{"id":3537,"date":"2005-07-01T01:00:00","date_gmt":"2005-07-01T04:00:00","guid":{"rendered":""},"modified":"2015-02-02T09:01:13","modified_gmt":"2015-02-02T12:01:13","slug":"una-reforma-revolucionaria","status":"publish","type":"news","link":"https:\/\/amchamchile.cl\/en\/noticia\/una-reforma-revolucionaria\/","title":{"rendered":"<!--:es-->Una Reforma Revolucionaria<!--:--><!--:en-->A Revolutionary Reform<!--:-->"},"content":{"rendered":"<p><!--:es--><br \/>\n<!--break--><br \/>\n<B><I>La reforma procesal penal chilena estuvo durante largo tiempo en gestaci\u00f3n -diez a\u00f1os en total- sin embargo, \u00e9sta constituye en s\u00ed una revoluci\u00f3n en la forma en la que el pa\u00eds ven\u00eda, hasta ahora, tratando con los delincuentes y el crimen.<\/B><\/I><\/p>\n<p>\u00bfAntes o despu\u00e9s de la medianoche del 15 de Junio? Esa era la interrogante para los delincuentes de Santiago durante el mes pasado, cuando un nuevo sistema procesal penal hac\u00eda su debut en la capital chilena, prometiendo un castigo m\u00e1s r\u00e1pido pero, tambi\u00e9n, mayor protecci\u00f3n para los derechos de los criminales.<\/p>\n<p>Los delitos cometidos con anterioridad a esa fecha ser\u00e1n tramitados de acuerdo al antiguo sistema y antes de que \u00e9ste sea eliminado en su totalidad, pero a partir del 16 de Junio, los delitos cometidos en Santiago ser\u00e1n tramitados por el nuevo sistema. Introducida gradualmente en el resto del pa\u00eds, a partir del a\u00f1o 2000, ella ha tenido -despu\u00e9s de un inicio vacilante- un buen resultado en dichos lugares.<\/p>\n<p>Pero Santiago -donde reside el 40% de la poblaci\u00f3n del pa\u00eds- es indudablemente su mayor prueba, tanto respecto de su eficacia como en lo que se refiere a la aceptaci\u00f3n p\u00fablica. \u201cRedactar el nuevo c\u00f3digo procesal penal fue la parte m\u00e1s f\u00e1cil; implementarlo es mucho m\u00e1s dif\u00edcil\u201d, se\u00f1ala el Ministro de Justicia, Luis Bates.<\/p>\n<p>Un sistema judicial basado en audiencias ante un panel de tres jueces, reemplaza al viejo sistema inquisitorial de m\u00e1s de un siglo de antig\u00fcedad, que utilizaba procedimientos escritos, bajo los cuales, un solo juez era responsable de investigar un delito, de acusar y sentenciar al delincuente. En vez de ello, ahora, las dos primeras de dichas funciones, ser\u00e1n trabajo de una Oficina del Fiscal aut\u00f3noma -el Ministerio P\u00fablico- con un personal de 700 fiscales.<\/p>\n<p>\u201cNo es exactamente igual al sistema estadounidense, dado que no existe un jurado, pero los principios son similares\u201d, expresa Mauricio Duce, un experto del Centro de Estudios Jur\u00eddicos de las Am\u00e9ricas, con sede en Santiago. M\u00e1s a\u00fan, el nuevo sistema chileno es parte de un proceso de reforma que se produce en la regi\u00f3n, en el cual la USAID -agencia del gobierno Norteamericano, que canaliza la asistencia externa- jug\u00f3, inicialmente, un papel importante en conjunto con otras agencias de otros pa\u00edses, incluyendo a Alemania.<\/p>\n<p>Este proceso de reforma, en el cual Chile fue un invitado de \u00faltima hora, comenz\u00f3 a mediados de los \u201880, impulsado por factores que incluyen el retorno a la democracia y un aumento de la preocupaci\u00f3n por los derechos humanos, as\u00ed como tambi\u00e9n de las demandas de desarrollo econ\u00f3mico y modernizaci\u00f3n. \u00c9ste fue un punto destacado en un seminario sobre el nuevo sistema, celebrado el 9 de Junio por AmCham.<\/p>\n<p>\u201cLa lentitud del antiguo sistema era una desgracia\u201d, afirm\u00f3 Juan Agust\u00edn Figueroa, un socio de la oficina de abogados de Santiago, Figueroa y Coddou, disertando en el seminario. Algunos de los casos que surgieron durante el colapso financiero chileno, a principios de los a\u00f1os \u201880, a\u00fan tienen su resoluci\u00f3n pendiente, se\u00f1al\u00f3.