El Comit\u00e9 de Mercado Laboral del Futuro ha prestado especial atenci\u00f3n al Proyecto de Ley sobre modernizaci\u00f3n laboral para la conciliaci\u00f3n, familia e inclusi\u00f3n, que introduce modificaciones al C\u00f3digo del Trabajo, y a otros cuerpos legales. Dentro del grupo asesor del comit\u00e9, quienes lideran esta tem\u00e1tica son Juan Crist\u00f3bal Iturrate de Barros y Err\u00e1zuriz, M\u00f3nica Fern\u00e1ndez de Deloitte y Eduardo Rojas de Aramark. El documento est\u00e1 siendo trabajado por AmCham Chile, que recogi\u00f3 los comentarios de sus empresas socias y posteriormente gestionar\u00e1 el plan de advocacy<\/em> pertinente.<\/p>\n

En total relaci\u00f3n con esta tem\u00e1tica, el comit\u00e9 realiz\u00f3 en junio de este a\u00f1o un encuentro con el Subsecretario del Trabajo, Fernando Arab, en el cual se abordaron los principales desaf\u00edos de esta regulaci\u00f3n.<\/p>\n

El Proyecto de Ley se estructura en tres ejes principales: (I) Medidas de adaptabilidad de\u00a0jornada; (II) Protecci\u00f3n del empleo, capacitaci\u00f3n del trabajador y nuevas formas de contrataci\u00f3n; y (III) Medidas de inclusi\u00f3n para el fomento del respeto y dignidad de la persona.<\/p>\n

Dentro de las principales modificaciones propuestas por el PL, destacan los siguientes puntos:<\/p>\n

  1. Medidas de adaptabilidad de jornada.<\/strong><\/li>\n
  2. Jornada mensual de 180 horas<\/li>\n
  3. Jornada de trabajo 4 x 3<\/li>\n
  4. Sistema excepcional de jornada<\/li>\n
  5. Horas extraordinarias<\/li>\n
  6. Posibilidad de adelantar el horario de salida<\/li>\n
  7. R\u00e9gimen especial de trabajo en \u00e9poca de vacaciones<\/li>\n
  8. Compensaci\u00f3n de horas o d\u00edas de trabajo adicionales a la jornada con permisos especiales<\/li>\n
  9. Nueva alternativa para descanso dominical<\/li>\n
  10. Adaptabilidad de horarios de entrada y salida del trabajo<\/li>\n
  11. Pactos sobre jornadas semestrales y anuales de trabajo<\/li>\n
  12. Pactos sobre tiempos preparatorios<\/li>\n<\/ol>\n

    1. Protecci\u00f3n del empleo, capacitaci\u00f3n del trabajador y nuevas formas de contrataci\u00f3n.<\/strong><\/li>\n
    2. Prestaci\u00f3n de servicios a trav\u00e9s de plataformas digitales de intermediaci\u00f3n<\/li>\n
    3. Formalizaci\u00f3n de trabajos espor\u00e1dicos u ocasionales<\/li>\n
    4. Permiso para nivelaci\u00f3n de estudios b\u00e1sicos y medios<\/li>\n
    5. Modificaciones al Estatuto Nacional de Capacitaci\u00f3n y Empleo (SENCE)<\/li>\n
    6. Suspensi\u00f3n del contrato de trabajo<\/li>\n<\/ol>\n

      III. Medidas de inclusi\u00f3n para el fomento del respeto y dignidad de la persona.<\/strong><\/p>\n

      2. Reinserci\u00f3n laboral privados de libertad<\/li>\n
      3. Adulto mayor<\/li>\n
