Por ello, a ojos de los actores del sector y del gobierno, es necesario reformular la normativa. Un proceso largo y complejo que reci\u00e9n est\u00e1 comenzando.<\/p>\n<p>En septiembre pasado y luego del Seminario Internacional: \u201cEl Futuro de la Distribuci\u00f3n de Energ\u00eda El\u00e9ctrica\u201d, organizado por el Ministerio de Energ\u00eda y actores del sector, se conformaron cuatro grupos de trabajo tem\u00e1ticos en aspectos t\u00e9cnicos, econ\u00f3micos y regulatorios, para llegar a un diagn\u00f3stico compartido que finalizar\u00e1 en abril.<\/p>\n<p>Lo que vendr\u00e1 m\u00e1s tarde, explica Andr\u00e9s Romero, Secretario Ejecutivo de la Comisi\u00f3n Nacional de Energ\u00eda (CNE), ser\u00e1 \u201cuna discusi\u00f3n participativa acerca del modelo que debe inspirar la regulaci\u00f3n, es decir, c\u00f3mo se organizar\u00e1 esta industria, hasta d\u00f3nde llega el monopolio y desde d\u00f3nde se abrir\u00e1 la competencia\u201d. Ya con un modelo claro, se proyecta a fines de 2017 iniciar la redacci\u00f3n del anteproyecto de una nueva ley de distribuci\u00f3n el\u00e9ctrica.<\/p>\n<p>\u201cEl futuro se nos viene encima\u201d, comenta Romero ante la normativa y se\u00f1ala que la participaci\u00f3n colaborativa de los actores, el foco hacia los consumidores, abrirse a la competencia y garantizar una retribuci\u00f3n justa a los distribuidores por sus inversiones, son algunos de los lineamientos que buscan imprimirse en la futura legislaci\u00f3n.<\/p>\n<p>En representaci\u00f3n de las firmas del sector, Rodrigo Castillo, director Ejecutivo de Empresas El\u00e9ctricas A.G, recalca que Chile est\u00e1 enfrentando desaf\u00edos similares a los pa\u00edses desarrollados y a\u00f1ade que la receta para el \u00e9xito de la nueva norma responder\u00e1, a su juicio, al nivel de participaci\u00f3n del proceso de elaboraci\u00f3n.<\/p>\n<p>Castillo adelanta que entre las empresas ya existen algunos objetivos que concitan consenso. Estos tienen que ver con mejorar la calidad del servicio, usar eficientemente los recursos, contar con mayor flexibilidad de los sistemas y tener m\u00e1s participaci\u00f3n de los clientes en la toma de decisiones sobre su consumo. En tanto, sobre los retos del gremio que representa, reconoce que est\u00e1n en \u201cconocer y adaptarnos a las nuevas tecnolog\u00edas de generaci\u00f3n y almacenamiento distribuidas en la red y aprender a interactuar con los clientes a trav\u00e9s de redes y medidores m\u00e1s inteligentes\u201d, ejemplifica.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-150388 \" src=\"https:\/\/www.amchamchile.cl\/wp-content\/uploads\/2017\/04\/Imagen_entrevistas_4-1024x357.jpg\" width=\"671\" height=\"234\" \/><\/p>\n<p>Ram\u00f3n Galaz, director de Valgesta -empresa consultora especializada en energ\u00eda- se\u00f1ala que la antigua normativa est\u00e1 obsoleta y que representa una \u201ccamisa de fuerza\u201d ante los nuevos requerimientos del mercado energ\u00e9tico que deben ser incorporados en el mediano y corto plazo. \u201cHoy las redes inteligentes, smart grid, sistemas de almacenamiento de energ\u00eda y generaci\u00f3n distribuida y recarga de servicios el\u00e9ctricos suponen un nuevo paradigma\u201d, sentencia.<\/p>\n<p>Y a\u00fan m\u00e1s all\u00e1, seg\u00fan Romero, incluso suponen nuevas estrategias para alcanzar metas que ya se hab\u00edan propuesto con anterioridad. En esta l\u00ednea, explica que la pol\u00edtica de energ\u00eda a 2050 y la calidad del servicio que queremos prestar exige pensar en c\u00f3mo se lograr\u00e1 -a esa fecha- que el promedio de indisponibilidad del servicio llegue a una hora al a\u00f1o, sabiendo que la mayor parte de los problemas actuales de indisponibilidad se encuentran, precisamente en el segmento de la distribuci\u00f3n.<\/p>\n<p>Desde el grupo Saesa, Francisco Alliende, gerente general, tambi\u00e9n reconoce los desaf\u00edos que supone la nueva ley y considera un elemento a tener en cuenta la gran cantidad de interacciones que deber\u00e1 soportar la red en el futuro y c\u00f3mo esta normativa deber\u00e1 ser flexible y promover incentivos a las mejoras y a la innovaci\u00f3n.