

Similarly, the tariff-free quotas for imports of Chilean dairy products into the U.S. are not being fully used. This is also the case of the 1,400 work visas – known as the H-1B1 FTA Professional Visas – reserved annually for Chileans with contracts with U.S. companies. Only one other country, Singapore, receives this preferential treatment but, in 2006, just 158 visas were issued in Chile!

Chile’s small and medium-sized firms (PYMEs) also need a new impulse to develop their exports to the U.S. Today, 2,084 Chilean companies export to the U.S. and almost half are PYMEs, but there are still enormous opportunities to be tapped and we will be directing our efforts at providing assistance to these companies through the creation of an AmCham PYME Center.

Some operational and administrative aspects of the FTA, such as customs formalities and sanitary regulations with respect to bio-terrorism, also require clarification in order to facilitate bilateral trade. This is an area in which AmCham can help through our special FTA Follow-up Committee, which brings together different business organizations linked to export activities and the most relevant public agencies.

CHILE, A BUSINESS PLATFORM

The second pillar of AmCham’s work this year is closely related to the Chile-U.S. FTA and, for several reasons, we have termed it FTA II. Although Chile has successfully positioned itself worldwide as a commodity and raw materials exporter, we are convinced it also has significant potential to develop as a services exporter.

This requires the government and the private sector to work in tandem to devise ways of generating incentives for multinational companies to use Chile as their regional business platform and, from here, to provide services to the rest of the continent and – why not? – the rest of the world.

In this area, Chile has many advantages over its neighbor countries but also a number of disadvantages. We must be very clear on this point – either we introduce the necessary changes now or else other countries will capture this huge worldwide flow of investment. Consider the cases of, for example, Ireland, India, New Zealand and Uruguay.

The issues that need to be resolved are not complex but they are detailed and long-term. They include the labor flexibility required for companies to serve different time zones, the requirements imposed on foreigners who work in Chile, and the persistence of double taxation problems. In addition, a huge effort must be made to ensure an adequate supply of qualified technicians and bilingual professionals. At a seminar last year, we were able to learn from the valuable experience of Uruguay and I believe that good ideas can be extracted from such a similar example.

We are convinced that Chile has much to offer. Our legal system, for example, is now equipped with a totally revamped International Commercial Arbitration Center led by the Santiago Chamber of Commerce whose council actively participates in AmCham. Nevertheless, if drastic and timely measures are not adopted on a number of important issues, I fear we will miss key international opportunities.

INTELLECTUAL PROPERTY

This is a topic of the utmost importance for Chile (and is the subject of this month’s cover story). At AmCham, we believe that it has not yet been adequately tackled and the Chamber has a clear position on the issue.

The safeguarding of intellectual property rights is not about protecting a given sector or industry; it is of direct benefit to Chilean entrepreneurs, innovators and businesspeople. The fear that scientific, artistic, technological or any other kind of invention will not receive sufficient protection means not only that developers lack incentives but also – as we see today – that they prefer to patent in the U.S. rather than Chile.

Consequently, if Chile wishes to become a country that generates innovation – and, in AmCham’s opinion, this is crucial for furthering economic progress – we must urgently focus on protecting intellectual property rights at all levels.

But there is also a second reason for enhancing intellectual property protection in Chile – the country must abide by its commitments. Chile’s success in taking advantage of globalization is due, to a large extent, to its reputation as a serious and reliable country. Therefore, the fact that the U.S. is questioning Chile and its compliance with the terms of the Chile-U.S. FTA in this area may jeopardize our future trade and development. The recent inclusion of Chile on the U.S. Priority Watch List should not be seen as a minor circumstance. Nor was it insignificant that U.S. Trade Representative Susan Schwab chose to personally announce the decision. This is just one more indication of the importance the U.S. attaches to intellectual property rights.

The defense of intellectual property is an attitude that must be imbedded in our culture, starting with our education system, in order to change the mentality reflected in arguments such as “it is cheaper”. What seems “cheaper” can prove very costly in the long run.

If a country is to attract foreign investment, the rule of law must always prevail and if Chile fails to adequately protect intellectual property rights, we will significantly diminish our options of wooing foreign investors. This will, in turn, have a negative impact on job creation and the transfer of knowledge.

CORPORATE SOCIAL RESPONSIBILITY

AmCham is proud to have been one of the pioneers of the promotion of socially responsible corporate practices in Chile. We have said this over and over again: social responsibility is not only a matter of ethics; it is also a matter of business. In today’s world, businesses that do not understand this are severely punished by consumers, however far away they may be.

The Chamber is also proud to count among its members companies that are doing far beyond their call of duty – as defined by Chilean regulation – in this area. In this sense, AmCham is pleased to acknowledge year after year – through our Good Corporate Citizen Award – those programs and examples that are worth imitating. We will also continue to work vigorously to increase awareness of successful U.S. experiences that we believe deserve to be emulated locally.

SERVICES FOR MEMBERS

None of the above would be meaningful if it did not ultimately represent a better service for AmCham members. Our mission is to promote free trade and investment between Chile and the U.S. and to facilitate related services. This is why we have restructured some of our work teams in order to provide timely and effective services to each according to their respective needs, taking into consideration the fact that the different interests of our members cannot be met by applying one single scheme to all.

Some of the services we expect to boost during the course of this year include the processing of U.S. visas as an exclusive service for Chamber members, their employees and families; market studies upon request; information searches and assistance in locating potential partners, contacts and distributors here or in the U.S.; a job center to help member companies find the professionals and technicians they need; and the marketing of members’ products and brand names.

Our members wish to have privileged access to information about matters of their interest and we will continue to hold committee meetings and invite speakers of renowned authority on specific topics. Likewise, we are generating new networking opportunities for persons seeking to complement their respective business operations.

In its pursuit of all these aims, AmCham has the advantage of a board of directors and an advisory council of great quality and, as regards the Chamber’s committees, we seek to ensure that their members are not only of great talent in their respective fields, but also that they represent different sectors of the economy. They will be the ones in charge of leading AmCham’s work in developing its five pillars in the year ahead.

We will continue to cooperate with the U.S. Embassy in Chile and with Chile’s export promotion agency, ProChile, to develop joint programs. In addition, we will work with other private and public sector organizations to find the best solutions to the problems that may arise.