<\/p>\n<p>Pero el Nuevo sistema con 751 jueces, cifra superior a los anteriores 200, as\u00ed como la nueva Oficina del Fiscal y del nuevo Servicio de Defensa, tambi\u00e9n es mucho m\u00e1s caro. As\u00ed como el gasto inicial, de USD 300 millones para financiar edificios y capacitaci\u00f3n, su operaci\u00f3n costar\u00e1 un estimado de USD 215 millones anuales, por sobre los USD 50 millones del antiguo sistema.<\/p>\n<p>Eso por supuesto, hace surgir la interrogante acerca de si el antiguo sistema era malo o s\u00f3lo estaba desfinanciado. \u201cLa investigaci\u00f3n muestra que invertir en el antiguo sistema no habr\u00eda producido los mismos resultados; simplemente, no val\u00eda la pena invertir en \u00e9l\u201d, expresa Duce.<\/p>\n<p>Y los resultados hasta el momento, sugieren que el nuevo sistema est\u00e1 dando resultados. Un estudio efectuado por la Universidad Cat\u00f3lica de Valpara\u00edso en el a\u00f1o 2003, encontr\u00f3 que \u00e9ste en promedio, era un 61% m\u00e1s r\u00e1pido que el antiguo sistema, mientras que las estad\u00edsticas oficiales muestran que entre el a\u00f1o 2000 y el 2004, el 89,8% de los casos presentados ante el nuevo sistema, fueron resueltos de un modo u otro. Pero ese \u2018de un modo u otro\u2019, est\u00e1 en el centro de una cr\u00edtica al nuevo sistema.<\/p>\n<p><B><font color=\"#990000\">\u00bfEs severo contra el delito?<\/B><\/font><\/p>\n<p>Un informe de Libertad y Desarrollo, centro de investigaci\u00f3n local (think tank) con sede en Santiago, se\u00f1ala que el t\u00e9rmino \u201cresuelto\u201d incluye muchos casos que fueron rechazados, en vez de ser presentados a juicio. Sin duda, en el 2003, el 73% de los casos de hurto y el 85% de los casos de robo con violencia, fueron rechazados, a pesar de que los casos de asesinatos cayeron un 7%.<\/p>\n<p>Muchos de esos, son casos tales como hurtar desde un autom\u00f3vil estacionado o arrebatar una billetera en la calle, en el cual no existe simplemente un medio para identificar al ofensor. Y ello no es tan diferente de lo que suced\u00eda en el antiguo sistema, bajo el cual s\u00f3lo en el 2% de los delitos se dictaba sentencia, se\u00f1al\u00f3 Figueroa en el seminario de AmCham.<\/p>\n<p>Menos del 5% de los delitos van a ser vistos por un tribunal en el nuevo sistema, predijo \u00e9l, pero eso no significa que nada se va a hacer. La reforma tambi\u00e9n introduce muchas medidas intermedias. Cuando el inter\u00e9s p\u00fablico no est\u00e1 en riesgo, un trasgresor puede convenir en reparar el da\u00f1o a satisfacci\u00f3n de la v\u00edctima. O se pueden tomar medidas precautorias, tales como la de obligar al trasgresor a retirarse lejos de la casa de la v\u00edctima. \u201cEso es mucho mejor para la v\u00edctima, que ver al delincuente en prisi\u00f3n durante tres meses, despu\u00e9s de los cuales, sale nuevamente en libertad\u201d, argument\u00f3 Figueroa.  <\/p>\n<p>La reforma tambi\u00e9n beneficia a los malhechores al establecer una mayor protecci\u00f3n para sus derechos. Dentro de 24 horas a partir del arresto, un delincuente debe ser presentado ante un juez y mientras tanto, debe ser retenido en una estaci\u00f3n policial y no en una prisi\u00f3n. M\u00e1s a\u00fan, a diferencia del antiguo sistema que depend\u00eda en gran parte en obtener una confesi\u00f3n, \u00e9ste establece el derecho a permanecer en silencio.<\/p>\n<p>La separaci\u00f3n de las funciones de un juez, tambi\u00e9n promete una audiencia m\u00e1s objetiva a los criminales acusados. \u201cBajo el antiguo sistema, usted necesitaba a Dios como abogado, para impedir que el juez que lo hab\u00eda acusado, lo sentenciara\u201d, se\u00f1al\u00f3 en el seminario de AmCham, Vinko Andr\u00e9s Fodich, fiscal jefe para el distrito de \u00d1u\u00f1oa en Santiago,.