<\/p>\n<p>El ejecutivo destaca que para empresas que operan en regiones -Saesa mantiene operaciones entre las regiones del B\u00edo B\u00edo y Ays\u00e9n, atendiendo a m\u00e1s de 710.000 clientes- las modificaciones que deban hacerse en la red para la incorporaci\u00f3n de nuevos usuarios, tecnolog\u00edas y servicios, implicar\u00e1n retos no menores para no impactar la calidad del servicio de los clientes. Esto porque una de las principales barreras que han enfrentado, adem\u00e1s de las dificultades geogr\u00e1ficas propias, corresponden a c\u00f3mo reflejar y traspasar los costos que una buena calidad de servicio implica, especialmente en zonas rurales.<\/p>\n<p>Sobre este punto tambi\u00e9n se detiene Galaz. A su parecer, cualquier decisi\u00f3n que se tome correr\u00e1 de norte a sur, lo que obligar\u00e1 a cualquier normativa a considerar objetivos generales, pero sin ignorar las condiciones diferentes en Santiago y regiones, las que obligan a implementar metas con gradualidad.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-150389 \" src=\"https:\/\/www.amchamchile.cl\/wp-content\/uploads\/2017\/04\/Entrevistas_Distrib_2-397x1024.jpg\" width=\"163\" height=\"420\" \/><\/p>\n<p><strong>Las lecciones de Estados Unidos<\/strong><\/p>\n<p>Como parte del proceso de discusi\u00f3n de la ley y para intercambiar experiencias y conocimientos entre Chile y Estados Unidos en materia de nuevos modelos de distribuci\u00f3n el\u00e9ctrica y redes inteligentes, la C\u00e1mara Chileno Norteamericana de Comercio, Amcham Chile, organiz\u00f3 una misi\u00f3n a EE.UU. En dicho pa\u00eds actores chilenos pudieron conocer los modelos de distribuci\u00f3n que est\u00e1n siendo aplicados en Nueva York y Boston (Massachusetts).<\/p>\n<p>Tatiana Molina, directora del Consejo Empresarial de Energ\u00eda Chile &#8211; EE.UU. de AmCham Chile, rescata de esta experiencia la articulaci\u00f3n p\u00fablico privada que ha logrado Estados Unidos. \u201cEn el caso de Nueva York hay una relato \u00fanico de todos los actores -industria, academia y gobierno- respecto de cu\u00e1les son los desaf\u00edos que se quieren lograr a 2030 (\u2026) Si bien no han terminado el proceso ya recorrieron un primer camino que era alinear a los actores\u201d, afirma y destaca que a su parecer la discusi\u00f3n en Chile va en la direcci\u00f3n correcta.<\/p>\n<p>Para Molina hoy hay un espacio en Chile donde las empresas se est\u00e1n sentando junto al regulador y \u201ceso es parte de nuestras perspectivas positivas\u201d. Adem\u00e1s, se abre una oportunidad para que el sector el\u00e9ctrico se posicione en el extranjero como un espacio de soluciones tecnol\u00f3gicas y polo de atracci\u00f3n para desarrolladores de tecnolog\u00edas.<\/p>\n<p>Como pr\u00e1cticas a imitar desde Estados Unidos, destaca la formaci\u00f3n de capacidades por parte de todos los actores, puesto que muchos conocimientos desde otras \u00e1reas ser\u00e1n necesarios en un nuevo paradigma, como por ejemplo, ciberseguridad e Internet de la Cosas, adem\u00e1s de inteligencia de datos. Adem\u00e1s, considera la flexibilidad para que una nueva norma incorpore la innovaci\u00f3n y permita el ensayo y error en la b\u00fasqueda de mejorar la distribuci\u00f3n. Lo anterior, teniendo en consideraci\u00f3n las premisas fundamentales de nuestro sistema en torno a costo, seguridad y calidad.<\/p>\n<p>Esta \u00faltima visi\u00f3n tambi\u00e9n la comparte Julio Friedman, gerente general de General Electric, Quien cree en una ley que, adem\u00e1s de potenciar nuevas tecnolog\u00edas, permita el suministro de energ\u00eda proveniente de fuentes renovables y medici\u00f3n inteligente, trayendo como consecuencia una mejor red, pero tambi\u00e9n mayor competencia en el sector.<\/p>\n<p>Para Romero de CNE, en tanto, la misi\u00f3n dej\u00f3 patente la necesidad de identificar con calma y de manera clara los objetivos que se definir\u00e1n para el sistema de distribuci\u00f3n y en base a ellos construir la estrategia de desarrollo, avanzando de manera gradual y paulatina.<\/p>\n<p>Algo que tambi\u00e9n es una de las grandes lecciones que rescata Galaz, desde Valgesta. Puesto que explica que si bien al llegar a EE.UU. la impresi\u00f3n es de un gran avance, el proceso se inici\u00f3 hace alrededor de cinco a\u00f1os y a\u00fan est\u00e1 en curso.<\/p>\n<p>Como modelo, Galaz se\u00f1ala que el mecanismo que se discute en Nueva York deja claro la importancia de cu\u00e1l ser\u00e1 a futuro y el rol de las empresas concesionarias y que servicios podr\u00edan ser entregados por esta infraestructura.<\/p>\n<p>\u201cHay que trabajar en definir esos roles y ver c\u00f3mo ser\u00e1n los servicios con un cambio en el esquema que tendremos (\u2026) Hoy el servicio es unidireccional, mientras que a futuro muchos de los servicios ir\u00e1n en la direcci\u00f3n contraria, por lo que la ley deber\u00e1 ser lo suficientemente clara, pero amplia, para permitir cierta flexibilidad en la aplicaci\u00f3n de la misma\u201d, explica.<\/p>\n<p>En tanto, y como recomendaci\u00f3n desde el trabajo en EE.UU., Carlos Nouel, vicepresidente de nuevas Soluciones de Energ\u00eda de National Grid, una de las compa\u00f1\u00edas de distribuci\u00f3n el\u00e9ctrica m\u00e1s relevantes a nivel mundial, recalca que es importante que la discusi\u00f3n no se centre solamente en la tecnolog\u00eda y en la modernizaci\u00f3n por la modernizaci\u00f3n. Lo importante, a su juicio, es considerar los modelos de negocio asociados al recambio de una red. La \u00fanica manera de hacer un proceso de construcci\u00f3n de la ley exitoso es poner los incentivos necesarios para que las empresas realicen las inversiones que el sector necesita. Y explica que Nueva York facilita iniciativas donde \u201csi la compa\u00f1\u00eda el\u00e9ctrica resuelve un problema de apacidad de manera eficiente, tiene un incentivo financiero\u201d, comenta.<\/p>\n<p>De la mano de este modelo, y considerando sus buenas pr\u00e1cticas, este a\u00f1o ser\u00e1 clave para que los actores del sector energ\u00e9tico comiencen a internalizar el nuevo paradigma de la distribuci\u00f3n el\u00e9ctrica y como pa\u00eds, tomar la oportunidad de ser pioneros en un proceso de reformulaci\u00f3n que no s\u00f3lo se est\u00e1 dando en Chile, sino tambi\u00e9n a nivel global.<\/p>\n<p>La motivaci\u00f3n es crear una ley que no sea una nueva camisa de fuerza sino que, muy por el contrario, solucione problemas del presente y sea capaz de ver el futuro.[:en]<strong><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-150387 \" src=\"https:\/\/www.amchamchile.cl\/wp-content\/uploads\/2017\/04\/Torres-1024x683.jpg\" width=\"534\" height=\"356\" \/><br \/>\nIn September 2016, a process was launched in Chile to devise a new law on electric power distribution. The primary actors in the field are now discussing how to organize an industry that is tasked with negotiating new business models while also overcoming the challenge of technological development.<\/strong><\/p>\n<p>It is more than 30 years since Chile amended its legislation on electric power distribution. The challenges today have evolved significantly since the 1980s and the existing regulatory framework is now beginning to limit market expansion. As a result, both industry players and the government agree on the need to reform the current law, in the full knowledge that the task will be a long and complex process.<\/p>\n<p>Last September, and following the international seminar entitled \u2018the Future of Electric Power Distribution\u2019, which was organized by the Ministry of Energy and the private sector, four thematic working groups were formed based on distinct technical, economic and regulatory aspects. The aim of these working groups was to devise a joint industry diagnosis by the end of April 2017.<\/p>\n<p>Andr\u00e9s Romero, executive secretary of the National Energy Commission (CNE), explains that subsequent to the drafting of the thematic diagnoses, a participatory discussion will be held, \u201crelated to the model on which the regulation should be based, i.e., how the industry will be organized, to what extent there will be a monopoly, and from which point (in the industry) will competition be introduced\u201d. Once this model has been defined, the draft of the bill related to the new electric power distribution legislation is expected by the end of 2017.