<\/p>\n<p>M\u00e1s a\u00fan, bajo el nuevo sistema, la prisi\u00f3n con antelaci\u00f3n al juicio es la excepci\u00f3n en vez de la regla. \u201c\u00c9sta es una sorpresa para muchos chilenos, pero deber\u00eda ser aceptada si es acompa\u00f1ada por una justicia r\u00e1pida y eficaz\u201d, expres\u00f3 Figueroa.<\/p>\n<p>El mantener a quienes delinquen por primera vez o a los menores de edad fuera de la prisi\u00f3n, tiene la ventaja de impedirles tener una oportunidad de aprender malos h\u00e1bitos o a\u00fan peores. Pero la interrogante permanece en cuanto a los efectos que el nuevo sistema procesal tendr\u00e1 sobre las tasas de criminalidad.<\/p>\n<p>Inicialmente, los partidarios de la reforma argumentaron que \u00e9sta reducir\u00eda el crimen, pero desde entonces, han tendido a sugerir que esto ser\u00e1 neutro, dice el Ministro Bates. \u201cPero mi punto de vista personal, es que si la Oficina del Fiscal hace un uso efectivo de toda la informaci\u00f3n que ella acumula, tendr\u00e1 una poderosa herramienta para combatir el crimen\u201d, expresa \u00e9l.<\/p>\n<p>Seg\u00fan Mauricio Duce, a\u00fan es demasiado temprano para predecir el impacto y, de todos modos, las comparaciones son dif\u00edciles debido a la falta de estad\u00edsticas hist\u00f3ricas confiables. \u201cPero en la medida que se racionalicen recursos y se usen m\u00e9todos m\u00e1s sofisticados, es razonable esperar un impacto positivo\u201d, argumenta \u00e9l.<\/p>\n<p><B><font color=\"#990000\">Preocupaciones en el Sector de Negocios<\/B><\/font><\/p>\n<p>Disertando en el seminario de AmCham, Jorge Bofill, un socio de la firma de abogados de Santiago, Grasty, Quintana, Majlis y C\u00eda., describi\u00f3 el antiguo sistema como \u201cabsurdo te\u00f3rica y pr\u00e1cticamente\u201d. De hecho, record\u00f3 que mientras estudiaba en Estados Unidos, se le solicit\u00f3 que describiera el sistema a su clase, s\u00f3lo para que se expresara, \u201cPero eso es como la Inquisici\u00f3n\u201d.<\/p>\n<p>Sin embargo, el nuevo sistema presenta algunas preocupaciones para el sector de los negocios. Uno de \u00e9stos que se discuti\u00f3 en el seminario de AmCham, es el acceso a informaci\u00f3n respecto de los antecedentes de un potencial empleado.<\/p>\n<p>Si un empleado es sorprendido hurtando, pero ofrece reparar el da\u00f1o, por ejemplo a trav\u00e9s de devolver el monto de lo hurtado y rehusando a la compensaci\u00f3n por despido, la informaci\u00f3n acerca del delito permanecer\u00e1 en los registros de la Oficina del Fiscal y puede ser utilizada en caso de cualquier trasgresi\u00f3n futura, pero no aparecer\u00e1 en los registros p\u00fablicos que lleva el Registro Civil.<\/p>\n<p>Esto, por supuesto que es bueno, ya que ello significa una segunda oportunidad, en vez de condenar a quien comete una trasgresi\u00f3n por primera vez, a una vida llena de rechazos de solicitudes de empleo y la obvia tentaci\u00f3n delictiva que ello implica. Por otra parte, ello ciertamente significa menos acceso a la informaci\u00f3n por parte de los empleadores.<\/p>\n<p>Pero una preocupaci\u00f3n m\u00e1s amplia surge de la falta de una reforma paralela a la justicia civil. La trampa, seg\u00fan explica Bofill, es que las compa\u00f1\u00edas que participan en conflictos econ\u00f3micos, en la pr\u00e1ctica han encontrado modos para utilizar los tribunales penales, en vez de hacer uso del sistema civil, a\u00fan cuando dichos casos no tienen ning\u00fan derecho para ser presentados ante ellos.<\/p>\n<p>\u201cLos tribunales civiles son muy lentos y son demasiado caros en t\u00e9rminos de tiempo de abogados\u201d, se\u00f1al\u00f3 Bofill. Y a pesar de que los antiguos tribunales del crimen eran tan penosamente lentos, la amenaza de prisi\u00f3n con anterioridad al juicio -actualmente muy reducida- era un incentivo poderoso para que la parte trasgresora llegara a un acuerdo r\u00e1pidamente.