<\/p>\n<p>\u201cThe future is coming up fast\u201d, says Romero with regard to the regulation. As a result, he explains that the key elements being sought for the future legislation include collaboration between different actors, focus being placed on consumers, opening up the market to competition and guaranteeing fair payment to the distribution companies for their investment.<\/p>\n<p>Representing the private sector firms, Rodrigo Castillo, executive director of the Chilean Association of Electricity Companies (Empresas El\u00e9ctricas A.G), states that the challenges being faced by Chile are similar to those in developed nations. He adds that the recipe for success for the new legislation is dependent upon the level of participation achieved during its design stage.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-150388 \" src=\"https:\/\/www.amchamchile.cl\/wp-content\/uploads\/2017\/04\/Imagen_entrevistas_4-1024x357.jpg\" width=\"671\" height=\"234\" \/><\/p>\n<p>Castillo anticipates that private firms already have certain objectives on which there is consensus. They relate to improving the quality of service, the efficient use of resources, ensuring greater system flexibility and enhancing customer participation in decision-making regarding consumption. In relation to the challenges facing the Association, Castillo recognizes that members have to, \u201cunderstand and adapt to the new technologies of generation and storage distributed across the network, and learn to interact with customers via smart grids and smart meters\u201d.<\/p>\n<p>Ram\u00f3n Galaz, director of the consultancy firm Valgesta that specializes in energy, says that the existing regulations are obsolete and represent a \u201cstraightjacket\u201d in terms of the new energy market requirements that need to be incorporated over the short and medium terms. \u201cToday, smart grids, energy storage and distributed generation systems, and rechargeable electricity services represent a new paradigm\u201d, he stresses.<\/p>\n<p>Francisco Alliende, CEO of the electric power distribution company Saesa, also recognizes the challenges posed by the potential new law. He deems that a particular element worthy of consideration is the large number of interactions that the network must support in the future and the manner by which any new regulation will have to be flexible while also promoting incentives for improvements and innovation.<\/p>\n<p>Saesa operates between the Bio Bio and Aysen regions and serves more than 710,000 customers. With that in mind, Alliende emphasizes the importance for companies operating in Chile\u2019s regions that any modifications to the network regarding the incorporation of new users, technologies and services, do not affect their ability to ensure quality customer service. This is significant because one of the main barriers faced by such companies, in addition to certain geographical difficulties, is how to reflect and transfer the costs implied by good service quality, especially in rural areas.<\/p>\n<p>On the latter point, Galaz believes that any decision taken will involve electricity running from north to south. This, he states, will oblige any regulation to consider general objectives, without ignoring the different conditions that exist in Santiago and the regions. In turn, this implies the gradual implementation of goals over a certain period of time.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-150389 \" src=\"https:\/\/www.amchamchile.cl\/wp-content\/uploads\/2017\/04\/Entrevistas_Distrib_2-397x1024.jpg\" width=\"163\" height=\"420\" \/><\/p>\n<p><strong>Lessons from the United States<\/strong><\/p>\n<p>As part of the discussion process surrounding the legislation, and in order to share experiences and knowledge between Chile and the United States in the field of new models of electric power generation and smart grids, the Chilean American Chamber of Commerce (AmCham Chile) has staged a mission to the US. This mission enabled participants to explore the different distribution models that are being applied in New York and Boston, Massachusetts.