<\/p>\n<p>\u201cAhora es tiempo para comenzar a pensar en una reforma de  la justicia civil; ella es tan urgente como la reforma procesal penal lo es para muchas personas\u201d, admite el Ministro Bates. De hecho, una comisi\u00f3n que celebr\u00f3 su primera reuni\u00f3n formal en Mayo, ha sido formada para lograr un diagn\u00f3stico de los cambios que son requeridos, pero una propuesta de reforma no estar\u00e1 lista antes de que el actual gobierno termine su mandato en Marzo.<\/p>\n<p>\u201cLos principios ser\u00e1n similares a aquellos de la reforma procesal penal, pero espero que puedan ser logrados en menor tiempo\u201d, manifiesta Bates. Uno de los modelos que est\u00e1 siendo considerado es el de Espa\u00f1a, el cual -a pesar de haber tenido menos progresos que Chile, en justicia penal- posee un sistema civil que es mucho m\u00e1s avanzado.<\/p>\n<p>Pero cualquiera sea el o los inconvenientes durante la transici\u00f3n hacia un mejor sistema de justicia civil, la conclusi\u00f3n principal, apoyada por la vasta mayor\u00eda de la opini\u00f3n p\u00fablica, es que la reforma procesal penal incrementar\u00e1 la transparencia y que es buena para la imagen pa\u00eds de Chile. Y que, por supuesto, a su vez, es buena para los negocios.<!--:--><!--:en--><br \/>\n<!--break--><br \/>\n<B><I>Chile\u2019s reform of criminal justice was a long time in the making &#8211; ten years in all &#8211; but it is, nonetheless, a revolution in the way the country deals with criminals and crime.<\/B><\/I><\/p>\n<p>Before or after midnight on June 15? That was the question for Santiago\u2019s criminals last month when a new system of criminal justice made its debut in Chile\u2019s capital, promising faster punishment, but also more protection for criminals\u2019 rights. <\/p>\n<p>Crimes committed before that date will be tried under the old system before it is phased out altogether but, as from June 16, crimes in Santiago will be dealt with by the new system. Introduced gradually in the rest of country since 2000, it has, after a hesitant start, worked well there. <\/p>\n<p>But Santiago &#8211; where 40% of the country\u2019s population lives &#8211; is undoubtedly its big test, both as regards effectiveness and public acceptance. \u201cWriting the new code of criminal justice was the easy bit; implementing it is much more difficult,\u201d points out Justice Minister Luis Bates.<\/p>\n<p>An adversarial system based on contested hearings before a panel of three judges, it replaces a century-old inquisitorial system, using written proceedings, under which a single judge was responsible for investigating a crime and charging and sentencing the offender. Instead, the first two of those functions will now be the job of an autonomous Prosecutor\u2019s Office &#8211; the Ministerio P\u00fablico &#8211; with a staff of 700 prosecutors. <\/p>\n<p>\u201cIt\u2019s not quite the same as the U.S. system, because there isn\u2019t a jury, but the principles are similar,\u201d says Mauricio Duce, an expert at the Santiago-based Justice Studies Center of the Americas. Moreover, Chile\u2019s new system is part of a process of reform around the region in which USAID, the U.S. government agency that channels foreign assistance, initially played a significant role, along with agencies from other countries, including Germany.<\/p>\n<p>This reform process, to which Chile was a relative latecomer, began in the mid-1980s, driven by factors that include the return of democracy and increasing concern for human rights, as well as the demands of economic development and modernization. That was a point highlighted at a seminar on the new system held by AmCham on June 9. <\/p>\n<p>\u201cThe slowness of the old system was a disgrace,\u201d said Juan Agust\u00edn Figueroa, a partner in Figueroa y Coddou, a Santiago law firm, speaking at the seminar. Some of the cases arising from Chile\u2019s financial collapse in the early 1980s have yet to be resolved, he pointed out. <\/p>\n<p>But the new system, with 751 judges, up from the previous 200, as well as the new Prosecutor\u2019s Office and a new Defense Service, is also a lot more expensive. As well as an initial outlay of US$300 million to finance new buildings and training, it will cost an estimated US$215 million annually to run, up from US$50 million under the old system. <\/p>\n<p>That, of course, raises the question of whether the old system was bad or just underfinanced. \u201cResearch shows that investing in the old system wouldn\u2019t have produced the same results; it simply wasn\u2019t worth investing in,\u201d says Duce. <\/p>\n<p>And results so far suggest that the new system is delivering. A study carried out by the Catholic University of Valpara\u00edso in 2003 found that it was an average 61% faster than the old system, while official statistics show that between 2000 and 2004, 89.8% of the cases presented under the new system were resolved in one way or another. But that one way or another is at the heart of a criticism of the new system.<\/p>\n<p><B><font color=\"#990000\">Tough on crime?<\/B><\/font><\/p>\n<p>A report by Libertad y Desarrollo, a Santiago-based think tank, points out that the term \u201cresolved\u201d includes the many cases that are dismissed, rather than brought to trial. Indeed, in 2003, 73% of robbery cases and 85% of cases of robbery with violence were dismissed although, in murder, this dropped to 7%. <\/p>\n<p>Many of those are cases, such as stealing from a parked car or the snatching of a wallet on the street, in which there is simply no way to identify the offender. And it\u2019s not so different from what happened in the old system under which only 2% of crimes were sentenced, pointed out Figueroa at the AmCham seminar.  <\/p>\n<p>Less than 5% of offenses are going to come to trial under the new system, he predicted, but that doesn\u2019t mean that nothing is done. The reform also introduces many intermediate measures. When the public interest is not at stake, an offender may agree to repair the damage to the victim\u2019s satisfaction. Or precautionary measures may be taken, such as obliging the offender to move house away from the victim. \u201cThat\u2019s much better for the victim than seeing the offender in prison for three months and then out again,\u201d argued Figueroa.<\/p>\n<p>The reform also benefits criminals by establishing greater protection of their rights. Within 24 hours of arrest, an offender must be brought before a judge and, in the meantime, must be held in a police station, not a prison. Moreover, unlike the old system, which relied heavily on extracting a confession, it establishes the right to remain silent.<\/p>\n<p>The separation of a judge\u2019s functions also promises charged offenders a more objective hearing. \u201cUnder the old system, you needed God as a lawyer to prevent the judge who had charged you from sentencing you\u201d, noted Vinko Andr\u00e9s Fodich, chief prosecutor for Santiago\u2019s \u00d1u\u00f1oa district, at the AmCham seminar. <\/p>\n<p>Moreover, under the new system, pre-trial imprisonment is the exception, rather than the rule. \u201cThat\u2019s a surprise to many Chileans, but it should be accepted if it\u2019s accompanied by fast and effective justice,\u201d said Figueroa.