<\/p>\n<p>Tatiana Molina, director of AmCham Chile\u2019s Chile-US Energy Business Council, stresses the importance of the public-private partnerships that have been achieved by actors in the US. \u201cIn the case of New York, all actors are on the same page, from industry to academia to government, regarding the challenges to overcome by 2030\u2026 While this process remains ongoing, they have taken the first step by aligning the different actors\u201d she states, adding that the debate underway in Chile is heading in the right direction.<\/p>\n<p>According to Molina, there is a space in Chile today in which businesses are sitting down with the regulator and, \u201cthis is part of the reason for our positive outlook\u201d. In addition, an opportunity is arising for the electric power sector to position itself abroad as a space for technological solutions and a means to attract the development of new technology.<\/p>\n<p>In terms of best practices from the United States that could be implemented in Chile, capacity building by all actors is one possibility. The importance of this aspect is due to the fact that knowledge from other industries and markets will be necessary in a new paradigm, such as cybersecurity, the internet of things and data intelligence. Moreover, flexibility within the new legislation is crucial for ensuring the incorporation therein of innovation and trial and error in the search for distribution enhancement. Nevertheless, the incorporation of any such practices must consider the fundamental premises of the Chilean system with regard to cost, security and quality.<\/p>\n<p>The latter view is one shared by Julio Friedman, CEO of General Electric Chile. He believes in a law that enables electric power to be supplied from renewable sources and measured with smart meters, in addition to fostering further new technologies. This approach, he believes, will help to give rise to an improved network and greater competition in the sector.<\/p>\n<p>Andr\u00e9s Romero says that the mission to the US highlighted the need to identify, clearly and calmly, the objectives that will be defined for the distribution system. Based on these objectives, actors will be able to subsequently devise the development strategy in a gradual manner.<\/p>\n<p>A further lesson taken from the mission, according to Ram\u00f3n Galaz, is that although the first impressions upon arriving in the US were positive in terms of the significant progress being made in that country, it should be recalled that the process began five years ago and remains ongoing today.<\/p>\n<p>As a model, Galaz highlights the mechanism discussed in New York. In doing so, he reflects on the need to ascertain the future importance and role of concessionary companies and the services that could be delivered by the respective infrastructure.<\/p>\n<p>\u201cIt is necessary to define these roles and to see what the services will be, given the changes to the existing blueprint\u2026 Today the service is unidirectional, whereas in the future many of the services will flow in the other direction, which means that the law must be sufficiently clear and broad ranging to enable a certain amount of flexibility in terms of application\u201d, states Galaz.<\/p>\n<p>In turn, and as a recommendation arising from the work undertaken in the US, Carlos Nouel, vice-president of new energy solutions at National Grid, a leading global electric power distribution company, emphasizes the importance of discussing more than just technology and modernizing for the sake of modernization. Rather, he stresses the need to consider the business models associated with the replacement of a network. The only way to successfully devise legislation in this regard is to include incentives for companies to make the investment the industry needs. Nouel concludes by explaining that authorities in New York facilitate initiatives in which, \u201cif the electricity company resolves a capacity-related problem in a positive way, it receives a financial incentive\u201d.<\/p>\n<p>Taking account of this model and the best practices it has to offer, 2017 will be a significant year for actors in the Chilean energy sector. Success will depend on their ability to internalize the new electric power distribution paradigm.