<\/p>\n<p>Keeping first-time or minor offenders out of prison has the advantage of depriving them of an opportunity to learn bad or worse ways. But the question remains as to the effect the new system of justice will have on crime rates. <\/p>\n<p>Initially, proponents of the reform argued that it would reduce crime, but have since tended to suggest that it will be neutral, notes Minister Bates. \u201cBut my personal view is that if the Prosecutor\u2019s Office makes effective use of all the information it accumulates, it will have a powerful tool for fighting crime,\u201d he says.   <\/p>\n<p>According to Mauricio Duce, it is still too early to predict the impact and, anyway, comparisons are difficult because of the lack of reliable historical statistics. \u201cBut to the extent that it rationalizes resources and uses more sophisticated methods, it\u2019s reasonable to expect a positive impact,\u201d he argues.<\/p>\n<p><B><font color=\"#990000\">Business concerns<\/B><\/font><\/p>\n<p>Speaking at the AmCham seminar, Jorge Bofill, a partner in Grasty Quintana Majlis &#038; C\u00eda., a Santiago law firm, described the old system as \u201ctheoretically and practically absurd\u201d. In fact, he recalled that while studying in the United States, he was asked to describe the system to his class, only to be told, \u201cBut that\u2019s like the Inquisition\u201d.<\/p>\n<p>However, the new system does raise some concerns for businesses. One of these, discussed at the AmCham seminar, is access to information about a potential employee\u2019s record. <\/p>\n<p>If an employee is caught stealing, but offers to repair the damage by, for example, paying back the amount stolen and waiving dismissal compensation, information about the offense will remain on the records of the Prosecutor\u2019s Office and can be used in case of any future offenses, but it will not appear on the public records held by the Civil Registry. <\/p>\n<p>That, of course, is good in that it means a second chance, rather than condemning a one-time offender to a life of rejected job applications and the obvious criminal temptations this implies. On the other hand, it certainly means less access to information for employers.<\/p>\n<p>But a broader concern arises from the lack of a parallel reform of civil justice. The catch, as Bofill explained, is that companies involved in economic disputes have, in practice, been finding ways to use the criminal courts, rather than the civil system, even though such cases have no rightful place there.<\/p>\n<p>\u201cThe civil courts are just so slow and they\u2019re too expensive in lawyer\u2019s time,\u201d pointed out Bofill. And, though the old criminal courts were also painfully slow, the threat of pre-trial imprisonment &#8211; now much reduced &#8211; was a powerful incentive for the offending party to reach an early agreement. <\/p>\n<p>\u201cIt\u2019s time now to start thinking about a reform of civil justice; it\u2019s just as urgent for many people as the reform of criminal justice,\u201d admits Minister Bates. In fact, a commission, which held its first formal meeting in May, has been set up to reach a diagnosis of the changes that are required, but a reform proposal won\u2019t be ready before the present government ends its term in March. <\/p>\n<p>\u201cThe principles will be similar to those of the criminal justice reform, although I hope it can be achieved in less time,\u201d says Bates. One of the models being considered is Spain which, although it has made less progress on criminal justice than Chile, has a civil system that is much more advanced. <\/p>\n<p>But whatever the drawbacks during the transition to a better system of civil justice, the overriding conclusion, supported by the vast majority of public opinion, is that the criminal justice reform will increase transparency and is good for Chile\u2019s country image.
